SUMMARY OF CHANGES

The purpose of this amendment is to highlight items covered during the Site Visit conducted on 23 August 2016 at the DFAC Illesheim. In addition, the amendment provides answers/clarifications to questions presented by the attendees.

1. Technical Exhibit listing – the technical exhibit listing has been verified/confirmed by the Requiring Activity. Any version otherwise provided, i.e. “DRAFT Solicitation”; is not valid. Consider only the data posted to FBO and reiterated in this amendment.

2. Deliverable Schedule – the deliverable schedule has been verified/confirmed by the Requiring Activity. Consider the due date and frequency outlined within the deliverable schedule when submitting your proposal.

3. Estimated Workload – the estimated workload pertains to the number of users (historical data).

4. Installation Access Clarification – Installation access is governed by Army Europe Regulation 190- 16 “Installation Access Control.” Below is an excerpt from the regulation in regards to background checks and/or who may gain access to a U.S. military installation.

As outlined in AER 190-16 (11 January 2010), Section III, paragraph 12, a. definition, b. type of pass authorized, e. background check.

Installation Access Privilege available to EU resident or NATO Member Country.

CONTRACTOR (RESIDENT OF EUROPEAN UNION (EU) OR NATO-MEMBER COUNTRY):

a. Definition. A Contractor (Resident of EU or NATO-Member Country) is an individual without NATO SOFA status who lives in the EU or a NATO-member country, is contracted to work for DOD in Europe, and is not a DOD ID cardholder. Contractors who are trying to establish a contract with DOD may be granted access only through an individual who has sign-in privileges or through access-roster procedures.

The temporary installation pass will be valid for the length of the contract or up to 90 days, whichever is less. The regular installation pass will be valid for the length of the contract, up to 2 years, or until the expiration date of the supporting document (for example, passport) that was used to obtain the installation pass, whichever is earliest.

Background check to work at DFAC (without access to government information network):

PGCC (Polizeiliches Führungszeugnis). This certificate is required before a temporary or regular installation pass may be issued.

MP Check. An MP check is required for U.S. citizens before a temporary or regular installation pass may be issued.

LNSP. LNSP screening applies to both non-U.S. citizens and U.S. citizens who have lived in Germany for more than 12 consecutive months without NATO SOFA status. This screening must be initiated before a temporary installation pass may be issued. The screening must be completed and returned negative with no entries before a regular installation pass may be issued.

Aufenthaltstitel. An Aufenthaltstitel may be required for non-host nation citizens unless the individual has an exception to this requirement (para 29c(6)).

Exceptions excerpt from AER 190-16, paragraph 29 (c) (6):

Citizens of the following EU countries DO NOT REQUIRE PERMITS TO RESIDE OR WORK in Germany: Austria, Belgium, Cyprus (Greek Part), Denmark, Finland, France, Germany, Greece, Ireland, Italy, Luxembourg, Malta, the Netherlands, Portugal, Spain, Sweden, and the United Kingdom.

Citizens of the following EU countries citizens DO NOT REQUIRE RESIDENCE PERMITS BUT ARE REQUIRED to have an EU WORK PERMIT (Arbeitserlaubnis-EU) authorizing them to work in Germany: Bulgaria, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia, and Slovenia.

Background check (with access to government network):

Contract employees must comply with AR 25-2 Paragraph 3-3 (c) which states that "Users must have a favorable background investigation or hold a security clearance and access approvals commensurate with the level of information processed or available on the system". For Local and Foreign Nationals, the background check is called an LNSP. Regardless of nationality, Part III of the DD FORM 2875 will have to be completed and digitally signed by the supporting security manager. The DoD Information Assurance Awareness class is also required, per PWS section 1.16.12.6.

Regardless government network access (CAC), a 12-month residency requirement is REQUIRED AND MANDATORY FOR THIS REQUIREMENT to get a permanent base pass, NO

EXCEPTIONS.

5. AR 380-19 has been replaced by AR 25-2 “Information Assurance.” PWS has been updated as reflected below.

6. Why does the DFAC Manager & Assistant DFAC Manager have to speak German? Is there a reference to this bilingual requirement?

Bilingual requirement has been amended for all aplicable personnel.

7. The word “Army” has been deleted from provision FAR 52.212-2 Technical to match section

1.6.15.3 of the PWS. Food Management Information System in lieu of “Army Food Management Information System.”

8. Could the vendor provide alternate sources of food?

No. Only properly vetted food provided through authorized sources. The government is providing all the food supplies as outlined in the PWS.

9. Does the vendor require access to the Army Food Management System network?

Yes. The vendor would be responsible to provide qualified individuals capable of passing a background check to gain access to the network and other systems outlined in the PWS.

10. How many shifts are being offered in the current contract?

Two shifts. Number of personnel varies depending on the throughput. Recommended to offerors to read the PWS and make their own plan to meet the requirement as outlined in the PWS.

11. What is the expectation for the Health Certificate? Need to know German and EU equivalent in the event these are provided.

A certified statement provided by the contractor indicating that the health requirements outlined in TB 530-2 (Employee Health) have been met will suffice noting that the contractor (not the employee) will be held accountable for misleading or false information.

12. How many personnel are normally used for money collection?

It depends on the number of dinners.

13. Contractors were reminded to keep their SAM information up to date to include phone and email. This is the information used to send amendments or any other correspondence related to this requirement.

14. Does Germany Law 613a apply to this requirement?

The govenrment refers all contractors to DFARS 252.222-7002 "Compliance with Local Labor Laws (Overseas)." Your legal cousel should be able to provide further guidance.
