Summary of Changes
The purpose of this amendment is to:
a. Answers questions as shown below;
b. Update Performance Work Statement (PWS), Paragraphs 2.4.4.3.1 and 7.1.1.14.1 as shown below;
c. Update Attachment 01, Common Level of Support CLS 411, Paragraph 5.2.2.9 as shown below;
d. All other terms and conditions of the Solicitation remain the same.
Questions and Answers:
1. Do we see Do we see this correctly, that the Prime Contractor must be certified both DIN 9001:2015 and DIN 140001:2015?
Yes, as stated at Clause 52.212-2 Evaluation – Factor 1: Technical – Subfactor 1: Contractor Certification
2. There`s still a difference between the numbering of the Technical Exhibits (TE) in the
PWS and the ELIN-Sheets. Therefore, it is not clear in which ELIN position the Technical Exhibit 6.10 (dehoust systems) is to be included. Where we should calculate these costs?
Both, TE # 6.7 and TE # 6.10 describes sprinkler systems, of course different type of system, however finally sprinkler systems. All these systems stated on TE #6.7 and TE # 6.10 shall be maintained monthly, semi-annually and annually. All resulting maintenance costs shall be calculated under the respective ELINs BY, 1stOY and 2nOY – Sub ELINS for example V004
(V004AA – V004AF).
3. We understand that the Key personnel and all Technicians, for whom we deliver certificates, must be reachable in the Area and must perform the work (in this Contract USAG Bavaria) in the Place of Performance. Is that right?
Yes, it is clearly defined within the respective Paragraphs.
It is not allowed that the Key personnel is located in Berlin. Is that right?
It is not required that the Key Personnel is permanently on site, however required to be available by telephone, fax and electronic mail communications during the specified operation hours. In addition reference is made to PWS Para 2.4.1 and 2.4.1.1 – Contract Manager or designated representative shall attend meetings “as requested by the Government”. As well as reference is made to the PWS Para 3.2, which compulsory requires the contractor to be present on site for Quality Control.
4. We assume that the required key personnel should have already performed activities as described in PWS 2.4.3. in similar contracts. Is this correct?
Evidence of qualifications shall be provided to the COR during the Pre-Performance Conference. If no Pre-Con will be held, evidence shall be submitted to the COR five (5) days after contract award. Please see attached, updated PWS, dated 14 December 2021, Paragraph 2.4.4.3.1.
5. For example in Technical Exhibit 6.10 and 7.5 a WILO GEP pump is installed. Should a pure function check or a complete maintenance according to the manufacturer's specifications be released and carried out?
On all systems listed in the TE’s, services shall be accomplished IAW the manufacturer guidelines.
6. Is it correct that during PM all seals must also be replaced per manufacturer's specifications and these costs (time and materials) should be included in the sprinkler system maintenance fee?
No, the decision to replace the seals will be made by the COR.
7. In the first sentence of 5.2.2.9, a cost estimate must be submitted to the COR within 3 days; in
5.2.2.9 d, it must be verbally immediately and in writing after one business day the speech.
Which applies and how should it be handled in practice?
The response date to provide written cost estimates generally were change to read three (3) days. Please see attached, updated Attachment 01 – CLS 411 – Paragraph 5.2.2.9.
8. 5.2.2.9 c. “Estimated start and completion date after receipt COR’s of approval to perform recommended repairs. All work shall be completed within five (5) calendar days after approval date and shall be performed in accordance to all applicable regulations.”
This is often not possible due to delivery deadlines. How should this be handled?
Notify the COR, that there are delays in the delivery of spare parts.
9. 5.2.2.9 d. “If routine or urgent required repair work is detected during the performance of PM, contractor shall provide a verbal cost estimate to the COR, however, a detailed written cost estimate shall follow the next contractor working day.”
This is not feasible in practice, since prices, delivery, etc. of the spare parts must first be requested from the supplier. Therefore, it is also not possible to submit a written offer on the next working day.
How should this be handled in practice?
Provide written cost estimates within three (3) working days (as mentioned in the PWS). If prices not available, inform COR and provide the prices from the suppliers as soon as they available.
10. 7.1.1.14.1 “…The lump sum cost of an on-call system includes all travel costs, labor, and two-hours of poor labor hours on site to localize the reason for the break down, to set the system back into operational condition, as well as to define labor and material cost to provide a cost estimate for repair.”
It is not always possible to ensure completion of the inspection within 2 hours and leave the system ready for operation.
What should be the procedure here?
Please see attached, updated PWS, Paragraph 7.1.1.14.1.
Hereto, reference is made to Attachment No 1- CLS, Para 5.2.2.6 - Any additional required labor hour exceeding this firm fixed price basis per call will be compensated with the regular labor hour price determined in the CLINs T&M – Labor Hours. All built-in material and spare parts will be reimbursed under the respective CLINs – T&M Parts.
11. There are also powder and foam extinguishing systems in the Technical Exhibit, which must be maintained by specially trained personnel. Are the corresponding certificates must be submitted in advance?
Evidence of qualifications shall be provided to the COR during the Pre-Performance Conference. If no Pre-Con will be held, evidence shall be submitted to the COR five (5) days after contract award.
Please see attached, updated PWS, dated 14 December 2021, Paragraph 2.4.4.3.1.
12. We assume that the monthly checks of the sprinkler systems must be carried out by VDS-certified personnel. Is this correct?
Yes, as outlined in the PWS Paragraph 2.4.4.3.1 and given by the pertinent Regulation outlined within Attachment 01 – CLS, Paragraph 5.2.1
13. In TE 7.5, the 2060 building is noted as "under construction", is this completed and must be calculated?
At present, no calculation required. Once the building is finally renovated and turned over to the requiring activity, contractor will be asked to provide prices for the performance of maintenance. Any additional systems will be added to the contract via Contract – Modification.
14. 5.2.2.3 “Safety Inspection after Ten (10) and Twenty/Twenty-Five (20/25) Years of Operation:
Requiring Activities will determine which systems will be ordered for inspection after the first maintenance cycle based on the contractor’s assessment of the condition of the systems at the individual communities.
Within four (4) weeks after contractor has identified which systems shall be inspected, the Contractor shall submit to the COR a proposed time schedule for the ten (10) respectively twenty-/twenty-five (20/25) year safety inspection. The Contractor shall not deviate from approved maintenance schedules.
(Deliverable A012)”
The statements are contradictory, who should decide which systems to maintain?
The requiring activity/subject matter experts will decide which systems shall be inspected. The contractor submits his results from the inspection.
