SECTION C
DESCRIPTION / SPECS / WORK STATEMENT
SPECIFICATIONS AND TECHNICAL PROVISIONS
LANDS MANAGEMENT SERVICES
1. GENERAL
1.1. Scope. Work shall consist of furnishing all labor, equipment, and materials, except as otherwise provided herein, to perform land management operations at Lake Shelbyville, Illinois (see Appendix A and A-1 for general location and project map) including: wildlife food plot plantings, succession control, maintaining hunter/fisherman parking lots and secondary roads, grass establishment, vegetation removal and rental equipment with operator. All work shall be performed in accordance with the work schedule and specifications contained herein and to the satisfaction of the Contracting Officer.
1.2. Project Description. Lake Shelbyville is a 34,100-acre federal flood control project with 11,100 acres of surface water located in Shelby and Moultrie Counties, Illinois. Lake Shelbyville is a very popular outdoor recreation destination for approximately 2.5 to 3.5 million visitors each year and contains eleven recreation areas managed by the US Army Corps of Engineers.
1.3. Contract Area. All work will be located on Project Lands with the majority of the work taking place in the developed recreation areas. However, some work may be required in outlying lands as directed by the COR. See Appendix A and B for general location map and Lake Shelbyville map.
1.4. Work schedule will vary, depending on seasonal factors. During the recreation season, the Contractor will be expected to safely work within heavily utilized areas. All potential bidders are encouraged to visit Lake Shelbyville prior to bidding to discuss the requirements with the Operations Manager and other Corps of Engineers personnel. Failure to inspect the site prior to bidding does not constitute grounds for withdrawal after the bid opening.
1.5. WORK HOURS. Contractor will be allowed to work Monday thru Friday from 7 a.m. until 5:00 p.m., excluding holidays. If need be, and agreed upon by the Contracting Officer, work may be performed on Saturdays from 7 a.m. – 5:00 p.m. All times and days must be approved by the Contracting Officer before the work is conducted.
1.6. Pre-bid Meeting and Site Visit. A pre-bid meeting and site visit will be held at the Lake Shelbyville Project Office, 1989 State Highway 16, Shelbyville, IL 62565 on 31 August 2022 at 10:00 A.M. For information regarding the meeting and site visit contact the Lake Shelbyville Project Office at (217) 774-3951 ext. 7005. All bidders are strongly encouraged to attend the pre-bid meeting and site visit.
1.7. Post Award Conference. A post award conference will be scheduled within approximately 5 working days of the contract award date. The successful Contractor is required to attend this meeting.
1.8. Definitions.
1.8.1. Contracting Officer (KO). The person executing this contract on behalf of the Government, and any other officer or civilian employee who is properly designated Contracting Officer. The term includes, except as otherwise provided in this contract, the authorized representative of a Contracting Officer (COR) acting within the limits of authority.
1.8.2. Contracting Officer Representative (COR). The person designated in writing as the Authorized Representative of the Contracting Officer.
1.8.3. Quality Control. The action taken by the Contractor and/or their personnel to document, inspect, and control performance of services to insure they meet the specifications and requirements of this contract.
1.8.4. Quality Assurance. The action taken by the Government to ensure the Contractor’s quality control system is functioning and effective and that the Contractor is providing services which are in accordance with the contract. See Appendix E for the Quality Assurance Surveillance Plan.
1.8.5. Contract Discrepancy Report (CDR). A CDR is a formal document used by the Government to process defects in services (see Appendix F). As initially issued to the Contractor, the CDR describes the discrepancy or problem. The CDR will be discussed with the Contractor or his representative when it is issued. The
Contractor shall provide his written response on the CDR form within 24 hours of issuance. The Contractor's response must:
a. Identify the cause and corrective action taken, and
b. Identify Contractor action to prevent recurrence.
The KO will evaluate the Contractor's response and take appropriate action, which may include making necessary deductions. Upon finalization of the CDR, the Contractor and the KO must sign the form. The Contractor will be given a copy of the completed form. Should the Contractor not concur with any decision, etc., the Contractor may so state, in writing, and request a final decision by the KO. The KO monitors all CDR's issued and the CDR's are the principle evidence used by the KO in determining government contract actions such as termination or decision not to exercise options.
1.8.6. DBH – Unless otherwise specified, all tree measurements will be taken at Diameter Breast Height (DBH); the diameter of the stem measured 4 ½ feet above the ground.
1.8.7 Caliper - the diameter of a tree trunk measured 6 inches above the ground. Applies to trees 3 inches in diameter and smaller.
1.9. Safety.
1.9.1. All work shall be performed in accordance with safety requirements set forth in the Corps of Engineers Manual, EM 385-1-1, entitled “Safety and Health Requirement Manual”, 2014. A copy of the manual is available at http://www.usace.army.mil/Safety-and-Occupational-Health/Safety-and-Health-Requirements-Manual/.
The Contractor shall be responsible for complying with the current edition and all changes posted on the web. All equipment and materials will be inspected by the Government. The COR will notify the Contractor of any noncompliance with these provisions. The Contractor shall, after receipt of such notice, immediately take corrective action. Such notice, when delivered to the Contractor, shall be deemed sufficient for the purpose. If the Contractor fails or refuses to comply promptly, the COR may issue a stop work order until satisfactory corrective action(s) has been taken. No part of the lost time due to the stop work order shall be made the subject of a claim for extension of time or excess costs or damages by the Contractor. Compliance with the provisions of this clause by subcontractors will be the responsibility of the Contractor.
1.9.2. Equipment/Materials. All equipment and/or materials not in compliance with the most current safety manual will be removed from Government property immediately.
1.9.3. Accident Prevention Program. Prior to commencing work, the Contractor will develop and submit an Accident Prevention Program utilizing the form located in Appendix D.
1.10. Security and Access to Recreation and Outlying Areas. The Contractor will be responsible for ingress and egress for all work locations. Frequently access is through locked gates or barricades. The Contractor shall access these areas only through the approved locations. Under no circumstances will the Contractor drive around a recognizable barrier. While inside the work area, the Contractor is responsible for maintaining area security during the performance of this contract. The Contractor will ensure that all gates are locked when entering and exiting a work area. Under NO circumstances will the gate be left swinging unsecured or “dummy” locked.
1.11. Work Plan. The Contractor shall submit a work plan indicating what equipment will be used, number of employees and how they will be used, employee names, and the supervisors or work leaders to whom deficiencies should be reported. Any changes to the approved work plan must be submitted to the COR for approval prior to implementation of the work plan change.
1.12. Quality Control Plan. At the pre-work conference and work site inspection, the Contractor shall furnish a Quality Control Plan to the COR for approval. Any changes to the approved plan shall be submitted to the COR for approval twenty-four hours prior to implementation of the Quality Control Plan change. Note: The Contractor’s initial Quality Control Plan and any changes must be approved by the COR before commencement of any work. The initial and each individual service Quality Control Plan shall include as a minimum the information outlined in Section H.
1.13. Report Unusual Conditions. The Contractor shall inform the COR of any unusual conditions observed, such as rain or storm damage and flooding.
1.14. Lost and Found Items. Any item(s) of value left behind by the public must be brought to the lake administration office within one working day of discovery.
1.15. Vehicle Use. Unless prior approval is granted by the COR, the Contractor will not drive licensed vehicles off the paved or gravel access roads onto the grass at any time. All damage from off road vehicle use will be repaired to original conditions at the Contractor's expense. The Contractor is expected to obey all posted speed limits and citations will be issued failure to observe posted speed limits and/or careless and negligent use of vehicles. Complaints from customers will usually be considered valid and action can be taken.
1.16. Damage to Government Property. It is the Contractor's responsibility to guard against destruction, injury, defacement, removal, or any alteration of public property including, but not limited to, developed facilities and vegetative growth. In the event public property is damaged it is the Contractor's responsibility to notify the COR of damage within 24 hours. Upon approval of the COR, replacement or repair shall be made within 10 calendar days of the incident.
1.17. Customer Service. All work will be performed on public lands and witnessed by the public. All visitors will be treated with respect by the Contractor and the Contractor will strive to have a minimum impact on their plans to use the facilities. The Contractor is required to cooperate and coordinate with the COR on any operations in and around other Contractor’s work crews or Government employees working within the contract areas. It should be noted that schedules and assignments still must be accomplished while meeting the needs of the customers. In addition, it is mandatory for the contractor to stop at the park Fee Booth and let the gate attendant(s) on duty what they will be doing in the park.
1.18. Insurance Requirement. As required by the Contract Clause entitled “Insurance Work on a Government Installation”, the Contractor shall furnish to the KO, prior to the commencement of work, a certificate or written statement as evidence of the minimum insurance listed in Section H.
1.19. Personnel Requirement.
1.19.1. Supervision. A minimum of one supervisor shall be on duty in the contract work area during all scheduled working hours to ensure compliance with contract specifications. The Contractor will furnish a telephone number and mailing address through which they can be contacted daily and must supply in writing the name(s) of their supervisor(s) who can be contacted daily.
1.19.2. Contractor’s Employees. The majority of work will be performed in the presence of the general public; thus, conduct of all employees is critical and will be closely monitored. The Contractor or their employees while performing work under this contract will consume no alcoholic beverages or illegal drugs and will remain fully clothed. The COR may require the Contractor to immediately remove any employee of the Contractor from the worksite who endangers persons or property. Notification will be by telephone or in person and will be confirmed in writing as soon as possible. No such removal, however, will reduce the Contractor’s obligation to perform all work required under this contract.
1.20. Environmental Protection.
1.20.1 General. This paragraph prescribes actions required for the prevention of environmental pollution during and as the result of operations under this contract. For the purpose of this specification, environmental pollution is defined as the presence of chemicals, physical or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances of importance to human life; affect other species of importance to human life; or degrade the utility of the environment for aesthetic and recreational purposes. The control of environmental pollution requires consideration of air, water, and land and involves noise, solid waste management, and management of radiant energy, and radioactive materials, as well as other pollutants.
1.20.2 Protection of Land Resources. The areas on which the work is to be performed under this contract, and the land resources adjacent thereto, will be preserved in their present condition.
1.20.3. Protection of Water Resources. Lakes, ditches, rivers, canals, waterways, or reservoirs shall not be polluted with fuels, oil, bitumen’s, calcium chloride, insecticides, herbicides, or other similar materials harmful to fish, shell fish, wildlife, or materials which may be detrimental to outdoor recreation.
1.20.4. Disposal of Materials. The methods and locations of disposal of materials, wastes, effluents, trash, garbage, oil, grease, chemicals, and other like materials shall be approved by the COR.
1.20.5. Permits and Responsibilities. The Contractor will, without additional expense to the
Government, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable Federal, State, and Municipal laws, codes, and regulations, in connection with the execution of the work.
The Contractor will be similarly responsible for all damages to persons or property that occur as a result of their fault or negligence; will take proper safety and health precautions to protect the work, the public, and all the property of others; will also be responsible for all materials delivered and work performed until completion and acceptance of the contract.
1.21 Equipment Removal and Storage
1.21.1 Removal of Equipment and Other Materials. Upon completion of working in an area, the Contractor will remove from the site of work all equipment, unused materials unless authorized by the COR, and any waste materials and rubbish resulting from the operation performed herein.
1.21.2 Property Storage. The Contractor will not be allowed to store any property on Government property unless approved in advance by the COR. If approval is given for property storage, the Government assumes no responsibility for the safety or security of property left on Government property. Property will be removed from the work site as soon as possible after the completion of the work described herein.
1.22. Contractor Availability.
1.22.1. Meetings. During this contract, the Contractor or an authorized representative will meet with the COR each working day. Meetings may be in person at the Administration Office or by phone during normal working hours between 8 a.m. and 11 a.m. If a CDR is issued, mutual effort will be made to resolve all problems identified to preclude their recurrence. The COR may reduce the frequency of these meetings if mutually agreeable between the COR and the Contractor.
1.22.2. Electronic Communication. The Contractor will maintain an electronic communication system to receive messages (cell phone). If the COR leaves a message between the hours of 7 a.m. and 8 p.m., the Contractor shall call back within 30 minutes of the time the message is left. The Contractor will provide crew leaders a communication system with numbers furnished to the Government. The system provided shall ensure communications between the Government and the Contractor crew leader(s) during all hours of scheduled work.
3. Government Furnished Items.
3.1. Water and Electricity. The Government will provide water and electricity, when and where available.
3.2. Keys. If government keys are issued to the Contractor, the final month's work will not be considered completed and accepted until the keys are returned to the government's key control officer. If key(s) are lost and/or not returned, a deduction fee of $250.00 per key will be made from the final payment. The Contractor shall not reproduce keys.
4. Contractor Furnished Items.
4.1. The Contractor will furnish all labor, equipment, and materials except for those mentioned in Section 3 to complete the work described herein.
4.2. Material Safety Data Sheets. The Contractor shall provide “Material Safety Data Sheets” from the manufacturers of all chemicals operation of this contract. The Contractor will submit “Material Safety Data Sheets” to the COR at the same time the list of chemicals is submitted as specified in 1.21.1.
4.3. Vehicles. All vehicles used in performance of this contract will be kept clean and in safe operating condition in accordance with Section C, paragraph 1.9 Safety and will comply with safety standards as required by the State of Illinois. Vehicles will be clearly marked with professionally made or professionally painted identification signs showing in 1-1/2" or larger letters the Contractor's name, type of business and phone number.
One sign or painting will be displayed on each side of all vehicles used by Contractor's employees.
4.4. Approval of Equipment and Materials. Prior to commencing work, the Contractor will:
a. Submit to the COR a written statement identifying the grade, type, quantity, mixture, and manner of application of all materials to be used during the contract period and
b. Provide a list of all equipment available to perform the services listed in this contract.
The COR reserves the right to inspect all equipment and materials at any time while tasks are being performed under this contract. All material, equipment, and operating procedures must be approved by the COR prior to the commencement of work and prior to implementing any changes.
5. Applicable Publications
The contractor shall perform all work in accordance with applicable publications. They include but are not limited to:
Manufacturers Recommendations:
- For equipment and materials used by the contractor
- Manuals supplied for Government furnished equipment
- Operating/Maintenance Manuals
Industrial Standards and Codes (Latest Editions):
- American National Standards Institute
- EM 385-1-1, General Safety and Health Manual of the U.S. Army Corps of Engineers
- OSHA Safety Standards
6. Tree Maintenance.
6.1. Location. The Government will supply to the Contractor a list and map of all trees, limbs, and stumps to be removed. These items may be located within any US Army Corps of Engineers managed location around Lake Shelbyville.
6.2. Dead Limb Removal. Trees marked for limb removal must have all dead or damaged limbs removed two inches and larger in diameter when measured at the final pruning cut. Limbs are to be cut according to the guidelines specified in Appendix C. Bark that is peeled or damaged so as to cause separation from the wood must be cut away from the tree. If the removed branch damages the tree or surrounding trees it is the responsibility of the Contractor to repair any damages. Limbs must be chipped and placed in a nearby location designated by the COR or disposed of off Government property if a suitable location does not exist within the park. Limbs that are too large to be chipped must be removed from Government property at the Contractor’s expense or cut to firewood size (not to exceed 24” lengths) and stacked at sites for campers. NOTE: Concerning limb removal, the unit “each” in Section B will be interpreted as each tree.
6.3. Tree Removal. Trees marked for removal will be cut flush with the ground. Trees marked for removal will be placed in one of four categories: under 6” DBH, 6 – 12” DBH, 13 – 24” DBH, and over 24” DBH. The tree (to include all limbs) must be removed from Government property at the Contractor’s expense. In cases where a tree is forked or multi-trunked, the tree will be measured at DBH and if the fork is BELOW 4 ½ feet, it will be counted as 2 trees (or more if multi-trunked). If the fork is ABOVE 4 ½ feet, it will be counted as a single tree.
Note: Concerning tree removal, the unit will be each.
6.4. Tree Removal including Stump Removal. Trees marked for removal will be cut down and the stump removed. Trees will be placed in one of the four categories: under 6” DBH, 6 – 12” DBH, 13 – 24” DBH, and over 24” DBH. Trees will be cut to a height so that the stump can be ground utilizing a stump grinder and the stump shall be ground approximately 10" below ground level. All stump holes will be filled with topsoil capable of producing a natural stand of grass and may contain NO more than 30% wood chips. The remaining wood chips are to be removed from the area and disposed of at the Contractor’s expense. Once the topsoil is packed level, it shall be seeded and fertilized (10-10-10) with a viable mixture of tall fescue, bluegrass, and ryegrass seed. If the fork is ABOVE 4 ½ feet, it will only be counted as one tree. However, for the purposes of tree removal including stump grinding, the diameter of the largest tree will be used to determine payment, and the remaining trunk(s) paid under 5.4 (Tree Removal). Note: Concerning tree removal including stump removal, the unit will be each.
6.5. Stump Removal. Marked stumps shall be removed with a stump grinder and the stump ground approximately 10" below ground level. All stump holes will be filled with topsoil capable of producing a natural stand of grass and may contain NO more than 30% wood chips. The remaining wood chips are to be removed from the area and disposed of at the COR’s discretion. Once the topsoil is packed level, it shall be seeded and fertilized (10-10-10) with a viable mixture of tall fescue, bluegrass, and ryegrass seed. Note: Concerning stump removal, the unit will be each.
6.6. Emergency Call Out. In cases of an emergency it may be necessary to call the contractor out to take care of a hazard tree/limb that is in imminent danger of or has already caused an accident. In such cases, the contractor will be required to report on-site and be prepared to work within 4 hours of receiving the call from Corps personnel. This line item is to cover the cost of mobilizing equipment and/or manpower to Lake Shelbyville on short notice. Each tree/limb removal will still be paid at the appropriate bid price. As an example: A 24” tree blows across the road blocking campers in at Coon Creek Recreation Area. The tree is too big for Corps personnel to handle and Corps personnel make an Emergency Call Out (Contractors bid price of $500.00 for an emergency call out). The contractors bid price for a 24” tree is $1,000.00. The contractor would be paid $1,000.00 for the tree and $500.00 for the Emergency Call Out for a total of $1,500.00. Predicting how often this line item will be utilized in any given year is not practical. However, only in true emergency situations will the Contractor be called out. Note:
Concerning Emergency Call Out, the unit will be for each incident.
6.7. Firewood Provision. In some instances where the species is desirable for firewood (oak, hickory, etc.), the COR may want a hazard tree cut into firewood and stacked neatly at a nearby location within the recreation area for camper use. Only trees between 6” and 15” DBH will be utilized for this purpose and will be specified by the COR. These trees must be cut into approximately 24" lengths and neatly stacked at a nearby campsite or nearby location within the park as designated by the COR. The remaining portions of the tree (to include limbs) outside of this size range must be removed from Government property at the Contractor’s expense. Note: Concerning firewood provision, the unit will be each. There will be two bid items under this section: Tree removal and tree removal including stump removal. For both bid items the specification is covered under Section 5.3 or 5.4 to exclude the portion to be left for firewood.
7. Pruning Services.
7.1. Roadway Limb Removal. A map of the area(s) to be limbed will be provided to the Contractor and the area clearly marked along the roadway with a starting and ending point. All limbs hanging over the roadway lower than 20 feet high and limbs within 15 feet of the road itself will be removed within the marked areas up to 20 feet high. This may mean cutting a limb 25 feet up the trunk to eliminate a 16-foot overhang. Simply limbing the overhanging branch to a height of 20 feet and not removing the entire limb will NOT be allowed. Limbs shall be cut back to the trunk of the tree according to the guidelines specified in Appendix C. Bark that is peeled or damaged so as to cause separation from the wood shall be cut away from the tree. If the removed limbs damage the tree or surrounding trees it is the responsibility of the Contractor to repair the damages at no expense to the Government.
Limbs shall be removed from Government property at the Contractor’s expense. Note: Concerning roadway limb removal, the unit will be linear yards and will only cover one side of the road. For example, if a 250-yard section of roadway needs both sides of the road trimmed 500 linear yards will be indicated on the task order.
7.2. Campsite Pruning. All limbs overhanging the campsite living or parking areas up to 20 feet high and limbs within 10 feet of the living or parking area shall be removed up to 20 feet. This may mean cutting a limb 25 feet up the trunk to eliminate an 18-foot overhang. Limbs must be cut back to the trunk of the tree according to the guidelines specified in Appendix C. Simply limbing the overhanging branch to a height of 20 feet and not removing the entire limb will NOT be allowed. Bark that is peeled or damaged so as to cause separation from the wood must be cut away from the tree. If the removed limbs damage the tree or surrounding trees it is the responsibility of the Contractor to repair the damages at no expense to the Government. Limbs shall be chipped, and chips placed in a nearby location designated by the COR. If limbs are too large to be chipped than they shall be removed from Government property at the Contractor’s expense or cut to firewood size (not to exceed 24” lengths) and stacked at sites for campers. Campsites are located within Lithia Springs, Opossum Creek, Lone Point, Coon Creek, and Bo Wood Recreation Areas.
