SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

AMEND 1 QUESTIONS AND ANWERS

Solicitation W912P917R0055 Questions

1. Can a previously completed PPQ be submitted vs. asking the client to fill out a new form? Clients become irritated when they are asked to complete the same information multiple times and so this request is for their convenience.

RESPONSE: Pg. 16 of 80 TAB 3: FACTOR 3 – PAST PERFORMANCE

The contract allows PPQs to be submitted that were previously submitted for other RFPs. The PPQ must be included in full and not incorporated by reference. PPQs should be current and relevant to the SOW, not necessarily new. The government will consider all documents submitted.

2. Will the government consider usage in our proposal of completed CPARS vs. a PPQ for the Past Performance section?

RESPONSE: Pg. 33 of 80 TAB 1: FACTOR 1 – TECHNICAL / MANAGEMENT; Performance Confidence Assessment states the following: “Additionally, the Government shall consider past performance information obtained from any other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardees Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contra ct Management Agency. As well as CPARS and the Past Performance Questionnaires.”

RESPONSE: The government requires both CPARS and PPQ.

3. Although it can be inferred that the government does want completed PPQs to be included in our proposal, it is not specifically stated. Please confirm that the government wants any new PPQ generated by client to be sent directly to the government and included in our proposal response.

RESPONSE: Pg. 16 of 80 TAB 3: FACTOR 3 – PAST PERFORMANCE; Volume III – Past Performance Information states, “The Proposal must include at least five (5) projects, which demonstrate specific performance history over the course of the past 5 years with a maximum of 10 pages, which do not include the PPQs.” “The attached Past Performance Questionnaire (PPQ) (end of Section M) (representing the offeror’s relevant Past Performance) forms shall be completed by customers of these projects and submitted independently by the them directly to NLT the due date of the proposal.”

RESPONSE: Yes submit them in your proposal and yes have the customers of those projects send them directly to the government.

4. Reference solicitation page 15, Remedial Project Manager qualifications. Please confirm that an engineering degree is acceptable for this personnel position?

RESPONSE: Pg. 15 of 80 TAB 1: FACTOR 1 – TECHNICAL EXPERTISE; Subfactor (b) – Key Personnel

Yes, an engineering degree is acceptable to Remedial Project Manager qualifications. However, the engineering degrees needs to be related to environmental studies. Comment is addressed by existing language as it reads “or related field”.

“Remedial Project Manager (RPM) Each individual proposed must have a Bachelor’s Degree (or higher) with emphasis in environmental studies, environmental (or other related field such as chemistry, or biology, etc.), and >10 years site investigation and remediation experience, including EPA Superfund Site Remediation project experience.”

5. Reference solicitation page 14, Senior FUDS Project Manager Qualifications. Please consider an education requirement of Bachelors in Science or Engineering and that the experience be 10 years in FUDS or similar program in order for us to propose qualified personnel at a more competitive rate.

RESPONSE: Pg. 14 of 80 TAB 1: FACTOR 1 – TECHNICAL EXPERTISE; Subfactor (b) – Key

Education degree can be reduced to a Bachelor’s degree. However, the requirement of 10 years of experience is rejected. This position is highly technical and performed by several individuals with similar years of experience. In addition, reject “or similar program” as this is a specific program requiring a unique skill set and we will not train individuals for this requirement.

6. Reference solicitation page 14-15, Senior Community Relations Specialist qualifications. Please consider an education requirement of Bachelors in communication, journalism, public relations or similar be allowed and that the experience be in FUDS or similar program in order for us to propose qualified personnel at a more competitive rate.

RESPONSE: Pg. 14/15 of 80 TAB 1: FACTOR 1 – TECHNICAL EXPERTISE; Subfactor (b) – Key

Education degree can be changed. However, reject “or similar program” as this is a specific program requiring a unique skill set and we will not train individuals for this requirement. This section has been edited to read as follows containing the changes in bold:

“Senior Community Relations Manager Each individual proposed must have a Bachelor’s degree in Information Science or Public Relations (or other Communication degrees such as Journalism) with >10 years of documented experience in public involvement issues surrounding high profile FUDS project sites, including public events and meetings, information dissemination, and planning and coordinating evacuations during investigations and removal actions at FUDS and/or Superfund projects on both complex and high profile sites.”

7. Reference solicitation page 15, sub factor e. Please consider having copies of HTRW certifications not go against page count. This information can be voluminous and prevent us from doing a comprehensive response on the other elements of the Factor 1 response in order to remain within page count.

RESPONSE: Pg. 15 of 80 TAB 1: FACTOR 1 – TECHNICAL EXPERTISE; Subfactor (e) – Resumes and HTRW Certificates

Certifications, PPQs,. will not count against page count.

8. Reference solicitation page 15, sub factor e. Please list the exact certifications the government requires certification proof thereof in the proposal response.

RESPONSE: Pg. 18 of 80 TAB 1: FACTOR 1 – TECHNICAL EXPERTISE; Subfactor (e) – Resumes and HTRW Certificates

There is not an “exact list”, the offeror is expected to have an understanding of HTRW related certifications and provide them accordingly. While there is no exact list, some of the certifications that would be reasonably expected relate to HAZWOPER, Asbestos, Lead, FA/CPR, and OSHA Construction. Item remains unchanged.

“Updated HTRW training certificates shall also be provided for all Technical & Key personnel (i.e.

OSHA 30, 40 hr HAZWOPER, Lead, Asbestos, etc.).”

9. Reference solicitation page 15, Factor 2 requiring the Contractor’s main office be located within 200 miles of the District Office in order to provide adequate time (within four hours) for mobilization and travel in the event of an Emergency Response. Please consider deleting the requirement for the main office to be within 200 miles of the District Office. Mastery of logistics and resources and a guaranteed response time window would seem to be more important than an exclusionary requirement for office location—especially with other EPA and USACE emergency response contracts in place resulting in likely a very small percentage of that type work be performed under this contract.

RESPONSE: Pg. 15 and 31 of 80 FACTOR 2 – GEOGRAPHIC PROXIMITY

Please see rewrite of Factor 2 – Geographic Proximity.

10. If the government will not consider modifying its response to question 9 above, please consider modifying the main office requirement to include office that will support this contract (vs. main office) and/or extending the mileage range beyond 200 miles.

RESPONSE: Pg. 15 and 31 of 80 have been changed. See answer to previous question#9.

11. Reference page 9, Factor 3. Do required letters of commitment, teaming arrangements, etc. go against page count? Please consider not having them go against page count.

RESPONSE: Pg. 9 of 80

Certifications, resumes, PPQs, teaming agreements, letters of commitment, etc. DO not count against the page count.

12. Reference page 9, Factor 3. Are executed copies of teaming agreements or joint venture agreements required to be included in the proposal?

RESPONSE: Pg. 16 of 80

TAB 2: FACTOR 2 – PAST PERFORMANCE INFORMATION; Volume III – Past Performance Information

“To receive credit for past performance as a Joint Venture, the PPQ form must state in detail the nature of the work performed by both of the Joint Venture partners, the total percentage of the work performed by both of the Joint Venture partners, and the total amount of work performed by both of the Joint Venture partners.”

13. Reference page 16, Factor 3 that states that minimum five projects must be included in demonstration of past performance for a maximum of 10 pages. However, note 1 of the Data Sheet for Performance Survey, seems to indicate the government is requiring five projects from the Prime and up to five for each team member. Please clarify the past project requirements.

“The Proposal must include at least five (5) projects, which demonstrate specific performance history over the course of the past 5 years with a maximum of 10 pages, which do not include the PPQs. Demonstrate the past performance of the offeror and if you wish, other members of the proposed team, if any, including Sub-Contractors, Teaming Partners and/or Joint Venture partners.”

14. Reference solicitation page 26, Cost Volume. Should “Section B, Price Proposal Schedule (CLIN 2)” be Attachment 2 vs. CLIN 2?

RESPONSE: Pg. 26 of 80

Should be Attachment 2, Tab 3 of Volume 2, Attachment 2, Bidding Schedule

15. Reference solicitation page 14. Please define the government’s definition of “floating plant.”

RESPONSE: Pg. 14 of 80 and 30 of 80

TAB 1: FACTOR 1 – TECHNICAL EXPERTISE; Subfactor (A) – Physical Sciences and Engineering:

TAB 1: FACTOR 1 – TECHNICAL / MANAGEMENT; Subfactor (A) – Physical Sciences and Engineering:

Floating plant include floating cranes, debris boats, towboats, tugs, survey boats, and other vessels used for conducting such navigation services as dredging, surveying, sediment management, analysis, scientific, and engineering missions.

16. Reference page 68 of representations and certifications. It states NAICS 561730 and Small Business size standard of $7.5M. Should this be NAICS 541620 and $15M as noted on 1449 form?

RESPONSE: Pg. 68 of 80

The NAICS code should read 541620 for Size Standard of $15,000,000 as stated in SF 1449.

17. Reference to the cover page, box #10 and page 33. NAICS code listed as 541620 on cover and as 562910 on page 33.

RESPONSE: Pg. 33 of 80

The NAICS code is 541620 for Environmental Consulting Services as stated on pg. 33.

18. Since questions need to be answered by the government for us to complete our proposal (typically at least a week from the due date) and we are a small business with limited resources and the holidays are quickly approaching, would the government consider a two-week proposal due date extension?

RESPONSE:

The solicitation will be extended until 10 am, January 16, 2018. (Note January 15,2018 is a federal holiday)

19. Can a smaller font (less than 10 pt.) be used in charts, tables, and graphics?

RESPONSE: Pg. 10 of 80

8 PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS, (b) General Instructions:

(2)…

10 pt. remains unchanged.

20. Reference solicitation page 12 (b.) requiring that letters of commitment go in factor 2 with page 9 indicating they should be included Factor 3. Please clarify.

RESPONSE: Pg. 9 of 80 and Pg. 12 of 80

10 SUB CONTRACTOR CONTRACTORS (b)

Revised to read Factor 3.

21. Reference Attachment 2, Items 119-126. What is the type and location of these items that require transport and disposal? The costs for each are based on the type of waste (i.e., non-hazv. haz, PCB or PCB-containing) and the locations of wastes relative to disposal facilities.

Items 119-126, depend on location and waste type.

22. Reference Attachment 2, Items 119-126. Could these items be removed from the cost estimate based on variability (too many variables)?

No. These items will remain in Atch 2 for pricing.

23. Reference to Attachment 2, Items 0146, 0148, 0150, 0152, etc. What is the location and distance basis for the mob/demob items?

Location and distance basis for the mob/ demob items are unknown. These will depend on location and waste type. They will be task ordered priced.

24. Reference to Attachment 2, Items 47-168. These are costs for materials, equipment, and some subcontracted services. How do these costs count towards the percentage of work performed by the contractor?

Items 47-168 do not count towards the percentage of work performed by the contractor. SBA requires 51% of work to be performed by the contractor.

25. Reference to Section 2.4 on page 4. Can you describe typical anticipated emergency response, and what would be the capacity?

RESPONSE: Pg. 4 of 80

These emergency responses are “atypical” and will vary greatly depending on size, scope, contamination, and risk. They will be determined by tasked orders.

26. On attachment 2, item 0041 Divers (2) – to clarify, this indicates you want the unit price for two divers, not a single diver, correct?

Correct USACE requires two divers per dive (diver and stand-by diver).

27. Reference to Attachment 2, Item 41. Would divers, dive supervisor, and dive tender be used to collect hazardous samples or biological samples (or both)? Diving in hazardous situations and for biological sampling requires different equipment and different training.

All dives are potentially hazardous; however, it is not the intent of this requirement to send divers into a known HTRW environment. Should this requirement arise, it would be subject to a future contract modification.

28. General question: Will unit based fixed costs (such as analytical fees (chemistry, bioassay, etc.)

be negotiated at the time of individual task order issuance?

No. Unless outside the statement of work (SOW).

29. On the provided pricing schedule, would items 0047-0050, Personnel Protection for Levels A-D, refer to the cost of PPE alone for employees in Levels A-D, or to a separate personnel position in addition to PPE for each level? One of the positions listed under key personnel is an Industrial Hygienist who is also a Certified Industrial Hygienist. However, on the provided pricing schedule, Item #0015 specifies a Certified Industrial Hygienist with 900 hours, and Item #0016 specifies an Industrial Hygienist with 1,500 hours. Does the key personnel position of Industrial Hygienist refer to Item #0015 or Item #0016?

Items 0047-0050, PPE for Levels A-D refer to the PPE [alone]. The key personnel position of Industrial Hygienist refer to the Item #0015.

30. Divers, dive supervisor, and dive assistant are not listed on the wage determination. Is there a wage determination for these categories?

No. The Department of Labor (DOL) link below is the Wage Determination. Master Mechanics, Class II, III, and IV are for Divers. See Classification Description at the bottom of the determination.

www.wdol.gov/wdol/scafiles/davisbacon/IL18.dvb

31. Page 15 - Factor 1 Subfactor (e): Resumes and HTRW Certificates The Government will review the Offeror' s expertise with completed individual resumes for all key and technical personnel, including details of prior experience related to the kinds of activities called for in the RFP and updated HTRW training certificates. Question: Beyond the 6 Key personnel listed in the solicitation, what other technical resumes are the Government expecting to evaluate and score? Should the Offeror provide additional resumes of other key technical personnel necessary to complete the scope of work, as identified on the pricing schedule (attachment 2)?

Will any of these additional resumes be evaluated and scored?

RESPONSE: Pg. 15 of 80

Yes, all Key and Technical personnel proposed will be evaluated.

32. Page 15 - The Government will review the Offeror' s expertise with completed individual resumes for all key and technical personnel, including details of prior experience related to the kinds of activities called for in the RFP and updated HTRW training certificates. Question: Do the updated HTRW training certifications count towards the total page limit of 30 for Factor 1?

RESPONSE: Pg. 15 of 80

Certifications, , PPQs, , etc. will not count against page count.

33. Page 16 - FACTOR 3 - PAST PERFORMANCE Volume III - Past Performance Information

(314) 331- 8965 Fax Number: (314) 331-8746 INSTRUCTIONS TO PRIME OFFEROR: Offerors shall complete one of these attachments for yourself and one for each division(s), major subcontractor(s), teaming partner(s), joint venture partner(s), or key person(s) the offeror wants the government to consider in the performance evaluation. YOUR NAME AND ADDRESS, AS THE PRIME OFFEROR, MUST APPEAR IN BLOCK 1 BELOW. Enter the name and address of the firm or individual you want surveyed in Block 2. If no name appears, only the firm or individual in Block 1 will be surveyed.

NOTE 1: Offerors shall complete a separate data sheet for each contract for itself (up to a maximum of 5), and each additional entity the offeror wants the government to consider (up to a maximum of 5 for each entity). *For Key Personnel to be evaluated project information in the same format below shall be provided--resumes will not be evaluated.

NOTE 2: Offerors shall submit this information with Volume I of their proposal. Offerors are encouraged, but not required, to provide copies to the Contracting Officer before the RFP closing date.

Can you please clarify the asterisk sentence under Note 1 concerning Key personnel being evaluated under Past Performance Factor 3? Are the Data Sheets to be submitted in addition to the PPQs? And will they count towards the page limit?

history over the course of the past 5 years with a maximum of 10 pages, which do not include the PPQs. Demonstrate the past performance of the offeror and if you wish, other members of the proposed team, if any, including Sub-Contractors, Teaming Partners and/or Joint Venture partners.”

Pg. 15 of 80

The government requires resumes only as addressed on page 15 of 80 under Subfactor (e) Resumes and HTRW Certificates Reference to resumes within the PPQ has been changed PPQs are to demonstrate how the contractor performed on similar SOW activities, the data sheets are required.

Certifications, , PPQs, , etc. will not count against page count.

34. Page 21 - FACTOR 3 - PAST PERFORMANCE PPQs Question: Can the Offeror or its subcontractor use PPQs we already have from previous submittals?

RESPONSE: Pg. 21 of 80

Yes, as long as the government can determine the relevance of these PPQs to the environmental engineering requirement.

35. Page 3 - 2.0 DETAILED DESCRIPTION OF SERVICE:

The contractor must have available the equipment, staff and overall capability to accomplish the following tasks in support of not only the St. Louis District but throughout the Mississippi Valley Division and other CONUS areas where noted.

Question: Page 3, Section 2 of the solicitation indicates that work will be completed within the St.

Louis District, the MVD, and/or other CONUS areas. Can the government estimate a percentage of each area that the work is expected to take place in?

RESPONSE: Pg. 3 of 80

No

36. Page 32, Section M, Factor 3: Past Performance. The text under Performance Area 2 indicates that the Government will evaluate the offeror’s “Experience and knowledge with the capability to manage cost reimbursable contracts…..”

Questions: (a) This statement seems to conflict with the information provided on pages 35 and 36, which suggests that task orders will be firm fixed price. Questions: (b) Please confirm whether task orders under this contract will be cost reimbursable or firm fixed price.

RESPONSE: Pg. 32 of 80

Work will be firm fixed price. Performance Area 2 has been updated.

37. Page 5, para 2.9 indicates conduct environmental studies to determine and execute remedial action. These studies may include sampling design and execution, environmental quality control, human/ecological health risk assessments, HTRW safety and health management, personnel and perimeter exposure monitoring, construction management and quality control, pilot remedial project development and implementation, and remediation/restoration activities.

Question: Does this contract allow remedial action? Last sentence supports that it does.

RESPONSE: Pg. 5 of 80

Yes. The NAICS code includes firms that provide site remediation consulting services.

38. Page 14 - Senior FUDS Project Manager - Each individual proposed must have a Master’s Degree in Science or related field with >15 years demonstrated experience in managing FUDS projects for USACE districts.

Question: Senior FUDS Project Manager. First sentence would suggest that offerors may submit more than one individual for this position. Is this correct? And can a Professional Engineer’s license substitute for the Master’s Degree?

RESPONSE: Pg. 14 of 80

Yes, a Professional Engineer’s license can substitute for the Master’s Degree, however the individual must demonstrate >15 years of experience in managing FUDS projects for the USACE districts.

39. Page 11 - SOURCE SELECTION INFORMATION – SEE FAR 2.101 AND 3.104 14 If an offeror wishes to receive credit for the experience or past performance of a Sub-Contractor, including a firm that is a proposed Sub-Contractor to the prime Contractor or a Joint Venture partner, the offeror must submit a letter of commitment to subcontract under the proposed project, signed both by the Sub-Contractor and the offeror…. Include letters of commitment in Volume 1, Factor 2, Past Performance.

Question: Does the of letter of intent count against the page limit? And where does the letter of intent belong in the proposal as Factor 2 is Geographic Proximity?

RESPONSE: Pg. 11 of 80

Certifications and PPQs, will not count against page count.

Letter of commitment should be included in Factor 3 Past Performance. And if using a subcontractor to respond to Factor 2, the letter of commitment must be provided in response to that Factor 2 and identify the physical address which must be active prior to proposal submission.

40. Page 14, Water Quality para indicates that the WQ specialist must have documented experience conducting water quality studies in the Upper and Lower Mississippi River Basins.

Question: Request that this requirement be adjusted to allow for experience in other river basins. Also, request that the Bachelor’s Degree be modified to include Environmental Engineering.

Suggested rewrite of the WQ Specialist qualifications:

“Each individual proposed must have a Bachelor’s Degree in environmental sciences (or other related field such as chemistry, or biology, environmental engineering, etc.,) with >10 years documented experience in developing and implementing Water Quality/Sediment sampling and monitoring design, statistical analysis, and assessing impacts of water resources projects. The individual must also have documented experience conducting water quality studies in the Upper and Lower Mississippi River Basins (or other similar river basins).

No. Our customers for this requirement are within MVD, MVS and other Conus.

41. Page 14/15, Senior Community Relations Manager.

Question: Request that the Master’s Degree in language that allows another communications degree as appropriate. Request that the requirement for experience in planning and coordinating evacuations during investigations and removal actions at FUDS be eliminated. Request that the required documented experience allow for other high profile Environmental projects.

Suggested rewrite of the Senior Community Relations Manager:

Each individual proposed must have a Master’s degree in Information Science or Public Relations (or other Communications degrees such as Journalism) with >10 years of documented experience in public involvement issues surrounding high profile FUDS project sites (or other equivalent high profile environmental projects), including public events and meetings, and information dissemination, and planning and coordinating evacuations during investigations and removal actions at FUDS. The individual must have documented evidence of public information and technical press release writing and editing skills used for FUDS and/or Superfund projects (or similar Environmental project) on both complex and high-profile sites.

Education degree can be changed. However, reject “or other equivalent high profile environmental projects” and “or similar Environmental program” as this is a specific program requiring a unique skill set and we will not train individuals for this requirement.

42. Normally we preface our Technical Proposal with a brief Executive Summary /Introduction of ourselves and our Teaming partners before proceeding into the Technical Expertise. Is this approach acceptable based on the instructions given in Section L – 12. (2) Format and Contents of Technical Proposal and List of Tabs?

RESPONSE: Pg. 12 of 80

Yes.

43. In Section L – 12.(2) (table) under Format and Contents of Technical Proposal and List of Tabs - Past Performance Questionnaires are included under TAB 3 with a page limit of 10 pages (for Ref on Page 12 of 80). However, in Section L – 14 Proposal Format, TAB 3: FACTOR 3 – Past Performance, reads: “The Proposal must include at least five (5) projects, which demonstrate specific performance history over the course of the past 5 years with a maximum of 10 pages, which do not include the PPQs. (for Ref see Page 16 of 80). Would you please clarify if the actual PPQ forms are included in the page count limitation?

PPQs are not included in the page count.

44. Are personnel resumes and HTRW certifications exempt from page count?

Certifications, PPQs. will not count against page count.

45. May the offeror submit Contracts of similar size and scope in place of Projects for Past Performance evaluation?

No.

46. Can the Past Performance projects/contracts be on going, or must they be completed tasks?

Past Performance projects/ contracts must be for completed tasks.

47. Will USACE accept CPARS evaluations instead of the PPQ for a project/contract? Would a CPARS submittal receive less merit than a PPQ submittal?

No, see response to Question #2.

48. Are Letters of Commitment and Teaming agreements included in page count? And should these forms be included in Technical, Price proposal, or both? Section 10 b. on page 12 of 80 indicates such documents should be included in Volume 1, Factor 2, Past Performance. However Section L 7. Factor 3, item 1 indicates these documents shall appear here. Which is correct?

RESPONSE: Pg. 9 of 80, and Pg. 12 of 80

Letters of Commitment and Teaming agreements are included in the page count.

Letters of Commitment and Teaming Agreements are to be included in Section L 7 Factor 3, Volume 1.

49. Is the offeror limited to 5 PPQs for the Proposed Team, or 5 PPQs for the Prime and up to 5 PPQs for each Team Member/Subcontractor?

RESPONSE: Pg 16 of 80.

history over the course of the past 5 years with a maximum of 10 pages, which do not include the PPQs. Demonstrate the past performance of the offeror and if you wish, other members of the proposed team, if any, including Sub-Contractors, Teaming Partners and/or Joint Venture partners.”

Quantity responses in Note 1: Pg 19 of 80 are removed.

50. Should equipment pricing in Section B include fuel, oil, and grease, or will that be negotiated on the individual Task Orders?

No it will not be negotiated at Task Order level.

51. Are service and maintenance costs to be included in the equipment pricing, or will that be negotiated on the individual Task Orders?

No will not negotiated.

52. Should the hazard pay differential be included in basic labor rate for Service Contract Labor categories? If so, which differential?

No.

53. In Section L – 4. Submission of Inquiries it is stated: “Written questions must be received by this office not later than 10 calendar days prior to the date set for receipt of offers.” But the posted notice on FedBizOpps reads: “All questions written regarding this Solicitation should be emailed on or before COB December 7, 2017….” Please clarify the last date to submit inquiries.

COB December 7, 2017

54. Section L states on Page 16 of 80 that: “The attached Past Performance Questionnaire (PPQ) (end of Section M) (representing the offeror’s relevant Past Performance) forms shall be completed by customers of these projects and submitted independently by the customer to the Contract Specialist Angie Grimes and Contracting Officer Archie Ringgenberg NLT the due date of the proposal.” Section L later states on Page 23 of 80 that: “NOTE: THE GOVERNMENT REQUESTS THAT THE CLIENT

COMPLETES THIS QUESTIONNAIRE AND SUBMITS DIRECTLY BACK TO THE OFFEROR. THE

OFFEROR WILL SUBMIT THE COMPLETED QUESTIONNAIRE TO USACE WITH THEIR PROPOSAL,

AND MAY DUPLICATE THIS QUESTIONNAIRE FOR FUTURE SUBMISSION ON USACE

SOLICITATIONS. CLIENTS ARE HIGHLY ENCOURAGED TO SUBMIT QUESTIONNAIRES DIRECTLY

TO THE OFFEROR. THE GOVERNMENT RESERVES THE RIGHT TO VERIFY ANY AND ALL

INFORMATION ON THIS FORM.” There is an apparent conflict between these two references in Section L. Would you please advise how we should collect and submit the completed PPQ forms?

RESPONSE: Pg. 16 of 80 and Pg. 23 of 80

See Response to question #33.

55. In Section L – 14, Proposal Format – Volume 1, Subfactor (a), 2, viii (Page 14 of 80) and again in Section M – 4, TAB 1: FACTOR 1, Subfactor (a), viii (Page 30 of 80), River engineering (water data gauge systems) is listed. This item is not described or alluded to anywhere in the SOW section of the RFP. Would the government please provide a brief description of the work required on this item?

Delete this in both page 14 and page 30.

56. For Key Personnel – Can we propose multiple personnel to fill these positions? For example, Senior FUDS Program Managers within the St. Louis District, as well qualified individuals located in other Divisions? Or Remedial Project Managers from within the St. Louis District and others from other USACE/USEPA divisions/regions? This would allow the Corps to choose contractor personnel that most closely fit specific task requirements, as well as economies realized from having personnel prepositioned throughout the MVD and CONUS.

Yes.

57. Section L-7 (page 9 of 80) and Sections L-12 and L-13 seem to be contradictory. L-7 indicates 1 original and 4 copies of the Technical Proposal in hardcopy and one electronic copy on a CD. It also indicates 1 original and 1 copy of the Price Proposal in hardcopy and one electronic copy on a CD.

Section L-12 (1) requires 1 original and 4 copies of the Technical Proposal in hardcopy and a CD containing the entire Technical and Price Proposal.

Section L-12 (1) eliminates price proposals.

58. Section L-13 (1) requires an original hardcopy of the Price Proposal and an electronic copy on CD. No mention of an additional hardcopy is made. Is it permissible to include both proposals on a single CD, or are two CDs required, one for the Technical Proposal and one for the Price Proposal?

Single CD for the technical proposal and single CD for the price proposal.

59. Is an extra hardcopy of the Price proposal desired or required?

No extra hardcopy of the price proposal is required.

8. PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS

a. Requirement for Separate Technical and Price Proposals.

DO NOT MIX CONTENTS OF VOLUME 1 (Technical) AND VOLUME 2 (Price) IN THE SAME

BINDER.

(1) Each offeror must submit a Technical Proposal and a Price Proposal. The Technical Proposal and the Price Proposal must be submitted as separate volumes. Both the Technical and Price Proposal shall be paginated (contain consecutive page numbers on each page).

(2) The outside cover of each separate volume (Vol 1 – Technical; Vol 2 – Price) must be clearly marked to indicate its contents and the identity of the Offeror. Additionally, identify the “original” Technical proposal and the “original” Price proposal on the outside cover.

(3) Both the Technical Proposal and the Price Proposal must be received by the closing date and time set for receipt of proposals.

(4) Pricing Schedule, Vol 2, shall be completed in full.

(5) Do not include any dollar amounts in the Technical Proposal that are taken from the Price Proposal.

(6) All information intended to be evaluated as part of the Technical Proposal must be submitted within the Technical Proposal. Do not cross-reference material in the Price Proposal, or vice versa. Also, do not include links to websites in your proposal. Technical Proposals will not be provided to the price team and Price Proposals will not be provided to the technical team. Therefore, information submitted in the wrong Volume could lead to the proposal being determined “unacceptable” if materially incomplete in any aspect.

(7) Do not attempt to modify the terms and conditions of the solicitation in the technical or price proposal or add conditions or qualifications to your offer. Should the offeror include terms and conditions that conflict with the terms and conditions of the Solicitation, the offer may be determined "unacceptable" and thus ineligible for award. Any questions related to specific terms and conditions contained within the Solicitation should be resolved prior to submission of the offer. Notwithstanding the above, the offeror must clearly describe on the Proposal Cover Sheet submitted with the Price Proposal any modifications to the contractual and/or technical terms and conditions of the solicitation contained in the Offer.

(8) Failure to submit required documents or failure to properly complete documents may result in rejection of the offer without further evaluation. Therefore, offerors are urged to follow instructions carefully and to speak with the Contracting Officer if the offeror does not understand any part of the Solicitation.

Discussions:

The Government intends to evaluate proposals and award a contract without discussions. However, the Government reserves the right to hold discussions if it determines that discussions are necessary.

Therefore, proposals should be submitted on the most favorable terms that the offeror can submit to the Government.

b. General Instructions:

(1) Submit only the documents specifically required in this section. Do not submit excess information;

do not include audio-visual materials, electronic media, etc.

(2) Use only 8 ½ by 11 inch paper or A4 paper for hard copy submissions, unless another paper size is specifically authorized elsewhere in this section for a particular submission. Do not use foldouts (e.g., 11” x 14” or 11” x 17” sheets). Do not use a font size smaller than Times New Roman, 10, or an unusual font style such as script, or condensed print for any submission. All page margins must be at least one inch wide, but may include headers and footers. All pages must be numbered.

(3) The preferred method for assembling your proposal is to use three-ring binders; however, the use of pressboard or other report covers with compression or other type fasteners is acceptable. Do not use spring clamps or exceed the recommended capacity of the fastener or binder. Do not use plastic multi-hole/spiral binding systems, heat-binding systems, or other systems, which do not facilitate the ready insertion of additional pages. Do not include loose papers.

(4) References to “Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the offeror’s technical proposal. Offerors that include in their proposals information they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must clearly mark their proposals in accordance with the instructions at FAR 52.215-1, “Instructions to Offerors— Competitive Acquisition,” paragraph (e), “Restriction on disclosure and use of data .”

(5) In the case of an offeror that is part of a large, multi-segmented business concern, provide information directly pertaining to the specific segment of the business concern (i.e., the division, group, unit, etc.) that will perform work under the prospective contract.

(6) For submissions with page limitations, the pages will be counted as follows: One side of the paper is one page; information on both the back and front of one sheet of paper will be counted as two pages. Pages furnished for organizational purposes only, such as a “Table of Contents” or divider tabs, are not included in the page limitation.

9. INSTRUCTIONS FOR SUBMISSION OF JOINT VENTURE AGREEMENTS

a. A Joint Venture offeror must submit with its technical proposal a copy of the joint venture agreement upon which the Joint Venture organization has been formed. The joint venture agreement must indicate that the Joint Venture is in existence as of the date and time that proposals are due to be submitted; or, alternatively, that the Joint Venture will automatically take legal effect immediately upon notification to the joint venture of contract award.

b. The joint venture agreement must be signed by a representative of each Joint Venture partner who has the requisite authority to bind the partner to the agreement, with the chief executive of each entity identified.

c. To be acceptable to the Government, the joint venture agreement must clearly state within its terms that each member of the Joint Venture is jointly and severally liable for all of the obligations of the Joint Venture itself with respect to completion of all work and services under the contract expected to result from the Solicitation.

d. The terms of the Joint Venture must detail, in terms of percentages, where appropriate, the relationship of the Joint Venture parties in terms of business ownership, capital contribution, and profit distribution or loss sharing.

e. Additionally, the joint venture agreement must specify who among the joint venture partners is authorized to sign the Solicitation's Standard Form 1442, acknowledge the amendments to the Solicitation, if any, and bind the entire Joint Venture to its obligations under any contract, which may result from the Solicitation.
