About this file

This is a Solicitation Amendment (SF 30 - Amendment 0002) issued by the Department of the Army Corps of Engineers, San Francisco District on May 29, 2026 for the Oakland Inner and Outer Harbor FY26 Maintenance Dredging Project in Alameda County, California. The amendment modifies the original solicitation (W912P726RA007) by amending the bid schedule, revising Section 00 22 00 (Supplementary Conditions), updating the wage determination, attaching the pre-award survey requirements, and responding to Requests for Information (RFIs). The procurement is conducted under NAICS Code 237990 with an estimated cost range of $10,000,000 to $25,000,000 and is being pursued as a full and open competition Request for Proposal using the Lowest Price Technically Acceptable (LPTA) method, resulting in a single firm fixed-price contract award.

The work scope includes annual maintenance dredging of Oakland's Inner and Outer harbor channels to -50 feet Mean Lower Low Water (MLLW) plus 1 foot of paid over-depth, with total estimated quantities of 765,800 cubic yards distributed across 12 contract line items (CLINs) for 11 dredging reaches plus mobilization/demobilization. All dredged material is to be transported to and placed at Montezuma Wetlands Restoration Project, with the Government paying separate fees for offloading and placement services. Dredging cannot commence until August 8, 2026 due to Tier III sampling requirements. Technical proposals (15-page limit) must address past performance on relevant dredging projects within three years and equipment availability to demonstrate completion within 155 calendar days from Notice to Proceed. Price proposals must include completed SF 1442, pricing schedule, annual representations and certifications, bid guarantee of at least 20 percent of proposed price (not to exceed $3 million), and pre-award survey information. All proposals were originally due May 28, 2026 at 12:00 PM PDT but have been extended to June 4, 2026 per Amendment 0001, with the Contract Specialist identified as Nairi Freeman (nairi.freeman@usace.army.mil).

SECTION 00 22 00

SUPPLEMENTARY INSTRUCTIONS

GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS,

EVALUATION STANDARDS FOR CONTRACT AWARD

1. OVERVIEW

Proposals received in response to this solicitation for the Oakland Inner and Outer Harbor FY26 Maintenance

Dredging Project, Alameda County California will be evaluated using the Lowest Price Technically Acceptable method of selecting the contractor offering best value to the Government, as explained below.

2. BASIS OF AWARD

2.1. ELIGIBILITY FOR CONTRACT AWARD

In accordance with the requirements of Federal Acquisition Regulation (FAR) Part 9, no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility of the prospective awardee. To be determined responsible, a contractor must meet the general standards in FAR Part 9 and any special standards set forth in this solicitation.

2.2. SOURCE SELECTION USING THE LOWEST-PRICE, TECHNICALLY-ACCEPABLE (LPTA) METHOD

The Government shall evaluate all proposals. The contract will be awarded to this offeror upon a determination of responsibility by the Contracting Officer (see paragraph 2.1, above).

3. GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS

For purposes of this RFP, an “Offeror” may include a group of two or more entities that have formed a “contractor team arrangement,” as that term is defined in the FAR Part 9.601. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether gained while working with the other member(s) of the currently proposed contractor team arrangement, may be presented in the Offeror’s proposal.

In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed at least one of the projects submitted in fulfillment of Factor 2 of this RFP. If information about a subcontractor is submitted, the

Government will review the information on the presumption that this subcontractor will perform similar work in the construction of this project, should award be made to the respective offeror. No such awardee may substitute another subcontractor without the Government’s prior written approval.

Similarly, an Offeror that relies on the performance history of a member or members of a proposed contractor team arrangement will be expected to maintain that arrangement during performance of any contract awarded to that

Offeror under this RFP. As a part of its proposal, the Offeror must provide a contractor team agreement signed by all parties, identifying the legal name(s) of all entities and describing the nature of each entity’s relationship

(teaming/partnering, joint venture, etc.) and its proposed role in performance of this contract. Past Performance information other than the Offeror will not be considered without the team agreement. In the case of joint ventures, at least one project will be submitted from each member to demonstrate past experience. This documentation must be provided in the applicable section of the Offeror's proposal.

3.1.1 Media, Page Size, Margins, Fonts, and Page Limitations

Submit only electronic files as specifically stated in this section. Do not submit excess information, to include audio-visual materials, electronic media, etc. Do not include links to information on websites in lieu of incorporating the information physically into the proposal. Except where another size is specifically authorized for a submission, use only 8 1/2” x 11” electronic pages. Use at least 1-inch margins; except headers and footers may be outside the 1-inch margins. Do not justify the right margin. Ensure that all text and graphics are clearly legible. Do not use a font size smaller than 10-point font, and do not use unusual font styles such as script, or condensed fonts. Pages furnished for organizational purposes only, such as a “Table of Contents” or divider tabs, are excluded from page limitations.

3.1.2 Conditional Offers.

Do not include exceptions to the terms and conditions of the solicitation in either the technical or price proposal volumes. Inclusion of any company terms and conditions that conflict with the terms and conditions of the solicitation may result in a determination that the offer is unacceptable and thus ineligible for award. Resolve questions about the terms and conditions or technical requirements of the solicitation prior to submission of your offer; see “Special Instructions for Submitting Your Proposal”, located in Section 00 21 00.

3.1.3 Restrictions on Offeror-Provided Information.

Proposals shall not contain classified data. “Confidential” projects may be submitted to demonstrate capability as long as all of the information required for evaluation as specified herein can be provided to the Government as part of the offeror’s technical proposal. Offerors that include data in their proposals that they do not want disclosed or used except for evaluation purposes, must redact the data in accordance with FAR 52.215-1, Instructions to Offerors

- Competitive Acquisition.

3.2 GENERAL PROPOSAL PREPARATION.

The proposal shall be submitted as summarized below.

(1) Volume I – Technical Volume

(a) Factor 1: Past Performance

(b) Factor 2: Availability of Equipment

(2) Volume II – Price Volume

(a) Proposal Cover Sheet

(b) Standard Form (SF)1442, to include acknowledgement of Amendments, and Joint Venture Agreement (if applicable)

(c) Price Schedule

(d) Annual Representations and Certifications

(e) Offer Guarantee

(f) Pre-Award Survey Information

Each offeror must submit a proposal consisting of a “technical” volume, and a “price” volume. The two volumes must be submitted as separate volumes. Both volumes must be received not later than the date and time specified in

Block 13 of SF 1442, or as amended in a SF 30. The information in the two volumes is evaluated separately and independently. Do not cross-reference material between the non-price and price volumes.

3.2.1 Marking of Proposal Volumes.

Name the technical volume as the “Technical Volume” and name the price volume as the “Price Volume”, and include the project title and location, solicitation number, name and address of the offeror on the title page of each volume. Offerors must include a table of contents for each proposal volume.

4. TECHNICAL VOLUME

The Technical proposal must be submitted as one complete PDF electronic document.

4.1. Format, Content and Tabs for the Technical Volume

There is a fifteen (15) page limit for the overall technical proposal; however, there may be limits imposed at the tab level. Organize your technical proposal as indicated below. The tabs directly correlate to the technical evaluation factors. Although the Government may use information obtained from any source in its evaluation of the technical proposal, the Government is not obligated to search for or to consider information that belongs under a specific tab in an offeror’s proposal but is elsewhere in the proposal. Limit proposal submittals to the information specified;

excess information will not be evaluated. The term “tabs” means searchable PDF bookmarks.

4.2 Tab 2 of the Technical Proposal: Factor 1 Past Performance

4.2.1 Submission Requirements

The Offeror shall provide past performance information on dredging projects within the last three (3) years.

Experience and Capability, using the Contractor Performance Assessment Reporting System (CPARS) for any past federal projects submitted, and other sources for non-federal projects.

If CPARS evaluations are not available, the Offeror shall submit a Past Performance Questionnaire (PPQ) for each project. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. Completed

PPQs should be submitted as part of the offeror’s proposal. If the Offeror is unable to obtain a completed PPQ before the proposal closing date, the Offeror shall complete and submit the first page of the PPQ, which provides contract and reference contact information for the project(s). The Offeror shall ensure correct phone numbers and email addresses are provided for each point of contact. Completed PPQs may also be submitted by the preparer directly to the Contract Specialist and Contracting Officer by email to nairi.freeman@usace.army.mil and copy to mary.fronck@usace.army.mil prior to the RFP closing date.

The Government may review and consider information obtained from other sources, e.g., CPARS information using

CAGE/Unique Entity ID/SAM numbers of the teaming arrangement, Federal Awardee Performance and Integrity

Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), etc.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Each example project must start on a new page and there is no page limitation for CPARS and PPQ’s submission.

Pass Performance will not count against the page limitation for this volume.

4.2.3 Evaluation Criteria:

The past performance evaluation is an assessment of the offeror’s ability to successfully perform this requirement based on the offeror’s record of relevant past projects, and the documented level of satisfaction of each project owner after completion of construction. Past Performance will be determined relevant if a submitted project is similar in size, scope, and complexity to this requirement.

How well the offeror performed the prior contracts submitted under Factor 2 will be evaluated by reviewing CPARS evaluations, completed PPQ forms and other information available to the Government.

*NOTE: If an offeror does not have a record of relevant past performance or information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown (or neutral) past performance (IAW FAR 15.305(a)(2)(iv)). A neutral rating shall be considered acceptable.

Each Offeror shall be assigned one of the two ratings set forth in the table below.

Adjectival Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown *(See note above).

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

4.3. Tab 1 of the Technical Volume: Factor 2 – Availability of Equipment

4.3.1 Availability of Equipment – Evaluation Factor

The Offeror shall provide a projected timeline and supporting narrative detailing the availability of equipment. The narrative shall be task-oriented, clearly indicating the number of calendar days following pre-construction submittals and mobilization— assumed to occur approximately 30 calendar days after Notice to Proceed (NTP)—by which dredging activities are to commence and be completed. This proposal shall assume that dredging cannot start until

August 8 due to Tier III Sampling requirements. This proposal will not limit the contractor from commencing dredging earlier if sampling is completed prior to August 8.

The narrative shall also include a summary of any failures and/or successes related to equipment availability on the last five dredging projects.

Constraints:

The Offeror must demonstrate the capability and flexibility of equipment availability to meet the proposed contract completion period. The narrative shall clearly identify any known or anticipated constraints, such as:

• Equipment or labor availability

• Weather impacts

• Other logistical or operational limitations

• Dredging shall not commence until August 8, unless instructed otherwise

4.3.2 Submission Requirements

Evaluation Criteria: The Government will evaluate the Offeror’s Availability of Equipment narrative to assess the likelihood that equipment will be provided in a timely and effective manner to ensure successful completion of the project within the specified period of performance.

Narratives that clearly demonstrate the Offeror’s ability to complete dredging within 155 calendar days from Notice to Proceed (NTP), along with a general understanding of potential factors that could impact availability (e.g., labor, weather, logistics), will be considered acceptable.

Proposals that indicate equipment availability or project completion beyond 155 calendar days after NTP will be rated Unacceptable under this factor.

A proposal will be rated as Unacceptable if it does not meet the definition of Acceptable.

Technical Acceptable/Unacceptable Ratings

Rating Description

Acceptable Proposal meets the minimum requirements of the solicitation

Unacceptable Proposal does not meet the minimum requirements of the solicitation

5. PRICE VOLUME

5.1 FORMAT, CONTENTS, AND LIST OF TABS FOR THE PRICE PROPOSAL

This should be a separate file from the technical proposal. There are no page limits for the price proposal; however, responses should be focused, providing required information only. Organize your price proposal as indicated below.

Tab 5: Bid Guarantee Form and Amount

The offeror shall furnish a separate bid guarantee in accordance with the solicitation provision titled "Bid

Guarantee", FAR 52.228-1. In accordance with FAR 28.101-2 (b) the bid guarantee amount shall be at least 20 percent of the "proposed price" but shall not exceed $3 million. When the penal sum is expressed as a percentage, a maximum dollar limitation may be stated.

In accordance with FAR 28.106-1 states that a Standard Form (SF) 24 shall be used for the bid bond.

In accordance with FAR 28.202(a) (1), corporate sureties utilized must appear on the list contained in the

Department of Treasury Circular 570 titled, "Companies Holding Certificates of Authority as Acceptable Sureties on

Federal Bonds and Acceptable Reinsuring Companies."

Contractor shall provide written confirmation that the Contracting Specialist may contact the bonding company to confirm the bond agreement’s legitimacy.

Tab 6: Contractor Responsibility, Pre-Award Survey Information

To determine a contractor's responsibility for purposes of contract award in accordance with FAR Part 9, the contractor is required to provide a statement regarding previous experience and past performance in performing comparable work, information related to the business organization, financial resources, and/or plant to be used in performing the work (see Attachment 2, Pre-award Survey).

The Government will request this information from the eligible contractor after receipt of offer if they have not had a contract with the San Francisco District within the last twelve months and the Government will set a due date for its submission.

(a) If required to determine that a prospective contractor is responsible, the offeror must:

1) Demonstrate that they have adequate financial resources to perform the contract or the ability to obtain them.

2) Be able to comply with the required or proposed delivery or perform schedule, taking into consideration all existing commercial and governmental business commitments.

3) Have a satisfactory performance record. In making the determination of responsibility, the Government

Contracting Officer shall consider relevant past performance information. A prospective contractor shall not be determined as responsible or not responsible solely based on a lack of relevant performance history except when there are special standards set forth in the solicitation, which applies, to all offerors that must be met in order to receive the award. These special standards may be necessary when unusual expertise or specialized facilities are necessary in the performance of the contract; therefore, in order to be determined as responsible for a particular contract, the offeror must be able to meet those special standards. A prospective contractor that is or recently has been seriously deficient in contract performance shall be presumed to be nonresponsive unless the Contracting

Officer determines that the circumstances were beyond the contractor's control or that the contractor has taken appropriate corrective action. Other responsibility considerations by the Contracting Officer will include past efforts by the contractor to apply sufficient tenacity and perseverance to perform acceptably, to meet quality requirements of contracts, and the contractor's past compliance with subcontracting plans (if required) under recent contracts.

4) Have a satisfactory record of integrity and business ethics.

5) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors).

6) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them.

7) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

There haven't been any geotechnical investigations completed within the dredge area.

9 Because there are no slide slope payable templates, how does the Government intend the Contractor to be compensated for removal of material that sloughs from outside the pay prism into the required template during the course of normal dredging operations due to the natural angle of repose of the sediment?

Dredging on the side slope is prohibited. Material that sloughs from the side slope into the channel and is removed will be paid as evidenced by the Before and After- Dredge surveys.

10 If it is the Government's position that re-dredging of sloughed material is to be included in the unit price for in-template material, please confirm this in writing prior to bid so that bidders may price the work accordingly and on a common basis.

Dredging on the side slope is prohibited. Material that sloughs from the side slope into the channel and is removed will be paid as evidenced by the Before and After- Dredge surveys.

11 Will the Government consider revising the pay template to include a payable side slope at the natural angle of repose for the material to be dredged, consistent with EM 1110-2-5025 and customary USACE dredging practice?

Dredging on the side slope is prohibited. Material that sloughs from the side slope into the channel and is removed will be paid as evidenced by the Before and After- Dredge surveys.

12 Other USACE districts that either do not permit or do not require dredging on the slopes will still pay for material that was removed from sloughing; will this be considered for this project?

Dredging on the side slope is prohibited. Material that sloughs from the side slope into the channel and is removed will be paid as evidenced by the Before and After- Dredge surveys.

13 Please provide overall location and layout points of the Montezuma Wetlands Restoration Project (MWRP), also any expected access points if required.

Please contact Sharon Hall at sharon@montezumallc.com for the overall location and layout points of the Montezuma Wetlands site and any expected access points.

14 Please confirm there are no fill elevations, limits, or other restrictions for the MWRP

The plans for the Oakland Dredging Project don't show fill elevations or limits for MWRP. The Government will be paying all fees associated with offloading and placement at Montezuma via a separate contract vehicle.

15 Please provide a point of contact for the

MWRP

Sharon Hall, sharon@montezumallc.com

16 Please advise if MWRP will provide scow unloading on this project or if the contractor is to provide their own means of disposal at

MWRP

MWRP will provide scow unloading on this project.

W912P726RA007 | Oakland Inner and Outer Harbor FY26 Maintenance Dredging Project Revision Date: 29 May 2026

Please provide current tipping fees if applicable to this project at MWRP

Tipping fees for placement at MWRP are not included in the Oakland Dredging Project. The Government will be paying all fees associated with offloading and placement at Montzeuma via a separate contract vehicle. See RFI #2.

18 What is the average scow unloading rate per hour for maintenance material at MWRP, if MWRP will be providing scow unloading services on this contract.

Please contact Sharon Hall at sharon@montezumallc.com for average scow unloading rate per hour.

19 Please provide coordinates (easting and northing) for the concrete slab where not digging can occur below -51' MLLW, depicted on sheet C109.

There are no coordinates (easting and northing) for the concrete slab. Refer to the plan sheet C-109 for the location of the concrete slab.

20 Would the Government consider creating seperate alternate CLINs for the option to dispose material at SF-11 and SF-DODS in the event there is a delay at Montezuma exceeding 24hrs? Costs for disposal at SF-11 and SF-DODS are substantiallt different than disposal at MWRP.

The Government will not create separate alternate CLINs for the option to disposal material at SF-11 and SF-DODS in the event there is a delay at Montezuma exceeding 24 hours.

Please provide coordinates (easting and northing) for the BART Transbay tube.

There are no coordinates (easting and northing) for the BART Transbay tube. Refer to the plan sheets C-106 and C- 109 for the location of the BART Transbay tube.

The profile depicted in A1/C109 shows the 10' wide cable trenches. Please confirm that digging within these cable trenches is required.

Dredging within the 10' cable trenches is not required since they are below the dredging project depth.

23 If digging is required within these trenches, the profile shows a solid line that extends vertically from the BART tube to the top of the existing bottom, please confirm that there are no obstructions associated with these tranches and the lines are for visual representation only.

Dredging within the 10' cable trenches is not required since they are below the dredging project depth.
