QUESTIONS AND ANSWER
Question Answers
Can you please confirm the PLA requirements for this project?
Confirmed; The solicitation includes 52.222-34 and 52.222-33 Alt I Project Labor Agreement
Is a PLA requirement based on the government estimate or the contractors bid to the government?
The PLA requirement applies to all Large-scale construction projects, which is defined by FAR 22.502 as “a Federal construction project within the United States for which the total estimated cost of the construction contract to the Federal Government is $35 million or more.”
If the requirement is based on the government estimate, can the government provide the precise government estimate prior to the bid date so that contractors can better prepare bids with the anticipation of a required PLA?
No, the government estimate is not releasable.
If the government is unwilling to provide a precise government estimate, can the government please revise the magnitude range posted for the solicitation to a range either above or below $35 million?
No, the magnitude ranges are dictated by DFAR 236.204.
Is a requirement for a PLA subject to the base bid only, or the base bid and all the option work?
The PLA requirement applies to all Large-scale construction projects, which is defined by FAR 22.502 as “a Federal construction project within the United States for which the total estimated cost of the construction contract to the Federal Government is $35 million or more.”
Can you share the Independent Government Estimate (IGE) for this project?
No, the Independent Government Estimate (IGE) is not releasable.
Sam.gov list the subject project as a small business set-aside but page 7 of the solicitation package denotes the project as Unrestricted. Please clarify if this project is a set-aside or unrestricted.
This Solicitation is Unrestricted, Full and Open Competition
Will a PLA be required on the subject project if the value of the awarded contract exceeds $35 Million?
Confirmed; The solicitation includes 52.222-34 and 52.222-33 Alt I Project Labor Agreement
In accordance with FAR 52.222-34, based on the Government’s total estimated construction cost of the contract, will a Project Labor Agreement be required on this project?
Yes. As stated in 52.222-34 and 52.222-33 Alt I a Project Labor Agreement is required.
FAR 52.222-34 provides conflicting information pertaining to when the Project Labor Agreement is required to be submitted. Please clarify if the Project Labor Agreement is required to be submitted with the offer, prior to award of the order, or after award of the order.
The FAR does provide alternative clauses to the default clause which allows for PLA submission after bid submission (either only by apparent successful offeror or after award), however SCO approval is required to use those alternatives.
Going through the solicitation, bid line items 0023 & 0024 show electrical work at both HC & PC. Going through the drawings, the grounding is only shown at one location on sheet 4EG101. Could you please clarify if this drawing is applicable to both sites?
The details for HC are shown on 1EG101. It is the last page of "WSLP 114A Drawings 3 of 6.pdf"
Please provide take off quantities for Lump Sum bid items.
Will be provided.
Please provide original cross sections with design levee template so we can verify plan quantities.
The typical cross sections included in the plans can be used to determine the quantities within the levee sections including the sand base and levee embankment material.
Sheet OS-007, Detail 4 shows Removable Bollards.
Are there any removable bollards on this project. If so, where do they show on the plans?
There are no bollards included in this project. Detail B4 on Sheet 0S-007 will be removed.
Spec 32 34 00.01 12 – 1.2.1 mentions cast in place approach slabs, the plan sheets 1S-110 and 4S-110 & 4S-111 call them out as precast. Which is correct? If cast in place, please provide details of approach slabs showing rebar and specific dimensions.
Approach slabs are precast. References to "cast in place concrete approach slab" will be removed from Spec 32 34 00.01 12 – 1.1 and 1.2.1 and replaced with "precast concrete approach slab".
Detail K16 on sheet OS-004 shows a different type of waterstop from what is normally used on Corps floodwall projects. Please clarify where this water stop is used.
The detail K16 on 0S-004 is to be used on the vertical seal between the drainage structure and the T-Wall for both Hope and Prescott. All other waterstops shall utilize what is shown on Detail A11 on 0S-131. All callouts referencing the vertical seal between the drainage structure and T-Wall on the following sheets will be changed from "9" PVC WATERSTOP" to " SEE
WATERSTOP DETAIL K16 ON SHEET 0S-004". Sheets 1S- 102, 1S-103, 1S-201, 1S-202, 4S-102, 4S-103, 4S-201, 4S-202, 0S-520, 0S-521, and 0S-523.
How many PDA test piles are there on this project?
2 - HP14x89 and 2 - Pipe piles per site for a total of 8 test piles.
The H pile tables on sheets IS-585 and 4S-592 include the PDA piles in that linear footage. Will these piles be measured and paid for by the LF per items 0059 and 0060?
No, they will be paid for in items 0061 and 0062.
Quantities to be updated.
On sheet 4S-601, the gate monolith has a note above the plan view that states 3 piles per monolith will be subject to Dynamic Testing. Are these three Dynamic Testing over and above the two PDA piles listed in the tables? Please clarify.
No, the Table indicating 3 piles per monolith PDA requirement will be removed from Sheet 4S-601.
The hp14x89 specification section calls for pipe piles to be Dynamically Tested, but none are shown in the plans. Are there steel pipe piles that will be subject to PDA? If so, will these steel pipe piles be permanent piles?
Yes, there are steel pipe piles subject to PDA (2 per site). PDAs will be performed in the locations shown on Sheets C-003 and C-004. These steel pipe piles will not be permanent production piles.
HP14x89 Specification 31 62 16.00 12 – 1.8 calls for a Geotechnical Consultant to be present to observe test pile and production pile installation. 31 62 16.00 12 – 3.1.4 e states the contractor’s geotechnical consultant must be available throughout pile driving operations to consult with the Contracting Officer’s Representative when required by the Contracting
Officer. Does this mean the contractor must have a Geotechnical Consultant onsite at all times when he is driving piles?
No.
Steel Pipe Pile Specification 31 62 17.00 12 – 1.8 calls for a Geotechnical Consultant to be present to observe test pile and production pile installation. 31 62 17.00 12 – 3.2.4 e states the contractor’s geotechnical consultant must be available throughout pile driving operations to consult with the Contracting Officer’s Representative when required by the Contracting Officer. Does this mean the contractor must have a Geotechnical Consultant onsite at all times when he is driving piles?
No.
Where in the plans can we find the Test Pile location for Hope Canal? Sheet C-003 shows a Test Pile Site (by others). Does this mean all pile testing for the Hope Canal site have already been performed and that no PDA testing of any piles are required at this site?
TheTest Pile location for the Hope site is identified on drawing C-003. The contractor will be requiured to perform the test pile program and Hope and Prescott sites .The "By Others" language in the callouts for the test pile sites for Hope and Prescott is to be removed from drawings C-003, 1CS101, 1CG101, 1CG102, and 4CS103 . On drawings 1C- 101 add to general notes "6. PDA tests will be performed under Phase 2" and on drawing 4C-101 add to general notes "4. PDA tests will be performed under Phase 2"
Please confirm the plan quantity of Steel Pipe Piles at Hope Canal.
There is a total quantity of 2295 LF for bid item 0063.
Bid item 0063 Furnish Steel Pipe Piles - HC quantity to be changed from 2895 LF to 2295 LF.
Are the bulkheads as noted on sheet OS-525 the same as stop logs which are bid items 0093 and
0094?
Yes.
Note on sheet OS-550 states the contractor is to provide 2 sets of stop logs to close one bay of maintenance at each location. How many stop logs are in a set?
There are 4 bulkheads per set totalling 8 bulkheads per site. Individual bulkhead height shall not exceed 2' 9".
Where on each site are the staff gauges located?
Staff gauge locations are provided on 1CS105 and
4CS105.
Please provide information on the 12” ppc piles that support the staff gauges. At a minimum, how long are these piles?
See Sheet 0S-540 for concrete pile details. Concrete piles supporting the staff gauges are 50' long
Please provide quantities for the F shape precast barriers. What pay item are we supposed to include this material and work in?
The F-shape precast barriers are being deleted from the plans.
Section 32 40 01.00 12 – 1.2.2 calls out W-beam guardrail. Where is this material located in the plans?
W-shape guardrails are not used in project. They will be deleted from the specifications.
Would the government please consider payment for material stored off site for the Slide Gates, Stop Logs and Precast Bridge Caps and Decks?
No.
Drawings 4CS110, 4CS112, 4CG109, and 4CG111 are missing from the Prescot plan set.
Those drawings were not used and were intended to be left out. Index Sheet will be edited to remove drawings 4CS110, 4CS112, 4CG109, and 4CG111.
Please provide typical sections of each crushed stone road and levee ramp for each site.
Typical section of ramps and access road are included in the plans.
Besides the TRS sheets that get cut off between the drainage structure and T wall, will the contractor be allowed to pull the TRS sheetpiling?
Yes.
Will the contractor be allowed to block the Hope Canal and Prescott Canal as part of his TRS plan?
Yes, as long as the bypass canal construction is complete prior to canals being blocked. Canal flow must be maintained throughout the duration of the project.
What are the design loads for the precast ramps? HS-20 design vehicle
Can we use (4) panels for each approach slab and ramp span instead of only (2) panels as shown on 0S-
301?
Yes.
The ramp approach slab plan view on Drawing 0S- 110 calls-out a 1%, 1-way tangent / monoslope cross slope AND a high-point (HP) along the ramp CL. It is understood that the 1-way tangent cross slope is correct; please confirm.
The 1% tangent cross slope is correct. Callout in quadrant G12 on sheet 0S-110 "C/L APPROACH
SLAB & BRIDGE & HP OF CONCRETE" to be replaced with "C/L APPROACH SLAB & BRIDGE"
It is understood that the 1%, 1-way tangent shown in the cross sections on drawing 0S-301 is intended to be achieved by varying the pile cut-off / top of pile elevations instead of adjusting the deck panel thicknesses; please confirm.
Confirmed, the slope will be accomplished by varying the pile cut off elevations and sloping the pile cap.
Are PLA’s required for this project?
Confirmed; The solicitation includes 52.222-34 and
52.222-33 Alt I Project Labor Agreement
Will PLA’s be required if the contractor’s bid is below $35,000,000.00?
Yes
Is the total estimated cost of the construction contract to the Federal Government $35 million or more?
The Independent Government Estimate (IGE) is not releaseable.
We respectfully request that an exemption to the PLA requirement be granted for this project and a formal ruling be provided. PLA’s have drastically reduced the number of bidders on recent New
Orleans District bids and is negatively impacting the local contracting community.
An exemprion will not be granted.
Due to the new PLA requirement, it is taking longer than anticipated to sign-up companies as part of the PLA. Will USACE please consider extending the due date by 6 weeks?
An extension is forthcoming via AMD 0002
Will the proposed access road (by others) terminate in a laydown area for contractors use?
If not will contractor be allowed to clear and finish an area for that purpose at the construction site?
The Access Roads have already been constructed, any “Laydown Area” will have to be at the contractor’s expense and located within the Right of Way provided for the project.
Will that access road be an all weather driving surface?
The current access roads have a crushed limestone surface and are suitable for all weather driving conditions; it will be the contractor’s responsibility to maintain them during the life of the construction project.
Will there be commercial electrical power available onsite during the construction of the monoliths?
No.
The contractor will design and install temporary cofferdams (TRS) in order to construct the monoliths in the channels. Will contractor be allowed to completely remove the TRS system, or will it be required to cut members off at some elevation below mudline?
Yes.
Please consider extending the bid date to allow offerors additional time to bid. An extension is forthcoming via AMD 0002
Is a project specific labor agreement required in addition if the successful offeror maintains a current and future corporate labor agreement with multiple labor unions?
Please refernce The DOL PLA Resource Guide website is a terrific resource for the acquisition community and potential contractors for PLA information. The website has a link to the North America’s Building Trades Union
(NABTU) website that has a PLA sample (see Field Services, Agreements and Forms). NABTU is one of many labor/trade unions across the country.
Contractors may also search DOL’s Office of Labor- Management Standards – OLMS Union Search page online (https://olmsapps.dol.gov/query/getOrgQry.do) for the unions in the state the project is located.
