REAL ESTATE APPRAISAL SERVICES FOR THE ATCHAFALAYA BASIN FLOODWAY
SYSTEM PROJECT
SUBJECT: Real Estate Appraisals for Acquisitions Required for the Atchafalaya Basin Floodway System Project, USACE New Orleans, Blanket Purchase Agreement Contract.
I. BACKGROUND
This contract involves the appraisal of land and improvements in connection with the Atchafalaya Basin Floodway Project (ABFS) located in southcentral Louisiana. The project consists of real property acquisitions for environmental protection and flood control related to the Mississippi River System. The purpose of the appraisals is to assist the client agency in acquiring the real property rights required for the project in accordance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, Public Law 91- 646, Title 49 CFR Part 24.
The entire Atchafalaya Basin is located in south-central Louisiana and extends from the confluence of the Mississippi, Red and Atchafalaya Rivers near Simmesport, Louisiana to the Gulf of Mexico south of Morgan City.
The ABFS project is in the Acadiana area of Louisiana and includes parts of Saint Laundry, Pointe Coupee, Iberville, Iberia, Saint Martin, and Saint Mary Parishes. The 833,000-acre Lower Atchafalaya Basin Floodway is bounded on the north by U.S. 190, on the east and west by the Atchafalaya Basin protection levees and extends south to the Gulf of Mexico.
The Lower Atchafalaya Basin Floodway System Project has two mutually supporting goals: to preserve the habitat of the nation’s largest and oldest river-basin swamp and to ensure that the Lower Atchafalaya Basin can pass a floodwater of 1.5 million cubic feet per second as required by the Mississippi River and Tributaries Project
(MR&T).
The ABFS Project was authorized by the Flood Control Act of May 15, 1928, Public Law 391; Supplemental Appropriations Act of 1985, Public Law 99-88; Water Resources Development Act of 1986, Public Law 99-662;
Water Resources Development Act of 1988, Public Law 100-202; Water Resources Development Act of 2000, Public Law 106-541; and Water Resources Development Act of 2007, Public Law 110-114.
II. APPRAISER SELECTION
Appraiser shall be a Louisiana Certified General Real Estate Appraiser with a minimum of five years of appraisal experience as a certified appraiser. Appraisers with a professional appraisal designation from a reputable source and/or with experience in Federal or State court are preferred in the selection process. Appraisers should be experienced in appraisals of vacant wooded land, appraising less than fee estates. Appraiser shall have the capacity to complete work assignments within the requested time. Appraisers/firms shall be registered in the System for Award Management located at SAM.gov. Reference the Real Estate Appraiser Selection Criteria document for details on items to be included in offeror’s proposal.
III. DESCRIPTION OF WORK TO BE PERFORMED
Required easement tracts range in size from under one (1) acre to over 1,000 acres. Some affected ownerships contain only one required easement tract while others contain multiple easement tracts. When applicable, timber valuations will be provided per required tract and/or ownership. The appraisals shall be complete appraisal reports in narrative format and must conform to the Uniform Standards for Federal Land Acquisitions (Yellow Book, UASFLA, Current Edition), the Uniform Standards of Professional Appraisal Practice (USPAP, Current Edition) and the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, Public Law 91-646, as amended. The appraisal content and format shall be in accordance with Sections 1 and 2 (Appraisal Development and Appraisal Reporting) of the Yellow Book which is available at the following website:
https://www.justice.gov/file/408306/download. Portable document format (PDF) copies of the appraisal report shall be provided to the U.S. Army Corps of Engineers, New Orleans District, and shall include color photographs of the property being appraised including any improvements and supporting exhibits.
The client and intended user of the appraisal reports are the USACE and/or their assigns. Appraisal reports shall be addressed as follows: Real Estate Division, U.S. Army Corps of Engineers, 7400 Leake Ave, Rm 396, New Orleans, LA 70118
The intended use of the appraisals is to assist the client agency in its determination of the amount to be paid for real property required of the affected ownerships for the project. The effective date of value will be the date of the appraiser’s most recent inspection of the property unless otherwise directed by the USACE.
The appraisals may consist of valuation of the following types of estates: fee, excluding minerals; flowage easement;
developmental control and environmental protection easement; and flowage, developmental control and environmental protection easement. Copies of the estates required of the ownerships and plat maps of same will be provided to the appraiser.
The larger parcel, or parent tract, is that tract or those tracts of land that possess a unity of ownership and have the same, or an integrated, highest and best use. In a partial acquisition, the larger parcel may be different than the tract required and mapped by the USACE. The appraiser must make, disclose, and support a lager parcel determination;
this is an integral part of the highest and best use analysis. Note that Larger Parcel and Parent Tract are synonymous.1 It may not always be appropriate for the Larger Parcel/Parent Tract to be the same as the entire affected ownership.
Personal verification of the comparable sales utilized in the appraisals is required and the appraisers are required by Public Law 91-646 to notify the affected landowner(s) they are conducting an appraisal of their ownership and must offer the landowner(s) the opportunity to accompany the appraisers on the property inspection. USPS Certified mail is the preferred method of landowner notification. The date of the inspection must be included in the appraisal report as well as a copy of the appraisal notification letter to the landowner or their representative with delivery receipt. The USACE review appraiser may also request to accompany the appraiser on the inspection of the affected ownership. On appraisals of such large or inaccessible properties that a physical on-the-ground inspection may be impossible or not useful, the appraiser may utilize the most recent aerial imagery available as the source of property inspection; however, the appraiser must meet with landowner if requested by same.
The contributory value of the timber within a required area is being appraised separately by a contractor of the Government. The timber appraisal reports will be furnished to the appraiser for the contributory value of the timber to be incorporated into the final value conclusion. The timber appraisal shall be included as an exhibit in the appraiser’s appraisal report. The appraiser shall allocate the difference between the before and after market values of the affected property amongst the real property interest to be acquired/Tract ID (land & improvements) and damages and/or benefits to any remainder property (if any).
The affected ownerships within the project area consist of recreational and/or residential land with only a few commercial and industrial properties. Some ownerships consist of several required tracts as indicated on the various ABFS segment maps. Contractors are asked to value all required tracts from an ownership tract in one appraisal report. Payment for the appraisal services is to be based on the number of tracts required from an ownership.
Appraisal reports will be reviewed by a USACE review appraiser for compliance with the rules and procedures summarized above. Payment for services will be recommended after the review process is completed and based on the preapproved appraisal fees.
IV. SCHEDULE AND DELIVERABLES
There are approximately 500 ownerships involved in the project. Multiple appraisal services contracts may be awarded. Assignments will be made by individual BPA Calls and Calls will likely include multiple ownerships. If an assignment is accepted by contractor, appraisals are to be delivered within sixty (60) to ninety (90) calendar days of receipt of a Notice to Proceed (NTP) and legal description and plat map of required tract(s). If the appraiser cannot deliver the appraisal within sixty (60) to ninety (90) calendar days of receipt of NTP and appraisal
1 Interagency Land Acquisition Conference, Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA), 2016 ed., 111.
assignment information, the appraiser must immediately notify the USACE which may elect to cancel and reassign the appraisal assignment at no cost to the Government.
V. MILESTONES AND PAYMENTS
When required, monthly status reports shall be provided by the contractor to a USACE review appraiser. The Contractor shall provide documentation in the form of detailed monthly progress reports that document project activities to date, percent complete, and an outline of future activities, expected dates of completion, and any perceived problems. Upon submittal of each monthly status report, the contractor may invoice for the appraisals completed, reviewed, and accepted by USACE during the reporting period. The following milestones of the appraisal assignment shall be utilized:
Milestone 1 – NTP and Landowner Notification Within one week of receipt of NTP, appraiser shall send appraisal notification letter to affected landowner(s).
Milestone 2 – Property Inspection Within fourteen (14) calendar days after landowner receipt or delivery confirmation of appraisal notification letter, the appraiser should schedule the property inspection and inspect the affected property with the landowner, or from the nearest public right of way if unable to receive permission to enter the property from the landowner or the landowner’s representative.
Milestone 3 – Draft Appraisal Report Within approximately sixty (60) calendar days of receipt of NTP, the contractor shall provide a draft appraisal to the USACE in portable document format (PDF) meeting all industry standards and requirements of this Performance Work Statement.
Milestone 4 – Final Appraisal Report After coordination with the USACE review appraiser to resolve appraisal report deficiencies or lack of compliance with requirements (if any), the appraiser shall provide a final (signed) appraisal report to the USACE within fourteen
(14) calendar days after receipt of USACE reviewer’s comments. All revised and/or final appraisal reports should have report dates reflecting date of final submission to the USACE. Reports are to be submitted to USACE review appraiser in portable document format (PDF).
VI. NEW APPRAISAL ASSIGNMENT OF A PRIOR APPRAISAL ASSIGNMENT
If the required real property acquisition(s) from an ownership needs to be reappraised (i.e., for condemnation proceedings) within one (1) year after the report date of a prior appraisal, and the same contractor is utilized, the fee charged to the Government shall be no more than 50% of the original appraisal fee. If the required real property acquisition(s) from an ownership need to be reappraised beyond one (1) year after the report date of a prior appraisal, and the same contractor is utilized, the fee charged to the Government may be up to the amount of the original appraisal fee. All appraisal fees will again require preapproved by the USACE Real Estate Division.
VII. APPRAISER TESTIMONY
While the vast majority of federal acquisitions do not involve litigation, every appraisal and report should be prepared with recognition of the possibility that the question of value may be litigated, since it is not possible to predetermine which tracts will be acquired amicably. If any appraisal assistance be attained by the contracted appraiser(s), disclose and summarize the extent of any significant real property appraisal assistance.2
As part of this contract, the appraiser may be asked to prepare an appraisal report as of a new effective date, or the date of filing of a Declaration of Taking, to be used for trial (condemnation). The trial appraisal report, which is estimated to occur one to two years after the original appraisal assignment, will be requested as a new assignment to be prepared in accordance with the same specifications as the original appraisal report plus the Federal Rule of Civil Procedure 26(a)(2)(B). The USACE will forward the trial appraisal report to the U.S. Attorney for further action, if
2 The Appraisal Foundation, Uniform Standards of Professional Appraisal Practice (USPAP 2020-2021), Standard Rule 2-2(a)(ix), necessary. Trial preparation and testimony, if required, are not part of this contract and will be negotiated separately under contract with the Department of Justice or the U. S. Attorney’s Office.
VIII. PERIOD OF PERFORMANCE
The term of the appraisal services contracts is for twelve (12) months with options to extend four (4) additional one-year terms. The effective date is the date of award unless otherwise specified by the contract.
IX. CONFIDENTIALITY
The appraiser must protect the confidential nature of the appraiser-client relationship and must act in good faith regarding the legitimate interests of the USACE in the use of confidential information and in the communication of assignment results. The appraiser must not disclose confidential information or assignment results prepared for the USACE to anyone other than a) authorized personnel within the USACE; b) state appraiser enforcement agencies and such third parties as may be authorized by due process of law; and c) a duly authorized professional peer review committee. Appraisers have an extraordinary duty to maintain confidentiality when the acquisition of the property appraised may have to be accomplished by condemnation, and any appraisal report prepared for the purposes of Government acquisition should be considered the subject of potential litigation until such time as the Government has consummated its acquisition.
X. ADDITIONAL INFORMATION
These are Blanket Purchase Agreement contracts with Calls. The minimum appraisals and/or appraisal updates ordered over the life of the contract is 10, with a maximum number of 250 appraisals and/or appraisal updates.
Actual orders, Calls, for tract appraisal or appraisal update services shall be issued by the Contracting Officer’s Representative when needed.

All appraisal fees will again require preapproved by the USACE Real Estate Division.
XVIII. APPRAISER TESTIMONY
While the vast majority of federal acquisitions do not involve litigation, every appraisal and report should be prepared with recognition of the possibility that the question of value may be litigated, since it is not possible to predetermine which tracts will be acquired amicably. If any appraisal assistance be attained by the contracted appraiser(s), disclose and summarize the extent of any significant real property appraisal assistance.4
Attorney for further action, if necessary. Trial preparation and testimony, if required, are not part of this contract and will be negotiated separately under contract with the Department of Justice or the U. S. Attorney’s Office.
XIX. PERIOD OF PERFORMANCE
The term of the appraisal services contracts is for twelve (12) months with options to extend four (4) additional one-year terms. The effective date is the date of award unless otherwise specified by the contract.
XX.
XXI.

REAL ESTATE APPRAISER SELECTION CRITERIA
ABFS Project
Each item described in the list of standards must be met in order for a firm to be considered qualified. If a proposal does not give an adequate description or appropriate reference to demonstrate that the contractor meets the experience, ability, and qualifications standards, it will be considered non-responsive. The Government may award a contract(s) based exclusively on a review of the proposals. Contract award(s) will be made to the contractor who provides the best value to the government, considering price and all other factors.
Following each standard is a description of the information that should be included in the proposals in order for the evaluator to determine that the standard has been met. Proposals will be rated using an adjectival rating system to denote the degree to which the proposals meet the standards. The adjectival ratings will be supported by narrative statements that address the proposals’ strengths, weaknesses and risks. The proposals will be evaluated based on technical experience (50%), price proposed and capacity (30%) and past performance (20%). Minimum technical experience is listed below for each real estate function. Appraiser’s business entity must be registered in the System for Award Management located at SAM.gov.
APPRAISAL TECHNICAL EXPERIENCE
The appraiser must be a Certified General Real Estate Appraiser in the State of Louisiana (include a portable document format [pdf] copy of current appraiser qualifications/curriculum vitae including State certification certificate), have a minimum of five years of appraisal experience as a certified appraiser, and will be evaluated on the following factors:
a) Experience in valuation of real estate for large acquisition projects - For each experience listed, the proposal should include the project name, location of property, number of appraisals prepared, year appraisals prepared, client’s name, and client reference (name and phone number). Please limit experience list to twenty-five (25) assignments or projects.
b) Experience in valuation of partial takings – For each experience listed, the proposal should include the year appraisals prepared, location of affected property, description of the estate(s) appraised, the highest and best use of the property appraised, whether there was severance damage to the remainder, and name of client.
Please limit experience list to twenty-five (25) assignments.
c) Professional appraisal designations – If the appraiser holds any professional appraisal designations from reputable professional associations, the proposal should state the organization’s name, the year the designation was attained.
d) Court testimony experience - The proposal should cite the number of occasions the appraiser has testified as an expert witness in court proceedings or depositions and should include specific references regarding the type of case, the name of the court in which the appraiser testified (if applicable), the client of the appraiser and the approximate date. Please delineate between testimony in Federal Court as opposed to State Court and limit number of citations to ten (10).
PRICE AND CAPACITY
Some affected ownerships contain only one required easement tract while others contain multiple easement tracts.
Price proposals should be submitted for each line item as a price per ownership with only one required parcel and prices per ownership with multiple required tracts. Prices should be submitted for the base year of the contract and for each additional option year. An example for the base year is as follows:
Appraisal Fees Base Year:5 Fee for appraisal of an Ownership with one flowage, developmental
5 Calculations are for illustration purposes only and are not meant to suggest an actual appraisal fee amount.
control and environmental protection easement tract: $100.00 Additional Fee for each additional easement tract required from an ownership: $15.00 Appraisal Fee for Ownership with Three Required Easement Tracts: $130.00 [$100.00 + (2 x $15.00) = $130.00]
The price proposal must include a statement signed by the primary appraiser and any proposed contributing appraiser trainee(s) by which they attest that each has read and understood the scope of work and they understand that this is a firm fixed-price contract and no price adjustments will be made once the contract is awarded. The primary appraiser/appraisal firm must also attest that it has sufficient manpower to handle a production rate of 10 appraisal reports every 90 calendar days.
PAST PERFORMANCE
Satisfactory past performance of similar work for the Federal or State Government is a critical evaluation factor.
Timeliness and quality of the product or service must be addressed. Those offerors with no previous work experience with the New Orleans District of the USACE should submit references that can verify past performance with other government agencies. The proposal must include the Government Agency contact name and phone number. An offeror who does not have past experience with a government agency may not be evaluated unfavorably. In such instance, offeror shall submit other business entity references with contact name and phone number. Please limit Government and other references to ten (10).
