About this file

This modification amends a solicitation for the Mississippi River and Tributaries Old River Low Sill Structure dewatering project in Concordia Parish, Louisiana. The U.S. Army Corps of Engineers Engineering District New Orleans seeks to dewater multiple gate bays, inspect concrete, and perform repairs on vertical lift gates, rails, and needle dams. The deadline for proposals is extended to August 1, 2023, with award anticipated in September 2023. Offerors must demonstrate experience with similar concrete repair projects. The scope involves diving inspections, performance testing of anchorages, and potential localized cofferdams for installation and testing of upstream and downstream anchors on piers. Questions and answers provide clarification on procurement of optional repair materials, submittal review timelines, use of floating plant during inspections, dredging requirements if needed, cover requirements for installed anchorages, and lifting capabilities of supplied drill rigs.

AMENDMENT 0003 ANSWERS

Amendment 0003 Mississippi River and Tributaries

Old River Low Sill Structure (ORLSS) - Dewatering W912P8-23-R-0041

*Numbering of Questions and Answers are continuous across amendments.

32. QUESTION: Specification Section 03 01 00 paragraph 1.2 indicates that this section applies to Inspection of Gate Guide Assembly, Vertical Lift Gate Rail Concrete Repair, and Downstream and Upstream Needle Seat Repair. Paragraph 1.6.3.3 states “The contractor performing the repair work must have been involved in a minimum of five concrete repair projects similar in size and scope to this project for at least five years.” Please verify that this qualification requirement only applies to the Vertical Lift Gate Rail Concrete Repair.

RESPONSE: The above mentioned experience requirement applies to all types of concrete repairs specified in the contract specifications.

33. QUESTION: How will contract days be counted in regard to allowed low water time? Based on the historic hydrographs, the best odds to have low water to work is July – November. The current time line is Bid 7/31/2023 – late award 10/29/2023, contract days 614, contract completion 7/4/2025. If we only get one month of work in 2024 there likely will not be more time prior to the end of the contract period. Please clarify.

RESPONSE: Reference Section 01100 Paragraph 1 TIME EXTENSIONS FOR UNUSALLY

SEVERE WEATHER.

34. QUESTION: If the government gives a time extension due to high water conditions not allowing the low water work to occur, will the contractor be paid for the costs associated with this time extension? That time risk is too much for the contractor to take as the project could turn into a 2 year project if not worse. In 2019 no work would have occurred based on river elevations.

RESPONSE: No. Reference Section 01100 Paragraph 1 TIME EXTENSIONS FOR

UNUSALLY SEVERE WEATHER.

35. QUESTION: Bid items "Removal and Installation of Gate Guide Rail and Assembly Hardware - OW", and Removal and Installation of Gate Tread Rail and Assembly Hardware - OW" both state they will be measured by each. Please clarify they quantities of 142 and 243 respectively when it appears each hardware component is measured individually under separate bid items.

RESPONSE: Reference Section 34 11 00 Paragraph 1.2.2. The option work Contract Line Item Numbers (CLINs) separate fabrication of the gate rail and assembly hardware from the removal and installation of the gate rail and assembly hardware. The quantities are as specified in the CLINs. If option items requiring the fabrication of gate rail and hardware have been executed by the Government, the Contractor shall have all fabricated rail and hardware components onsite prior to the commencement of any dewatering activities. After review of the Contractor submitted Gate Rail Inspection Report, the Contracting Officer may direct replacement of these components by exercising the respective option work repair CLINS.

36. QUESTION: Please clarify how the Contractor is to procure the option repair materials. It is our understanding that the government will not decide on repairs until after the gate bay is dewatered and inspected, but specification section 34 11 00 paragraph 3.9.1 states “If option items requiring the fabrication of gate rail and hardware have been executed by the Government, the Contractor shall have all fabricated rail and hardware components on site prior to the commencement of any dewatering activities.” Shouldn’t this put the procurement of the optional repair materials as base bid items?

RESPONSE: See Response to Question #4.

37. QUESTION: Can the government provide the results from the 1987 inspections as offered in specification section 35 20 16.62 12 paragraph 3.2.5 and referred to in note 2 on sheet SC307.

RESPONSE: Reference Solicitation Amendment #0002 Appendix E.

38. QUESTION: Will the contractor be allowed to utilize floating plant during the initial inspections specified in paragraph 3.2 of section 35 20 16.62.12?

RESPONSE: Yes.

39. QUESTION: Specification section 01 33 00 paragraph 1.9 states “Adequate time (a minimum of 30 calendar days exclusive of mailing time) shall be allowed and shown on the register for review and approval.” Several other districts have dropped this to 14 days or less.

With the aggressive schedule, will the government lower this to 14 days?

RESPONSE: No. Submittal review time shall be as specified in Section 01 33 00 paragraph 1.9.

40. QUESTION: Paragraph 3.2 of section 35 20 16.62.12 states “Use results of survey to determine where barge can spud down.” Are we not allowed to spud down upstream and downstream of the existing aprons (100’ upstream and 110’ downstream)?

RESPONSE: Reference Section 01100 Paragraph 25 e (1).

41. QUESTION: Paragraph 3.2.4 of section 35 20 16.62.12 requires the contractor to submit a diving inspection report. Does this require approval prior to finalizing fabrication drawings?

RESPONSE: Yes. Reference Section 35 20 16.62.12 Paragraph 3.2 (4). USACE will need to review and approve the Diving Inspection Report and the Performance Anchor Testing Report prior to approval of final fabrication drawings.

42. QUESTION: Paragraph 3.2.4 of section 35 20 16.62.12 requires the contractor to submit a diving inspection report. If this requires approval prior to finalizing fabrication drawings, will the government utilize the full 30 days?

RESPONSE: Submittal review time shall be as specified in Section 01 33 00 paragraph 1.9.

43. QUESTION: At the pre-bid site visit it was stated that the government has permitted for dredging. Does the permit allow for side casting the material or does the material need to be hauled off site?

RESPONSE: Dredging is not a contractual requirement. Reference Section 35 20 16.62 12 Paragraph 3.1. (4).

44. QUESTION: Plan Sheet S-001 Anchorages Note 5 states “Cover anchorage in Piers with 3-inch UHMP strip or thicker as required to fully cover anchors. Please verify that this is only required to protect the anchors after completion of the work.

RESPONSE: Upon completion of the anchorage installation and testing, Contractor shall cover the anchorages as described in Plan Sheet S-001 Anchorages Note 5. The anchorages shall remain covered when not in use (i.e. anchorage cover removed to install cofferdam components) and at the completion of the work.

45. QUESTION: Please verify that the government supplied drill rig has lifting eyes capable of supporting the weight of the drill rig.

RESPONSE: The Government supplied CME-850X drill rig has two lifting rings on the front and two additional lifting rings on the rear.

46. QUESTION: What is the turn around time on diving submittals, with working 24/7 and likely multiple diving crews there is high probability of turnover and need to submit replacement personal and/or equipment.

RESPONSE: The original dive plan submittal review time shall be as specified in Section 01 33 00 paragraph 1.9. Once the original dive plan submittal is approved, amendments to the dive plan for replacing equipment and/or personnel can be quickly turned around if submitted during Government’s normal business hours, Monday – Friday, excluding Federal Holidays.

47. QUESTION: Currently the solicitation only requires past performance, small business participation and cost/price. It is our experience on the more technical projects that a technical write up in terms of work methods is required. The government acknowledges in the mandatory site visit that “Due to the complex nature of this work, a site visit is mandatory for each prospective bidder in order to view the existing conditions” With that being said we feel it could be beneficial to the government to require a technical write up. Please clarify but certainly more time would be needed to supply a technical write up.

RESPONSE: No Technical will be evaluated. See Section 00700 PROPOSAL EVALUATION

CRITERIA.

48. QUESTION: Specification section 35 20 16.62 paragraph 2.1.11 discusses localized cofferdam work for gates 1 thru 4 and 8 thru 11. How does the government envision this work happening for gates 5 thru 7?

RESPONSE: Installation and testing of the anchorages shall be in accordance with Section 05 05 20.00 27 and Section 35 20 16.62. Gate bays 5 through 7 require pier anchorages for the safety girder installation (upstream and downstream). Depending on the river stages, a localized cofferdam might be required to execute installation and testing of the anchorages in accordance with the above mentioned specifications.

49. QUESTION: Specification section 35 20 16.62 paragraph 2.1.11 discusses localized cofferdam work for gates 1 thru 4 and 8 thru 11. Please verify that this is for the upstream needle dam only and not both upstream and downstream.

RESPONSE: Installation and testing of anchorages shall be in accordance with Section 05 05

20.00 27 and Section 35 20 16.62. This applies to both upstream and downstream anchorages.

50. QUESTION: Specification section 35 20 16.62 12 paragraph 3.2.1.5 states “Measurements must be reviewed by the COR prior to the fabrication of the needle dam components.” To do this, we must beat the spring rise. When does the government anticipate award?

RESPONSE: Government anticipates award in September 2023.

51. QUESTION: Specification section 35 20 16.62 12 paragraph 3.2.1.5 states “Measurements must be reviewed by the COR prior to the fabrication of the needle dam components.” To do this, we must beat the spring rise. Some years this happens as early as mid-January. Will the government expedite start up and diving submittal review to make this happen?

RESPONSE: Reference Response to Question #15.

52. QUESTION: Specification section 35 20 16.62 12 paragraph 3.2.1.5 states “Measurements must be reviewed by the COR prior to the fabrication of the needle dam components.” To do this, we must beat the spring rise. Will the government give a contract extension if the water levels do not get below elevation 45 until the fall low water season as happened in 2016 and 2019?

RESPONSE: Reference Section 01100 Paragraph 1 (a) (3).

53. QUESTION: I am writing to confirm the dive spec included with the RFP that references compliance with NAVSEA 03150-001A, 03151-001, and 5100-017. These are Navy documents not typically required of USACAE projects for diving services; and I can not locate the specs.

Can you please confirm whether these are intended to be part of the requirements and if so, provide copies or links?

RESPONSE: Section 00 73 75.00 12 Paragraph 1.3 REFERENCES has been updated as follows:

U.S. ARMY CORPS OF ENGINEERS (USACE)

EM 385-1-1 (2014) Safety – Safety and Health Requirements Manual

ER 385-1-86 (2021) U.S. Army Corps of Engineers Dive Program

NAVAL SEA SYSTEMS COMMAND (NAVSEA)

NAVSEA 03150-001B (2021) Navy Diving Program

NAVSEA 03151-001B (2022) Diving and Manned Hyperbaric System Safety Certification

Program.

OFFICE OF THE CHIEF FOR NAVAL OPERATIONS (OPNAV)

OPNAV M-5100.23 (2020) Navy Safety and Occupational Health Manual

In addition, Section 00 73 75.00 12 Paragraph 1.6 HEALTH REFERENCES has been updated as follow: “Equipment and procedures shall comply with the most stringent of the following for the particular application: EM 385-1-1; ER 385-1-86; NAVSEA 03150-001B; NAVSEA 03151-

001B; OPNAV M-5100.23. “

RESPONSE: See response to question #22.

55. QUESTION: Response to Question #4 (Amendment #0002) states that there is an SF30 with a revised bid submission date, but we don’t see that it was attached. Is there a revised bid date?

RESPONSE: Please see this SF30 that extends the RFP submission date to 01 Aug 2023.

56. QUESTION: There are several questions (Questions 17-19, 23, and 31 in Amendment #0002) about small business participation under this contract. The confusion is that we are not sure what the threshold of an “Acceptable” SBPP is and the goals are difficult to meet on this type of a contract. Can you please clarify if an offeror does not meet the current New Orleans District goals, will the plan be “Acceptable”?

a. I.e., the ‘current USACE New Orleans Annual Small Business Goal’ is listed as 46% for small business. If an offeror proposed say 10% (arbitrary number, just for example) with justification of why they are not meeting the goals, could that be considered “Acceptable”?

RESPONSE: The goals provided are annual goals for USACE New Orleans for each category.

It is not anticipated that an offeror’s proposal meets New Orleans District goals in each category.

Please see evaluation criteria794613.

57. QUESTION: It appears that there is another amendment coming as there are some questions still not answered. Can you let us know when to expect it?

RESPONSE: Please see this SF30 and responses to questions.
