PERFORMANCE WORK STATEMENT (PWS)
Bulgarian Local National Engineer Support Services
Part 1
General Information
1. Introduction: This is a non-personnel services contract to provide Bulgarian Local National Engineer Support Services. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1. Background: In order for United States Army to comply with US Construction and Host Nation Construction Standards, local Engineers are required to assist USG in following local construction standards and practices. Local Engineers must be educationally qualified and have relevant work experience in the host nation. Contract will be to provide TWO qualified Engineers (one General Engineer and one Environmental Engineer) for support the Black Sea Area Support Team’s (BS-AST) Directorate of Public Works (DPW) with duty in the Novo Selo Training Area, Bulgaria.
1.2. Responsibilities: The Contractor shall assume total responsibility for all requirements stated herein on the commencement date of the performance period. The Contractor shall perform as specified in this Contract and under the direction of the Contracting Officer (KO).
1.2.1. Work Responsibility: The Contractor shall perform all work and assume responsibility for planning, programming, administering, managing, and executing all functions necessary to provide the services specified in this PWS. The Contractor shall conduct work in accordance with this PWS and all applicable United States (U.S.), Bulgarian, and local laws, regulations, standards, provisions, and directives to include applicable publications in Part
6. The Contractor shall ensure that all work meets the level of service, performance standards, or tolerances specified in the PWS or in applicable referenced documents. Some services under this Contract may be performed at designated facilities, or portions of installations, by in-house Government personnel or by other contractors.
1.2.2. Administrative Responsibility: The Contractor shall perform all related administrative actions required to provide services or perform work such as material requisitioning, quality control (QC), financial control, meetings, and correspondence. The Contractor shall also maintain accurate and complete records, files, and libraries of documents to include all U.S. German, and local regulations, standards, provisions, codes, laws, technical manuals, and manufacturers’ instructions and recommendations that are necessary and related to the functions being performed. The Contractor shall compile historical data, prepare required reports, and submit information as specified by the Deliverable List presented in this PWS.
1.3. Objectives:
1. Provide One (1) General Engineer (Civil, Architectural, Structural, Mechanical, Electrical or applicable).
2. Provide One (1) Environmental Engineer (Environmental Engineer, or Environmental Sciences)
1.4. Functional Areas: Majority of the work to be performed will be at Novo Selo Training Area, Bulgaria.

1.6. Management and Administration:
1.6.1. Phase In /Phase Out Period: N/A
1.6.2. Contractor Management: The Contractor shall perform continual management of the functional areas contained in this PWS and shall be responsible for the performance of the work. The Contract Manager shall conduct overall management coordination and shall be the central point of contact (POC) with the Government for performance of all work under the PWS. At the Post Award conference, the Contractor shall submit to the COR, in writing, the name, title, office, home and mobile telephone number of the Contract Manager. A Contractor employee shall be designated to act for the Contract Manager during the Contract Manager’s absence.
Both the Contract Manager and the Contractor employee filling in for the Contract Manager, shall have full authority to act for the contractor on all Contract matters relating to daily operation of this Contract.
*NOTE: The Contractor shall only provide two individuals in support of this requirement: One (1) General Engineer and One (1) Environmental Engineer. It is acceptable that one of these individuals is appointed and performs the functions of Contract Manager.
1.6.3. Contractor Responsiveness: The Contract Manager or designated alternate shall be available for telephone communication or site attendance, with the COR, as required by the COR, between 8:00 a.m. to 5:00 p.m., Monday thru Friday except recognized local holidays. A personal answering service is permitted at other than normal Contract workdays and work hours for receipt of COR emergency response work requirements, provided that the Contract Manager or designee responds to all calls within a time not to exceed two hours after notification of the call by the answering machine and/or service.
1.6.4. Meetings, Conferences, and Briefings: The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Contract Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter.
Meetings may start or end outside of regular duty hours.
1.6.5. Hours of Operation: The contractor is responsible for conducting business, between the hours of 8 AM to 5 PM Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons.
The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.6.6. Recognized Holidays: See local clause 5152.204-4000 U.S. AND HOST NATION HOLIDAYS (March 2005)
1.6.7. Training Holidays: USAREUR has historically granted military personnel Training Holidays as compensation for time that they spent in field training. These are typically combined with regular holiday leave schedules (for example, Christmas half days or day on day off schedules). Training Holidays may affect access to military operated facilities. If scheduled work or access to facilities is required, coordination with occupants will be necessary or the work in affected facilities shall be rescheduled after the training holiday. However, announced training holidays or exodus of military personnel may provide the Contractor with an opportunity for unrestricted access to facilities and areas. The Contractor shall take full advantage of such opportunities by planning maintenance or actions that are better accomplished when such areas are vacant.
1.6.8. Quality Control: N/A
1.6.9. Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.10. Place of Performance: The work to be performed under this contract will be performed at Novo Selo Training Area (NSTA), Bulgaria.
1.6.11. Type of Contract: The government will award a Firm Fixed Price contract.
1.6.12. Security Program:
1.6.12.1. AT Level I Training. All contractor employees, including subcontractor employees, requiring access to Army installations, facilities, and controlled-access areas will complete AT Level I awareness training within 30 calendar days after the contract start-date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor will submit certificates of completion for each affected contractor employee and subcontractor employee to the COR or to the contracting officer, if a COR is not assigned, within 30 calendar days after training is completed by all employees and subcontractor personnel. AT Level I awareness training is available online at https://atlevel1.dtic.mil/at.
1.6.12.2. AT Awareness Training for Contractor Personnel Traveling Overseas. Specific AOR training content may be directed by the USEUCOM Commander, with the USAREUR ATO being the local POC.
1.6.12.3. Access and General Protection/Security Policy and Procedures. The contractor and all associated subcontractor employees will comply with applicable installation, facility, and area commander installation/facility access and local security policy and procedures (provided by Government representative). The contractor will also provide all information required for background checks to meet installation-access requirements to be accomplished by the installation provost marshal office, director of emergency services, or security office. The contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA, and local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the force protection condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
1.6.12.4. iWATCH/iSALUTE Training. The contractor and all associated subcontractors will brief all employees on the local iWATCH/iSALUTE program (training standards provided by the requiring activity ATO). This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training will be completed within 30 calendar days after the contract is awarded and within 30 calendar days after new employees commence contract performance, with the results reported to the COR within 30 calendar days after the contract is awarded.
1.6.12.5. For Contracts That Require Performance or Delivery in a Foreign Country. DFARS 252.225-7043.
The clause will be used in solicitations and contracts that require performance or delivery in a foreign country. This clause applies to both contingencies and non-contingency support. The key AT requirement is for non-local national contractor personnel to comply with theater clearance requirements and allows the combatant commander to exercise oversight to ensure the contractor's compliance with combatant commander and subordinate task-force commander policy and directives.
1.6.12.6. Contractor Employees Who Require Access to Government Information Systems. All contractor employees with access to a Government information system must be registered in the Army Training Certification Tracking System (ATCTS) at commencement of services, and must successfully complete DOD information assurance awareness training before access to the information system and then annually thereafter.
1.6.12.7. For Contracts That Require an OPSEC Standing Operating Procedure/Plan. N/A
1.6.12.8. For Contracts That Require OPSEC Training. According to AR 530-1, new contractor employees must complete Level I OPSEC training within 30 calendar days after they report for duty. All contractor employees must complete annual OPSEC awareness training.
1.6.12.9. For Information Assurance (IA)/Information Technology (IT) Training. All contractor employees and associated subcontractor employees must complete DOD information assurance awareness training before issuance of network access and annually thereafter.
1.6.12.10. For Information Assurance (IA)/Information Technology (IT) Certification. N/A
1.6.13. Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.
1.6.14. Key Control: The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons.
NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor. The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer. The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. Key Control will be in accordance with Army Regulation 190-51.
1.6.15. Special Qualifications: A verifiable Curriculum Vitae (CV) of all personnel performing work must be submitted to the Contracting Officer with offers. The contractor is responsible for ensuring all related professional accreditations and certifications are valid during the execution of this contract. The contractor personnel performing the tasks specified here in shall be able-bodied and possess the following qualifications, as a minimum:

Degree shall be from an accredited university recognized by one of the following: United States (ABET – Accreditation Board for Engineering and Technology, Inc.), Europe (any national members of FEANI – European Federation of National Engineering Associations), or Europe (any agencies of ENAEE – European Network for Accreditation of Engineering Education). Minimum of 4 years’ experience in facilities engineering related to a large industrial complex. Minimum 1-year experience working with multi-national agencies or companies. 1.6.15.2. Environmental Engineer Education and Experience: Environmental Engineer, or Environmental Sciences degree, 4 years. Degree shall be from an accredited university recognized by one of the following: United States (ABET – Accreditation Board for Engineering and Technology, Inc.), Europe (any national members of FEANI – European Federation of National Engineering Associations), or Europe (any agencies of ENAEE – European Network for Accreditation of Engineering Education). Minimum of 2 years’ experience providing environmental consultation services; may include soil/groundwater remediation studies, environmental protection projects, and/or waste management. Minimum 1-year experience working with multi-national agencies or companies.
1.6.15.3. Experience working with U.S. Department of Defense (DoD) or other U.S. government agency preferred, not mandatory.
1.6.15.4. Familiarity with Novo Selo Training Area (NSTA) military base desirable, not mandatory.
1.6.15.5. C2 level proficiency in speaking, reading, and writing both English and Bulgarian based on the Common European Framework of Reference for Languages' (CEFR) Common Reference Levels.
1.6.15.6 Proficient computer literacy skills to include proficiency in Microsoft Outlook, Office, Word, and Excel.
1.6.15.7. No criminal record or adverse history that would limit the applicant’s ability to apply for access to enter a U.S., Host Nation, or NATO military base.
1.6.16. Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced.
Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.17. Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract:
perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.6.18. Key Personnel: The following personnel are considered key personnel by the government:

1.6.19. Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. Contractor personnel shall not be required to obtain and wear badges in the performance of this service.
1.6.20. Contractor Travel: N/A
1.6.21. Other Direct Costs: N/A
1.6.22. Data Rights: The Government has unlimited rights to all documents/material produced under this contract.
All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.
1.6.23. Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

DEFINITIONS & ACRONYMS
2. Definitions And Acronyms:
2.1. Definitions:
Contractor - A supplier or vendor awarded a contract to provide specific supplies or service to the government.
The term used in this contract refers to the prime.
Contracting Officer - A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
Contracting Officer's Representative (COR) - An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
Defective Service - A service output that does not meet the standard of performance associated with the Performance Work Statement.
Deliverable - Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
Key Personnel - Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
Physical Security - Actions that prevent the loss or damage of Government property.
Quality Assurance - The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
Quality Assurance Surveillance Plan (QASP) - An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
Quality Control - All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
Subcontractor - One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
Work Day - The number of hours per day the Contractor provides services in accordance with the contract.
Work Week - Monday through Friday, unless specified otherwise.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3. Government Furnished Items and Services
3.1. Services: N/A
3.2. Facilities: The Government will provide the necessary workspace for the contractor staff to provide the support outlined in the PWS to include desk space, telephones, computers, and other items necessary to maintain an office environment. The contractor shall instruct employees to maintain their workspace in a neat, organized, professional manner.
3.3. Utilities: The Government will provide all utilities in the facility, which will be available for the contractor’s use in performance of tasks outlined in this PWS. Since utilities will be furnished, the following is required: The Contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.
3.4. Equipment: The Government will provide access to government computers, monitors, scanners, copiers, printers, and telephones. The contractor shall instruct employees on maintaining proper care of all government furnished equipment.
3.5. Materials: N/A

CONTRACTOR FURNISHED ITEMS AND SERVICES
4. Contractor Furnished Items And Responsibilities:
4.1. General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

SPECIFIC TASKS
5.1. Basic Services: The contractor shall provide services for Black Sea Area Support Team Directorate of Public Works, by providing one General Engineer and one Environmental Engineer.
5.2. Recurring Services: The contractor shall provide the following services on a recurring basis. For all tasks, Contractor will not be making any decisions, cannot provide direction to other contractors or government employees, but will work in close coordination with Government officials.
5.2.1. Objective: Provide technical report interpreting the results of third party contracted water quality tests.
Standard: Technical Bulletin 577 ALP: For each third party water test submitted, the technical report shall be submitted within one (1) work day and be 100% accurate
5.2.2. Objective: Document Work Order Log within 1 day after Work Order receipt.
Standard: Logged work orders shall be 97% accurate
5.2.3. Objective: Provide written translation of utility and construction-related bills.
Standard: Within 2 working days after receipt or bills, grammatically correct, and 100% accurate
5.2.4. Objective: As required, provide written assessment (technical report) of utility systems, buildings, and other facilities and make recommendations for repair and/or upgrade.
Standard: In accordance with (IAW) USAREUR, Base Camp Facilities Standards ALP: Relevant, grammatically correct and within format and timeframe provided by the Government
5.3. On-Demand Services: As required, the contractor shall provide the following services on-demand basis. For all tasks, Contractor will not be making any decisions, cannot provide direction to other contractors or government employees, but will work in close coordination with Government officials.
5.3.1. Objective: Provide technical assistance to DPW in developing plans and projects. Includes conducting field surveys, accompanying US Government officials on site visits, providing basic technical drawing(s), and providing local material/manpower cost analysis.
Standard: IAW USAREUR, Base Camp Facilities Standards ALP: Relevant, grammatically correct and within format and timeframe provided by the Government
5.3.2. Objective: Using local and European practices and standards, provide technical assessment on construction and maintenance of buildings and structures; HVAC, electrical, natural gas, water, and wastewater systems; roads and grounds; custodial services; refuse removal; pest control; housing/billeting; and work control.

5.3.3. Objective: Provide technical advice on contractor or government furnished environmental reports with emphasis on construction and land usage.

5.6. Enterprise-Wide Contractor Manpower Reporting Application (eCMRA): The contractor shall ensure ALL contractor labor hours (including subcontractor labor hours) required for the performance of services provided under this contract are reported via a secure data collection site.
The contractor (and all subcontractors providing direct labor under this contract) shall report complete and accurate data for the labor executed during the period of performance during each Government fiscal year (FY), which runs from October 1 to September 30. The Contractor shall input the data into the appropriate eCMRA reporting tool, which can be accessed via a secure web site at http://www.ecmra.mil/. There are four separate eCMRA tools: Army, Air Force, Navy and All Other Defense Components. The appropriate eCMRA reporting tool to use is determined by the requiring activity being supported (e.g., if DISA awards a contract for an Air Force requiring activity, the contractor shall load the required reporting data in the “Department of Air Force CMRA” tool). While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. The contractor shall completely fill in all required data fields. The contractor shall enter initial data into the appropriate eCMRA tool to establish the basic contract record no later than 15 working days after receipt of contract award or contract modification incorporating this clause. The contractor shall notify the COR when the basic contract record has been established in the appropriate eCMRA tool.
