About this file

This amendment modifies a solicitation for a hopper dredge rental contract. The amendment adjusts the bid opening date to May 29, 2020, establishes a fuel price adjustment formula using a Bureau of Labor Statistics index, and provides an example calculation. Offerors must furnish a fully crewed and equipped self-propelled trailing suction hopper dredge to perform work in the Mississippi River Southwest Pass and other areas of the New Orleans, Galveston, and Mobile Districts. The estimated value of the contract is between $5 million and $10 million under NAICS code 237990.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. AMENDMENT 0003

Instructions to Bidders

1. The fuel price of $1.25 / gallon was selected as an average fuel cost that should be incorporated into each Contractor’s Dredging Item unit price. This fuel cost will serve as the basis of the fuel adjustments that will be applied when the dredge is working under this contract. The fuel price of $1.25 / gallon was determined by watching the trend of the cost of #2 diesel fuel (not seasonally adjusted) over the last month to project a conservative average price of fuel for May 2020. We have continued to monitor the fuel price since Amendment 0001 was posted on 13 May and the fuel price is still below $1.25, therefore the average fuel price for the month of May should be below $1.25 per gallon.

2. The original bid price will not be adjusted for May 2020. As stated in answer #1, the average fuel price is still below the estimated fuel price of $1.25 per gallon listed in Amendment 0001.

The Dredging Item’s unit price will not be adjusted until the dredge is working under this contract and it will be adjusted using the formula provided in Amendment 0001, as shown in the example below.

Example fuel adjustment calculation:

If a contract is awarded with a Dredging Item unit price of $4000 / hour the Dredging Item unit price will be adjusted as shown below. Example Preliminary BLS Index values are as listed below for the purposes of the example calculation:

Preliminary BLS Index for May 2020 = 125.0 Preliminary BLS Index for February 2021 = 205.0 Preliminary BLS Index for March 2021 = 210.0

Fuel Price Adjustment for Dredging Items = [(Dollar Amount of Dredging Items)*(0.18)*(Latest Preliminary BLS Index - Preliminary BLS Index for May 2020)] / [Preliminary BLS Index for May 2020]

February 2021 Fuel Price Adjustment = [($4000)*(0.18)*(205.0-125.0)] / [125.0] = $460.80/hour

March 2021 Fuel Price Adjustment = [($4000)*(0.18)*(210.0-125.0)] / [125.0] = $489.60/hour

3. Bid Opening will be held on Friday, 29 May 2020 at 11:30 AM CST. Please use the following call-in information to attend the meeting:
