BIDDER QUESTIONS AND GOVERNMENT RESPONSES
Q1. Drawing C-02 – Typical Floatation Channel for Jetty and Jetty Tiebacks. The distances of 70’ (East Jetty) and 50’ (West Jetty) with no vessels allowed within this area make it impossible to build these sections. The equipment industry uses to do this work do not have the capabilities to make these reaches up 120 feet to backside toe with a 4 ton boulder. Major safety concerns here. Will the design engineers allow the standard 30 feet distance that is normal for this work?
A1. The purpose of maintaining a 70-ft distance from the top of excavation channel to the centerline of the West Jetty is to not disturb the siltation close to the jetty, which exists as its foundation. This standoff distance is the same as on previous year’s contracts for SWP Jetty Construction as well as the jetties built in Calcasieu Pass. Contractors bidding on this work are expected to utilize cranes large enough to safely lift and place jetty stone in a manner that is consistent with the contract specifications.
Q2. Drawing C-02 – Note 7 States that limits of repair will be established by Task Order. Also Amendment 001 Section 35 31 19.01 12 paragraph 3.3.1 states that the stone jetty repairs shall be specified in the before-construction surveys or as directed in the field by the CO. These areas my require much more dredging than the engineers realize. For example, the East Jetty Tiebacks are more on land and surrounded by large sandbars that will not only require a floatation channel but an access channel to get to the floatation channel. Access channels could be +/- 600 to 700 feet of hard packed sand that may not even stay open during the duration of the work. Will the New Orleans District provide the Stone Jetty Repair reaches prior to bid so we can prepare a more competitive bid for these specific reaches?
A2. All work associated with this base contract will be issued under an initial task order at the time of the award. The reaches of work identified by the government that need repair to include on the task order are included in this response in two documents labeled ‘2021 Proposed.pdf’ (map) and ‘Task Order 1.doc’.
Approximately 20k tons of stone will be needed for Stone Jetty Repair, 10k for the East Jetty Tiebacks and 10k for the East Jetty, itself. Most of the work done under this contract will be the East and West bank foreshore dike repairs.
Q3. The specs state that the Jetty areas to be repaired will not be given until after award. We need to know the approximate areas that you will require us to work. Some of the tie backs on the East Jetty are land locked and cannot be accessed from water. Some have a sandbar that goes out over 500 feet from the jetty and will require an access channel to get to the flotation channel. Please consider giving us an estimated station or coordinate instead of saying the entire area may need work.
A3. See response to question 2.
Q4. The drawings show that the flotation channel on the East side cannot be closer than 70 feet from the toe of the Jetty, that will make the reach to repair the Jetty a maximum of about 120 feet to reach the backside of the Jetty. That will be an impossible reach, no machine that will fit in the flotation channel can place a 4-ton rock that far from the barge. Your USACE safety manual will not allow that. Please consider allowing a 30’ limit from the toe of the Jetty.
A4. See response to question 1. The flotation channel width may be adjusted, if needed.
Q5. The bid schedule has an estimated 60,000 CY of excavation for the project. From our site inspections the East Jetty and tie back areas that will require flotation to access is approximately station 0+00 to 52+00 and has about 90,000 CY. The West Jetty area that will need floatation to access is from station 0+00 to 94+00 and has about 167,000 CY. These quantities do not include the access channels that will need to be excavated to get to the floatation channels. Some of these areas are extremely hard to excavate and some are easier. To allow us to prepare a fair and competitive bid it’s imperative that we have a better idea of the exact work areas for the Jetties.
A5. See response to question 2.
Q6. I just read in the amendment 001 specifications 35 31 19.01 part 3: Stone foreshore dike repair areas and Stone Jetty repair areas shall be specified in the before construction drawings, Jobsite specifications and/or by the contracting officer. Will those placement areas be provided before bid date?
A7. See response to question 2.
Q8. The drawings show that the flotation channel on the East side cannot be closer than 70 feet from the centerline of the Jetty, that will make the reach to repair the Jetty a maximum of about 120 feet to reach the backside of the Jetty. That will be an impossible reach, no machine that will fit in the flotation channel can place a 4-ton rock that far from the barge. Your USACE safety manual will not allow that. Please consider allowing a 30’ limit from the toe of the Jetty.
A8. Repeat of question 4.

NOTE 2: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH
THE UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS
BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR AWARD.
NOTE 3: Any bid may be rejected if the Contracting Officer, in writing, determines that it is unreasonable as to price. Unreasonableness of price includes not only total price of the bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub-line items are materially unbalanced.
NOTE 4: NOTICE OF AWARD/NOTICE TO PROCEED: The successful bidder is advised that performance and payment bonds will be submitted in accordance with the time frame in block 12B of SF 1442 after the Notice of Award. Performance and payment bonds will be required per individual task order. The Notice To Proceed will be issued immediately after verification of acceptable performance and payment bonds. A separate Notice To Proceed will be issued for each Task Order. Within 7 days after issuance of the Notice To Proceed, the Contractor will initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start on a first Task Order until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required have been submitted and approved and all preliminary meetings called for under the contract, have been conducted. Similarly, physical work cannot start on subsequent Task Orders until Task Order specific supplements to the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all Task Order specific preliminary meetings called for under the contract, have been conducted.
NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of Item Nos. 0005, 0006, 0007, and 0008, identified in the schedule as Optional Work items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the Optional Work by written notice to the Contractor within the one-year period of the contract. The Government will exercise the Optional Work in accordance with the Clause in Section 00700 CONTRACT CLAUSES entitled “OPTION FOR INCREASED QUANTITY-SEPERATELY PRICED LINE ITEM” (FAR 52.217- 7, MAR 1989). Failure to bid on all items will result in a non-responsive bid.
NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement.
Evaluation of options will not obligate the Government to exercise the option(s).
NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF OPTIONAL WORK. In the event that the OPTIONAL WORK item Nos. 0005, 0006, 0007, and 0008 are exercised under the terms of the contract, the time required for completion of the contract will not be adjusted but shall be performed concurrent with the original contract duration of 365 calendar days.
NOTE 8: Initial mobilization and demobilization costs will be paid for by the Government. Any subsequent mobilization and demobilization costs will be paid for by the Government provided that (a) the Contractor has completed all the work assigned in all the Task Orders issued and the Contractor has demobilized, or (b) the Government has suspended the Contractor and the Contractor has demobilized.
Descriptions of the anticipated work is specified in Section 01100, paragraph entitled “LOCATIONS AND
ANTICIPATED WORK”.
NOTE 9: Attention is directed to the Section 00700 CONTRACT CLAUSES entitled "ORDER LIMITATIONS" (FAR 52.216-19, Oct 1995) for Task Order limitations.
NOTE 10: Task Orders will be issued by electronic communications (e-mail or facsimile) by the Contracting Officer.
NOTE 11: All quantities are estimated and are to be used for bid evaluation purposes only. Estimated quantities of individual contract line items may vary significantly either up or down depending on the work required during the one-year contract period as long as the earnings limitations of the contract are not exceeded.
NOTE 12: Any travel and lodging costs of Contractor personnel shall be considered in the Contractor’s pricing and shall be distributed among the individual contract line items.
NOTE 13: This Pricing Schedule is for evaluation purposes only to determine the lowest bidder.

CLAUSES INCORPORATED BY FULL TEXT
52.204-13 SYSTEM FOR AWARD MANAGEMENT MAINTENANCE (OCT 2018)
Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management (SAM) records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.
Registered in the System for Award Management (SAM) means that--
(1) The Contractor has entered all mandatory information, including the unique entity identifier and the EFT indicator (if applicable), the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into SAM;
(2) The Contractor has completed the Core, Assertions, Representations and Certifications, and Points of Contact sections of the registration in SAM;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record ``Active''.
System for Award Management (SAM) means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—
(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;
(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12;
and
(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.
Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.
(b) If the solicitation for this contract contained the provision 52.204-7 with its Alternate I, and the Contractor was unable to register prior to award, the Contractor shall be registered in SAM within 30 days after award or before three days prior to submission of the first invoice, whichever occurs first.
(c) The Contractor shall maintain registration in SAM during contract performance and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement. The Contractor is responsible for the currency, accuracy and completeness of the data within SAM, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in SAM after the initial registration, the Contractor is required to review and update on an annual basis, from the date of initial registration or subsequent updates, its information in SAM to ensure it is current, accurate and complete. Updating information in SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(d)(1)(i) If a Contractor has legally changed its business name or ``doing business as'' name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to--
(A) Change the name in SAM;
(B) Comply with the requirements of subpart 42.12 of the FAR; and
(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor shall provide with the notification sufficient documentation to support the legally changed name.
(ii) If the Contractor fails to comply with the requirements of paragraph (d)(1)(i) of this clause, or fails to perform the agreement at paragraph (d)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the electronic funds transfer (EFT) clause of this contract.
(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR subpart 32.8, Assignment of Claims). Assignees shall be separately registered in SAM. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the EFT clause of this contract.
(3) The Contractor shall ensure that the unique entity identifier is maintained with the entity designated at www.sam.gov for establishment of the unique entity identifier throughout the life of the contract. The Contractor shall communicate any change to the unique entity identifier to the Contracting Officer within 30 days after the change, so an appropriate modification can be issued to update the data on the contract. A change in the unique entity identifier does not necessarily require a novation be accomplished.
(e) Contractors may obtain additional information on registration and annual confirmation requirements at https://www.sam.gov.
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within (Contracting Officer insert number) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 365 calendar days after the date of issuance of the notice to proceed. The time stated for completion shall include final cleanup of the premises.
52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $2,920.00 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
52.216-18 ORDERING. (AUG 2020)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 09/27/2021 through 09/26/2022.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) A delivery order or task order is considered "issued" when--
(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;
(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or
(3) If sent electronically, the Government either--
(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or
(ii) Distributes the delivery order or task order via email to the Contractor's email address.
(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.
52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $1,000,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor -
(1) Any order for a single item in excess of $24,000,000.00;
(2) Any order for a combination of items in excess of $24,000,000.00; or
(3) A series of orders from the same ordering office within 3 calendar days that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 3 calendar days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
52.216-22 INDEFINITE QUANTITY. (OCT 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in theTask Order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that Task Order to the same extent as if the Task Order were completed during the contract's effective period.
(e) The Contractor shall provide written telecommunication notice (e-mail or facsimile) to the Contracting Officer's Representative of the need to place any quantity for an item of a Task Order above the estimated quantity included for that item in the Task Order. The notice shall be provided at least five (5) calendar days prior to the anticipated need for the additional quantity. The Contractor will be responsible for any impact on the completion of the work resulting from an untimely notice. Upon approval by the Contracting Officer for any additional quantity of an item, the time specified in the Task Order shall be modified accordingly.
52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM (MAR 1989)
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 30 DAYS. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

Component means an article, material, or supply incorporated directly into a construction material.
Construction material means an article, material, or supply brought to the construction site by the Contractor or subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.
Materials purchased directly by the Government are supplies, not construction material.
Cost of components means--
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

The cost of foreign iron and steel includes but is not limited to the cost of foreign iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the construction material and a good faith estimate of the cost of all foreign iron or steel components excluding COTS fasteners. Iron or steel components of unknown origin are treated as foreign. If the construction material contains multiple components, the cost of all the materials used in such construction material is calculated in accordance with the definition of "cost of components".
