Contracting Officer Determination Brand Name

The U.S. Army Corps of Engineer (USACE), Clarence Cannon Dam and Mark Twain Lake Project Office intends to make contract award pursuant to the authority of FAR 16.505, Ordering, for the purposes of providing written consent and approval to award Brand Name ABS/Sulzer submersible sewage pumps.

Clarence Cannon Dam and Mark Twain Lake has a requirement to procure six ABS/Sulzer non-clog submersible grinder sewage pumps.

In accordance with FAR 16.505(a)(4) The following requirements apply when procuring items peculiar to one manufacturer (i) The contracting officer must justify restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer).

One of the many problems encountered at the lake facilities is maintaining sewage systems that, in the past, were designed with a wide variety of pumps and control systems. The variation in pumps led to inefficiencies and caused pumps to fail. The facility already has 64 pumps in service. The requirement is to have spare pumps on hand when a pump fails. This immediate repair will prevent Mark Twain Lake from receiving citations and clean-up costs associated with sewage loss on the ground surface or public water supply. The hardware in the wet-wells is designed for the specific pumps and would require structural changes to the wet-well, costing approximately $30,000 to $50,000 each depending upon the individual lift station, with another brand pump. Additionally, the electrical components in the control cabinets are designed for specific pumps and are not interchangeable. The project currently has 18 stations with control cabinets compatible with Sulzer pumps, with cost advantages to the Government by a reduced requirement for spare pumps.

Based on the above and in accordance with FAR 16.505(a)(4)(i), it is hereby determined that Brand Name ABS/Sulzer products are the only products compatible with existing Mark Twain Lake lift stations and control panels, therefore in the best interest of the Government to procure Brand Name ABS/Sulzer products.
