Calcasieu River and Pass, Maintenance Dredging FY17, Mile 15.0 to Mile 36.0, 00010-2 ED 17-015
NOTE 1: The unit “Job” as used in this Bidding Schedule is synonymous with the term “Lump Sum” used elsewhere within these plans and specifications.
NOTE 2: Bidders shall furnish unit prices for all items listed on schedule of bid items, which require unit prices. If the bidder fails to insert a unit price in the appropriate blank for required items but does furnish an extended total or an estimated amount for such items, the Government will deem his unit price to be the quotient obtained by dividing the extended estimated amount for that line item by the quantity. IF THE BIDDER OMITS BOTH THE UNIT PRICE AND THE
EXTENDED ESTIMATED AMOUNT FOR ANY REQUIRED ITEM, HIS BID WILL BE DECLARED
NON-RESPONSIVE.
NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442 after Notice of Award. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within 24 hours after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Program, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.
NOTE 4: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or subline items are materially unbalanced (See FAR 14.404-2).
NOTE 5: OPTION WORK ITEMS: The Government may require the delivery of, in whole or part, the Option Work Item(s) 0004 thru 0008. The Government may exercise the Option Item by written notice to the contractor. If the Government activates an Option Item, the activation will occur while the Contractor’s plant is within the limits of work. No additional mobilization/ demobilization will be paid to the Contractor for the Optional work.
NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
NOTE 7: Any VEQ analysis under Option Items 0004AA and 0006AA will be based upon the variation in the line item quantity provided in the Bid Schedule above, and not a variation in any lesser quantity actually awarded under that option line item.
Calcasieu River and Pass
Maintenance Dredging FY17, Mile 15.0 to Mile 36.0 and, 00010-3 ED 17-015
NOTE 8: The quantities shown in Items 0008 and 0009 are for evaluation purposes only;
payment for these line items will be based on the actual quantities used and they shall be excluded from the “VARIATIONS IN ESTIMATED QUANTITIES” clause.
NOTE 9: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF OPTIONAL
WORK. In the event that the OPTIONAL WORK items are exercised under the terms of the contract, the time required for completion of the contract shall be 45 calendar days for Items 0004, and 0005; 25 calendar days for Items 0006 and 0007 in addition to the original contract duration of 250 calendar days established for the BASE WORK items specified in Section 00800, SPECIAL CONTRACT REQUIREMENTS paragraph entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK”. In the event that OPTION WORK item 0008 is exercised, the time required for completion of the contract will not be adjusted but shall be performed concurrent with original contract duration.
NOTE 10: RAPID VENDOR PAYMENT: Web based instructions for the submission of invoices;
http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.as px
NOTE 11: EVALUATION OF SUBDIVIDED ITEMS. Item Number 0002, 0004, and 0006 are subdivided into two (2) or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its sub-items.
VARIATIONS IN ESTIMATED QUANTITIES - SUBDIVIDED ITEMS. (UAI 52.211-5001 - MAR
95). The Variations in Estimated Quantities Subdivided Items clause is applicable only in Item Number(s) 0002, 0004, and 0006.
a. Variations from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.
b. Where the actual quantity of work performed for Item No. 0002, 0004, and 0006 is less than 85% of the quantity of the first sub-item listed under such items, the Contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment in contract price shall be made in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity.
c. If the quantity of work performed under Item No. 0002, 0004, and 0006 exceeds 115% or is less than 85% of the total estimated quantity of the sub-items under that item, and/or if the quantity of work performed under the second sub-item or any subsequent sub-item under Item No. (NONE) exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity.

RESPONSES TO QUESTIONS RECEIVED
PROJECT: Maintenance Dredging FY17, Mile 15.0 to Mile 36.0, Calcasieu and Cameron Parishes, LA
SOLICITATION NUMBER: W912P8-17-B-0033
QUESTION 1) As there any geotechnical data concerning the material to be dredged available? If so please provide any and all geotechnical data available.
RESPONSE: As the grab sample information from the last contract covering this reach is not yet available, we are including the grab sample information that was obtained from Contract 09-C-0069 and 10-C-0060. These samples covered the main channel reach between Miles 5 and 31.5.
QUESTION 2) Specification Section 35 20 23 - 3.1.4 Order of Work states “Dredging shall commence at Station 1427+51.41, approximate river mile 27.0.”
Commencing work at this station would result in mobilizing the equipment spread from the Southern limit of the base work, approximate river mile 15.0 to approximate river mile 27.0 to conduct option work. Can the Contractor commence work at river mile 15.0 to prevent this additional mobilization? If work is required to commence at river mile
27.0 can an additional bid item be included in the bid schedule for mobilization from the base work to the option work?
RESPONSE: The order of work for the base reach was determined based upon channel conditions surveys taken prior to advertisement and the areas in most need for dredging. Therefore, the order of work for base dredging, as presented in the specifications, will remain as is.
With regards to the optional reaches of work; if and when optional dredging is awarded, the sequence and locations of dredging will be directed by the Contracting Officer in order to meet navigation needs. With regards to any additional mobilization associated with movement of the Contractor’s dredge equipment and attendant plant that may be required to accommodate optional dredging, if awarded, the Contractor shall base his bid on re-mobilizing his dredge to Mile 34, with dredging to proceed downstream, unless otherwise directed by the COR.
Paragraph 3.1.4 shall be revised to address this optional Additional Mobilization and Demobilization, and a new paragraph entitled “1.3.6 Changing Location of Plant on Job” will be incorporated into the specs. These revised specs, along with the revised Bid Schedule, may be found at the end of this responses to the questions posed.
QUESTION 3) There are 14 different disposal areas available to the Contractor with a total area of over 1900 acres and perimeter dike length in excess of 25 miles. Collecting the required survey data to properly price the Dike Construction bid items is both time consuming and expensive. Can the CoE provide survey data concerning the condition of the existing dikes to include xyz data, estimated dike capacity, condition and quantity of weirs, and estimated perimeter dike rehabilitation requirements to include lineal and vertical foot requirements to return dikes to a workable condition?
RESPONSE: Unfortunately, the frequency of dredging that is required to maintain the Calcasieu River ship channel does not allow for time to survey these areas between contracts. An assessment of the sites should be made by each contractor, if deemed necessary, during the 30 day advertisement period. Required dike rehab and estimated lifts required for each disposal area are contingent upon several variables, including but not limited to the following:
- Character of material that is routinely dredged within specific reaches of the channel (i.e. sand versus silts and clays);
- Quantity of material within respective channel reaches to be dredged, as well as overdepth proposed to be dredged;
- Gross quantity of material planned to be dredged within the vicinity of each disposal area;
- Management of the dredge and disposal discharge and how high the dikes will need to be upgraded in order to maintain the required minimum 2’ of freeboard;
and
- How many disposal sites the contractor plans to use in completing the work.
QUESTION 4) Currently Bid Items 0003, 0007, and 0008 are all lump sum bid items for ‘Dike Construction.’ To ascertain the condition of these dikes requires a significant site investigation by all potential Contractors. Contractors will have varying price determinations depending on the level of effort & understanding of the disposal area maintenance & repair needs as determined by their costly site investigations. Due to the nature of the repairs to these perimeter dikes and because these are lump sum items potential Contractors must price risk into these bid items. To eliminate risk and burden on potential Contractors can the structure of Bid Items 0003, 0007, and 0008 be changed from Lump Sum to Unit Price? For example the repairs to the disposal sites generally occur on a linear foot basis in one foot vertical increments. If the USACE had a unit of linear foot which would allow Contractors to be bidding on a similar quantity and program the USACE would eliminate a significant amount of risk from all potential bidders likely reducing the cost of the work to the USACE.
RESPONSE: Maintenance of existing dikes along the Calcasieu River ship channel has always been paid for as ”Lump Sum” items and not by a unit price, such as “linear foot” which has been used for areas where new dikes and weirs have been constructed.
Therefore, no revisions will be made for this contract. As stated previously, the amount of dike work required will vary based upon each contractor’s dredge plant, as well as their proposed disposal plan that they deem necessary to accommodate the dredged material.
QUESTION 5) Please extend the bid deadline 2 additional weeks to allow Contractors adequate time to investigate the disposal sites.
RESPONSE: As stated previously, this solicitation was issued with a 30 days advertisement period during which a site investigation could have been performed.
Therefore, no additional time will be allowed for preparation of bids for this solicitation.
Revisions to the Contract Specifications
SECTION 00010
See the attached revised bidding schedule
SECTION 35 20 23.00 12
1. Add the following new paragraph 1.3.6:
“1.3.6 Changing Location of Plant on Job
Measurement for moving the Contractor's dredge equipment, attendant plant and equipment upon completion of base work to optional dredging reach(es), if awarded, and/or when directed to move by the Contracting Officer, will be made at the contract unit price for "Additional Mobilization and Demobilization for Moving to Option Reach - OW" (if Optional Work is exercised). Price and payment shall constitute full compensation for all operations necessary to commence dredging at the new location.”
2. Revise paragraph 3.1.4 to read as follows:
“3.1.4 Order of Work
Unless otherwise directed by the Contracting Officer, dredging shall commence at Station 1427+51.41, approximate river mile 27.0. However, the Government reserves the right to adjust order of work to be performed based on channel shoaling, changes in priority, and/or or timeliness of exercising optional work items.
If and when optional dredging is awarded, the location(s) of dredging will be directed by the Contracting Officer in order to meet navigation needs. Any additional mobilization required for movement of the Contractor’s dredge equipment and attendant plant to accommodate optional dredging, if awarded, will be paid for under the bid item entitled “Additional Mobilization and Demobilization for Moving to Option Reach - OW" (if Optional Work is exercised).
For purposes of canvassing bids, the Contractor shall base his bid on re-mobilizing his dredge from Mile 15 (lower limit of base dredging) to Mile 34 (upper limit of Option Item 0006), with dredging to proceed downstream.”
