Department of Army Limited Sources Justification

1. Contracting Activity: U.S. Army Corps of Engineers (USACE), Mississippi Valley Division (MVD), St. Louis District (MVS), St. Louis, Missouri 63101.

2. Description of Action: This action will result in a commercial firm fixed price Federal Supply Schedule order for Quality Assurance Support Services.

3. Description of Supplies/Services: This action will support twelve (12) months of Quality Assurance Services at an estimated value of $405,000.00 at the Formerly Utilized Sites Remedial Action Program (FUSRAP) within the St. Louis District.

4. Authority and Supporting Rational: FAR 8.405-6(a)(1)(i)(A), An urgent and compelling need exists, and following the procedures would result in unacceptable delays. The Government issued a purchase order in fiscal year 2016 to obtain similar services, which included four (4) options for extension of services. During the course of contract performance the Government was experiencing lower quality of performance than in prior years. As a result the Government identified several additional requirements that would better describe the level of quality and performance that is required to successfully meet the need. As a result there was a need to modify the performance work statement. The collective changes that would be required of the performance work statement made the exercising of the existing options to not be most advantageous in fulfilling the Government’s need.

In order to fulfill the Government’s immediate need, a revised scope of work was developed. In order to mitigate the primary concern of high quality performance, the Government identified a contractor who carries superior technical expertise. This contractor also holds a GSA Schedule, and is capable to support the immediate need to include all changes at a competitive rate.

The Government considered advertising for a competitive procurement to cover the one year period of time it will take to make final changes to the scope of work and prepare an appropriate procurement. It was determined that this option is not feasible due to the time involved in the acquisition process. In order to advertise, obtain proposals, evaluate, award, and establish a new contractor for such a requirement the time required would far exceed the time available to put services in place for continued support of the FUSRAP mission.

5. Best Value: The government has determined that the price is far and reasonable based on a comparison with the Independent Government Cost Estimate and prices previously paid for similar services.

6. Market Research: The Government utilized historical procurements for similar services to determine available sources. Historically these services have been provided by multiple contractors, and have been awarded competitively through the General Services Administration (GSA) Supply/Services Schedules. In response to the most recent competitive award, several responses were received. Those responses were submitted in response to a competitive GSA Request for Quotes (RFQ), set aside for small businesses. The sources that responded to the prior RFQ were reviewed independently by the Government.

Limited Sources Justification

7. Actions to remove or overcome barriers: As explained in Paragraph 4 above, additional competition for the requested contract is not feasible at this time due to unexpected change in the overall requirement for the follow-on requirement and a need for uninterrupted service.

Issuance of this contract action will allow the Government the time needed to complete a follow-on acquisition that uses competitive procedures to the maximum extent practical. It is anticipated that the follow-on acquisition will result in a long term contract to efficiently meet the ongoing FUSRAP requirements.

The St. Louis district will be preparing a competitive acquisition for these services. This re-procurement strategy will serve to remove or overcome barriers to competition before the subsequent acquisition is awarded.

The Request for Proposals (RFP) for the future long term contract vehicle will specifically define the performance criteria as well as quality expectations. The requirements for performance of these services are well-defined and must be executed in accordance with regulation and existing decision documents. Prospective offerors will have a sufficient period of time to respond following publicizing of the RFP. Based on past history of hazardous and toxic waste design contracting within the Corps of Engineers purview, there will be sufficient response from the FedBizOpps solicitation to select a highly rated proposal.

A Notice of Intent to “Sole Source Quality Assurance Services” will be posted in FedBizOpps in accordance with FAR regulations for publicizing contract actions. The Notice of Intent will request that any interested parties capable of meeting the requirement identify themselves and provide evidence of their capability for consideration in the follow-on competitive procurement.

Any responses received will be reviewed and documented by the Government and utilized in market research documentation for the upcoming competitive procurement.
