SECTION 00700 - CONTRACT CLAUSES

The following have been added by reference:

52.222-21 Prohibition Of Segregated Facilities APR 2015

The following have been added by full text:

52.225-9 BUY AMERICAN—CONSTRUCTION MATERIALS (NOV 2021)

(a) Definitions. As used in this clause--

Commercially available off-the-shelf (COTS) item—

(1) Means any item of supply (including construction material) that is--

(i) A commercial product (as defined in paragraph (1) of the definition of "commercial product" at Federal Acquisition Regulation (FAR) 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4) such as agricultural products and petroleum products.

Component means an article, material, or supply incorporated directly into a construction material.

Construction material means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.

Materials purchased directly by the Government are supplies, not construction material.

Cost of components means--

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

Domestic construction material means--

(1) For construction material that does not consist wholly or predominantly of iron or steel or a combination of both-

(i) An unmanufactured construction material mined or produced in the United States; or

(ii) A construction material manufactured in the United States, if--

(A) The cost of its components mined, produced, or manufactured in the United States exceeds 55 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic. Components of unknown origin are treated as foreign; or

(B) The construction material is a COTS item; or

(2) For construction material that consists wholly or predominantly of iron or steel or a combination of both, a construction material manufactured in the United States if the cost of foreign iron and steel constitutes less than 5 percent of the cost of all components used in such construction material. The cost of foreign iron and steel includes but is not limited to the cost of foreign iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the construction material and a good faith estimate of the cost of all foreign iron or steel components excluding COTS fasteners. Iron or steel components of unknown origin are treated as foreign. If the construction material contains multiple components, the cost of all the materials used in such construction material is calculated in accordance with the definition of "cost of components".

Fastener means a hardware device that mechanically joins or affixes two or more objects together. Examples of fasteners are nuts, bolts, pins, rivets, nails, clips, and screws.

Foreign construction material means a construction material other than a domestic construction material.

Foreign iron and steel means iron or steel products not produced in the United States. Produced in the United States means that all manufacturing processes of the iron or steel must take place in the United States, from the initial melting stage through the application of coatings, except metallurgical processes involving refinement of steel additives. The origin of the elements of the iron or steel is not relevant to the determination of whether it is domestic or foreign.

Predominantly of iron or steel or a combination of both means that the cost of the iron and steel content exceeds 50 percent of the total cost of all its components. The cost of iron and steel is the cost of the iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the product and a good faith estimate of the cost of iron or steel components excluding COTS fasteners.

Steel means an alloy that includes at least 50 percent iron, between 0.02 and 2 percent carbon, and may include other elements.

United States means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the domestic content test of the Buy American statute is waived for construction material that is a COTS item, except that for construction material that consists wholly or predominantly of iron or steel or a combination of both, the domestic content test is applied only to the iron and steel content of the construction materials, excluding COTS fasteners. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial product or to the construction materials or components listed by the Government as follows:

NONE

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 20 percent;

(ii) The application of the restriction of the Buy American Act to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American Act. (1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including--

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

Foreign and Domestic Construction Materials Price Comparison Construction material description Unit of measure Quantity Price (dollars) \*\

Item 1:

[* Include all delivery costs to the construction site and any applicable duty (whether or not a duty-free entry certificate is issued)].

[List name, address, telephone number, and contact for suppliers surveyed. Attach copy of response; if oral, attach summary.] [Include other applicable supporting information.]

AM 0001

Bidders Questions and Government Responses Amendment 0001

Question 1 - We find the scope to be extremely vague. Can a further detailed description be provided?

Question 1A: Spec section 31 11 13- scope states that “It includes the clearing and satisfactory disposing of trees within the limits specified herein and as shown on the drawings, only as required for access to the temporary staging areas.”

Response 1A: The intent of this contract is to clear and snag Lower Jones Creek within the 70’ offset as shown on the drawings and to minimally clear, as needed, for access to the temporary staging area. See reference paragraphs below for clarifications.

SECTION 31 11 13.00 12, PARA. 3.1 states “Clearing and snagging shall be performed at an offset distance from the creek centerline within the construction easement.” The intent is to clear and snag within the 70’ offset from the centerline. SECTION 31 11 13.00 12, PARA. 3.3.1 states “Clearing, unless otherwise specified, shall consist of felling, trimming, and cutting of trees and other vegetation designated for removal, including downed timber, stumps, roots, brush, piling, riprap, abandoned structures, fencing, and similar debris within the limits specified on the contract drawings. Snagging shall consist of the removal of all submerged or partially submerged snags, downed timber, debris, and abandoned structures from the creek.”

SECTION 31 11 13.00 12, PARA. 3.1 states “Clumps of trees on higher elevation sites shall be cleared only as required for access from the channel to the adjacent temporary staging areas.” The intent is to clear, as needed, within the access corridors and staging areas. SECTION 31 11 13.00 12, PARA. 3.3.2 states “Clearing along Lower Jones Creek, for access operations, shall be limited to the minimum required for access from the channel to the adjacent temporary staging areas.”

All trees located outside of the limits of clearing and snagging, access corridors, and staging areas shall not be disturbed. If a tree is growing outside of the areas previously stated and its limbs are growing down into the channel (interfering with work or impeding flow) those limbs will be removed (not the whole tree). No change.

Question 1B: Are all trees and canopies hanging into the limits of work (70’ of centerline) to be removed or are certain canopies able to remain? Any limbs that interfere with work or impede flow will be removed.

Response 1B: All trees located outside of the limits of clearing and snagging, access corridors, and staging areas shall not be disturbed. If a tree is growing outside of the areas previously stated and its limbs are growing down into the channel (interfering with work or impeding flow) those limbs will be removed (not the whole tree). No change.

Question 1C: The documents do not provide enough detail for contractors to determine the quantity to be removed. Can the Government provide a quantity per mile or foot that the contractor should assume?

Response 1C: Quantities shall be assumed via the pictures at the end of the P&S or via a site visit. No change.

Question 1D: Would the Government consider pay items for cutting leaners and hangers per each?

Response 1D: The Government will not add bid items for cutting leaners and hangers.

All clearing work shall be included in CLIN 0008 Clearing and Snagging. No change.

Question 2: What are the limits of seed and fertilizing?

Response 2: Fertilizing and seeding shall be performed on all disturbed areas. This includes all disturbed areas within access corridors and staging areas. No change.

Question 3: Can details and specifications be provided for curbing, sidewalks and road pavement?

Response 3: Curbing, sidewalk, and road pavement will be restored to their original or better conditions. Contractor shall visit areas of access where potential curbing, sidewalk, and road pavement repairs will be made and bid accordingly. No change.

Question: Could you please confirm that we are required to submit only the documents listed below? Are there any other requirements?

o Standard form 1442 o Bid bond o Bidding Schedule o Certification of Nonsegregated Facilities o DUNS number o Representations and Certifications

Response: It is the potential bidder(s) responsibility to review the solicitation, in its entirety, to determine any and all required submittals for the requirement that will render their bid as responsive.

Question: Please provide a specification for the herbicide application for the cut stumps, including herbicide type, spray rates, and the time frame to be applied after tree cutting.

Response: SECTION 31 11 13.00 12, PARA. 3.3.1.3 states “Herbicide, in accordance with the manufacturer's label, shall be applied to the top surface of all stumps greater than 1-1/2 inches in diameter. The contractor shall submit his/her proposed herbicide materials and application methods to the Contracting Officer for approval.” The specification for the herbicide application for cut stumps, including herbicide type, spray rate, and the time frame to be applied shall be chosen by the Contractor. No change.

Question: For the access clearing, please advise if this bid item is for the staging area cleaning.

Response: Yes, the CLIN “Access Clearing” includes the staging area. SECTION 31 11 13.00

12. PARA. 1.2.2 states “…and performing all operations necessary for clearing access at staging area locations”. No change.

Question: Regarding plan pg. 280, Section 1.4, Submittals, a culvert installation plan is called out; however, there are no culverts shown for installation. Please clarify.

Response: SECTION 32 15 00.00 12, PARA 3.1.2 states “Prior to the placement of surfacing, culverts shall be placed at locations where temporary access roads would cross over a ditch.”

The Contractor shall place a culvert at ditch locations such as the ingress/egress point of the staging areas to public roads, if needed. No change.

Question: Is the contractor required to install a stone construction access road along the entire

3.3 mile clearing area? In lieu of this, can the contractor just remove the rutting as a result of the clearing and return to natural conditions to reduce cost?

Response: The only required stone surfacing is from the truck washdown rack to the public road. See SECTION 01 57 23.01 12, PARA 3.1. The Contractor is allowed, not required, to place stone surfacing from the staging area to the channel. See SECTION 32 15 00.00 12, PARA. 3.3. No change.

Question: The solicitation indicates that a bid guarantee is required, but does not specify the amount. Please provide.

Response: The amount of the bid guarantee shall be (20%) twenty percent of the bid price or $3,000,000.00, whichever is less.

Question: Insurance requirements do not appear to be included in the contract clauses; please provide.

Response: Please reference Page 158 within the solicitation. Upon award, the Contractor will be required to provide their Certificates of Insurance as part of the submittal process.

Question: How much disturbance is required before restoration activities are required?

Response: Any area that is disturbed by construction activities shall be restored to original conditions. No change.

Question: Can a barge and machinery such as excavators be placed in the creek for working?

Response: Yes, barge and machinery are allowed but shall not disturb the existing channel banks and shall not obstruct flow in the channel. No change.

Question: What is an acceptable ground disturbance?

Response: Any area that is disturbed by construction activities shall be restored to original conditions. No change.

Question: From the center line of the creek, 70' out is the scope. If there is snag outside the LOD, are we still to remove or leave in place? How are we to handle a tree/rootball that straddles the 70’ from centerline boundary? How would an exposed root ball that is just outside the 70’ limit be addressed? Same for a tree that that is rooted outside of the 70’ limit but leaning significantly over the creek?

Response: Any trees or debris located outside of the limits of work shall be left in place.

However, if a tree is located outside of the limits of work but has a portion impeding flow or construction within the limits of work, that portion that is impeding shall be removed. No change.

Question: Regarding the migratory birds nesting, is construction to halt during the entire nesting season or stop only if birds are located within the work zone?

Response: See SECTION 01 57 20.00 12, PARA. 3.3. “Presence of nesting wading birds or nesting bald eagles must be immediately reported to Tammy Gilmore at (504)862-1002. If nests of these birds are present at the work area; a no work distance restriction of 1000 feet for colonial nesting wading birds and a distance restriction of 660 feet from a nesting bald eagle must be implemented.” No change.

Question: Where healthy trees have stumps that have been eroded, at what point do the trees need to be removed?

Response: Stumps are to be cut to within 2 inches of natural ground. Stumps that are located below natural ground are to remain and trimmed to within 2 inches of the ground surface. See SECTION 31 11 13.00 12, PARA 3.3.1.3. No change.

Question: Do undermined stumps need to be removed to prevent future snagging which will need to be removed in the future?

Response: Stumps are to be cut to within 2 inches of natural ground. Stumps that are located below natural ground are to remain and trimmed to within 2 inches of the ground surface. See SECTION 31 11 13.00 12, PARA 3.3.1.3. No change.

Question: In the location where there is no defined access area (staging area), is a temporary crossing area acceptable for a stream crossing? Are additional staging areas permitted to be created?

Response: Temporary crossings are not allowed. Contractor shall not impede flow of the creek.

Contractor shall be limited to the areas shown on the drawings. SECTION 01100, PARA 6b provides information if the Contractor wishes to deviate from the Government furnished rights-of-way. No change.

Question: In the areas where the bank has been seriously eroded, is a stabilization required?

Response: No, bank stabilization is not required. Clearing and snagging only. No change.

Question: How is it determined that all underwater snags have been removed due to muddy water if we are unable to see the bottom of the creek?

Response: The majority of snags will be fallen trees with limbs sticking out of the water or within a foot or two below the water. No change.

Question: For the staging areas located close to traffic, is it possible to get a temporary construction speed limit change to lower the speed of vehicles?

Response: The Contractor can coordinate this with LADOTD and EBR Parish. No change.

Question: Will police be available for any required traffic control?

Response: The Contractor can coordinate this with LADOTD and EBR Parish. No change.

Question: Are water level gauges installed on the creek, and/or are there any records available for annual rainfall and seasonal water levels?

Response: The nearest gauge is located on Jones Creek at Old Hammond Hwy. Info from that gauge can be found here https://waterdata.usgs.gov/la/nwis/uv/?site_no=07378650&PARAmeter_cd=00065,72020,63160 ,00060. Additional gauges are located on the Amite River. No change.

Question: For forwarding material from within the right of way on the banks, how much ground disturbance is acceptable before major restoration is required?

Response: The Contractor shall not impair bank stability. Any area that is disturbed by construction activities shall be restored to original conditions. No change.

Question: Are the stone access roads required to be constructed the entire length of the snagging removal? If so, how are we to prevent the stone from being absorbed into the clay?

Does a fabric need to be installed?

Response: The only required stone surfacing is from the truck washdown rack to the public road. See SECTION 01 57 23.01 12, PARA 3.1. The Contractor is allowed, not required, to place stone surfacing from the staging area to the channel. See SECTION 32 15 00.00 12, PARA. 3.3. No change.

Question: Please advise the installation length and location of temporary access roadways.

Outside of the laydown areas, will access or haul roads into the creek be allowed? Are there current easements or rights-of-way that are available?

Response: The only required stone surfacing is from the truck washdown rack to the public road. See SECTION 01 57 23.01 12, PARA 3.1. The Contractor is allowed, not required, to place stone surfacing from the staging area to the channel. See SECTION 32 15 00.00 12, PARA. 3.3. All temporary access roads shall be located within the limits of work provided on the plans. No change.

Question: If LOD is 70' and additional access is needed, will an additional area be approved for work?

Response: The Contractor shall be limited to the areas shown on the drawings. SECTION 01100, PARA 6b provides information if the Contractor wishes to deviate from the Government furnished rights-of-way. No change.

Question: Can we temporarily dam a section of the creek to increase draft for a small barge?

Response: Temporary dams are not allowed. Contractor shall not impede flow. No change.

Question: If nesting or wading birds are found, will a project schedule extension be issued?

Response: If nesting or wading birds are found, any project schedule change will be handled through a contract mod. No change.

Question: Item m. on pg. 4 of 289 of the solicitation (bid checklist) states, "Bidders are to ensure that the Original Certified Payment & Performance Bonds are electronically provided in accordance with Block 12b of the SF1442 and subsequently mail the originals to the address provided in Block 7 of the SF1442." However, SF1442 indicates that performance and payment bonds are to be provided within 5 days after project award. Please confirm that bidders are not required to include performance and payment bonds with their proposals.

Response: The Contractor must furnish any required Performance and Payment Bonds within five (5) calendar days after award as annotated in Block 12b of the SF1442.

Question: Item II. on pg. 2 of 289 of the solicitation states, "Bidders, offerors and applicants are cautioned to note the "Certification of Non-Segregated Facilities" in the solicitation. Failure of a bidder or offeror to agree to the certification will render his bid or offer non-responsive..."

However, this certification does not appear to be included in the solicitation; please provide.

Response: FAR 52.222-21, Prohibition of Segregated Facilities clause has been incorporated into the solicitation.

Question: Please confirm that the Buy American Act does not apply to this project.

Response: Yes, it does apply. FAR 52.225-9, Buy American – Construction Materials has been incorporated into the solicitation.

Question: Per RFP the POP is 300 days; please confirm.

Response: The contract duration is 300 days. No change.

Partial acceptance of completed work will be determined solely at the discretion of the Government. Reaches of completed work must be relatively large, continuous, and organized (no less than 3,000 linear feet of channel at a time). The Contractor will be responsible for all remedial work resulting from his construction operations at no additional cost to the Government.
