SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

CONTINUATION PAGE

Question #1: The answer to FAQ Question 4 states “If a Prime Contractor proposes the use of a sub-contractor to meet the security guard license requirement, the prime contractor must be included, among other instructions in the proposal: sub-contractor’s state of LA license and a signed letter of commitment from the sub-contractor to the prime contractor” Will the Government consider amending this language to allow bidders whose state license is in process to bid as a prime and self-perform on this requirement?

Government answer: Government will accept bidders whose state license is “in process”, provided written proof of bidder’s state license submission is provided. Offerors must possess the required license at the time of award to be eligible for award.

Question #2: The potential question is whether the MECS plan required to be submitted with the proposal is considered part of the Emergency Response Plan (Factor 2 in Vol I) or a separate appendix (excluded from page count). MECS is mentioned in the PWS I believe.

Government answer: A separate Mission-Essential Contractor Services Plan is not required as contractor meeting PWS deliverables is the MECS standard.

Question #3: What is the expected start date?

Government answer: The current contract expires 27 November 2023. A new contract will need to be in place prior to expiration.

Question #4: Are all of the required training subjects from AR-190-56 provided by the government as indicated in the Basic Training Requirement table on page 59? Or is AR-190-56 to be completed by the contractor as indicated in section 2.26 on page 26?

Government answer: The Government will accept company provided training that meets the requirements of AR- 190-56 training. The Government can provide detailed lesson plans for the contractor, after contract award, for presentation by company training personnel.

Question #5: Can our guys work an entire shift (until 2200 instead of drawing down at 1800)? Section 3.3 in the PWS states that guards may not work greater than 10-hours in a 24-hour period. Therefore, the contractor’s CSGs and SSSGs are required to work an 8-hour or 10-hour shift each day. However, section 3.3.1 states that the USACE facility operates using a 12-hour rotation for day shift (6 CSGs) and night shift (3 CSGs). By reducing the number of contract guards at the MVN HQ building from 6 to 3 at 18:00, 3 CSGs of the second shift will be sent home at 18:00 during the middle of the second eight-hour shift (14:00-22:00). Is it possible to maintain the full contingent of 6 CSG guards on duty at MVN HQ until the second shift concludes at 22:00? This will assist the contractor in keeping guards on a straight 8-hour rotation and not having 3 CSGs leave after working only four hours on the 14:00-22:00 shift.

Government answer: The Government will accept contractor employees working longer than 10 hours in a 24-hour period, provided performance is not degraded or compromised.

Question #6: Is it the intent of USACE that every CSG and SSSG complete the entire 64-hour course every year as the Annual Training?

Government answer: The 64-hour initial training course is mandatory, yearly refresher training.

Question #7: PWS 11, #Q20 is regarding the Tier 3 investigation for personnel and asking for clarification on whether an FCL (Facility Clearance Level) is required to perform on this contract. USACE answered that "an FCL is not required for this contract," which seems to contradict PWS 2.12.1 and 2.12.2. These sections state that a Tier 3 Investigation by DCSA is a mandatory minimum requirement for "all persons on this contract." T3 is DCSA's secret level clearance which would also require the contractor to have a minimum secret clearance in order to employ anyone with a clearance. Please clarify.

Government answer: An FCL is not required to perform this contract. All contract personnel performing on this contract are required to have a Favorable T3 investigation, without adjudication. Put another way, all contract personnel will have favorable T3 investigations, without being granted SECRET clearances.

Question #8: Section 2.1 of the SOW states “PM shall have a minimum of 8 years of experience in law enforcement or military service, with a minimum of 2 years in a supervisory role.” Does a PM who has a demonstrated track record of PM for security contract(s) of this size or larger for the same period qualify?

Government answer: Yes, the Government will accept a PM who has a minimum of 8 years’ experience as a PM for security contract(s) of this size or larger.

Question #9: The Government provides wage determination 2015-5189 Rev 24, dated 12/27/2022 for this proposal, however, 2015-5189 revision 25 dated 7/25/2023 is the active wage determination for the area in question. Does the government acknowledge Rev 25, and will it provide this version for guidance on this proposal?

Government answer: Wage Determination 2015-5189 Rev. 25 dated 7/25/2023 is in effect and is included in this amendment to the solicitation.

Question #10: Executive Order 14026 calls for a minimum wage of $16.20, which is higher than that listed on the Wage Determination. Does the government recognize that the executive order minimum wage is in effect for this proposal, and that offerors are required to use that as a reference for minimum wage to be paid to officers?

Government answer: FAR Clause 52.222-55, Minimum Wages for Contractor Workers Under Executive Order 14026 (JAN 2022) is included in the solicitation.

Question #11: The Government has indicated in frequently asked questions that offerors should ask the incumbent for a seniority list in order that accuracy and parity can be achieved in pricing offerings. As the incumbent is not under any obligation to provide this information to offerors (and it may be in direct conflict of interest if, in fact, the incumbent is re-competing), will the Government re-consider and provide this critical seniority list, for the aforementioned reasons? (note: the incumbent is required to provide such a list to the government upon request).

Government answer: DOL - WD successorship determinations are not required for this solicitation as the incumbent does not have a collective bargaining agreement with their workforce. DOL Wage determinations for prevailing wage and fringe benefits must be followed.

Question #12: Who is the incumbent?

Government answer: NGLR SECURITY, LLC.

Question #13: Reference is made to PWS 2.15 wherein it is stated, "It is required that the Contractor or major sub-contractor have the Louisiana state licenses in place at the time of proposal." Will the government consider changing the language to read "in place at the time of award"? This will still not delay contract start.

Government answer: Replace PWS 2.15 as follows:

“PWS 2.15 Guard Certifications and Licenses: For the purpose of performance under this Contract, the Contractor shall employ armed security guards who have been certified by the state of Louisiana. Additionally, the Contractor shall provide all necessary certifications and licenses for the FTO to allow for certification of the FTO by the KO as the recognized trainer for this Contract. It is required that the Contractor or major sub-contractor have the Louisiana state licenses in place at the time of award. Each SSSG and CSG persons employed under this Contract will require a valid Louisiana State-issued Armed Security Officer (Guard) Registration Card prior to Notice to Proceed.”
