SPECIFICATIONS AND TECHNICAL PROVISIONS
VEGETATIVE REMOVAL SERVICES
1. GENERAL
1.1. Scope. The successful Contractor will provide all labor, materials, and equipment for vegetative removal at Lake Shelbyville as specified in this Section and to the satisfaction of the Contracting Officer.
1.2. Project Description. Lake Shelbyville is a 34,100 acre federal flood control project with 11,100 acres of surface water located in Shelby and Moultrie Counties, Illinois. Lake Shelbyville is a very popular outdoor recreation destination for approximately 2.5 to 3.5 million visitors each year and contains eleven recreation areas managed by the US Army Corps of Engineers.
1.3. Contract Area. All work will be located on Project Lands with the majority of the work taking place in the developed recreation areas. However, some work may be required in outlying lands as directed by the COR. See Appendix A and B for general location map and Lake Shelbyville map.
1.4. Ideally, work will take place outside of the recreation season which typically runs from April to October. However, work during the recreation season is often unavoidable and to be expected. During the recreation season, the Contractor will be expected to safely work within heavily utilized areas. All potential bidders are encouraged to visit Lake Shelbyville prior to bidding to discuss the requirements with the Operations Manager and other Corps of Engineers personnel. Failure to inspect the site prior to bidding does not constitute a grounds for withdrawal after the bid opening.
1.5. WORK HOURS. Contractor will be allowed to work Monday thru Friday from 7 a.m. until 5:00 p.m., excluding holidays. If need be, and agreed upon by the Contracting Officer, work may be performed on Saturdays from 7 a.m. – 5:00 p.m. All times and days must be approved by the Contracting Officer before the work is conducted.
1.6. Pre-bid Meeting and Site Visit. A pre-bid meeting and site visit will be held at the Lake Shelbyville Project Office, 1989 State Highway 16, Shelbyville, IL 62565 on December 20, 2017 at 10:00 A.M. For information regarding the meeting and site visit contact the Lake Shelbyville Project Office at (217) 774-3951 ext. 7012. All bidders are strongly encouraged to attend the pre-bid meeting and site visit.

As initially issued to the Contractor, the CDR describes the discrepancy or problem. The CDR will be discussed with the Contractor or his representative when it is issued. The Contractor shall provide his written response on the CDR form within 24 hours of issuance. The Contractor's response must:

The Contractor will be given a copy of the completed form. Should the Contractor not concur with any decision, etc., the Contractor may so state, in writing, and request a final decision by the KO. The KO monitors all CDR's issued and the CDR's are the principle evidence used by the KO in determining government contract actions such as termination or decision not to exercise options.
1.8.6. DBH – Unless otherwise specified, all tree measurements will be taken at Diameter Breast Height (DBH); the diameter of the stem measured 4 ½ feet above the ground.

The Contractor shall be responsible for complying with the current edition and all changes posted on the web. All equipment and materials will be inspected by the Government. The COR will notify the Contractor of any noncompliance with these provisions. The Contractor shall, after receipt of such notice, immediately take corrective action. The Contractor will ensure that all gates are locked when entering and exiting a work area. Under NO circumstances will the gate be left swinging unsecured or “dummy” locked.
1.11. Work Plan. The Contractor shall submit a work plan indicating what equipment will be used, number of employees and how they will be used, employee names, and the supervisors or work leaders to whom deficiencies should be reported. Any changes to the approved work plan must be submitted to the COR for approval prior to implementation of the work plan change.
1.12. Quality Control Plan. At the pre-work conference and work site inspection, the Contractor shall furnish a Quality Control Plan to the COR for approval. All damage from off road vehicle use will be repaired to original conditions at the Contractor's expense. The Contractor is expected to obey all posted speed limits and citations will be issued failure to observe posted speed limits and/or careless and negligent use of vehicles.
Complaints from customers will usually be considered valid and action can be taken.
1.16. Damage to Government Property. It is the Contractor's responsibility to guard against destruction, injury, defacement, removal or any alteration of public property including, but not limited to, developed facilities and vegetative growth. 1.19. Personnel Requirement.
1.19.1. Supervision. A minimum of one supervisor shall be on duty in the contract work area during all scheduled working hours to ensure compliance with contract specifications. The Contractor will furnish a telephone number and mailing address through which they can be contacted on a daily basis and must supply in writing the name(s) of their supervisor(s) who can be contacted on a daily basis.
1.19.2. Contractor’s Employees. The majority of work will be performed in the presence of the general public; thus conduct of all employees is critical and will be closely monitored. The Contractor or their employees while performing work under this contract will consume no alcoholic beverages or illegal drugs and will remain fully clothed. The COR may require the Contractor to immediately remove any employee of the Contractor from the worksite who endangers persons or property. Notification will be by telephone or in person and will be confirmed in writing as soon as possible. No such removal however, will reduce the Contractor’s obligation to perform all work required under this contract.
1.20. Environmental Protection.

The control of environmental pollution requires consideration of air, water, and land and involves noise, solid waste management, and management of radiant energy, and radioactive materials, as well as other pollutants.
1.20.2 Protection of Land Resources. The areas on which the work is to be performed under this contract, and the land resources adjacent thereto, will be preserved in their present condition.
1.20.3. Protection of Water Resources. 1.20.4. Disposal of Materials. The methods and locations of disposal of materials, wastes, effluents, trash, garbage, oil, grease, chemicals, and other like materials shall be approved by the COR.
1.20.5. Permits and Responsibilities. The Contractor will, without additional expense to the
Government, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable Federal, State, and Municipal laws, codes, and regulations, in connection with the execution of the work.
The Contractor will be similarly responsible for all damages to persons or property that occur as a result of their fault or negligence; will take proper safety and health precautions to protect the work, the public, and all the property of others; will also be responsible for all materials delivered and work performed until completion and acceptance of the contract.
1.21 Equipment Removal and Storage
1.21.1 Removal of Equipment and Other Materials. Upon completion of working in an area, the Contractor will remove from the site of work all equipment, unused materials unless authorized by the COR, and any waste materials and rubbish resulting from the operation performed herein.
1.21.2 Property Storage. The Contractor will not be allowed to store any property on Government property unless approved in advance by the COR. If approval is given for property storage, the Government assumes no responsibility for the safety or security of property left on Government property. Property will be removed from the work site as soon as possible after the completion of the work described herein.
1.22. Contractor Availability.
1.22.1. Meetings. During the course of this contract, the Contractor or an authorized representative will meet with the COR each working day. Meetings may be in person at the Administration Office or by phone during normal working hours between 8 a.m. and 11 a.m. If a CDR is issued, mutual effort will be made to resolve all problems identified to preclude their recurrence. The COR may reduce the frequency of these meetings if mutually agreeable between the COR and the Contractor.
1.22.2. Electronic Communication. The Contractor will maintain an electronic communication system to receive messages (cell phone, beeper, and/or radio tuned to the Corps' frequency). If the COR leaves a message between the hours of 7 a.m. and 8 p.m., the Contractor shall call back within 30 minutes of the time the message is left. The Contractor will provide crew leaders a communication system with numbers furnished to the Government. The system provided shall ensure communications between the Government and the Contractor crew leader(s) during all hours of scheduled work.
3. Government Furnished Items.
3.1. Water and Electricity. The Government will provide water and electricity, when and where available.
3.2. Keys. If government keys are issued to the Contractor, the final month's work will not be considered completed and accepted until the keys are returned to the government's key control officer. 5.3. Tree Removal. Trees marked for removal will be cut flush with the ground. Trees marked for removal will be placed in one of four categories; under 6” DBH, 6 – 12” DBH, 13 – 24” DBH, and over 24” DBH.
The tree (to include all limbs) must be removed from Government property at the Contractor’s expense. In cases where a tree is forked or multi-trunked, the tree will be measured at DBH and if the fork is BELOW 4 ½ feet, it will be counted as 2 trees (or more if multi-trunked). If the fork is ABOVE 4 ½ feet, it will be counted as a single tree.
Note: Concerning tree removal, the unit will be each.
5.4. Tree Removal including Stump Removal. Trees marked for removal will be cut down and the stump removed. Trees will be placed in one of the four categories; under 6” DBH, 6 – 12” DBH, 13 – 24” DBH, and over 24” DBH. Trees will be cut to a height so that the stump can be ground utilizing a stump grinder and the stump shall be ground approximately 10" below ground level. All stump holes will be filled with topsoil capable of producing a natural stand of grass and may contain NO more than 30% wood chips. The remaining wood chips are to be removed from the area and disposed of at the Contractor’s expense. Once the topsoil is packed level, it shall be seeded and fertilized (10-10-10) with a viable mixture of tall fescue, bluegrass and ryegrass seed. If the fork is ABOVE 4 ½ feet, it will only be counted as one tree. However, for the purposes of tree removal including stump grinding, the diameter of the largest tree will be used to determine payment, and the remaining trunk(s) paid under 5.4 (Tree Removal). Note: Concerning tree removal including stump removal, the unit will be each.
5.5. Stump Removal. Marked stumps shall be removed with a stump grinder and the stump ground approximately 10" below ground level. All stump holes will be filled with topsoil capable of producing a natural stand of grass and may contain NO more than 30% wood chips. The remaining wood chips are to be removed from the area and disposed of at the COR’s discretion. Once the topsoil is packed level, it shall be seeded and fertilized (10-10-10) with a viable mixture of tall fescue, bluegrass and ryegrass seed. Note: Concerning stump removal, the unit will be each.
5.6. Emergency Call Out. In cases of an emergency it may be necessary to call the contractor out to take care of a hazard tree/limb that is in imminent danger of or has already caused an accident. In such cases, the contractor will be required to report on-site and be prepared to work within 4 hours of receiving the call from Corps personnel. This line item is to cover the cost of mobilizing equipment and/or manpower to Lake Shelbyville on short notice. Each tree/limb removal will still be paid at the appropriate bid price. As an example: A 24” tree blows across the road blocking campers in at Coon Creek Recreation Area. The tree is too big for Corps personnel to handle and Corps personnel make an Emergency Call Out (Contractors bid price of $500.00 for an emergency call out). The contractors bid price for a 24” tree is $1,000.00. The contractor would be paid $1,000.00 for the tree and $500.00 for the Emergency Call Out for a total of $1,500.00. Predicting how often this line item will be utilized in any given year is not practical. However, only in true emergency situations will the Contractor be called out. Note:
Concerning Emergency Call Out, the unit will be for each incident.
5.7. Firewood Provision. In some instances where the species is desirable for firewood (oak, hickory, etc.), the COR may want a hazard tree cut into firewood and stacked neatly at a nearby location within the recreation area for camper use. Only trees between 6” and 15” DBH will be utilized for this purpose and will be specified by the COR. These trees must be cut into approximately 24" lengths and neatly stacked at a nearby campsite or nearby location within the park as designated by the COR. The remaining portions of the tree (to include limbs) outside of this size range must be removed from Government property at the Contractor’s expense. Note: Concerning firewood provision, the unit will be each. There will be two bid items under this section: Tree removal and tree removal including stump removal. For both bid items the specification is covered under Section 5.3 or 5.4 to exclude the portion to be left for firewood.
