D. CONTRACTOR’S INQUIRIES: By this Amendment, the Chicago District, USACE responds to Contractor’s inquiries as follows:
Q1. At the discretion of the government, it may award any, all or none of the Option Items within 180 calendar days following the Contractor’s acknowledgment of the Notice to Proceed letter. For any option exercised, the option will be awarded at the price(s) set forth in the resultant contract and the work must be completed within the performance time of the contract, which is 365 calendar days following the Contractor’s acknowledgement of the Notice to Proceed. Should any one of the option items be awarded, the Contractor will be required to secure additional bonding (RE: FAR Clause 52.228-15 at Section 00 70
00 of the solicitation and resulting contract document. If the item #0002AA awards 180 days after NTP then we have only 185 days to complete then the remaining time could exceed the manufacturing lead time of the Generator Alone. Typical lead time could be 26 weeks and with the LDs $ 1,515.37 per day could add up to 90 days.
USACE Response Q1: The equipment supplier has indicated (confirmed) that fabrication of the generator will not exceed 12 weeks from the date of order. In addition, the government may award the options at the time of award. However, should a worst case scenario result, a time adjustment can be implemented at the government’s discretion. Therefore, if a time adjustment is warranted, the Contractor would not be subjected to liquidated damages.
Q2. Will the contractor be responsible for hiring a NACE inspector for the special coatings? 09 96 00
USACE Response Q2: This is not a requirement of this contract.
Q3. If the Generator option is accepted will the contractor be responsible for the diesel fuel during start up and load bank testing?
USACE Response Q3: The contractor shall account for the fuel costs in the generator option item. By this Amendment, a revised Measurement and Payment paragraph, specific to this item, is not being included. Instead, the government will provision the payment for said costs at the pertinent section of the conformed, resulting Contract.
Q4. Is this project tax exempt?
USACE Response Q4: Please visit Specification Section 01 10 00, paragraph 1.9, wherein it states the following, "Pursuant to the rulings of the Illinois Department of Revenue, materials which are to be physically incorporated into real estate owned by the Government are exempt from Illinois Retailers' Occupational Tax and Use Tax. However, sales of tools, fuel, lumber for forms and other end use or consumption items which are not physically incorporated into real estate are taxable sales. After contract award, the Contractor may request the Government Sales Tax Exemption Number, which must be used when purchasing tax exempt material. Nothing herein shall be construed to affect the provisions contained in Solicitation Section 00 70 00, Contract Clause entitled FEDERAL, STATE, AND LOCAL TAXES."
Q5. If there is a permit review with Calumet City will any fees be waived?
USACE Response Q5: Calumet City is waving all permit fees.
Q6. Has the USACE contacted the state of Illinois or Indiana about NPDES Permits?
USACE Response Q6: No special permits are required or anticipated to complete the work/project, including NPDES, point source, or CWA Section 401/404.
If the Contractor proposes temporary construction features that are not shown on the drawings that would require a permit (including more than one acre of land disturbing activity, or fill in a waterway, etc.) coordination will be required in accordance with Specification Section 01 57 20 paragraph 3.3.1.
Q7. Will 401,402, 403, and or 404 permits be completed by the USACE before construction begins?
USACE Response Q7: See response to Q6 above.
E. WAGE DETERMINATION: This Amendment encloses the most recent Wage Determination, General Decision IL20190009 08/30/2019.
