Statement of Work FY 2018-2020 Maintenance Dredging

Eelgrass and Light Monitoring Surveys Alameda and Contra Costa Counties, CA

January 18, 2018

1. INTRODUCTION AND BACKGROUND

This scope of work describes the tasks that will be performed by the contractor to determine the extent of eelgrass

Zostera marina in and around the Federal navigation channels in Richmond Inner Harbor and Oakland Harbor before and after the FY 2018 – FY 2020 maintenance dredging episodes and perform light monitoring around the identified eelgrass beds when project activities occur close to them. Eelgrass and light monitoring surveys are required to mitigate the potential direct and indirect effects during dredging, pursuant to the Essential Fish Habitat consultation between the National Marine Fisheries Service, USACE and the US Environmental Protection

Agency dated July 13, 2010.

Maintenance dredging of both projects can initiate no earlier than June 1st for Richmond Inner Harbor and August

1st for Oakland Harbor. A commercial contractor will be dredging Richmond Harbor and Oakland Harbor. To comply with the Magnuson-Stevens Fishery Conservation and Management Act, the District needs to assess the effects of the dredging on Essential Fish Habitat (EFH). Eelgrass is relatively rare in coastal California embayments; however, the habitat provided by this plant is considered a significant component of EFH. The data collected from the pre-and post- dredge surveys will be analyzed to determine if there is a significant net loss of eelgrass resulting from the increased turbidity levels induced by the maintenance dredging projects. A summary report will compare the results of previous eelgrass with the results of the pre-and post-dredge surveys.

The Oakland Inner and Outer Harbor is located in the City of Oakland in Alameda County. The site is currently bordered by industrial and marine uses, as well as recreational areas: Port View Park and Middle Harbor Shoreline

Park. The Richmond Inner and Outer Harbor is located within the boundaries of Contra Costa County.

Richmond Inner Harbor dredging is scheduled to start as early as June 1st and Oakland Harbor on August 1st each year. Dredging starts are dependent on contract awards for construction, as well as securing permits from the resource agencies prior to each dredging episode.

2. DESCRIPTION OF WORK AND SERVICES REQUIRED

For Tasks 1 – 3 and Options, the contractor shall provide the services of a team composed of biologists (botanists and ecologists included), and mapping technicians with experience in eelgrass surveying in the San Francisco Bay and coast of California. The eelgrass survey team shall have extensive knowledge of the existing eelgrass patches within the vicinity of Oakland Harbor and Richmond Harbor.

The proposal will include the resume of each proposed project team member to demonstrate the aforementioned qualifications.

BASE TASKS:

Task 1 - Pre-dredge eelgrass surveys within Oakland Harbor, and Richmond Inner Harbor (with deliverables)

Please see description under work and services required for conducting pre-dredge eelgrass surveys within

Oakland Harbor and Richmond Harbor. In addition to the eelgrass surveys as described above, a reference site for Oakland Harbor (Port View Park and Middle Harbor Shoreline Park) and for Richmond Harbor (Point

Richmond and the Outer Training Jetty) shall be surveyed as well. The contractor will ensure that the reference sites are located away from areas that may be impacted by dredging-induced turbidity or any other unnatural causes of turbidity.

Eelgrass shall be surveyed within the growing season and prior to the dredging episode. Dredging is proposed to begin in Richmond Inner Harbor no earlier than June 1st and at Oakland Harbor no earlier than August 1st and pre-dredge eelgrass survey shall be conducted as soon as contract award, and as tide and weather conditions allow. Pre-dredge surveys are submitted to the National Marine Fisheries Service (NMFS) for their review at least 30 days before dredging begins for each project.

Please see deliverables/submittals/reports section below for a description of the Pre- dredge eelgrass surveys and memo to be performed as part of this task.

The contractor shall contact the Technical POC immediately if there are any technical or logistical difficulties which may delay the completion of the surveys or if there are any issues observed during the survey. The contractor shall notify the Technical POC upon completion of the surveys.

Task 2 - Post-dredging eelgrass surveys within Oakland Harbor and Richmond Inner Harbor (with deliverables)

Post-dredge surveys are to be conducted after completion of each dredging episode. If eelgrass is in its dormancy stage after dredging has concluded, surveys will be conducted during the start of the growing season in the spring

(April). USACE will notify the contractor two weeks before the end of each dredging episode.

See deliverables section below for a description of the Post-dredge eelgrass surveys and memo to be performed as part of this task.

Task 3 – Light Survey Monitoring and Reporting for Oakland Harbor and Richmond Inner Harbor

a. Contractor will develop and submit individual light monitoring plans based on the pre-dredge surveys and submit a draft to USACE within ten days after completing the Oakland Harbor and Richmond Inner

Harbor pre-dredge eelgrass surveys from Task 1. The plans will be based on the San Francisco Bay Light

Monitoring Survey Protocol (Appendix 3 of the Essential Fish Habitat Consultation between USACE, USEPA and NMFS, July 13, 2010). Contractor will deliver a final plan based on USACE and NMFS comments within five days of receiving them.

b. Once the plans are approved by USACE in coordination with NMFS, contractor will be given the authority to perform the light surveys during daylight hours when dredge operations are within the designated and approved buffer zones surrounding the eelgrass beds or patches.

c. USACE will provide the dredging contractor with the pre-dredge eelgrass survey and light monitoring plan for each project and coordinate the schedule when light monitoring activities will be needed during weekly teleconference meetings.

d. Contractor will make themselves available for the weekly teleconference calls (30 minutes) between

USACE and the dredging contractor.

e. Expected durations (not contiguous) for light monitoring is 34 days for Richmond and 28 days for

Oakland.

Option for additional Eelgrass survey (with deliverables)

If awarded, contractor will perform one additional eelgrass survey (pre- or post- dredge survey), as directed by

USACE.

OPTION YEAR: The option(s) will be exercised in accordance with Federal Acquisition Regulation (FAR) 17.207.

If exercised, option(s) would be exercised prior to the expiration of the contract. The Government will notify the contractor within 30 calendar days prior to the exercise of options. The pricing of the options will be evaluated with the overall price to ensure there is no evidence of unbalancing.

Option Year 1 for Fiscal Year 2019

Contractor shall perform Tasks 1 - 3 as stated above and if required the optional task will be exercised at the discretion of the Contracting Officer. Schedule will be provided approximately 120 days prior to the first activity needed for these projects. Year after year, these projects maintain essentially the same schedule.

Option Year 2 for Fiscal Year 2020

Contractor shall perform Tasks 1 - 3 as stated above and if required the optional task will be exercised at the discretion of the Contracting Officer. Schedule will be provided approximately 120 days prior to the first activity needed for these projects. Year after year, these projects maintain essentially the same schedule.
