To be determined a responsible contractor, Offerors must meet the following general standards:

(a) Have adequate financial resources to perform the contract or the ability to obtain them.

(b) Be able to comply with the required or proposed delivery or performance schedule taking into consideration all existing commercial and Governmental business commitments.

(c) Have a satisfactory performance record.

(d) Have a satisfactory record of integrity and business ethics.

(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them.

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them.

(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

2. GENERAL TECHNICAL CRITERIA

a. Significant omission(s) may cause the technical proposal to be rejected as unacceptable.

b. Proposals which are generic, vague, or lacking in detail may be considered unacceptable. The offeror’s failure to include information that the Government has indicated should be included may result in the proposal being found unacceptable if inadequate detail is provided.

c. The Government cannot make award based on an unacceptable offer. Therefore, receipt of an “UNACCEPTABLE” rating for any non cost factor will make the offer ineligible for award, unless the Government elects to enter into discussions with that Offeror and all deficiencies are remedied in a revised proposal.

d. Offerors may NOT be credited with the past performance of a separate corporation, whether that of a parent, affiliate or subsidiary, unless the proposal clearly establishes that the resources of those companies will be available for performance on the contract to be awarded.

3. BASIS OF AWARD

Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors. Technical acceptability will be determined first. Then, only the technically acceptable offers will be evaluated for price and an award made. The Government reserves the right to accept other than the lowest price offer if the lowest priced offer is not technically acceptable.

4. SOURCE SELECTION USING THE LOW-PRICED, TECHNICALLY ACCEPTABLE PROCESS.

An evaluation for acceptability will be performed on each proposal in accordance with FAR 15.101-2(b) (3). The proposal that provides the lowest price and is otherwise technically acceptable in all non cost factors will be selected for award. To be considered technically acceptable, no technical factor in the proposal may be determined unacceptable. The failure of a proposal to meet any of the non cost factors will result in a technically unacceptable rating and preclude award.

5. EVALUATION OF THE PRICE PROPOSALS

C-18

a. Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness. They may also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.

b. The otherwise technically-acceptable, lowest-priced offeror may be required to verify its price on a CLIN, element, or total price basis, prior to contract award at the Government’s request and discretion.

6. EVALUATION OF THE TECHNICAL PROPOSAL

FACTOR I: PAST PERFORMANCE: The Government will review and evaluate information submitted by the Offeror for past performance. Offeror must have substantially performed a minimum of three (3) projects, within the last five (5) years, involving general fish cleaning stations and waste removal work similar to the complexity and value of the work described by the scope of work of this solicitation. Offeror must demonstrate the following minimum acceptability standards to receive an “ACCEPTABLE” on this factor:

Past Performance Evaluation Ratings Rating

Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the past performance is not available or so sparse that no meaningful past performance rating can be reasonable offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” Offerors who have past performance records and do not provide/submit past performance information will receive an “UNACCEPTABLE” rating for this factor.

Data Sheets. The Contractor shall complete minimum of three (3), not more than five (5), “DATA SHEET PERFORMANCE SURVEY” forms attached at the end of this section in response to this factor. All blocks must be filled in and all data should be accurate, current, and complete. All projects submitted must have been underway or completed within the last 5 years. Contractor shall adhere to Data Sheet format shown above on page 8.

Aspects of Past Performance Evaluation The past performance evaluation results is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements. There are two aspects to the past performance evaluation. The first is to evaluate whether the offeror’s present/past performance is relevant or not relevant to the effort to be acquired. The criteria to establish what is recent and relevant shall be unique to each LPTA source selection. Therefore, the solicitation shall establish the criteria for regency and relevancy in relation to the specific requirement being procured. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract history would give the most confidence that the offeror will satisfy the current procurement. The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.

The Technical Proposal will be evaluated based on the following evaluation criteria:

C-19

The Government will evaluate the information submitted to determine if it is technically acceptable by meeting the minimal requirements for this factor. To be rated as acceptable, all of the minimum technical capability performance requirements must be met by the proposal, and past performance evaluations must be acceptable.

Technical Acceptable/Unacceptable Ratings Rating

Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Failure to demonstrate the minimally acceptability standards under this factor will result in an “UNACCEPTABLE” rating and elimination from further consideration for contract award.

FACTOR II: TECHNICAL CAPABILITY

There are two subfactors under Factor 2: Technical Capability:

Subfactor A (Work Plan) Subfactor B (Personnel)

Subfactor A (Work Plan): The Government will evaluate an offeror’s planned approach for providing sufficient technical resources (labor, equipment and materials) that would be commensurate with the successful accomplishment of the project as specified. For the general fish cleaning stations and waste removal work tasks within this solicitation, the offeror shall submit separate work plans for the required services and support in a quality and safe manner that meets the required task duration. These general contract tasks shall be broken in the following groups (numbers represent tasks within the Bid Sheet):

a. Waste Removal (0001-0002)

b. Fish Cleaning Stations (0003)

The offeror must submit a work plan for each group that demonstrates an adequate understanding of the task scope and demonstrates an approach for providing adequate and safe technical resources for the project requirements.

Subfactor B (Personnel): The Government will evaluate appropriate information for the following work staff.

1. Project Manager/Supervisor Resume: Must have a minimum of three years experience within related disciplines in accordance with the Statement of Work, including project organization, coordination, supervision and administrative functions.

2. Offeror must submit a staffing roster or personnel sheet to support the work plan.
