Section 35 20 23.23 12, Paragraph 3.3 “Rights of Way”
3.3 Rights of Way
a. The U.S. Army Corps of Engineers, Venice Sub-Office and Harbor will not be available to the Contractor for vehicle parking or vessel docking.
b. Special Permit Conditions - The United States Department of the Interior, United States Fish and Wildlife Service (Service) granted Right of Entry, including ingress and egress, to perform dredging, disposal, and dike construction within the Delta National Wildlife Refuge Area ( DNWR), along the eastside of the Mississippi River and north of Pass A Loutre. All work must be completed in accordance with the contract plates and specifications, including all special permit conditions. The Contractor shall comply with the following special permit conditions:
1. The Right of Entry is valid through December 31, 2018.
2. The refuge manager is the coordinating official, having immediate jurisdiction and administrative responsibility for the refuge lands and property. The permittee must coordinate all entry onto these premises with the Refuge Manager, James Harris, or his authorized representative. Before work may begin including moving in equipment, notification of the Refuge Manager of the Delta NWR must occur by phone at (985) 882- 2027 or (985) 882- 2000.
3. All refuge regulations will be in force. Feeding wildlife is prohibited. No fishing is allowed while on location. Crewmembers can fish on their own time when properly licensed and in areas open and accessible to the general public. No pets or other animals are allowed on the refuge. Violations of applicable laws or regulations may subject the permittee and his or her employees to prosecution under State and/or Federal laws, and put this permit in jeopardy.
4. The failure of the United States or the Service to require strict performance of the terms, conditions, covenants, agreements, or stipulations, of this permit as listed in this memo, on DNWR lands will not constitute a waiver or relinquishment of the right of the United States to strictly enforce thereafter, such terms, conditions, covenants, agreements, or stipulations, which shall, at all times, continue in full force and effect.
5. If any action of the USACE employees or agents in the exercise of rights granted by this ROE result in damage to the Service's real property, the USACE will repair such damage or make an appropriate settlement with the decision made by the U.S. Fish and Wildlife Service. In no event shall such repair exceed fair market value of the fee title to the real property at the time immediately preceding such damage. The provisions of this condition are without prejudice to any rights the Service may have to make a claim under applicable laws for any damages other than those provided herein.
6. The USACE employees, agents, and/or contractors will follow all applicable State and Federal laws.
The USACE will give the refuge manager written notice of its intentions and scope of work and approval must be granted prior to the work beginning.
7. Killing or harassing wildlife is prohibited. It is illegal to molest or destroy the home or dens of wildlife. The USACE will have no impact to fish, wildlife, and their habitat.
8. Littering is prohibited. The USACE must remove all refuse each day of operations.
9. The refuge manager and/or staff can at any time inspect all sites used or occupied by the USACE or its Contractors.
10. Any disturbance impacting vegetation or surface lands beyond that identified in the scope of work are not authorized. If additional work is determined to be required, an additional written request must be made and an amendment may be added if approved by the refuge manager. If any additional disturbance occurs beyond the work request, all work must cease until approval is granted.
11. Any USACE and/or contractor equipment, facilities, or items deemed by the refuge manager necessary to be moved shall be performed at the expense of the USACE or its Contractor.
12. Should activity become necessary within DNWR, a copy of the Right of Entry permit will be sent to the Contractor. A copy of the permit, map, special conditions, and copies of the contract plates, must be carried in each vehicle or vessel while on the refuge and aboard each vessel/barge/equipment used to complete the work.
13. Access and all work is only granted to the disposal areas identified on the contract plates which are under the direct ownership and control of the U.S. Fish and Wildlife Service.
14. All other refuge regulations apply.
c. Special Permit Conditions - The Louisiana Department of Wildlife and Fisheries (LDWF) has granted Right of Entry, including ingress and egress, to perform dredging, disposal, and dike construction within the P as s A L o u t r e W i l d l i f e M an ag e me n t A r e a ( PALWMA). The disposal areas covered under the Right of Entry permit are located between Southwest Pass and South Pass, and from Head of Pass to Joseph Bayou. All work must be completed in accordance with the contract plates and specifications, including all special permit conditions. The Contractor shall comply with the following special permit conditions:
1. The Right of Entry is valid through December 31, 2018.
2. The U.S. Army Corps of Engineers (USACE) will notify LDWF at least two weeks in advance of mobilization of equipment on PALWMA. This notification shall include the project plans, anticipated date of equipment mobilization, equipment to be used on the project, and anticipated project schedules. In addition, a pre-construction meeting must be held with LDWF before initiating any activities on PALWMA. This meeting shall be attended by USACE staff including the project inspector, the dredging contractor, and PALWMA staff. USACE shall contact Vaughan McDonald at vmcdonald@wlf.la.gov or at (225) 763-8807 or Lance Campbell at ljcampbell@wlf.la.gov or at (337) 373-0032 to request a meeting.
3. LDWF would like the maximum elevation of beneficial use to be 4.5' NAVD'88. This would be consistent with previous requirements and work performed in the area. It would also provide habitat that is beneficial to a large number of wildlife that utilize the MS Delta and that are designated as "species of conservation concern" as outlined in the 2015 Louisiana Wildlife Action Plan. A few of these species include mottled ducks, and colonial birds such as black skimmers and terns.
4. Please be aware that LDWF prefers not to restrict public access on PALWMA as a result of this project. Thus, LDWF must approve any requests for closures of waterways. A request for closures of waterways shall be submitted to LDWF staff at least two weeks in advance of the need of the closure.
5. The USACE, its contractors, agents, employees and representatives must follow the rules and regulations of PALWMA. These regulations prohibit mud-boat use after 2:00 pm from September 1 through January 31. LDWF will issue separate conditional permits upon request to allow the use of mud-boats in direct support of this project. LDWF will condition these permits to limit disturbance to waterfowl and to recreational users of the PALWMA during peak periods particularly during the months of September, November, December, and January. A request for a mud-boat permit should be made at least one week prior to the need of the vessel, but should be made with as much advanced notice as possible to allow adequate time for permit processing. Requests should be made via e-mail to Vaughan McDonald at Vaughan.mcdonald@la.gov.
6. This right of entry authorizes USACE and/or its assigns the use of airboats in direct support of this project. However, no airboat activity will be allowed on PALWMA during the waterfowl seasons.
Airboat activity shall be suspended during the months of September, November, December, and January. If an airboat is needed during these months it shall be granted on a case by case basis and will require an additional "airboat permit" from LDWF. Please be aware that airboats should only be used when necessary or when an airboat can be used in lieu of marsh buggies. All marsh buggy (rubber, tire, or track) ingress or egress shall be on LDWF approved routes and shall be limited to two tracks per location except for the placement of disposal pipe during dredging operations.
7. USACE must coordinate with LDWF regarding the overnight mooring of quarter barges, equipment barges, tugboats, crewboats, etc. and the staging of floating discharge pipe at PALWMA. LDWF reserves the reasonable right to select the locations for mooring and staging of this type of equipment. LDWF also requires all floating structures to be illuminated with flashing hazard lights during night time hours. All submerged pipelines and emergent pipelines in open water must also be marked with lighting to alert boaters of the potential hazards.
8. Colonial nesting seabirds and wading birds (including, but not limited to, terns, gulls, black skimmers, egrets, herons, and pelicans) should be avoided to reduce the risk of injuring birds. The nesting activity period generally extends from February 15 through September 15. A visual inspection of the project area for nesting birds will be made prior to startup of work by qualified personnel from the USACE and LDWF. Presence of nesting wading birds and/or seabirds must be immediately reported to LDWF by the project inspector. This action will trigger an additional coordination between LDWF and USACE to perform such activities necessary to identify the nesting birds and initiate any necessary project modification(s) that would avoid disturbance to these birds and teir nests. If nests of these birds are present on the work area, a "no- work" distance restriction of 650 feet for terns, gulls, and black skimmers, 1,000 feet for colonial nesting and wading birds, and 2,000 feet for brown pelicans must be implemented. Further coordination by USACE with the U.S. Fish and Wildlife Service may result in a further reduction of "no-work distance restrictions" depending on the species of birds found nesting at the work site.
9. Should activity become necessary within PALWMA, a copy of the Right of Entry permit will be sent to the Contractor. The Contractor shall keep a copy on the job site at all times during the project.
10. Bi-weekly progress meetings between USACE and LDWF staff will be held on site during construction process of the project. Additional meetings may be required by LDWF if problems arise.
11. All equipment used in connection with the project must be removed upon completion.
12. Upon completion of the project, a final inspection and/or post-project meeting may be required by LDWF.
The meeting would be comprised of PALWMA staff, the contractor, and a representative from USACE to ensure that all stipulations have been adhered to. USACE must also submit pre and post project data (elevation/bathymetry information, acreage of marsh created, cut/fill material quantities, etc.) to LDWF.
13. USACE shall use reasonable care to avoid damage to PALWMA while conducting maintenance dredging operations. The United States has waived sovereign immunity for negligence in the Federal Tort Claims Act, 28 U .S.C. 1346, 2671-2680, and the Department of the Army acknowledges that in the event its employees are negligent, liability may attach for such negligence under the Federal Tort Claims Act. At LDWF's discretion, the USACE may be asked to maintain, repair, or restore to their pre-project condition, any canals, ditches, levees, signs, pilings, or other structures on the WMA which are damaged due to the negligence of USACE or its contractors during dredging activities. USACE may be asked to dredge to their pre-project condition, any waterways (bayous, passes, cuts, canals, trenasses, etc.) that are filled in as a result of the negligence of USACE or its contractors in the dredging operations. USACE reserves the right to either undertake the performance of any repairs, restoration, or dredging requested by LDWF; or to dispute USACE's liability for any alleged damages to PALWMA; or to enter into a settlement agreement with LDWF. In no event shall the costs of the repairs, restoration, or dredging, or the financial amount of the settlement, exceed the fair market value of the fee title to the damaged real property at the time immediately preceding the damage. USACE's liability under this paragraph is subject to availability of appropriations to make any such repairs, restoration, dredging, or payment, and nothing contained in this agreement shall be construed to imply that Congress will appropriate sufficient funds to meet any deficiencies at a later date.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
