1.2 BID FORM NOTES

a. Bidders shall bid on all items including optional items (see "Evaluation of Options" FAR

52.217-5). Failure to bid on all items will result in a non-responsive bid.

b. Bidders shall use the Item No. 0002 unit price to compute Option Item No. 0003 total price, Item No. 0004 unit price to compute Option Item No. 0005 total price, and Item No. 0007 unit price to compute Option Item No. 0008 total price.

c. Any bid may be rejected if the Contracting Officer or his/her authorized representative determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only the total price of the bid, but the prices for individual line items as well.

Any bid may be rejected if the prices for any line items or subline items are materially unbalanced (see "Rejection of Individual Bids" FAR

14.404-2.

d. THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442 after Notice of Award. The NTP will be issued after verification of acceptable performance and payment bonds.

Within 48 hours after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Administrative Contracting Officer or his/her authorized representative.

Physical work cannot start until the Resident Management System is set-up, the Accident Prevention Program and other required submittals have been submitted and approved, and all preliminary meetings called for under the contract have been conducted.

e. RAPID VENDOR PAYMENT: See the following web based instructions for the submission of invoices:

www.mvn.usace.army.mil/Business-With-Us/Contracting/Rapid-Vendor-Payment.aspx

f. The unit "job" is a one-time payment for work performed.

"Job" is synonymous with the previously used term "lump sum".

1.3 BIDDING

a. The bidder shall select only one bid lot, determined by the class of dredge intended to be used.

Bids which are submitted on an inappropriate bid lot will be declared non-responsive.

b. Bidders shall furnish unit prices for all items listed on the schedule of bid items that require unit prices. If the bidder fails to insert a unit price in the appropriate blank for required items but does furnish an extended total or an estimated amount for such items, the Government will deem the unit price to be the quotient obtained by dividing the extended estimated amount for that line item by the quantity.

IF THE BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED ESTIMATED

AMOUNT FOR ANY REQUIRED ITEM, THE BID WILL BE DECLARED

NON-RESPONSIVE.

1.4 EVALUATION OF BIDS

a. To provide fair competition between dredges of dissimilar sizes and production rates, the hourly dredging quantities have been determined based on the estimated quantity of shoal material to be removed and the http://www.mvn.usace.army.mil/Business-With-Us/Contracting/Rapid-Vendor-Payment.aspx

SECTION 00010 Page 6 nominal production rate(s) of the dredge in each bid lot. The production rates shown in the chart(s) in the paragraph entitled

"Minimum Production Rate Requirements" located in the Dredging Region

Section(s) were used to make this determination.

b. The nominal dredge production rates listed in this solicitation were conservatively estimated based on lower-bound material face availability of this solicitation's dredging regions, which have variable and dynamic shoaling conditions. It is the bidder's responsibility to make its own assessment of the actual dredging conditions in order to prepare a bid for this work.

c. Award will be made to that responsible bidder presenting the lowest priced responsive bid in response to this solicitation, regardless of the Bid Lot used.

d. The hourly quantities for the Dredging and Option Dredging Items shown on the bid lots are 100% pay time hours. The actual term of the dredge rental may vary as a result of fractional pay time. Refer to Section 35 20 23.23, paragraph entitled "Dredging and Option Dredging Items", for additional information.

1.5 CONDITIONS OF CONTRACT AWARD

a. Award will be made as a whole to one bidder. The dredge and attendant plant offered in the bidding schedule shall be complete with full operating personnel and in operating status for the contract period. EM 385-1-1, Section 19, "Floating Plant and Marine Activities" shall be complied with at all times. NOTE: All work under these specifications shall be performed in accordance with the provisions of EM 385-1-1 "Army Corps of Engineers Safety and Health Requirements Manual", latest edition.

b. The Government may award the contract at the total bid price, comprised of the base items and option item(s); however, the Government is not obligated to exercise any option item(s).

c. The number of hours of rental time stated in the bidding schedule is an estimated quantity. The dredge and attendant plant will be retained for an approximate number of days shown in the table below starting no later than 8 June 2020.

d. The bidder shall be capable of providing for assignment of the dredge and all attendant plant, complete and in full operating condition in all respects, with commencement of dredging beginning no later than 8 June 2020.

1.6 BIDDER QUALIFICATIONS

a. Before the Government will award a contract based on this solicitation, the apparent low bidder shall establish that it is responsible and entitled to award of the contract, by certifying that its dredge meets the appropriate production rate for the dredging region, as listed in the chart(s) in the paragraph entitled "Minimum Production Rate Requirements" located in the Dredging Region Section(s). The dredge must have performed at, or above, the listed production rate for at least 85 percent of the total contract duration, on any contracts that are used to prove plant capability, within three years prior to the bid opening date of this solicitation. Failure to establish the dredge's capability to meet the required production rate will result in a finding of non-responsibility.

b. A bidder may be rejected as non-responsible if it cannot show the necessary capital, experience, or equipment needed to perform the work described under this solicitation (see "Responsible Prospective Contractors" FAR 9.1). The bidder must also show that the dredge and attendant plant are not already obligated for the performance of other work which would delay commencement, performance, and completion of the solicited work, and must show that delivery of the dredge and attendant plant to the site of work can be made within the time allowed in the specifications.

c. Bidders must register in the System for Award Management (SAM) database in accordance with FAR 52.204-7.

1.7 PRE-AWARD INSPECTION OF PLANT

a. The apparent low bidder shall make the dredge and attendant plant available for inspection, to determine compliance with these specifications, as soon as practicable after bids are opened, and prior to contract award. If deficiencies are found during the inspection, the bidder will be notified in writing, which may be transmitted by email or facsimile. Upon receipt of such notice, the bidder shall correct all deficiencies at least two calendar days in advance of the projected contract award date.

SECTION 00010 Page 8

b. Two calendar days before the projected award date, or upon notification by the bidder that the deficiencies have been corrected, a Government representative will re-inspect the dredge and attendant plant. If at that time the dredge and attendant plant do not meet the requirements of these specifications, the bidder will be rejected as non-responsible.

c. The Government may choose to waive the pre-award inspection if the projected contract award date is less than five calendar days after the bid opening date. Waiver of the pre-award inspection does not relieve the bidder from the requirement to provide a dredge and attendant plant in full compliance with the specifications.

1.8 OPTION ITEMS

a. The Government may require the delivery of, in whole or part, any Option Items. The Government may exercise an Option Item by written notice to the Contractor. If the Government activates the Option Item, the activation will occur while the Contractor's equipment is in the work vicinity as described in the applicable Dredging Region Section(s). If Option Dredging Item work is exercised, it shall be performed as a continuance of Dredging Item work, which shall be activated first.

b. No additional mobilization/demobilization will be paid to the Contractor for Option Item work performed within the work region. The Contractor shall commence performance of optional work no more than three calendar days after the time the Contractor receives the Government's Notice to Proceed with the optional work.

3.1.1.1 Baptiste Collette Bar Channel

a. The authorized dimensions for Baptiste Collette Bar Channel are -14 feet Mean Low Gulf (MLG) by 150 feet bottom width from Station 270+00 to 320+00, with a transition to -16 feet MLG by 250 feet from Station 320+00 to 330+00, and -16 feet MLG by 250 feet from Station 330+00 to 590+00. The Contractor should note that Station 560+00 to 590+00 has never been dredged and consists of virgin material. The Contracting Officer or his/her authorized representative may issue dredging assignments for all or portions of this dredging region. Each dredging assignment will define the dredging template to be dredged by the Contractor. The dredging template will include the swing width, the side slope, and the specified elevation. The specified elevation in the dredging assignment will not exceed 2 feet below the authorized elevation and may be specified above the authorized dimensions when determined to be beneficial to the Government.

mailto:kelly.angelette@shell.com

SECTION 35 20 23.23 16 Page 5

b. Disposal of dredged material shall be at the Government's direction. Approved disposal sites are listed below and shown on the Baptiste Collette Bar Channel Maintenance Dredging Plates.

(1) Wetland Creation Sites/Disposal Areas "G" and "H": Material dredged between approximate C/L Stations 270+00 and 420+00 shall be placed unconfined in Disposal Area "G" and/or Disposal Area "H". If these wetland creation sites are utilized, Disposal Area "H" shall be used prior to using Disposal Area "G".

Dredged material shall be limited to a maximum initial elevation of +4.0 feet MLG, not to exceed +4.5 feet MLG, with an estimated final elevation of +2.5 feet MLG following dewatering and compaction.

For Disposal Area "G", the dredged material shall run in an east-northeasterly direction. For Disposal Area "H", disposal shall begin at the southern limit and proceed in a northerly direction. For Disposal Areas "G" and "H", the Contractor will be allowed a 150 foot access corridor to access the disposal area.

For Disposal Area "G", the 150 foot access corridor shall be between C/L Stations 356+80 and 375+80. For Disposal Area "H", the access corridor locations depicted on the plate are approximate and shall be approved by the Contracting Officer's

Representative prior to access operations. The Contractor shall take precautions to avoid/minimize damages to existing wetlands during access operations. The Contractor shall limit all construction, including placement and movement of discharge pipe, marsh buggies, airboats, personnel, and other equipment, to the disposal area and within the above referenced access corridors.

The Contractor shall take precautions, when accessing and performing disposal operations, in order to prevent damage to the existing rock jetties, existing wetlands (including Paul Island when disposing in "G"), as well as any pipelines and/or wells that fall either adjacent to or within the disposal area. At no time shall dredge effluent material be allowed to exceed one foot in height over existing vegetated wetlands. Once dredging operations are completed, the access corridor(s) shall be backfilled with disposal material to a maximum of two feet above existing adjacent marsh.

(2) Single Point Discharge (SPD)/Gunn Island: Material dredged between approximate C/L Stations 420+00 and 590+00 shall be placed on the bird breeding island, Gunn Island, east of the channel.

The elevation of the dredged material placed on the island shall not exceed +8.0 feet MLG, the purpose of which is to enhance the bird breeding island and maintain a final elevation of +6.0 feet

MLG after consolidation. Dredged material shall be initially discharged at the Single Point Discharge (SPD) location shown on the plate. The dredged material shall be placed in a manner such that the island's footprint expands in an easterly direction. The

Contractor shall maintain at all times a minimum distance of 2,000 feet at elevation 0.0 feet MLG, between all existing and new bird island locations.

3.1.2 Dredge Discharge Pipeline

The Contractor shall provide 15,000 feet of serviceable floating, submerged, or shore pipeline and all associated equipment as directed by the Government. See Section 35 20 23.23, paragraph entitled "Dredge

Discharge Pipeline", for additional information regarding pipeline

SECTION 35 20 23.23 16 Page 6 requirements.

3.1.3 Before and After Disposal Surveys

a. A before and after disposal survey shall be taken at the

Government's direction at each disposal site. Soundings and/or rod readings shall be recorded to the nearest tenth of a foot and the distance between soundings and/or rod readings shall not exceed 50 feet. The surveys shall extend to adequately cover the area impacted by dredged material placement.

a. Disposal Areas "G" and "H": The Contractor shall take a minimum of three disposal cross sections normal to the channel centerline before and after disposal operations. These cross sections shall be equally spaced across the proposed disposal footprint. For Disposal Area "G", the before disposal cross sections shall extend east approximately 1000 feet, and the before and after cross sections shall initiate at the waters edge of the previously filled portion of Disposal Area "G". In addition, for Disposal Areas "G" and "H", the Contractor shall take a minimum of three disposal cross sections parallel to the channel centerline. These cross sections shall be taken prior to and following placement of dredged material and at intervals and locations to be determined by the Contracting Officer's Representative. Spacing between the cross sections shall not exceed 500 feet. The width of the parallel cross sections shall cover the proposed disposal sites as shown on the plate.

b. Gunn Island: The Contractor shall take a minimum of three disposal cross sections normal to the channel centerline and a minimum of three disposal cross sections parallel to the channel centerline.

These cross sections shall be taken prior to and following placement of dredged material and at intervals and locations to be determined by the Contracting Officer's Representative. The before disposal cross sections shall extend a minimum of 1,000 feet and shall be centered on the SPD location.

The after disposal cross sections shall extend to adequately cover the area impacted by dredged material placement.

c. All surveys shall be tied/referenced to the centerline of the channel. All notes resulting from these surveys shall be presented to the Contracting Officer's Representative. The Contractor shall provide a topographic plot of each disposal site. The plot shall have contour intervals of not less than 1 foot and a scale of 1 inch = 100 feet.

The before and after disposal surveys shall be furnished to the

Government in a Microstation version 5.07.01.22 (or updated) design file containing survey elevations with contours in one foot increments. A hard copy of the before and after disposal surveys with contours shall also be furnished to the Government. All survey data shall be in NAD 83. Data shall also be furnished to the Government in a computerized IBM-compatible structured ASCII format on magnetic media. Each disk submitted shall bear a pre-printed disk label that provides for disk contents, have a write protect seal mechanism, and provide a space to indicate disk virus check. All disks submitted shall be virus checked, cleared of viruses if necessary, and all disk label entries completed. All disposal surveys shall be submitted and accepted before final payment is made to the Contractor. In addition, copies of the before and after disposal surveys shall be submitted to

3.1.4 Before and After Dredging Cross-Sections

In addition to the requirements in Section 35 01 50.73, paragraph entitled

"Before and After Dredging Cross Sections", the before and after dredging cross-sections of the channel shall be taken at approximately 200-foot intervals along the channel, as well as at all utility crossings and at all

P.C.'s, P.T.'s, P.I.'s, and P.O.T's. Depth soundings shall be made with the hydrographic surveying system and the recorded sounding density shall be one sounding for every five feet. The graphical chart layout must represent a scaled plan view of the survey area with the recorded five-foot interval depth soundings (0.1 ft. resolution) plotted at their x,y positions. The actual location of each sounding taken on each before dredging cross section range shall be provided in the form of a printout tabulation giving the actual distance of the soundings from the centerline

(on an azimuth normal to the centerline of the cut).

3.1.5 Survey Data

In addition to the requirements in Section 35 01 50.73, paragraph entitled

"Survey Data", the Contractor shall promptly plot the channel cross sections on a scale of 1 inch = 200 feet horizontal and 1 inch = 5 feet vertical.

3.2 COLONIAL NESTING BIRDS

3.2.1 General

Colonial nesting wading birds (including but not limited to, herons, egrets, and Ibis) and seabirds/water-birds (including, but not limited to terns, gulls, Black Skimmers, and Brown Pelicans) are known to nest in the project area.
