REVISED STATEMENT OF WORK.

Statement of Work for Barge and Tow Services for Safety Testing at the CSSC Fish Barriers

1. SUMMARY

The Contractor is required to provide barges, tow boats, operating crew, storage facilities, loading service, materials, and barge docking facilities for six (6) months from the date of award.

2. SAFETY AND HEALTH

All work shall be performed in accordance with EM 385-1-1, U.S. Army Corps of Engineers (USACE) Safety and Health Requirements Manual. Contractor personnel shall participate in morning safety briefings conducted jointly by USACE and the Contractor on days services are required (EM 385-1-1).

3. BACKGROUND

USACE operates four (4) Aquatic Nuisance Species Dispersal Barriers, which are located between the Romeoville Road Bridge (RM 296.7) and the Pipeline Arch (RM 296.1) in the Chicago Sanitary and Ship Canal (CSSC). The U.S. Coast Guard (USCG) has established a Regulated Navigation Area (RNA) in this section of the waterway. In an ongoing effort to maintain and improve these systems, barge sparking, collision, and personnel safety testing will be performed in the Oxbow Petroleum and Marine Material Handling loading facilities.

4. DESCRIPTION OF SERVICES

4.1 - The Contractor shall ensure that all equipment has been properly inspected and tested. The Contactor shall ensure that the crew provided is fully capable and is suitably trained and certified in the safe operation of the equipment. Copies of operator licenses and equipment inspection certification shall be available for inspection upon request.

4.2 -. The Contractor shall provide five (5) barges for long tow and three (3) additional barges to be parked at the fleeting area directed by USACE. Barges shall be in suitable condition for the request and shall be loaded to 9 feet of barge draft. the Contractor shall either fully load the barges with non-hazardous material to achieve maximum hull exposure underwater, or leave barges unloaded as directed by the Government’s representative.

The loaded or unloaded barge shall be ready for operation; the barges will be loaded for the duration of any testing period. A rake end at the front of the required barge configuration may be necessary. There may be some testing of voltage between barges, so push knees or bumpers in between barges may be needed. No special speeds are required.

4.3 - USACE will provide a small air conditioned shelter, AC power generator and fuel to support four (4) people and data collection equipment during testing. USACE will arrange with the United States Coast Guard for a waiver of navigation rules for this operation. No personnel will be allowed outside of the building on the barges during passage within the RNA unless they are attached to suitable safety harnesses. No welding to barges is anticipated. The lift fee (CLIN 0003) applies to placement of USACE-supplied shelter and equipment onto barges.

4.4 – Examples of types of testing USACE will perform in the RNA include: field mapping, sparking during fleeting, sparking between fixed barges and moving long tow, voltage between barges and long tow, fleeting dock and barge touch potential. The Contractor shall move and place barges safely within the RNA at the direction of the USACE personnel. Barges may be configured both end- to-end and side-by-side during testing.

USACE will facilitate the configuration of the probes, fish cages, and wiring during these tests. The Contractor’s tow boat captain shall have authority over all personnel on the barge and tow boat configurations regarding all matters of waterway safety.

4.5 – The Contractor shall provide daily docking facilities suitable for the configuration and loading of equipment and personnel. The docking facilities shall have suitable parking and loading facilities for these operations. All arrangements with docking facility owners shall be coordinated by the Contractor. Docking facilities during days of actual testing in the RNA shall be located nearby, such that personnel may board as early as 0630 and be at the RNA by 0700. The Contractor shall coordinate docking of barges outside the limits of the RNA during days of actual testing for any breaks in waterway closures to allow boat traffic to pass. Work within the RNA shall be completed by 1700, and transport of personnel to a suitable docking facility to safely disembark by 1730 shall be provided.

5. SCHEDULE

The period of performance is six (6) months from date of award. Work to install new equipment and prepare the barges for testing may commence at any time during the period of performance. USACE will inform the Contractor of the need for services with at least a one-week notice. Personnel from USACE and United State Fish and Wildlife Service (USFWS) may need to have access to barges at a suitable docking facility on any or all days during the period of performance between the hours of 0600 and 1800 for loading and unloading. Closure of the RNA section of the canal will be arranged beforehand to facilitate testing efforts. Actual testing within the waterway may be delayed pending any weather and waterway conditions that would prevent safe operations.

Equipment preparation/removal operations and testing operations will only be conducted on weekdays.

6. QUALITY ASSURANCE

USACE will develop a Quality Assurance/Work Plan (QAP) for all activities using these services over the period of performance. The QAP will include a schedule indicating when the Contractor shall provide services in accordance with this SOW. This plan is designed to include an effective surveillance method to promote effective Contractor performance. The QAP will provide a method for the Government’s representative to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to conduct quality assurance to ensure that contract standards are achieved.

7 PERFORMANCE OBJECTIVE SERVICES

The Contractor shall performs services set forth in this Statement of Work. All required services are performed and no more than three (3) customer complaints are received during performance period.

7.1 SURVEILLANCE. The Government’s representative will receive and document all complaints from Government personnel regarding the services provided. If appropriate, the Government’s representative will send the complaints to the Contractor for corrective action.

7.2 STANDARD. The performance standard is that the Government receives no more than three (3) customer complaints during the performance period. The Government’s representative shall notify the Contracting Officer of the complaint(s) so that the Contracting Officer may take appropriate action to enforce the inspection clause (FAR 52.212.4, Contract Terms and Conditions–Commercial Items), if any of the services exceed the standard.

7.3 PROCEDURES

(a) If any Government personnel observe unacceptable services, either incomplete work or required services not being performed, they should immediately contact the Government’s representative.

(b) The Government’s representative will complete appropriate documentation to record the complaint.

(c) If the Government’s representative determines the complaint is invalid, the Government’s representative will advise the complainant. The Government’s representative will retain the annotated copy of the written complaint for his/her files.

(d) If the Government’s representative determines the complaint is valid, the Government’s representative will inform the Contractor and give the Contractor additional time to correct the defect, if additional time is available. The Government’s representative shall determine how much time is reasonable.

(e) The Government’s representative shall, as a minimum, orally notify the Contractor of any valid complaints.

(f) If the Contractor disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the Contractor will notify the Government’s representative. The Government’s representative will review the matter to determine the validity of the complaint.

(g) The Government’s representative will consider complaints as resolved unless notified otherwise by the complainant.

(h) Repeat customer complaints are not permitted for any services. If a repeat customer complaint is received for the same deficiency during the service period, the Government’s representative will contact the Contracting Officer for appropriate action under the Inspection clause.

C. CONTRACTOR INQUIRIES

By this Amendment No. 0001, the Chicago District, USACE provides its responses to contractor inquiries:

Q1: The bid closes on the 25th and is good for 6 months. During that 6-month timeframe you will give a week notice to have the barges ready to go? Sound right? Does anyone have a rough idea on when this might happen?

During the current lock closure? The whole Project will only go for straight 28 days?

USACE Response Q1: We expect to need barge services between 12–24 October 2020 (13 days). However, per Section B of the solicitation, we have a larger timeframe should we need to perform follow-up testing (the ordering period of any awarded contract will be 6 months).

Q2: How many barges are needed for project? I see that it says 5 and 3, so is that a total of 8 at once or is it just 5?

USACE Response Q2: We anticipate needing 5 barges for long tows and 3 barges to barge at a nearby fleeting area, a total of 8 per day per the statement of work at paragraph 4.2.

Q3: Do you need Rakes? Or Boxes? Does not matter?

USACE Response Q3: We would only want a rake end at the front of whatever barge configuration we are planning to use per the revised statement of work, paragraph 4.2.

Q4: Will all barges needed to be loaded for the duration?

USACE Response Q4: We will need the barges loaded for the duration of testing per the revised statement of work, paragraph 4.2.

Q5: What barge draft do you want barges loaded to?

USACE Response Q5: 9 feet per the revised statement of work, paragraph 4.2.

Q6: Do you have a special tow configuration(s)?

USACE Response Q6: End to end (5 barges long) for long tow. End to end 3 long for fleeting area per the statement of work at paragraph 4.2.

Q7: Do you need to make any modification to the barges? We had to weld on fittings to the barge in past for the FWLS to mount testing equipment.

USACE Response Q7: No welding is anticipated per the revised statement of work, paragraph 4.3.

Q8: Do you need to add push knees or bumpers in between barges? We had to do this for the FWLS as well so they could test in between rake and box junctions.

USACE Response Q8: There may be some testing of voltage between barges, so we may need push knees or bumpers in between barges per the revised statement of work, paragraph 4.2.

Q9: Do you need anything craned onto the barges? We had to crane some of the FWLS equipment onboard so is not an issue, just wanted to check.

USACE Response Q9: Yes will need equipment craned on barges per the revised statement of work, paragraph 4.3.

Q10: Any special Speeds you are trying to achieve when going through the barrier?

USACE Response Q10: No special speeds are required per the revised statement of work, paragraph 4.2.

Q11: One question regarding item #3 in the request. Could you please confirm what “LIFT FEE”. Could you please define that better, i.e., LIFT fee would be for use of crane for one day to set USACE supplied shelter and equipment onto barges.

USACE Response Q11: LIFT FEE will apply to placement of USACE-supplied shelter and equipment onto barges per the revised statement of work, paragraph 4.3.
