Contractor Questions & Government Answers
1. Is Past Performance required to quote on this solicitation?
ANSWER: No. However, if you don’t have any past performance, please make that statement in your proposal. Please see Solicitation Section M, subsection E, page 31, “Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance.”
2. Please confirm if this project is tax exempted.
ANSWER: USACE contracting officer shall provide certificate for tax exemption upon request.
Terms included on the certificate for tax exemption shall comply with individual state department of revenue requirements. Consult with the state department of revenue in which supplies, or construction materials are to be purchased by the prime or subcontractor for a copy of that state’s tax exemption form. Machinery, equipment, or tools are typically not tax exempt.
3. Are offerors able to provide CPARS evaluation in lieu of Past Performance Questionnaires (PPQ)? Federal clients have limited time to complete forms during bid season, especially if they have already provided a CPARS or PPQ previously.
ANSWER: The Government will not accept CPARS evaluations in lieu of PPQs.
4. Because our clients have been accommodating in processing previous PPQS, would you allow us to be more efficient by accepting the recently completed PPQs in lieu of processing a new one?
ANSWER: If a PPQ that you used for a previous proposal is applicable to this requirement and follows the PPQ requirements of this solicitation, you may use it for this proposal.
5. Solicitation page 7 indicates that "52.228-1 Bid Guarantee" applies to this opportunity. Please provide requirement details about “(c) The amount of the bid guarantee shall be ______ percent of the bid price or $________, whichever is less”.
ANSWER: FAR Clause 52.228-1 Bid Guarantee has been changed to full text to provide this information. See Solicitation Amendment 0001.
6. Section L, Factor 1, Subfactor (a) – Key Positions: This section specifically states, “Offeror shall provide minimum qualifications the company requires for each key position, including required education, specialized experience, and certifications.” It further goes on to state that the offeror is NOT to provide resumes for proposed individuals to fill these positions. Please confirm that the Solicitation is requesting a statement from the offeror identifying that the minimum requirements documented in the solicitation for these positions are the same as those required by the contractor to be considered for employment or subcontracted for services.
Please also confirm that the offeror is not required to show proof via resumes of specific individuals’ minimum certifications to be eligible for this contract.
ANSWER: The offeror shall identify the minimum requirements they require for employment or subcontracted for services for each of the positions listed. Don’t simply make a statement that it is the same as the solicitation. The solicitation only states the minimum for some of the required positions and is not all encompassing. Resumes are NOT to be included.
7. Section L, Factor 1, Subfactor (a) – Key Positions: The required key positions include “Geologist” and “Engineering Geologist or Geotechnical Engineer”. The contract does not appear to require these positions, but the proposal requirements list these “key positions”. The technical specifications do not address either of these “key positions”. It is not within the scope of the contract to conduct borings, as they have already been performed. Additionally, the relief wells are already designed. It is unclear what these “key positions” will do on this contract. Please advise.
ANSWER: Key Positions have been included in Amended Specification 33 27 15 section 1.5.2 as part of this amendment.
The specifications only list the minimum requirements for the position descriptions “Geologist” and “Engineering Geologist or Geotechnical Engineer”. How these positions are to be utilized shall not be specified.
8. Does USACE have a specific contact at Ameren that is familiar with this project?
