Award will be made as a whole to one bidder.
NOTE 1: The unit “Job” as used in this Bidding Schedule is synonymous with the term “Lump Sum” that may be used elsewhere within these plans and specifications.
NOTE 2: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A
BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT
FOR ANY ITEM, ITS BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE
INELIGIBLE FOR AWARD.
NOTE 3: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only the total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub-line items are materially unbalanced (See FAR 14.404-2).
NOTE 4: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442 after Notice of Award. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within 24 hours after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Program, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

EVALUATION OF SUBDIVIDED ITEMS. (UAI 52.211-5000 - Nov 14). Item No.
0012 is subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its sub-items.
VARIATIONS IN ESTIMATED QUANTITIES - SUBDIVIDED ITEMS. (UAI 52.211-
5001 – Nov 14). This variation in estimated quantities clause is applicable only in Item No. 0012.
a. Variation from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.
b. Where the actual quantity of work performed for Item No. 0012 is less than 85% of the quantity of the first sub-item listed under such item, the contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause FAR 52.212-11, variation in estimated quantities.
c. If the actual quantity of work performed under Item No. 0012 exceeds 115% or is less than 85% of the total estimated quantity of the sub-item, and/or if the quantity of work performed under the second sub-item or any subsequent sub-item under Item No. NONE exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity.
INTERESTED VENDOR QUESTIONS AND GOVERNMENT RESPONSES
1. Stainless Steel 316 type wire versus Stainless Steel 316 L type wire. This Solicitation specs (Section 31 36 00.0013, Page 7 - Part 2, Item 2.1.1) call for Stainless Steel type 316 wire. While cost estimating this project, the New Orleans District asked pricing for Stainless Steel type 316 L wire (for budgetary purposes), which we provided. There is a difference between plain 316 type wire and 316 L type wire:
The 316 L type wire is more corrosion resistant than the plain 316 type wire. We would appreciate your looking into this item and determining if staying with 316 type wire or upgrading to 316 L type Stainless Steel wire.
Contractors shall be required to provide 316L type Stainless Steel wire for this contract in response to Bidding Schedule line item 0009.
2. Domestic or imported Stainless Steel wire. In our Gabion and Gabion mesh/accessories material fabrication we prefer utilizing domestically produced wire as it guarantees its compliance with the applicable ASTM Standards. Foreign produced wire could cost a little less but it could carry compliance’s risks. There is also the possibility that this Gabion lids’ mesh and accessories could be fabricated entirely overseas and imported in the US. Again, we would appreciate your looking into this other item and letting us know what is required for this project.
The Buy American Act applies to this solicitation. See clause 52.225-9, “Buy American – Construction Materials” and clause 52.225-10 “Notice of Buy American Requirement – Construction Materials.” Any request for a determination on the proposed use of construction material that is not compliant with the Buy American Act must be submitted in accordance with the terms of these clauses.
3. Since the site showing was less than 24 hours ago and from what we saw at the site we need more time to generate the proper questions on the project, please consider extending the question period through at least the end of the day on Monday the 29th.
Amendment 0001 was issued on 1/25/2018 to extend the bidder question submission deadline to 2:00pm, 1/29/2018.
4. On plan sheet C-02 note 8 it states that Splices in the gabion lid rolls in the Vertical direction shall have a minimum of a 2’ overlap inshore over off shore. Please clarify that note, all of the new gabion lids will lay horizontally and not vertically. I don’t see anywhere in the specifications where it mentions overlapping new lids.
See Section 31 36 00.00 13, Paragraph 3.1.2. The alignment of the stainless steel lids will follow the alignment of the existing gabion baskets. Wire lids shall be unrolled from the inshore edge of the existing baskets down slope towards the outflow channel. (Gabion lid rolls shall be placed with the long dimension being perpendicular to the outflow channel.) The two foot minimum overlap is along the 6’ edge (only) of a 150’ x 6’ roll; inshore over offshore.
5. After walking the area we found allot of the existing gabions did not have any lids or diaphragms, what do we tie the new gabion lids to when this occurs?
There are no current requirements on the Contractor to break out, replace, or repair existing damaged gabions.
Gabion lid ties will be adjusted to the degree practical at these sites to best fit ties to remaining vertical sides and/or existing lids. Such areas will likely be further repaired with a grout solution as directed by the COR, to be paid for by the cubic yard for grout placement.
6. We found that some of the existing gabions had stone missing and the plans and specs do not address replacing any missing Gabion stone, please clarify that no new stone will be required in those areas.
Contractor is responsible for clearing of the gabion surface to provide and clean flat surface prior to new lid placement, including removal of loose stones. First order of disposal for these loose stones shall be to fill any existing open gabion baskets that have stone missing. No “new” stone will be required in those areas.
7. In some areas of the existing gabions that requires new lids there is a considerable amount of stone on top of the baskets, and due to the condition of the existing baskets equipment can’t be operated over the entire area, we request that the stone be placed on the existing stone above or below the area to receive new lids.
Concur – see response to question 20.
8. Due to the complexity of the project and the number of questions, we request that the bid date be extended a minimum of 2 weeks after all questions are answered.
The bid opening date will not be extended.
9. The RFP identifies that the SDVOSB entity must perform a minimum of 20% of the work. If the SDVOSB can perform ALL or a significant portion of the work itself, will that percentage be advantages in the award scoring criteria?
This project has been advertised as an Invitation for Bid. Accordingly, there is no scoring criteria.
10. What is the USACE holding timeline of the P&P Bond?
In the solicitation, on page 1 of the SF1442 form (page 4 of the solicitation), section 12a states that performance and payment bonds are due within 3 calendar days after contract award.
11. Will USACE consider partial bonding value release based upon work completed?
No.
12. Explain Rapid vendor payment details as link is NOT working?
As of the date of this amendment, the following link is active: http://www.mvn.usace.army.mil/Business-With- Us/Contracting/Rapid-Vendor-Payment/
Rapid payment (i.e. the Prompt Payment Act) for construction services states that the Government will disburse funds within 14 calendar days of receipt of a proper invoice from the contractor except for refunds and final payment. Refunds and final payments are disbursed within 30 calendar days.
Since this project is set-aside for Service-Disabled, Veteran-Owned, Small Businesses, DoD’s policy is to expedite payment. In most cases, the Government will attempt to make payment after the 7 calendar day constructive acceptance period has passed.
13. Do labor requirements identified within the RFP apply to companies outside the jurisdiction…Home Town Plan and New Orleans Standard Metropolitan Statistical Area?
The wage rates incorporated in the Solicitation apply to Concordia Parish, Louisiana where the work will be completed.
14. Section 013300 Page 6 identifies measurement of payment by truck shall be paid by weight or volume tickets.
However, material by barge was discussed otherwise, hence conflicting data. Please clarify/validate how material tonnages will be measured and paid?
Contractors shall refer to Section 35 31 19.04 12, Paragraph 1.2.3 which outlines measurement for tonnage of Bedding Stone and Armor Stone delivered either by barge or truck.
15. If tonnage is paid by scale tickets, will contractor be paid if material is delivered and stored on site but not placed?
Negative – price for stone includes materials and placement. Stone not placed within allowable contract tolerances will not be paid for.
16. Will the contractor be afforded the opportunity to set-up temporary living arraignments on site?
No the contractor will not be allowed to set-up temporary living arrangements on site. The contractor is only allowed to set up an office trailer. Self-sustained barge mounted quarters are allowable.
17. Will existing water for non-potable purposes be available on-site for the selected contractor?
Yes non-potable water is available onsite, but only in the vicinity of the office trailer layout location in the immediate vicinity of the gated Old River Complex.
18. Will temporary construction power be available on-site for the selected contractor?
The contractor will need to contact the electric company to set up a temporary power pole for their electrical requirements.
19. Will the contractor be responsible to make repairs to existing damaged gabion netting that receive a new steel gabion? If so how will the contractor be compensated for this repair work?
There are no current requirements on the Contractor to break out, replace, or repair existing damaged gabions.
Should that requirement change at a later date, compensation would be handled under the Contract Clause in Section 00700 entitled “CHANGES (FAR 52.243-4)”.
20. During our site visit it was discovered that there is quite a bit of loose gabion stone on top of existing baskets, will the contractor be responsible to remove these loose stones? Or can we install new steel gabion lid over these loose stones?
The Contractor is responsible for removal of these loose stones to assure a clean existing surface remains for placement of new lids. First order of disposal shall be to fill any existing open gabion baskets that have stone missing. The Contractor shall then be allowed to cast stone landward and/or channelward beyond the limits of existing gabion baskets such that no significant buildup of cast stone results. All remaining cleared stone shall be removed to the government provided stone disposal site, or as directed by the COR placed in low areas of existing stone paving.
21. Based on COR provided water level information provided on drawing C-19 and C-20, it is difficult to determine when water levels will affect work at the site. With that said, will contractors be compensated for down time work stoppage due to the site limiting or stopping contractors scope of work (SOW), including being under water?
The Contractor shall make all efforts to complete work on the lower portion of the gabion field when the water levels allow for work in these areas. Mandatory work stoppages, including temporary standby or directed demobilization/remobilization would be handled under the Contract Clause in Section 00700 entitled “CHANGES (FAR 52.243-4)”. Contractor will be given notice based on the 10 day river forecast, and is responsible for removal from the site of all equipment and/or materials that might be damaged by high water. The Contractor takes the risk of leaving equipment/materials on site during these periods.
22. Item 27 of the General Provisions states that each contractor and subcontractor’s employees need to complete Suspicions Activity Reporting Training, will this training be provided by the COR or is the done 3rd party at the contractor’s expense? If provided by the COR can you provide us with the duration of the training class?
The training will be provided by the COR. The training class duration is less than one hour. This determination of training location shall be made by the COR.
23. Is there a weight capacity limit that can sit on top of the existing gabions slated to remain and receive a new lid?
Section 31 11 00, Paragraph 3.2.1 states that “Any proposed crossing of existing gabion baskets shall include provisions to assure the integrity of the gabion system remains intact.” Furthermore, Section 35 31 19.04 12, paragraph 3.1.2 states that “Truck access over the limits of existing gabions that are to receive stainless steel lid placement is not allowed.” However, based on previous contract work in the gabion field, bobcats and standard pickup truck size vehicles will be allowed to carefully traverse the gabions. No tracked equipment which may catch and damage the existing gabion wires and ties would be allowed.
24. Will a SWPP (Storm water Management Plan) be required prior to construction activities?
A SWPP (Storm Water Pollution Plan) is not required for this contract.
25. Will the bid date be pushed back to allow time to receive and evaluate responses to the questions being presented today? Can the Bid be extended one week?
The bid opening date will not be extended.
26. There are numerous loose rocks sitting throughout the project site on top of the existing gabion baskets. Can new lids be attached to existing gabions with rock remaining between the existing lids and the new lids? If not, what is the protocol to deal with the additional rock?
The contract states that the surface shall be free of any obstructions which may inhibit a flat surface for lid placement or prohibit access to the existing wire for tie placement. If loose rocks are in a depressed area such that loose rocks improve the finished surface or such that a flat surface is not inhibited, they may remain between the existing lids and the new lids. However the Contractor shall assume for the sake of bidding purposes (See Section 31 11 00, Paragraph 3.3.2 Gabion Field Clearing) that the “portion of gabion baskets to receive new stainless steel lids requires clearing to the extent that a clean existing wire surface remains for placement of new lids. This may require extensive manual clearing of stone debris… First order of disposal of misplaced gabion stone shall be to fill any existing open gabion baskets that have stone missing, to be paid for under “Clearing”. No “new” rock placement is anticipated.
27. In several locations the vertical side of the existing gabion boxes to which the lids had previously been attached are missing, meaning in that location there are two adjacent gabion boxes with no diaphragm separating them anymore. What does the contractor have to do in these locations with respect to attaching new gabion lids? Will the contractor be required to do any additional excavation at these locations to reinstall or repair the vertical portion of the existing, but damaged, gabion?
There are no current requirements on the Contractor to break out, replace, or repair existing damaged gabions.
Gabion lid ties will be adjusted to the degree practical at these sites to best fit ties to remaining vertical sides and/or existing lids. Such areas will likely be further repaired with a grout solution, to be paid for by the cubic yard for grout placement.
28. The detail labeled “GABION LID TIE DETAIL” on Sheet C-10 shows new ties being used to attach existing mesh to existing mesh without being tied to the new lid. Is this correct? If so, what are the requirements for such attachment?
The intent of the “Gabion Lid Tie Requirements” is to place ties (connecting new lids to existing seams) along the existing basket seams in both directions. Tie spacing shall not exceed 12 inches in either direction. In areas where vertical side of the existing gabion boxes are missing, gabion lid ties will be adjusted to the degree practical at these sites to best fit ties to remaining vertical sides and/or existing lids.
Such areas will likely be further repaired with a grout solution, to be paid for by the cubic yard for grout placement.
29. Note 2 under the detail labeled “GABION LID TIE DETAIL” requires tie spacing at a minimum of 12” in both directions. Should that be at a maximum of 12” in both direction?
To clarify, tie spacing shall not exceed 12 inches in either direction.
30. Note 8 on Sheet C-02 refers to rolls “in the vertical direction”? Is that a reference to rolls laid horizontally in a north-south or “towards the shore-away from the shore” orientation? It further requires “overlapped a minimum of two feet”. Is this meant to be limited to an overlap of 2’ at the short distance end of a roll, i.e. along the 6’ edge of a 150’ x 6’ roll? As written it appears that two-thirds of all new lids will be overlapped (2’ on each side of a 6’ roll).
See Section 31 36 00.00 13, Paragraph 3.1.2. The alignment of the stainless steel lids will follow the alignment of the existing gabion baskets. Wire lids shall be unrolled from the inshore edge of the existing baskets down slope towards the outflow channel. The two foot minimum overlap is along the 6’ edge of a 150’ x 6’ roll; inshore over offshore.
31. The specifications state the “Mesh shall be six (6) feet in width”. Measurements in the field indicate that some gabion boxes are not 6’ across but rather 6’ 3”. Presumably there will be other areas encountered where the existing gabion boxes are less than 6’ wide. What are the requirements for edge connection between rolls of new lids and, separately, new lid to existing gabion connections when the existing seams do not fall into line with new lid rolls?
Maximum mesh opening is limited to 4.5”. At most, new lid strand will be 2.25” from existing basket joint. Install ties on new lid strand closest to existing gabion joint/diaphragm even if they don’t exactly line up. Using 6’ rolls will consistently be the most effective roll width throughout the area. Connecting to existing lid when not practical to connect to seam will be allowed as a last resort.
32. What are the standards/requirements which will be used to evaluate any repairs needed to the access levees due do construction vehicle traffic?
The levee crown access roads shall be restored as necessary to a minimum 14 foot crown width, with no less than a 4 inch crushed stone surfacing. An additional paragraph shall be added to the Section 01100 GENERAL PROVISIONS sections of the specifications entitled “Video and Photographic Documentation” to document before and after access road conditions. All obvious rutting on the levee slopes as a result of contract activities will be repaired by the Contractor.
33. Is this project sales tax exempt? If the project is sales tax exempt can the government provide a sales tax exemption certificate?
This project is not exempt from sales taxes. See clause 53.229-3, “Federal, State and Local Taxes”.
34. Will the Government provide comprehensive written badging requirements for the project if badging is required?
There are no badging requirements to access the site during construction.
35. Does the Government currently have a 3rd party testing service for those items requiring testing or is the contractor free to locate and hire applicable testing firms?
Contractor is responsible for selecting testing laboratory, however this laboratory must be approved by the government.
36. Will the government pay for utilities to the office trailers?
The contractor will have to coordinate with the electric company to install a temporary pole a separate meter for the office trailers. Contractor is responsible for payment of these utilities.
37. Are there utility tie-in locations for the office laydown area?
The contractor will have to coordinate with the electric company to install a temporary pole a separate meter for the office trailers. Contractor is responsible for payment of these utilities.
38. How much notice will be given for high water event shut downs?
The river predictions are based on a ten day forecast so if a shutdown is required we would provide a ten day notice.
39. What are the requirements for securing the site during high water events?
The Contractor shall remove all equipment and construction materials from the gabion field work area that may be damaged during a high water event. Contractor takes all risk in leaving equipment/construction materials onsite.
40. If a high water event causes excessive delays to the project, will the general contractor be able to recoup operating expenses such as office trailer or equipment stuck on site?
Office trailer layout locations will be made available on higher ground immediately outside the gated Old River Complex. In response to the ten day notice of high water event shutdowns, the Contractor should remove equipment from the jobsite which may have the potential to be damaged during a high water event. The contractor will be responsible for equipment left on site. See response to question 21.
41. The area to receive lids only is covered with sediment and the condition of the existing baskets cannot be determined. In the case where the baskets condition is compromised such that areas where lid ties would occur are damaged or weakened by corrosion. Will the contractor be required to replace these compromised baskets? How will the contractor be compensated for this work?
There are no current requirements on the Contractor to break out, replace, or repair existing damaged gabions.
Gabion lid ties will be adjusted to the degree practical at these sites to best fit ties to remaining vertical sides and/or existing lids. Such areas will likely be further repaired with a grout solution, to be paid for by the cubic yard for grout placement.
42. The Hydrograph included in the Plans is for the Old River Outflow Channel. The hydrograph for the Mississippi River is not included. River levels can be 8 to 16 feet higher than those shown for the Outflow Channel. Mississippi water levels will impact the construction in at least two ways: first once water is against the needles on the Overbank Structure, leakage between the needles will flow toward the gabion field and could flow along the surface of the gabions; and the second and most likely issue is there will be flow through the filter material parallel to the top of bank. This flow could originate from needle leakage and/or seepage generated from the difference in head (8 to 16 foot of head) between the river and outflow channel. When this case occurs, work will have to stop even though outflow elevation is below gabions. How will this issue be addressed? Will the contractor be paid standby cost? Will the contractor be paid to demobilize and remobilize until the event passes? Will the Government Issue a stop work order when there is flow in the filter layer?
If the Government has to order the contractor to stop work due to a structure operation, the "Suspension of Work" Clause would be enacted and the contractor would be compensated for overhead costs during the suspension. If the contractor must stop work due to high water with no structure operations, the "Default" Clause would be enacted and the contractor will not be compensated but additional time would be added to the contract.
