The w ork consistis of a deep cutoff w all in the Wood River Levee Disctrict and includes environmental protection, site demolition, restoration, geotechnical instrumentation, engineering fabric, stripping, care of w ater, earthw ork, cement-bentonite slurry trench cutoff w all construction and establishment of turf.

The project magnitude is betw een $10,000,000 - $25,000,000.

Site visit w ill be on 25 July at 0900. Offerors are to meet at Mel-Price Lock and Dam Conference Room.

SCHEDULE NOTES

1. All quantities shown on the SCHEDULE are estimated quantities except when the unit is shown as job "JOB".

2. When proposals are solicited on a unit price basis, bidders shall insert in the spaces provided therefor in the SCHEDULE both the "unit price" and the "estimated amount" resulting from applying the said unit price to the estimated quantity shown. In event the bidder quotes only a total price ("estimated amount") in its bid and fails to quote the unit price, the Government will determine such unit price by dividing the total price quoted by the quantity of the item set out in the SCHEDULE. The bidder agrees that the unit price so determined shall be used for the purpose of bid evaluation, award and all payments to the Contractor including final payment.

3. All extensions of the unit prices shown will be subject to verification by the Government. In case of variation between the unit price and the extension, the unit price will be considered to be the proposal and the extension will be corrected accordingly.

4. If a modification to a bid based on unit prices is submitted, which provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to each unit price in the bid schedule must be stated. If it is not stated, the bidder agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the bid schedule.

5. Bidders are required to propose all items listed on the Schedule in addition to inserting a total quoted bid in the appropriate space provided.

Failure to do so will be considered good cause to disqualify the bid.

6. Bidders are encouraged to pay particular attention to the requirements on lab “validation” in Section 01 14 40 of the contract specifications.

7. EVALUATION OF SUBDIVIDED ITEMS (MAR 1995) UAI 52.211-5001

Item Nos. 0009, 0010, 0011, 0012, 0014, 0016, 1007, 1008, 1010, 1011, and 1014 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its sub-items.

8. VARIATIONS IN ESTIMATED QUANTITIES - SUBDIVIDED ITEMS. UAI 52.211-

5001. This variations in estimated quantities clause is applicable only to Item Nos. 0009, 0010, 0011, 0012, 0014, 0016, 1007, 1008, 1010, 1011, and 1014.

(a) Variation from the estimated quantity in the actual work performed under any second or subsequent subitem or elimination of all work under such a second or subsequent subitem will not be the basis for an adjustment in contract unit price.

(b) Where the actual quantity of work performed for Item Nos.

0009, 0010, 0011, 0012, 0014, 0016, 1007, 1008, 1010, 1011, and 1014 is less than 85 percent of the quantity of the first subitem listed under such item, the Contractor will be paid at the contract unit price for that subitem for the actual quantity of work performed, and, in addition, an equitable adjustment shall be made in accordance with the Contract Clause FAR 52.212- 11, Variation in Estimated Quantities.

(c) If the actual quantity of work performed under Item Nos. 0009, 0010, 0011, 0012, 0014, 0016, 1007, 1008, 1010, 1011, and 1014 exceeds 115 percent or is less than 85 percent of the total estimated quantity of the subitems under that item, and/or if the quantity of work performed under the second subitem or any subsequent subitem under Item Nos. 0009, 0010, 0011, 0012, 0014, 0016, 1007, 1008, 1010, 1011, and 1014 exceeds 115 percent or is less than 85 percent of the estimated quantity of any such subitem, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the Contract Clause FAR 52.211-18, Variation in Estimated Quantities.

9. OPTIONAL BID ITEMS.

Bid Item Nos. 1001-1016 are OPTIONAL ITEMS. Upon the review of inspection at the site, the Contracting Officer, in accordance with the specifications and drawings, will direct the optional bid item work as needed. The Contractor shall perform the appropriate work ONLY when directed by the Contracting Officer. The Government is not obligated to request any work under any optional item(s). The bid prices for each optional item shall represent your firm price to perform that service. Payment will be made ONLY for work actually requested and performed to the Government’s satisfaction.

The work pertaining to OPTIONAL ITEMS 1001 – 1016 shall be priced, however funding and actual work may be delayed until February 2020.

INSURANCE

REQUIRED INSURANCE

(a) As required by the Contract Clause entitled "Insurance—Work on a Government Installation", the Contractor shall furnish to the Contracting Officer, prior to the commencement of work, a certificate or written statement as evidence of the minimum insurance listed below. The Contractor shall procure and maintain such types and amounts of insurance during the entire period of his performance under this contract. The Contractor shall assure that the certificate or written statement is in accordance with required wording indicated in paragraph b of the aforementioned Contract Clause.

(1) Workmen's Compensation – Amounts required by applicable jurisdictional statutes.

(2) Employer's Liability Insurance – $100,000.00

(3) Comprehensive General Liability Insurance – (No property damage liability insurance is required.)

Bodily Injury — $500,000 per occurrence

(4) Comprehensive Automobile Insurance –

Bodily Injury — $200,000 each person $500,000 each accident Property Damage — $ 20,000 each accident

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)

(a) Definitions. As used in this clause--

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. (See 29 CFR 4.173)

HOLIDAYS: A minimum of ten paid holidays per year: New Year's Day, Martin Luther King Jr.'s Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day. (A contractor may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the employees involved.) (See 29 CFR 4.174)

THE OCCUPATIONS WHICH HAVE NUMBERED FOOTNOTES IN PARENTHESES RECEIVE THE FOLLOWING:

1) COMPUTER EMPLOYEES: Under the SCA at section 8(b), this wage determination does not apply to any employee who individually qualifies as a bona fide executive, administrative, or professional employee as defined in 29 C.F.R. Part 541. Because most Computer System Analysts and Computer Programmers who are compensated at a rate not less than $27.63 (or on a salary or fee basis at a rate not less than $455 per week) an hour would likely qualify as exempt computer professionals, (29 C.F.R. 541.

400) wage rates may not be listed on this wage determination for all occupations within those job families. In addition, because this wage determination may not list a wage rate for some or all occupations within those job families if the survey data indicates that the prevailing wage rate for the occupation equals or exceeds $27.63 per hour conformances may be necessary for certain nonexempt employees. For example, if an individual employee is nonexempt but nevertheless performs duties within the scope of one of the Computer Systems Analyst or Computer Programmer occupations for which this wage determination does not specify an SCA wage rate, then the wage rate for that employee must be conformed in accordance with the conformance procedures described in the conformance note included on this wage determination.

Additionally, because job titles vary widely and change quickly in the computer industry, job titles are not determinative of the application of the computer professional exemption. Therefore, the exemption applies only to computer employees who satisfy the compensation requirements and whose primary duty consists of:

(1) The application of systems analysis techniques and procedures, including consulting with users, to determine hardware, software or system functional specifications;

(2) The design, development, documentation, analysis, creation, testing or modification of computer systems or programs, including prototypes, based on and related to user or system design specifications;

(3) The design, documentation, testing, creation or modification of computer programs related to machine operating systems; or

(4) A combination of the aforementioned duties, the performance of which requires the same level of skills. (29 C.F.R. 541.400).
