FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Brand

Name Justification and Approval

1. Contracting Activity: 414th Contracting Support Brigade, Unit 31423, Box 77, APO

AE 09630

2. Description of Action: Department of Public Works (DPW) requests a firm-fixed-price requirements contract for one basic year with four options for the purchase of Saflok key cards. The Government projects award for September 2016. No funds will be obligated on the initial contract, but will be funded with each delivery order.

3. Description of Supplies/Services:

The Saflok Key Cards are for the Saflok door locks used in the Del Din barracks. These locks were purchase under a navy MILCOM contract in 2009, which was completed in 2013. The locks installed were custom made for the US Army by Kaba SrL (Italian Company). DPW would like a requirements contract in place that would allow them to place delivery orders. It will include one basic year and four (4) option years.

Base Period: Sept 2016 to Sept 2017 Value: $ 49,200.00 Option Period 1: Sept 2017 to Sept 2018 Value: $ 49,200.00 Option Period 2: Sept 2018 to Sept 2019 Value: $ 49,200.00 Option Period 3: Sept 2019 to Sept 2020 Value: $ 49,200.00 Option Period 4: Sept 2020 to Sept 2021 Value: $ 49,200.00

Total: $246,000.00

1901 as implemented by FAR Subpart 13.5: Exclusive licensing agreements

5. Reason for Authority Cited:

a. This subpart authorizes the use of simplified procedures for the acquisition of supplies and services in amounts greater than the simplified acquisition threshold…including options, if the contracting officer reasonably expects, based on the nature of supplies or services sought, and on market research that offers will include only commercial items.

b. This requirement is for commercial off the shelf Saflok keycards that are available to the general public. These key cards must be procured using a brand name

Version – MAY 2016 FOR OFFICIAL USE ONLY because they are the only cards that will work in the Saflok locks located in the Del Din Barracks.

c. The Saflok keycards use a unique formatting and algorithm necessary for the functioning of the memory key cards for the custom locks. The Saflok memory keycards are the only keycards compatible with software for the Saflok systems used in the Del Din barracks. There is no possibility of procuring different items without changing the entire locking system, which consists of almost 4,000 electronic locks. The estimate to replace every lock in the barracks on Del Din, including the software, is approximately Euro 500.00 for each lock, which would total approximately € 2M.

6. Efforts to Obtain Competition: Multiple vendors distribute the Saflok key cards.

The Contracting Officer shall publish the notices required by FAR 5.201.

7. Actions to Increase Competition: Multiple vendors distribute the Saflok key cards.

The solicitation will go out for full and open competition.

8. Market Research: This is a recurring requirement and has been purchased by the 414th CSB on at least three previous occasions, W912PF-15-P-0067, W912PF-16-P- 0006, and W912PF-16-P-0038. The first two contracts were sole source to Kaba Srl (Italian Company), because it was believed they were the only company that could provide these keycards. During the last purchase (0038), when the J&A was posted, another firm contacted this office offering to sell the cards. Even though the Saflok locks required this particular card, other companies have the capability of providing them. Contract 16-P-0038 was then competed. Two companies, one in the United States and another in Italy, provided quotes. The Italian company, Kaba Srl, was awarded the purchase order after providing the lowest priced quote.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable.

Although this requirement is for a brand name item, competition is anticipated, as there are multiple vendors that can offer this product. Price reasonableness will be established based on responses to the RFQ (competition).

As a part of this basis, certified cost or pricing data is not required because the item and/or services being acquired are considered commercial.
