52.212-2 ADDENDUM
ADDENDUM TO 52.212-2
BASIS FOR AWARD
(1) This acquisition will be conducted in accordance with FAR Part 12 Acquisition of Commercial Items, FAR 13.5 Test Program for Certain Commercial Items, and as supplemented by agency procedures using the Lowest Price with Responsibility Determination (Past Performance) selection process. This is a selection process where best value is expected to result from selection of the acceptable offer with the lowest price. Award will be made to the lowest priced offer that meets or exceeds all the minimum mandatory criteria in the solicitation factor and “Past Performance (Determination of Responsibility)”. Award will be on an “all or none” basis. Offerors are put on notice that:
(a) The non-price factors will be evaluated on an “acceptable”/unacceptable” basis
(b) The non-price factors are evaluated for acceptability and NOT ranked.
(c) Offers are NOT compared to each other.
(d) Tradeoffs are NOT permitted.
(e) The offerors must provide all required information or the offer will not be considered.
(2) In order to be eligible for an award, an offer shall be rated “ACCEPTABLE” on all non-price factors.
(3) Once the Contracting Officer and the Past Performance Evaluation Team have identified the offers that are technically acceptable, the Contracting Officer will make the source selection decision ONLY on the basis of lowest price.
(4) The U.S. Government intends to evaluate proposals and award a contract without discussions; however, the U.S.
Government reserves the right to hold discussions. It should be noted that there is no obligation on the part of the government to make an award to any offeror in response to this RFQ.
(5) Offerors may be asked to clarify some issues regarding the non-price factors to enhance U.S. Government understanding of them. Such clarifications shall NOT be used to cure offer deficiencies or material omissions, enter into discussions, and/or otherwise revise the offer.
(6) The evaluation is conducted in two phases. In Phase One, proposals will be reviewed to ensure that all documents requested in Volumes I through II outlined in the solicitation have been submitted. Proposals not meeting the solicitation requirements may result in disqualification of the proposal from any further evaluation. In Phase Two, the Past Performance Evaluation Team will evaluate the one (1) non-price factor. The award will be made to the lowest price proposed from the offeror whose proposal is rated “acceptable” on all the non-price factors.
FACTORS TO BE EVALUATED
The term “offeror” means:
a. An individual firm;
b. The Pool of Firms (Consorzio) / ATI and the firm proposed by the Pool of Firms
(Consorzio) / ATI to perform the work.
The evaluation factors for this solicitation are:
TECHNICAL FACTOR FACTOR I – CERTIFICATIONS
TECHNICAL FACTOR II – PAST PERFORMANCE
FACTOR III - PRICE
A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach” of this section.
During evaluations of each proposal, the Government will assign each factor an acceptable or unacceptable rating.
EVALUATION APPROACH
All proposals shall be subject to evaluation by the Technical and Past Performance Evaluation Team. (Except Price)
The factors are defined as follows:
a. TECHNICAL FACTOR I - CERTIFICATIONS
The offeror must provide all certifications listed in FAR provision 52.212-1 ADDENDUM, VOLUME I - TECHNICAL FACTOR I - CERTIFICATIONS, paragraph a. and b.
b) TECHNICAL FACTOR II – PAST PERFORMANCE
Past performance will be rated on an acceptable / unacceptable basis using the following ratings:
Rating Description
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown (See note below)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
i. In case of Pool of Firms (Consorzio)/ATI, all proposed partners will be assessed individually and the results will then be assessed in their totality to derive the offeror’s past/present performance. The offeror must demonstrate relevant projects consistently met contractual requirements. The Government will evaluate all proposed partners’ recent and relevant past performance to determine their ability to successfully perform the required effort.
For the purpose of this solicitation, performance recency is performance completed or performed within three (3) years of the solicitation release date. For the purpose of this solicitation, performance relevancy is defined as similar in complexity, magnitude, and scope of the project required by this solicitation.
ii. The offerors provided information (questionnaire) along with any information obtained by the Contracting Officer through alternate sources (independent research, CPARS,VCE–COR, etc) will be utilized to determine the offerors past performance as acceptable/unacceptable in accordance with the above table. A maximum of three (3) projects will be reviewed.
iii. The Government may consider past performance information from other sources such as: offeror's former customers, business associates, Federal, state, and local government agencies;
the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Contractor Performance Assessment Reporting System (CPARS) or other databases; interviews with Program Managers, and Contracting Officers.
d) FACTOR III – PRICE
i. The price structure will consist of quantity multiplied by unit price equaling total line item cost. The price offer will be evaluated separately from the non-price factors. An assessment of the reasonableness of each proposed price will be made. The Contracting Officer will perform a price analysis of each offer found to be acceptable. As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (6) months of the offeror's final option period price to the offeror's total price. Offerors are required only to price the base and option periods. Offerors shall not submit a price for the potential six (6) month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period (base or option periods), utilizing the rates of that performance period.
ii. The price analysis is the process of examining and evaluating a proposed price to determine if it is fair and reasonable, without evaluating its separate cost elements and proposed profit. The Contracting Officer may use various price analysis techniques and procedures to ensure a fair and reasonable price. Examples of such techniques include but are not limited to those shown here below.
The first two (2) techniques are the preferred techniques. However, if the Contracting Officer determines that information on competitive proposed prices or previous contract prices is not available or is insufficient to determine that the price is fair and reasonable, the Contracting Officer may use technique as appropriate to the circumstances applicable to this acquisition.
1. Comparison of proposed prices received in response to the solicitation normally satisfies the requirement for adequate price competition and establishes price reasonableness.
2. Comparison of previously proposed prices and previous Government contract prices with the currently proposed prices for the same or similar items. However both the validity of the comparison and the reasonableness of the previous price must be established.
3. Use of parametric estimating methods.
4. Published price lists.
5. Independent Government Cost Estimates.
6. Market Research.
7. Information provided by the offeror.
8. Information/reports from DCAA or other outside agencies as required.
(End of addendum)
