If the need for overtime is anticipated, the contractor must receive approval from the KO at a minimum of seven calendar days prior to execution.) The Contractor’s proposed Work Plan shall be submitted to the COR for review within 7 days after contract award. The Government will review and either accept or return their comments to the Contractor within 10 days. The Contractor shall then have three days to submit a Final Work Plan. The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor” and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements.
Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable COR plans and procedures –this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
1.9.1. Physical Security. All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location.

Contract personnel shall comply with all personal identify verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the COR.
1.9.2. Suspicious Activity Reporting training (e.g., iWATCH, CorpsWatch, or See Something, Say Something). All contract personnel shall receive initial and annual refresher training from the RA representative or COR on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
1.9.3. Pre-screen candidates using E-Verify Program. Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements.
Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
1.10. Key Control. The contractor shall establish and implement a method of securing all keys issued to the contractor by the Government. The contractor shall be responsible for all lost or misplaced keys and keys used by unauthorized persons. No keys shall be duplicated.
The contractor shall immediately report any incident of a lost or duplicated key. If locks rekeyed, due to a lost or duplicate key, the contractor shall be responsible for all costs associated to do so.
1.10.1. Individual Termination or Expiration of Employment. The contractor shall collect all gate keys the same day employment of an individual has expired or has been terminated and shall return them to the issuing COR within 3 calendar days.
1.10.2. Contract Termination or Cancellation. Upon termination or cancellation of this contract, the contractor shall collect all gate keys and return them to the COR within 3 calendar days.
1.11. Gate/Lock Requirements. The Contractor shall be responsible for access to, into and through all locations. Access to locations may or may not be through locked barricades or gates on Government property and shall be by routes approved by the COR in advance prior to entry. The Contractor shall lock all Government gates or barricades when entering and leaving a closed area. All gates that are to be left open during or after a service shall be locked in the open position.
1.12. Post Award Conference/Periodic Meetings. The contractor shall attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR subpart 42.5. The KO, COR, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor’s performance. At these meetings the Government will apprise the contractor of how the Government view the contractor’s performance and the contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no cost to the Government.
1.13. Contracting Officer’s Representative (COR). The COR is not authorized to change any of the terms and conditions of the resulting contract. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is not authorized to obligate the Government. The COR is not authorized to request new or additional work. The COR’s functions are as follows:
Perform inspections Maintain written and oral communications Monitors contractor’s performance Notifies the Contracting Officer and Contractor of any deficiencies
1.14. Personnel. The contractor shall provide the KO and COR with a list of employee names or alternates to be employed in the performance of the contract 10 days after contract award.
The Contractor shall also notify the COR with any additions or deletions to the list of employees immediately.
1.14.1. Employees of the contactor assigned for performance of this contract shall be capable employees with sufficient experience and training to assure compliance with the contract requirements. The employees shall be required by the Contractor to maintain a clean and neat appearance. Contractor personnel shall not consume, nor be under the influence of alcoholic beverages, or illegal drugs.
1.15. Conduct of Personnel. The COR or KO may require the contractor to remove from the job site any employee working under this contract for reasons of misconduct, security, or found to be or suspected to be under the influence of alcohol, drugs, or other incapacitating agents. Contractor employees shall be subjected to dismissal from the premises upon determination by the COR or KO that such action is in the best interests of the Government.
Such removal from the job site or dismissal from the premises shall not relieve the contractor of the requirement to provide sufficient personnel to perform the services as required by the PWS.
1.16. Quality Control Representative. The contractor shall provide a Quality Control
Representative and alternate who shall be responsible for the performance of the work detailed within this PWS. The Quality Control Representative and Alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. These individuals shall be available during normal Government operating hours listed in section 1.8.1. The Contractor Quality Control Representative shall meet the following requirements. This person shall be identified in writing at the Post Award meeting prior to work beginning on this contract. Any changes regarding this person shall be identified in writing and submitted to the COR or KO within 3 calendar days of the change.
1.16.1. Work on similar projects.
1.16.2. Competent person training as needed.
1.17. Identification of Contractor Employees. All contract personnel working in situations where their contractor status is not obvious to third parties are required to identify themselves. This may be accomplished by wearing clothing bearing the name of the company or by wearing clearly written and visible nametags which always contain the company name and employee name, as such to avoid creating an impression in the minds of members of the public that they are Government officials.
1.18. Quality Control. The contractor shall provide a written description of the quality control system to include identification of the commercial practices and procedures to be used. The contractor shall develop and implement procedures to identify, prevent, and ensure non-performance and continual repeat of defective service does not occur. The contractor shall submit a written quality control plan to the COR for approval. The contractor shall submit the plan no later than the post-award conference. The plan shall specifically address the contractor’s strategy to provide quality workmanship, continual process improvement and for correcting deficiencies as required.
1.19. Performance Requirements Summary (PRS). The contract service requirements are summarized in performance objectives that relate directly to those requirements. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The PRS and the contractor’s Quality Control Plan provide information in contract requirements, the expected level of contractor performance and the expected method of government validation and confirmation of services provided. These thresholds are critical to mission success. See Technical Exhibit A.

While inputs may be reported at any time during the FY, all data shall be reported no later than October 31 of each calendar year.
Contractors may direct questions to the help desk by clicking “View Assistance for
SAM.gov” which is located at the top of the SAM.gov website. From there, you can select the “Contract Our Service Desk”: which will allow you to contact SAM.gov directly. If contract period of performance ends prior to September 30, the Contractor has 30 calendar days from end date of the contract to complete the SAM SCR requirement.
Steps for submitting a Service Contract Report (SCR)
1. Go to www.sam.gov and log in.
2. Select Entity Registrations and then select Service Contract Reporting.
3. SAM displays your entities which have service contracts and meet the reporting criteria. Select view by entity to see the service contract for each entity.
4. Next, select Add for the service contract against which you want to create a Service
Contract Report. Each service contract which meets the FAR Subpart 4.1703 reporting thresholds is displayed.
5. You will be taken to the Complete Service Contract Report page. SAM displays the contract details and allows you to report. You are required to enter the following information:
Total Amount Invoiced: Total dollar amount invoiced for services performed during the previous Government fiscal year under the contract (this amount should include the prime and any subcontract amount.)
