REVISED STATEMENT OF WORK – AMENDMENT NUMBER 0001

Statement of Work for Barge and Tow Services for Safety Testing at the CSSC Fish Barriers

1. SUMMARY

The Contractor is required to provide barges, tow boats, operating crew, storage facilities, loading service, materials, and barge docking facilities for one (1) month after the date of award. Test dates are scheduled for September 11-15, 2023.

2. SAFETY AND HEALTH

All work shall be performed in accordance with EM 385-1-1, U.S. Army Corps of Engineers (USACE) Safety and Health Requirements Manual. Contractor personnel shall participate in morning safety briefings conducted jointly by USACE and the Contractor on business days services are required (EM 385-1-1).

3. BACKGROUND

USACE operates four (4) Aquatic Nuisance Species Dispersal Barriers, which are located between the Romeoville Road Bridge (RM 296.7) and the Pipeline Arch (RM 296.1) in the Chicago Sanitary and Ship Canal (CSSC). The U.S. Coast Guard (USCG) has established a Regulated Navigation Area (RNA) in this section of the waterway. In an ongoing effort to maintain and improve these systems, barge sparking, collision, and personnel safety testing will be performed in the Oxbow Petroleum and Marine Material Handling loading facilities.

4. DESCRIPTION OF SERVICES

4.1. The Contractor shall ensure that all equipment has been properly inspected and tested. The Contactor shall ensure that the crew provided is fully capable and is suitably trained and certified in the safe operation of the equipment. Copies of operator licenses and equipment inspection certification shall be available for inspection upon request.

4.2. The Contractor shall provide a total of seven (7) barges for long tow. At any time, up to two (2) barges may be required to be parked at the fleeting area as directed by USACE. Barges shall be in suitable condition for the request. the Contractor shall fully load the barges with non-hazardous material to achieve maximum hull exposure underwater. The loaded barge shall be ready for operation as part of the tow or to be parked as directed by the COR.

4.3. Examples of types of testing USACE will perform in the RNA include: field mapping, voltage between barges and long tow, fleeting dock and barge touch potential. The Contractor shall move and place barges safely within the RNA at the direction of the USACE personnel. Barges may be configured both end- to-end and side-by-side during testing. USACE will direct the configuration of the barges as needed for the testing. The Contractor’s tow boat captain shall have authority over all personnel on the barge and tow boat configurations regarding all matters of waterway safety.

4.4. The Contractor shall provide daily docking facilities suitable for the configuration and loading of equipment and personnel. The docking facilities shall have suitable parking and loading facilities for these operations. All arrangements with docking facility owners shall be coordinated by the Contractor. Docking facilities during business days of actual testing in the RNA shall be located nearby, such that personnel may board as early as 0630 and be at the RNA by 0700. The Contractor shall coordinate docking of barges outside the limits of the RNA during business days of actual testing for any breaks in waterway closures to allow boat traffic to pass. Work within the RNA shall be completed by 1700, and transport of personnel to a suitable docking facility to safely disembark by 1730 shall be provided.

5. SCHEDULE

The period of performance is one (1) month from date of award. Two (2) business days of barge time will be required on the water to perform the safety testing. Work to install new equipment and prepare the barges for testing may commence at any time during the period of performance. USACE will inform the Contractor of the need for services with at least a one week notice. Personnel from USACE may need to have access to barges at a suitable docking facility on any or all business days during the period of performance between the hours of 0600 and 1800 for loading and unloading. Closure of the RNA section of the canal will be arranged beforehand to facilitate testing efforts. Actual testing within the waterway may be delayed pending any weather and waterway conditions that would prevent safe operations. Equipment preparation/removal operations and testing operations will only be conducted on weekdays.

6. QUALITY ASSURANCE

USACE will develop a Quality Assurance/Work Plan (QAP) for all activities using these services over the period of performance. The QAP will include a schedule indicating when the Contractor shall provide services in accordance with this SOW. This plan is designed to include an effective surveillance method to promote effective Contractor performance. The QAP will provide a method for the COR to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to conduct quality assurance to ensure that contract standards are achieved.

7. ANTITERRORISM/ OPERATIONAL SECURITY REQUIREMENTS

7.1. The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 calendar days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative.

Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.

7.2. All contract personnel requiring routine access to Army installations, facilities, and controlled access areas, or requiring network access shall complete initial and annual refresher AT Level I awareness training. Online AT Level I awareness training is available at https://jko.jten.mil/ (website subject to change).

7.3. All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.

7.4. Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.

8. PERFORMANCE OBJECTIVE SERVICES

The Contractor shall perform services set forth in this Statement of Work. All required services are performed and no more than three (3) customer complaints are received during performance period.

8.1. SURVEILLANCE. The COR will receive and document all complaints from Government personnel regarding the services provided. If appropriate, the COR will send the complaints to the Contractor for corrective action.

8.2. STANDARD. The performance standard is that the Government receives no more than three (3) customer complaints during the performance period. The COR shall notify the Contracting Officer of the complaint(s) so that the Contracting Officer may take appropriate action to enforce the inspection clause (FAR 52.212.4, Contract Terms and Conditions- Commercial Items (May 2001)), if any of the services exceed the standard.

8.3. STATEMENT OF EQUIVALENT RATES FOR FEDERAL HIRES (MAY 2014). In compliance with the

Service Contract Labor Standards statute and the regulations of the Secretary of Labor (29 CFR part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332.
