Price Schedule

Q: Will the government provide an excel spreadsheet to input pricing data or does the offeror provide its own format for submission? Recommend that the government provide a pricing document to ensure all bidders provide the same amount of information and that all information for pricing is transparent to the government.

A: Please refer to Addendum to provision 52-212-1 Instructions to Offerors. A completed CLIN Price Schedule must be provided with the proposal via SF 1449. No excel spreadsheet is necessary.

1.21.1 & 1.21.1.1

Q: Do the provisions of Sections 1.21.1 and 1.21.1.1, which cover construction safety and health laws/requirements, apply to this RFP, considering that this RFP is unrelated to construction?

A: It is applicable since a DRAW is required for each course. 1.21.1.

Host Nation Safety Laws and Regulations: The Contractor shall comply with FAR 52.236-13, Accident Prevention (November 1991), the references contained therein (e.g. U.S. Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1)), and applicable Host Nation Safety Laws and Regulations.

The requirements under FAR 52.236-13 and specifically of the EM 385- 1-1 include, but are not limited to the following:

(a) Before initiation of work at the job site, an Accident Prevention Plan, written by the Contractor for the specific work and hazards of the contract and implementing in detail the pertinent requirements of EM 385-1-1; will be reviewed for acceptance by designated Government personnel, called see PWS section 5.2.7.5 Draw requirement. Specific requirements for development of the Accident Prevention Plan are found in 01.A and Appendix A of EM 385-1-1. EM 385-1-1 is available online at https://www.usace.army.mil.

PWS Section 1.10.5

Q: Solicitation page 74 states “the Lead Instructor (1) and other three (3) Instructors have at least three (3) years’ experience within the past five (5) years in the area of expertise. The expertise required includes experience instructing Small Arms Maintenance, serving as a Unit Armorer, or working in some other professional capacity that requires the management of an arms room and unit and field level maintenance and repair of a variety of handheld, shoulder fired and crew-served weapons.”

PWS Section 1.10.5 states “The contractor shall provide fully qualified training instructors (one lead instructor and three other instructors), who, as a minimum, have at least six (6) months experience within the past ten (10) years in the area of expertise required to instruct Small Arms Maintenance, serving as a Unit Armorer, or working in some other professional capacity that requires the management of an arms room and unit and field level maintenance and repair of a variety of handheld, shoulder-fired and crew- served weapons or should have at least two (2) years of experience as an arm's room maintenance supervisor.”

Will the Government please indicate the correct requirements and qualifications for Lead Instructors and regular Instructors?

A: Will correct Page 74 to match PWS, also will correct 52.212-2 to match.

PWS Section 1.10.4.2.1/Page 9 of 43, Q: PWS Section 1.20.4.2.1 states resumes for Substitute/Replacement Instructors shall be included in the proposal. How many resumes and what resumes are required to be provided with the proposal?

A: 1.10.4.3.1. The Contractor will provide resumes of replacement and substitute instructors for adherence to contract requirements.

Replacement/substitute instructor must meet the level of qualification standards. (A.008). Section 1.20.4.2.1 does not exist, and replacement/substitute resumes are only applicable during the contract if new personnel are hired.

PWS Section 1.6.4

Q: PWS Section 1.6.4 states “Army in Europe (AE) Regulation 604-1 provides guidance pertaining to background checks for U.S. and Host Nation Contractors.” Will the government provide detailed steps on how background checks will be done?

A: 1.6.4.1 Background Checks/Local National Screening Program (LNSP): Army in Europe (AE) Regulation 604-1 provides guidance pertaining to background checks for U.S. and background checks/ LNSP checks for Host Nation Contractors

1.6.4.1.1 U.S. Citizen: The Requiring Activity Manager will determine the extent of background checks required. The Contractor employee may begin performance of the contract after receiving a favorable local background check. The Contractor agrees to replace the employee should results of the stateside background check, if required, be unfavorable as determined by the Requiring Activity Manager. The Contractor’s replacement of the employee with the unfavorable background check shall be within a timeframe provided by the Requiring Activity Manager. The Contractor shall also replace employees whose background check, during their tenure of employment, renders them with an unfavorable local or stateside background check, as determined by the Requiring Activity Manager. The Contractor shall forward a copy to the Contracting Officer via the COR and the Requiring Activity Manager of each favorable background check within 3 days of receipt by the Contractor, identifying such with the appropriate contract number The Contractor shall forward a copy to the Contracting Officer via the COR and the Requiring Activity Manager of each unfavorable background check within 24 hours of receipt by the Contractor, identifying such with the appropriate contract number When the Government awards a non-personal services contract directly to an individual, the failure of the individual to provide a favorable background check would be grounds for termination.

1.6.4.1.2 Local Nationals and Third Country Nationals: Local national and third country national Contractors are subject to background checks and LNSP checks as determined by the Requiring Activity Manager. As a minimum prior to beginning performance, Contractors employing local national and third country nationals shall furnish the Contracting Officer via the COR and the Requiring Activity Manager a Polizeiliches Fuehrungszeugnis, issued within the previous three months, no later than 5 days after contract award.

Forwarding correspondence from the Contractors shall identify the associated contract number. The Requiring Activity Manager will determine the favorability of the Polizeiliche Fuehrungszeugnis and notify the Contractor.

The Contractor shall forward a copy of unfavorable Polizeiliche Fuehrungszeugnis to the Contracting Officer via the COR and the Requiring Activity Manager within 3 days of receipt, identifying such with the appropriate contract number. Local nationals and third country nationals agree to the same employee termination provisions as stated for U.S. Citizens (see paragraph 1.6.4.1.1 above, in particular, same requirements to replace the employee (and within timeframe noted) when results of background check are unfavorable).

a) Additionally, does the line item only include new/current/upgraded weapons?

b) Can the government provide guidance that articulates pricing for this line item, for example, should a plug number be given for this as this is currently an unknown and undetermined type of quantity of work to be performed?

A: Yes, upon Government approval. Yes, only new, current and upgraded weapons. b) An estimate of 150 LH are calculated. Line of work is defined in PWS section 1.23.7

Q: Can the Government provide clarification Line Item 0003 Security Checks of Arms Room?

a) How is this currently being conducted ie number of times per day, by whom are they being conducted?

b) Are instructors dual-hatted performing this task or is this task performed by the Lead or other designated individual?

A: a) Three times per day (every 8 hours) via Contractor personnel. b) Any SAM31 instructor can perform the security checks.

Will the Government clarify how the color rating will align appropriately with the numerical score? What is the minimum SPSRS score required?

Will the government consider past performance in staffing, management of providing personnel with similar size & scope in lieu of substitute resumes required? If not will the government quantify the number of substitute resumes required and are these for Lead and regular instructors or just regular since the Lead would be considered key personnel?
