STATEMENT OF WORK

SPECIFICATIONS / WORK STATEMENT FOR REFUSE REMOVAL

1. GENERAL

1.1. SCOPE OF WORK. Work shall consist of furnishing all labor, equipment, and material necessary to remove refuse, service dumpsters, and collect litter at designated areas around Rend Lake in accordance with the work schedule and specifications contained herein. Contractor's work and responsibility shall include, but is not limited to, all job planning, programming, scheduling, administration, inspection, and management necessary to accomplish the required specified services. Contractor shall assure that all work is accomplished in accordance with contract requirements, all applicable laws, and regulations and/or written directives issued by the Contracting Officer or his authorized representative. All work shall be performed to the satisfaction of the Contracting Officer or authorized representative.

1.2. DEFINITIONS. As used throughout this description / specification, the following terms shall have the meaning set forth below:

1.2.1. CONTRACTOR -the term Contractor refers to the prime Contractor and all contractor employees and personnel. The prime Contractor shall be responsible for ensuring all subcontractors comply with the provisions of this contract.

1.2.2. CONTRACTOR REPRESENTATIVE -a foreman or superintendent, assigned to represent the interests of the Contractor with regards to all matters involving the contract.

1.2.3. CONTRACTING OFFICER (CO) -the term "Contracting Officer" means the person executing this contract on behalf of the Government, and any other officer or civilian employee who is properly designated Contracting Officer; and the term includes, except as otherwise provided in this contract, the authorized representative of a Contracting Officer acting within the limits of their authority.

1.2.4. QUALITY CONTROL -the term "Quality Control" refers to action taken by the Contractor and/or their personnel to document, inspect, and control performance of services to ensure they meet the specifications and requirements of this contract.

1.2.5. QUALITY ASSURANCE -the term "Quality Assurance" refers to action taken by the government to ensure the Contractor's quality control system is functioning and effective, and the Contractor is providing services, which are in accordance with this contract.

1.2.6. Q.A.S.P. -Quality Assurance Surveillance Plan. This is a detailed plan defining Government inspection methods.

1.2.7. C.D.R. -the Control Deficiency Report is a written record of unsatisfactory performance by the Contractor as observed by the Quality Assurance Inspection.

1.2.8. CLEAN(ED) -refers to, but not limited to, dumpster free of dirt, garbage, paper, metal, trash, debris, driftwood, plastic, cigarette butts, rocks, animal remains, tree limbs, sticks, glass, bottle caps, pull tabs, gravel, mud, sand, grass, vegetation, leaves, ashes, charred wood, standing water, and shall be free of offensive odor.

1.2.9. FULLY CLOTHED -The term "fully clothed" shall be construed as, at a minimum, contractor and employees must wear short sleeved shirts without abusive language and/or pictures, safety shoes as stated in EM 385-1-1 , "Safety and Health Requirements Manual", and long pants without holes. No shorts will be allowed.

1.2.10. LITTER -refers to, but is not limited to, garbage, trash, debris, paper, metal, plastic, cigarette butts, glass, bottle caps, pull tabs, food, animal remains, driftwood, tree limbs, sticks, grass, vegetation growth, dirt, gravel, mud, sand, rocks, algae, moss, ashes, charred wood, any other foreign material.

1.3. CONTRACT AREA AND LIMITS. Areas to be maintained will be specified in Appendix A. General location maps are available at the Rend Lake Management Office, 11981 Rend City Road, Benton, IL 62812 and included as Appendix B.

1.3.1. WORK PERIOD. The services listed herein shall be performed between the hours of 0700 to 1430.

1.3.2. FACILITIES TO BE SERVICED. The approximate number of facilities per area will be as specified in Appendix A.

1.3.3. SERVICING SCHEDULE. The schedule of services shall be in accordance with Appendix A.

1.4. UTILITIES. The Contractor shall provide water and electricity required in the performance of this contract. Water and electricity may be obtained and utilized by the Contractor from government sources within the recreation areas at no cost to the Contractor or from other sources approved by the Contracting Officer. If water or electricity is obtained from sources other than the Government, all arrangements and payments, if any, shall be the responsibility of the Contractor. The absence of a government water or electric source will not relieve the Contractor of obligation to provide services as scheduled for any facility or area. Raw lake water shall not be used for cleaning.

1.5. SAFETY. All equipment used and work performed shall be in accordance with safety requirements set forth in the most current version of the Corps of Engineers Manual, EM 385-1-1 entitled, "Safety and Health Requirements Manual". Any unsafe work and/or actions will be stopped immediately. All equipment or materials found not to be in conformity with the requirements of EM 385-1-1 shall be removed from Government property immediately.

1.5.1. In order to provide safety controls for protection to life and health of employees and other persons, for prevention of damage to property, materials, supplies, and equipment, and for avoidance of work interruptions in the performance of this contract, the Contractor shall comply with all pertinent provisions of EM 385-1-1, and shall also take or cause to be taken such additional measures necessary for that purpose. Compliance with the provisions of this clause by employees and subcontractors will be the responsibility of the Contractor.

1.5.2. The Contracting Officer shall notify the Contractor of any noncompliance with the provisions of this clause and any corrective action required. Work will be stopped immediately when unsafe work practices are recognized by any employee representing the Government. The Contractor will then be directed as to the appropriate corrective action to take. The Contractor shall, after receipt of such notice, immediately take corrective action. Such notice, when delivered to the Contractor or his representative at the site of the work, shall be deemed sufficient to take immediate action. If Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor shall make no part of the time lost due to any such stop orders the subject of claim for extension of time or for excess costs or damages.

1.5.3. SAFETY PLAN. Contractor shall develop and submit a written detailed safety plan. This plan must indicate in detail the general policies and procedures for safe operation in the accomplishment of this contract. The plan shall show how the Contractor intends to perform all services in full compliance with the safety requirements set forth in EM 385-1-1, entitled "Safety and Health Requirements Manual". Contractor shall submit the safety plan to the Contracting Officer for approval at the pre-

B - 5 work conference. If the plan is judged not to be adequate and is disapproved by the Government, the Contractor must revise the plan and submit it to the Contracting Officer for acceptance within five

(5) working days.

1.5.4. ACCIDENT REPORTING. An accident constitutes an incident or act involving the Contractor, which may or may not have caused obvious damage to persons or property. All accidents shall be reported to the Contracting Officer immediately.

1.5.5. SAFETY EXPOSURE REPORTING. The Contractor shall maintain an accurate record of, and shall submit a monthly "SAFETY EXPOSURE REPORT" to the Contracting Officer in the manner and on the forms as prescribed. The report will cover hours worked during the previous month, accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies, and equipment necessary to work performed under this contract. The report will be submitted the first week of the month with contractors invoice.

1.5.6. GATES. Gates shall remain secured at all times, either locked open or locked closed.

1.6. VEHICLES. All vehicles utilized under this contract shall be presentable, serviceable, must meet all safety requirements set forth in EM 385-1-1 (see Section C.1.5, SAFETY), and shall comply with all applicable state and federal motor vehicle regulations. All systems and body panels that were installed at the time of manufacturing, i.e. fenders, brakes on all wheels, speedometers, gas gauges, complete exhaust systems, etc., shall be in good working condition. Any vehicle utilized under this contract that is found deficient shall be removed in accordance with Section C.4.2.2, INSPECTION OF EQUIPMENT, MATERIALS, and SUPPLIES.

1.6.1. IDENTIFICATION OF CONTRACTOR VEHICLES. All Contractor vehicles shall be identified with the company name or logo, type of business, address, and phone number conspicuously displayed on both sides. Professionally done hand lettering, magnetic signs, or pressure sensitive decals with 1 1/2" or larger lettering may be used to comply with this specification. The signs shall be subject to the approval of the Contracting Officer and displayed on the vehicles within 30 days of contract award date.

1.6.2. The Contractor shall not drive off the paved or gravel access roads at any time without prior approval of the Contracting Officer.

1.6.3. No vehicles shall be left unattended for any extended periods of time at any recreation area or elsewhere without prior approval of the Contracting Officer.

1.6.4. Vehicles shall be operated in accordance with posted regulations and traffic control signs. The

Contracting Officer shall closely monitor the Contractor vehicles' speed and driving habits in the contract areas.

1.6.5. Any vehicle that is parked along a roadway and not parked in a designated parking space in the recreation areas shall utilize their hazard lights (four-way flashers).

1.7. OTHER CONTRACTS. The Contractor's attention is called to the fact that other Contractors and Corps of Engineers employees may be in the area for the purpose of performing duties. The Contractor will cooperate fully with all Contractors and Corps of Engineer employees in the area and shall not impede the work of other Contractors and Corps of Engineer employees in any way.

1.8. DAMAGES. The Contractor is responsible for taking any action necessary to protect all supplies, and property, including material and supplies issued by the Government to accomplish a job against damage, theft, or loss. Government assumes no responsibility for loss or damage to any material, supplies, or

B - 6 property after it is received by, or in the possession of the Contractor. The Contractor at no cost to the Government shall replace any Government property lost or stolen due to negligence of the Contractor.

1.8.1. Contractor shall use reasonable care to avoid damaging buildings, equipment, vegetation and public personal property; the Contractor shall replace or repair any damages at no expense to the Government within a time frame approved by the Contracting Officer. If the Contractor fails or refuses to make such repairs or replacement, within the time frame, the Contractor shall be liable for the cost to make the repair or replacement, which will be deducted from the contract payment.

1.9. CAUTION. The work areas are located in heavily used recreational areas. All bidders are encouraged to attend a pre-bid site visit and inspection. WARNING: IN NO EVENT SHALL A FAILURE TO

INSPECT THE SITE CONSTITUTE GROUNDS FOR WITHDRAWAL OF BID AFTER OPENING.

2. PERSONNEL REQUIREMENTS

2.1. MINIMUM MANPOWER REQUIREMENTS. The Contractor shall provide an adequate number of fully qualified personnel to perform the specified services properly and efficiently within the time limits specified. If the Contractor is unable to accomplish work in accordance with the requirements of this contract within the times specified, he shall immediately obtain additional personnel as necessary to fulfill the requirements of this contract.

2.2. EMPLOYEE CONDUCT. The majority of work will be performed in the presence of the general public;

thus the conduct of all employees is critical and will be closely monitored. The Contractor shall be responsible for insuring that his employees strictly comply with all Federal and State laws. Any illegal or criminal activity may result in the removal of Contractor employee(s) from the project. Speed limits are posted and shall be adhered to for the safety of our customers.

2.2.1. The Contractor or employees, while working on this contract, shall not consume or be under the influence of alcohol and/or drugs.

2.2.2. All workers are to be fully clothed, in accordance with Section C.1.2.I, FULLY CLOTHED & E.M.

385-1-1, "Safety and Health Requirements Manual", and maintain a neat and clean appearance.

2.3. CONTRACTOR EMPLOYEE IDENTIFICATION. The Contractor shall furnish the Contracting Officer the name, address, telephone number and date of birth of each employee which will be working under this contract.

2.4. REMOVAL OF CONTRACTOR EMPLOYEE. The Contracting Officer or Contracting Officers

Representative may require the Contractor to immediately remove from the work site any employee of the Contractor or subcontractor, who, in the opinion of the Contracting Officer or Contracting Officers Representative, is incompetent; who endangers persons or property; who interferes with, impedes, or disrupts the use of the project; or whose physical or mental condition is such that it would impair the employee's ability to safely or satisfactorily perform his work. Notification to the Contractor shall be verbal or by telephone, and shall be confirmed in writing as soon as possible. No such removal, however, will reduce the Contractor's obligation to perform all work required under this contract, and immediate replacement will be made as required. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents.

2.5. SUPERVISION. The Contractor shall establish a defined chain of command including Contractor

Representatives and Quality Control Inspectors. The Contractor Representatives and/or Quality Control personnel shall be required to have a copy of the contract in their possession at all times for referral concerning questions of Contractor responsibility.

2.5.1. CONTRACTOR REPRESENTATIVE. The Contractor shall appoint in writing, subject to the approval of the Contracting Officer, a minimum of two Contractor Representatives. A minimum of one Contractor Representative, with full authority and power to act for the Contractor on items pertaining to overall work performance, management, coordination and supervision, will be readily available, either in person or by electronic communication, to meet with the Contracting Officer whenever work specified herein is being performed. The Contractor Representative serves as the central point of contact with the Government for performance of all work under this contract. The Contractor Representative shall deal directly with the Contracting Officers Representative for normal day-to-day administration of this contract. These individuals may also serve as Quality Control inspectors (see Section C.2.5.2, QUALITY CONTROL INSPECTOR), provided that their job performance in each category is maintained at an acceptable level to the Contracting Officer. The Contractor Representative and/or Quality Control inspectors may be working members of the crew.

2.5.2. QUALITY CONTROL INSPECTOR. The Contractor is responsible for insuring that all work performed under this contract, including any performed by subcontractors, is in accordance with the specifications. To accomplish this, the Contractor shall appoint in writing, subject to the approval of the Contracting Officer, one Quality Control inspector, who shall be responsible for the requirements set forth in Section C.3, INSPECTIONS.

3. INSPECTIONS

3.1. CONTRACTOR QUALITY CONTROL. The Contractor is responsible for establishing and maintaining an adequate quality control system to satisfactorily inspect and ensure that all work performed by the Contractor's organization is in full compliance with this contract. The Contractor shall designate, in writing, Quality Control inspector, as described in Section C.2.5.2, QUALITY CONTROL INSPECTOR, whose duty shall be to verify contract compliance of all work performed and to notify the Contracting Officer of anything requiring his immediate attention.

3.1.1. The Contractor Quality Control inspectors shall provide the Contracting Officer with a Quality

Control weekly report for the services performed under this contract.

3.2. CONTRACTOR QUALITY CONTROL PLAN. The Contractor is responsible for establishing and maintaining a complete Quality Control System to ensure satisfactory performance of all sections of the contract. This will be assured by the development of a comprehensive Quality Control Plan by the Contractor and supplied to the Contracting Officer at the pre-work conference for acceptance prior to initiating work. If the plan is judged not to be adequate and is disapproved by the Government, the Contractor must revise the plan and submit it to the Contracting Officer for acceptance within five (5) working days.

3.2.1. The Contractor shall submit a detailed plan of an inspection system covering all the services stated in the contract specifications. The plan shall include, but is not limited to the following:

3.2.1.1. Work/inspection schedule.

3.2.1.2. Identification of authorized Quality Control Inspectors (QCI), their vehicles, and

3.2.1.3. An inspection method of identifying deficiencies in the quality of services performed before the level of performance is unacceptable.

3.2.1.4. A method and response time for correcting recurring minor deficiencies and unacceptable work that the Contractor is requested to re-perform.

3.2.1.5. Identification of how the QCI will perform their inspection.

3.3. GOVERNMENT QUALITY ASSURANCE. The Government will monitor and inspect the Contractor's operation to ensure the Quality Control Plan is in place and is working, and that the Contractor's performance meets all contract specifications. The Government will monitor the Contractor's service performance through a Quality Assurance Surveillance Plan (QASP) utilizing the random sampling method, the planned sampling method, unscheduled inspection method and/or the 100% inspection method. The Government reserves the right to alter or change the type of inspection plan at its discretion at any time, and to make deductions accordingly. The QASP is included for information purposes only.

3.4. REPERFORMANCE AND REINSPECTION. The Government may require the Contractor to re- perform services, not on the random sample, which are found to be deficient by the Quality Assurance inspector.

3.5. There will be a re-inspection charge if it becomes necessary for the Government Quality Assurance inspector to perform re-inspections of defective work. The Contractor's Quality Control system must be developed to locate and cure these deficiencies prior to the initial Quality Assurance inspection. The charges will be deducted from the Contractor's monthly invoice, in accordance with the QASP.

3.6. PERFORMANCE EVALUATION MEETINGS. The Contractor, his Contractor Representative, and/or

Quality Control inspectors shall meet with the Contracting Officer or his representatives as often as determined necessary by the Contracting Officer in order to discuss performance. Mutual effort will be made to resolve any and all problems identified.

4. CONTRACTOR FURNISHED EQUIPMENT, MATERIALS, AND SUPPLIES

4.1. GENERAL -Unless otherwise stated, the Contractor shall furnish and maintain all sufficient equipment, materials and supplies suitable to satisfactorily perform the requirements of this contract.

4.1.1. All equipment shall be maintained in safe operating condition complying with all requirements of

EM 385-1-1 and in accordance with Section C.1.5, SAFETY. A regular schedule of preventive maintenance shall be followed on all equipment.

4.1.2. If the Contractor is unable to accomplish work in accordance with the requirements of this contract within the times specified, the Contractor shall immediately obtain additional equipment, materials, and supplies necessary to fulfill the requirements of this contract. Any deviations to the contract schedules shall be reported to the Contracting Officer Representative immediately.

4.1.3. All Contractor's equipment, materials, and supplies to service dumpsters shall be removed from

Government property at the end of each working day unless otherwise approved by the Contracting Officer.

4.2. APPROVAL OF EQUIPMENT, MATERIALS AND SUPPLIES -Prior to commencing work, the

Contractor shall attend a pre-work conference at the Rend Lake Management Office and submit to the Contracting Officer, a written statement identifying the grade, type, quantity, mixture, and manner of application of all materials to be used during the contract period; and provide a list of all equipment, materials and supplies available to perform the services listed in this contract. All equipment, materials, supplies, and operating procedures must be approved by the Contracting Officer prior to the commencement of work, or prior to implementing any changes.

4.2.1. MATERIAL SAFETY DATA SHEETS. The Contractor shall be responsible for obtaining the most recent "Safety Data Sheets" from the manufacturers for all cleaning solutions or agents, insecticides, enzymes or bacterial agents, disinfectants, graffiti remover or any other supplies of a chemical nature used in the operation of this contract. All MSDS sheets must be submitted to the Contracting Officer for approval prior to beginning any services required by this contract.

4.2.2. INSPECTION OF EQUIPMENT, MATERIALS, AND SUPPLIES. The Contracting Officer may inspect all equipment, materials, and supplies at any time when on Government property. Any equipment or supplies found deficient shall be removed from service immediately until such time as deficiencies have been corrected and approved for use by the Contracting Officer. No such removal will reduce the Contractor's obligation to perform all work required within this contract. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents.

4.3. CREW SUPPLIES. The Contractor shall be responsible for providing each crew with sufficient supplies for performing each days required services.

4.4. MANUFACTURER'S DIRECTIONS. The Contractor shall be responsible for ensuring that all employees follow all manufacturer's instructions for use of all materials and supplies.

4.5. REFUSE REMOVAL EQUIPMENT, MATERIALS, AND SUPPLIES. The Contractor shall furnish all required equipment, materials and supplies including, but not limited to, all dumpsters, vehicles, disinfectant, soaps, cleaning compounds, odor control chemicals, brushes, paint, painting brushes, safety equipment, and any other materials required to clean, service and maintain sanitary conditions. The packer truck shall be designed to hold liquids.

4.5.1. DUMPSTER. The Contractor shall provide two (2) cubic yard, four (4) cubic yard, six (6) cubic yard, and eight (8) cubic yard durable, commercial dumpsters, constructed from a suitable material so as to hold refuse, prevent effluent (liquids) leakage, and inhibit debris from escaping. Lids shall be of lightweight material or counter balanced, such that no greater than five (5) pounds of pressure is required to lift the lid. All dumpsters shall be free of any sharp edges. All materials and devices used shall be provided by the Contractor and must be approved by the Contracting Officer. In the event that a dumpster is moved, the contractor shall be responsible for returning the dumpster to its proper location.

4.5.1.1. All dumpsters shall be in compliance with safety standards including stability requirements as set forth by the American National Standards Institute. The Contractor shall remove from Government property all dumpsters found not to conform to applicable safety standards.

4.5.1.2. The Contractor shall be responsible for maintaining dumpsters in good working condition and repairing, replacing or repainting, by the next servicing, any that are damaged, vandalized, defective, missing or are judged by the Contracting Officer as non-serviceable. Dumpsters shall be maintained with a clean and neat appearance. It is the Contractor's responsibility, at no cost to the Government, to keep the dumpsters free of rust, scratches, dents, and vandalism.

4.5.1.3. All 2, 4, 6, and 8 cubic yard dumpsters shall be painted Chateau Brown, with oil base and high gloss enamel. A paint sample shall be submitted to the Contracting Officer Representative for approval prior to painting. The Contractor shall paint dumpsters each year by March 1. The Contractor shall touch up, repaint, repair, or swap out any dumpsters that are not in accordance with Section C.4.5.1.2 or as directed by the Contracting Officer. Stickers shall be replaced in accordance with Section C4.5.1.4.

4.5.1.4. The Contractor shall supply and install signs on each dumpster in the campgrounds and day use areas. The signs shall be professionally done hand lettering or pressure sensitive decals with 1.5" to 2" Helvetica Medium letters for the message and .5" Helvetica Medium letters for the regulation citation. Signs shall be maintained with a clean, readable, and neat appearance.

The Contractor shall touch up, repaint, replace, or repair any signs that are faded, torn, vandalized, unreadable or as directed by the Contracting Officer. Proposals for signs shall be submitted at the pre-work conference. Signs shall be subject to the approval of the Contracting Officer. ADVERTISING SHALL NOT BE PERMITIED ON ANY DUMPSTERS.

4.5.1.5. The dumpsters shall be cleaned when serviced to prevent offensive odors.

4.5.2. ROLL-OFF DUMPSTER. The Contractor shall provide a thirty (30) cubic yard durable, commercial dumpster, which is constructed from a suitable material so as to hold refuse, prevent effluent leakage, and inhibit debris from escaping. The roll-off dumpster shall have an open top to allow for loading with a front- end loader. All dumpsters shall be free of any sharp edges.

4.5.2.1. All roll-off dumpsters shall be in compliance with safety standards including stability requirements as set forth by the American National Standards Institute. The Contractor shall

B - 11 remove from Government property all dumpsters found not to conform to applicable safety standards.

4.5.2.2. The Contractor shall be responsible for maintaining dumpsters in good working condition and repairing, replacing or repainting, by the next servicing, any that are damaged, vandalized, defective, missing or are judged by the Contracting Officer as non-serviceable.

4.5.2.3. The roll-off dumpster shall be cleaned regularly, or as directed by the Contracting Officer, to prevent offensive odors.

4.5.3. PACKER TRUCK. The Contractor shall provide a self-contained garbage truck capable of properly servicing a compatible two (2) cubic yard, four (4) cubic yard, six (6) cubic yard, and eight (8) cubic yard dumpster. The packer truck shall be designed and maintained to preclude solid or liquid waste from escaping during service. The packer truck shall be cleaned regularly, or as directed by the Contracting Officer, to prevent offensive odors.

4.5.4. ROLL-OFF DUMPSTER TRUCK. The Contractor shall provide a truck capable of transporting and servicing a thirty (30) cubic yard roll-off dumpster. The roll-off dumpster truck shall be cleaned regularly, or as directed by the Contracting Officer, to prevent offensive odors.

4.5.5. CLEANING EQUIPMENT, MATERIALS, AND SUPPLIES. The Contractor shall furnish all required materials and supplies including, but not limited to detergents/soaps, disinfectants, deodorizers, odor control chemicals, stain and/or graffiti remover, safety equipment and any other materials required to clean, service and maintain sanitary conditions of the dumpsters.

4.5.5.1. DETERGENTS. Only soap, soap compounds, cleansers, and/or biodegradable detergents shall be used. If the Contractor uses a cleaning compound containing disinfectants and deodorants in lieu of applying these materials separately, the label must state that the compound is biodegradable. The manufacturer's instructions shall be followed in mixing the proper strength solution for application.

4.5.5.2. DISINFECTANTS. Only standard commercial disinfectants shall be used. The manufacturer's instructions shall be followed in mixing the proper strength solution for application. The disinfectant may be mixed with the cleaning solution if the manufacturer's instructions on the disinfectant's label do not prohibit it.

4.5.5.3. DEODORIZERS. Deodorizers must leave a strong and pleasant residual scent. The manufacturer's instructions shall be followed in mixing the proper strength for application. The deodorant may be mixed with the cleaning solution if the manufacturer's instructions on the deodorant's label do not prohibit it.

4.5.6. COMMUNICATION. The Contractor shall be equipped with a working cellular telephone to allow for communications between the Contractors Representative and/or Quality Control inspector and Government personnel during times when services under this contract are being performed. A telephone number or numbers must be provided where a person of authority within the Contractors organization can be reached during non-duty hours.

4.5.7. LOCKS. The Contractor shall provide one lock for the South Marcum Dale Miller Youth Area, North Marcum Day Use Area, and North Sandusky Shagbark Group Area. The Contractor will also provide four (4) locks and eight (8) keys to the Rend Lake Project Office. All locks shall be keyed the same.

5. GOVERNMENT FURNISHED EQUIPMENT, MATERIALS, AND SUPPLIES

5.1. GENERAL. Except as noted below, the Government will not furnish any equipment, materials, or supplies under this contract.

5.2. FOUNDATION MATERIAL AND PLACEMENT. The Government will provide concrete pads and/or gravel beds for dumpsters larger than two (2) cubic yards, excluding the thirty (30) cubic yard dumpster, to be of appropriate size to place the dumpster. Concrete pads/Gravel beds will be placed in a position that is accommodating of the vehicle used to empty the dumpster. The Contractor shall be on site to coordinate the placement and layout of the concrete pads/gravel beds to prevent rework.

6. GENERAL SERVICES SPECIFICATIONS

6.1. SCOPE OF WORK. Work shall consist of furnishing all labor, equipment, and material necessary to remove refuse, service dumpsters at designated areas around Rend Lake in accordance with the work schedule and specifications contained herein.

6.2. FREQUENCY OF SERVICE. The required frequency of service is provided in Appendix A.

6.3. CHANGES TO SERVICE FREQUENCIES AND/OR QUANTITIES. The Government reserves the option, should it become necessary, to decrease, increase or eliminate services, service frequencies and/or facility quantities in any or all recreation areas or portions of recreation areas. The Government may, at any time during the duration of this contract, open or close any recreation area or any portion of a recreation area and add or delete any services in the recreation area. The Contractor shall be given adequate notification to prepare for either contingency. This increase or decrease will be paid for or deducted from the Contractor's monthly invoice in accordance with the bid schedule. In addition, the Contracting Officer may, on special occasions such as major holidays or special events, change or reschedule a service frequency in order to provide for public safety and avoid conflicts with increased visitation. A minimum of twenty-four (24) hour's notification shall be given to the Contractor in such cases.

6.3.1. Occasionally, emergencies and maintenance problems arise that require the immediate closure of a facility. The Contractor shall be verbally notified as soon as possible, with written notification issued within five working days.

6.4. ADDITIONAL DUMPSTERS. Additional dumpsters are not guaranteed. If additional dumpsters are required, they shall be placed as directed by the Contracting Officer.

6.4.1. Contractor may be responsible for placing additional dumpsters. Placing an additional dumpster is defined as placing a two yard, four yard, six yard, eight yard, or thirty yard dumpster for special events and holidays. If additional dumpsters are required, they shall be placed as directed by the Contracting Officer and in accordance with the correlating ADDITIONAL DUMPSTER bid prices.

The Contractor shall be notified at least twenty-four (24) hours prior to the event.

6.5. ADDITIONAL SERVICE. Additional services are not guaranteed. If additional services are required, they shall be performed as directed by the Contracting Officer.

6.5.1. Contractor may be responsible for performing additional services. Additional services are defined as increasing the service frequency of an existing dumpster. If additional services are required, they shall be performed as directed by the Contracting Officer and in accordance with the correlating ADDITIONAL SERVICE bid prices. The Contractor shall be notified at least twenty-four (24) hours prior to the event.

6.6. EXCEPTION TO SERVICING. If the Contractor is unable to service a dumpster due to circumstances beyond their control, the Contractor shall immediately record the unit, by area and number, on the daily activity report as a non-serviced unit. If the dumpster becomes available while the Contractor is still in the

B - 13 recreation area, the unit shall be serviced as required and that unit shall be removed from the report. If the dumpster is still unavailable for service, the report shall remain as is and shall be turned into the Contracting Officer for non-payment. The daily report must be kept current and maintained by the crew so that a dumpster which is found un-serviced or deficient and rejected by the Government's Quality Assurance inspector can be checked against the crew's report for un-serviced dumpsters. A dumpster that is confirmed as being unavailable may then be counted as non-performance due to public use rather than rejected as deficient. The intent of this contract is to leave all facilities in a clean and sanitary condition.

6.7. WORK SCHEDULE. The Contractor shall submit to the Contracting Officer for approval a detailed work schedule showing approximate beginning and completion times for services required in this contract listed by recreation area. The work schedules must be submitted at the pre-work conference or as requested by Contracting Officer. The schedule shall include what equipment and supplies are to be used, the number of employees to be used, which bid items the employees will be performing, and the names of Supervisors/Quality Control inspectors.

6.7.1. The Contractor shall provide with the work schedule, a list of telephone numbers where persons of authority within the Contractor's organization can be reached during non-duty hours.

6.7.2. Accuracy of work schedules are extremely important as it controls the time at which Government Quality Assurance inspections are performed, ensuring that said inspections are done only after the required service has been completed. Any variation or unforeseen change, such as being ahead or behind the approved schedule, must be reported immediately by phone or in person.

6.7.3. Any proposed change to an approved schedule or change of Contractor Representative or Quality

Control inspectors must be submitted in writing and approved by the Contracting Officer a minimum of five (5) working days prior to implementation of the change.

6.8. WORKDAY. Services scheduled to be performed may not commence before 0700 hours in the campgrounds. All services must be completed by 1430 hours on all scheduled workdays. The Contracting Officer must approve any variation from this schedule in advance.

6.8.1. If for any reason the day's required service cannot be completed within the required time frame, the

Contractor must notify the Contracting Officer by 1400 hours of that day, either by phone or in person, followed in writing within three working days, advising him of the facilities not serviced and the reason work was not completed. If sufficient time is available for completion of the uncompleted service prior to the next scheduled performance of the bid item, the Contracting Officer may approve the performance of these items by the Contractor. Deductions for services not performed will be made on the Contractor's monthly invoice in accordance with the bid schedule.

6.9. APPLICABLE PUBLICATIONS. The Contractor shall perform all work in accordance with applicable publications. They include but are not limited to:

7. SPECIFICATIONS FOR REFUSE REMOVAL.

7.1. SCOPE OF WORK. Work shall consist of furnishing all labor, equipment, materials, and supplies necessary to install, move, remove refuse, clean, repair, maintain, and service dumpsters at public use areas and facilities at Rend Lake in accordance with this contract.

7.2. LOW LYING AREAS. All equipment, materials, and supplies located in low lying areas susceptible to flooding will be moved to higher ground at the Contractor's own expense when flooding conditions are present. The relocated dumpsters shall be re-stationed at the original site when the flood conditions cease.

The Government assumes no responsibility for lost, damaged, or destroyed receptacles and dumpsters as a result of flood conditions. It will be the Contractor's responsibility to obtain the lake elevation from the Lake Management Office when the possibility of flood conditions exists.

7.3. TWO (2), FOUR (4), SIX (6), AND EIGHT (8) CUBIC YARD DUMPSTERS

7.3.1. DUMPSTER SERVICE. Dumpsters shall be emptied and cleaned. The Contractor shall remove all loose litter, trash bags, garbage, etc., on the surface of the dumpster pads, and within twenty (20) feet around dumpster, and place it in the refuse truck. In the event dumpsters are moved, the Contractor shall return them to their proper locations at each regularly scheduled service.

7.3.1.1. The Contractor shall wash and/or disinfect dumpsters and/or apply an approved odor control chemical during each servicing, when any odor is detected, or as directed by the Contracting Officer such that dumpsters and receptacles remain clean and free of offensive odors.

7.3.1.2. Contractor shall reposition all dumpsters within designated areas, and shall ensure that all dumpster lids are properly closed.

7.3.1.3. All collected refuse shall be transported by the Contractor to, and deposited in, a sanitary landfill having a current and valid State EPA permit. THE CONTRACTOR SHALL SUBMIT

A COPY OF REFUSE DEPOSIT RECEIPTS FOR EACH LOAD DEPOSITED AT THE

APPROVED SANITARY LANDFILL WITH EACH MONTHLY STATEMENT.

7.3.2. ADDITIONAL DUMPSTER SERVICE.

7.3.2.1. Additional dumpster services are not guaranteed and shall only be performed at the direction of the Contracting Officer. Services may be required on days that are not normally scheduled.

7.3.2.2. Dumpsters shall be emptied and cleaned. The Contractor shall remove all loose litter, trash bags, garbage, etc., on the surface of the dumpster pads, and within twenty (20) feet around dumpster, and place it in the refuse truck. In the event dumpsters are moved, the Contractor shall return them to their proper locations at each regularly scheduled service.

7.3.2.3. Contractor shall wash and/or disinfect dumpsters and/or apply an approved odor control

7.3.2.4. The Contractor shall reposition all dumpsters within the designated areas, and shall ensure that all dumpster lids are properly closed.

7.3.2.5. All collected refuse shall be transported by the Contractor to, and deposited in, a sanitary

7.3.3. ADDITIONAL DUMPSTERS.

7.3.3.1. During special events or periods of heavy use, the Contractor may be required to provide additional dumpsters in areas designated by the Contracting Officer. These dumpsters shall meet all requirements of this contract.

7.3.3.2. Additional dumpsters are not guaranteed and shall only be performed at the direction of the

Contracting Officer.

7.3.3.3. All collected refuse shall be transported by the Contractor to, and deposited in, a sanitary

If servicing of the dumpster is required prior to removal, it will be in accordance with Section C.7.3.2, ADDITIONAL DUMPSTER SERVICING.

7.4. THIRTY (30) CUBIC YARD ROLL-OFF DUMPSTER

7.4.1. ROLL-OFF DUMPSTER RENTAL. The Contractor will provide and maintain a thirty cubic yard roll-off dumpster at the stockpile or behind the maintenance compound. The location shall be at the discretion of the Contracting Officer.

NOTE: For bidding purposes, the price shall be for placing a roll-off dumpster at a designated location for one month. Emptying or replacing with an empty dumpster will be billed as “ROLL-OFF DUMPSTER SERVICE”.

7.4.2. ROLL-OFF DUMPSTER SERVICE. Roll-off dumpster service is not guaranteed and shall only be performed at the direction of the Contracting Officer. Roll-off dumpsters shall be emptied and cleaned.

7.4.2.1. The Contractor shall wash and disinfect dumpsters and/or apply an approved odor control

7.4.2.2. The Contractor shall position all roll-off dumpsters within the designated areas or as directed by the Contracting Officer.

7.4.2.3. All collected refuse shall be transported by the Contractor to, and deposited in, a sanitary

7.4.3. ROLL-OFF ADDITIONAL DUMPSTER.

7.4.3.1. During special events, construction, or periods of heavy use, the Contractor may be required to provide additional roll-off dumpsters in areas designated by the Contracting Officer. These dumpsters shall meet all requirements of this contract.

7.4.3.2. Additional roll-off dumpsters are not guaranteed and shall only be performed at the direction of the Contracting Officer.

7.4.3.3. All collected refuse shall be transported by the Contractor to, and deposited in, a sanitary

8. ENVIRONMENTAL PROTECTION

8.1. SCOPE. This paragraph describes actions required for the prevention of environmental pollution during and as the result of operations under this contract. For the purpose of this specification, environmental pollution is defined as the presence of chemicals, physical, or biological elements or agents which adversely affect human health or welfare: unfavorably alter ecological balances of importance to human life; affect other species of importance to man; or degrade the utility of the environment for aesthetic and recreational purposes. The control of environmental pollution requires consideration of air, water and land, and involves noise, solid waste management and management of radiant energy and radioactive materials as well as other pollutants.

8.2. PROTECTION OF LAND RESOURCES. The work areas on which the work is to be performed under this contract and the land resources adjacent thereto should be preserved in their present condition.

8.3. PROTECTION OF WATER RESOURCES.

8.3.1. CONTAMINATION OF WATER. Lakes, ditches, rivers, canals, waterways; or reservoirs shall not be polluted with fuels, oil, bituminous, calcium chloride, insecticides, herbicides or other similar materials harmful to fish, shell fish, or wildlife, or materials which may be detrimental to outdoor recreation.

8.3.2. DISPOSAL OF MATERIALS. The methods and locations of disposal of materials, wastes, effluent, trash, garbage, oil, grease, chemicals, etc., within the right-of-way limits shall be such that harmful debris will not enter lakes, ditches, river, canals, waterways or reservoirs by erosion.

8.3.3. PERMITS AND RESPONSIBILITIES. The Contractor shall, without additional expense to the

Government, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable Federal, State, and Municipal laws, codes and regulations, in connection with the prosecution of the work contained within this contract. The Contractor shall be similarly responsible for all damages to persons or property that occur as a result of his fault or negligence; shall take proper safety and health precautions to protect the work, the workers, the public, and all the property of other; shall also be responsible for all materials delivered and work performed until completion and acceptance of the contract.
