QUESTION 1
Section 01 35 26 Page 11 1.6.1.1.1 States SSHO cannot be Supt. or CQC Mgr.
Section 01 45 00.00 10 Page 5 3.4.2 States "The CQC System Mgr. is assigned no other duties."
(a) Is it correct that, each position of Supt., CQC Mgr. and SSHO are to be staffed by three different individuals and that none of the three can be a combined position?
(b) Is it correct that, each position of Supt., CQC Mgr. and SSHO, must be an employee of the general contractor (i.e., the Supt. cannot be an employee of a subcontracted marine contractor)?
(c) Would it be of best value to save project costs and allow the combination of CQC Mgr. and Supt.?
USACE Response 1:
(a) The original requirement was for each position of Supt., CQC Mgr. and SSHO be staffed by three different individuals and that none of the three can be a combined position. Due to the scope of this contract, the Government will allow the roles of QCQ Manager and Superintendent to be combined and fulfilled by one person. However, if the individual proves to be incapable of performing both duties adequately once the project has begun, the Contractor will then be required to staff both roles separately.
(b) The SSHO must be under direct control of the Prime Contractor.
(c) The original requirement for separation of duties is to ensure each position may execute their duties to their fullest extent.
QUESTION 2
Section 01 52 02 Page 2 1.3.2 Telephone, Water and Electricity
(a) Will the Waukegan Port District provide space in their parking lot for placement of temporary field office and storage/ lay-down area surrounded by temporary fencing?
(b) How large of an area is allowable?
(c) Where on the property will this be located? No location shown on project drawings.
(d) Will the Waukegan Port District allow temporary electrical hookup to a light pole or other source of power for temporary field office use? (Contractor to pay for hookup and electrical consumption.)
(e) Or will contractor be required to bring portable generator for power to office trailer?
USACE Response 2:
Note 5 on Sheet G-002 states: Contractor is responsible for coordinating landbased storage and handling areas, the contractor may contract either the Waukegan Port District located at 55 South Harbor Place, Waukegan, IL (847) 244-3133 and/or the Waukegan Park District located at 2000 Belvidere Street, Waukegan, IL (847) 360-4700.
QUESTION 3
Section 01 35 26 Page 27 3.4.2.1 Additional Personal Fall Protection
Per the SOW for this project, utilizing the required fall protection systems, PFD's and life rings and in accordance with EM 385-1-1, Sections 21.O thru 21.O.06, a safety skiff is not required, correct?
USACE Response 3:
EM 385-1-1 Section 05.K.01 and 29 CFR 1926.106 both require a safety skiff “where employees work over or immediately next to water”.
QUESTION 4
The Project Specifications state that the SSHO may not serve a duel roll (SSHO/QC, or SSHO/Superintendent). It is not clear if the Quality Control manager is permitted to serve as the Superintendent as well. Please advise.
USACE Response 4:
Specification Section 01 45 00.00 10, paragraphs 3.4.2 states “The CQC System Manager is assigned no other duties.” Due to the scope of this contract, the Government will allow the roles of QCQ Manager and Superintendent to be combined and fulfilled by one person. However, if the individual proves to be incapable of performing both duties adequately once the project has begun, the Contractor will then be required to staff both roles separately.
QUESTION 5
The drawings do not identify staging/laydown area. Please advise.
USACE Response 5:
Note 5 on Sheet G-002 states: Contractor is responsible for coordinating landbased storage and handling areas, the contractor may contract either the Waukegan Port District located at 55 South Harbor Place, Waukegan, IL (847) 244-3133 and/or the Waukegan Park District located at 2000 Belvidere Street, Waukegan, IL (847) 360-4700.
QUESTION 6
The Specifications state the Contractor is to provide a field office for Government administrative personnel. Due to the proximity of the USACE Northern Office, will the Government reconsider this requirement?
USACE Response 6:
Provide the specific location of this requirement in the specification. Upon verification that the specifications state that the Contractor is to provide a field office for Government administrative personnel, then yes, the Government will reconsider this requirement and likely amend the specifications to reflect the removal of the requirement to provide a field office for Government administrative personnel.
QUESTION 7
Pursuant to Solicitation Number W912P618B0007, Article 52.228-1 BID GUARANTEE (SEP 1996) (b), please advise regarding Bid Bond form that is acceptable to the Government. Also provide a Government acceptable bid bond form.
USACE Response 7:
Regarding the Bid Guarantee requirement, all bidders must comply with the provisions set forth at Clause Number 52.228-1, which is included in full text at Section 00 21 13(Instructions to Bidders) of the Solicitation document.
The prescription of the Clause can be read at www.acquisition.gov/far, by searching Subpart 28.101-2 under the Federal Acquisition Regulation. Per Clause Number 52.228-1, "the bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States." Therefore, to answer the inquiry, the "form" indicated by the Clause is meant as a form of "commitment," not a paper "form" issued by the Government.
