(2) Paragraph F, has been revised to read as follows:
F. BASIS FOR AWARD: Subject to the provisions contained herein, award will be made to one (1) Offeror who is deemed responsible in accordance with the FAR, who conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, provides the best value to the Government in accordance with the evaluation criteria. The Government reserves the right to accept other than the lowest priced offer. The right is also reserved to reject any and all offers. The basis of award will be a conforming offer, the price or cost of which may or may not be the lowest. If other than the lowest offer, it must be sufficiently more advantageous than the lowest offer to justify the payment of additional amounts. Any award price must be determined to be fair and reasonable. SEE
SECTION M FOR THE EVALUATION CRITERIA.
B. Section M of the Solicitation Document has been revised to replace the evaluation criteria and basis for award provided at Clause 52.212‐2. Therefore, the provisions set forth below replaces those previously issued under the Solicitation.
52.212‐2 EVALUATION‐‐COMMERCIAL ITEMS (JAN 1999)
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
1. RATING SYSTEM: Through use of the best value method of contracting, using the source selection trade off process, the USACE‐Chicago District seeks to acquire the services described in this solicitation and its accompanying documents. This particular acquisition method considers award to other than the lowest priced offeror or other than the highest technically rated offeror. In addition, this process permits tradeoffs among cost or price and non‐cost factors and allows the Government to accept other than the lowest priced proposal. THE BELOW RATING ADJECTIVES WILL
BE APPLIED TO EVALUATE TECHNICAL FACTORS A THROUGH H:
Outstanding: Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
Good: Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
Acceptable: Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Marginal: Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Unacceptable: Proposal does not meet requirements and contains one or more deficiencies.
Proposal is unawardable.
2. EVALUATION SYSTEM: The evaluation process essentially consists of the following: 1) Proposal compliance review, 2) technical evaluation, 3) price evaluation, and 4) price technical trade‐off analysis. An evaluation team will evaluate each contractor’s submittals in response to this Request for Proposals.
Submittals will be evaluated based on the factors described herein. The technical and non‐technical aspects of each submittal will be evaluated. ‐ RELATIVE ORDER OF IMPORTANCE: All non‐price evaluation factors are equal, when combined, are more important than price.
(i) COMPLIANCE REVIEW. The Contract Specialist or designee will make an initial review of each submittal to look for submittal information, apparent errors, omissions and areas that require clarification.
Thereafter, the findings will be submitted to the Contracting Officer for review. This information will state the specific nature of the question and the page and paragraph of the submittal requiring correction or clarification. The Contracting Officer will review the findings and, if considered appropriate, task the Contract Specialist to submit questions to the Offerors for a quick response to the Contracting Officer. The Contract Specialist will not cite apparent deficiencies (parts of the submittal that fail to meet the Government’s requirements). The submittals will not be evaluated at that time. The purpose of this preliminary review session is to eliminate minor irregularities or apparent clerical mistakes. This preliminary evaluation will assure that each submittal contains the required documentation/forms/pricing and certifications called out in the RFP.
(ii) TECHNICAL/SUBMITTAL EVALUATION. Offerors passing through the compliance review, will have each of their submittal items evaluated using the aforementioned rating system.
(iii) PAST PERFORMANCE. The offeror shall provide a listing of three relevant projects, with detailed project description of each, along with a Point of Contact Name and Telephone Number. A minimum of 2 references will be interviewed and requested to provide a rating based on the Offeror’s: a) Quality of Work; b)
Timely Performance; c) Effectiveness of Management; d) Compliance with Safety Standards; and e) Compliance with Labor Standards.
(iv) PRICE EVALUATION: Price analysis will be used to determine the total evaluated price to support the selection of the lowest priced, technically acceptable offeror. Unbalancing of line items will be checked.
3 . REQUIRED SUBMITTALS: Offerors shall provide the following materials in binders with a table of contents and tabbed Section dividers. Each Section submitted must be parallel with the submission requirements identified below. The documents required by Tab 5 shall be submitted in originals only and shall be placed in a clearly marked envelope. All information requested for Tab’s 1 through 5 must be submitted for the proposal to be considered responsive to the Solicitation.
Tab 1: TECHNICAL EVALUATION FACTORS “A” THROUGH “E:”
For Technical Evaluation Factors “A” through “E,” the offeror must provide written documentation demonstrating its ability to provide a storage facility that meets or exceeds the following minimum requirements for GFI storage as described at Technical Evaluation Factors A through E. A proposal receiving a rating that’s less than acceptable for any one of the Technical Evaluation Factors A through E will be rejected and ineligible for award. Therefore, a proposals cannot move forward in the evaluation process should the offeror’s proposal receive an unacceptable rating for any one of the Factors A through E.
TECHNICAL EVALUATION FACTOR A: Indoor: 6,000 contiguous square feet to be dedicated solely to the storage of the cylinders and hydraulic power units.
TECHNICAL EVALUATION FACTOR B: Indoor: 16,000 contiguous square feet to be dedicated solely to the gates and appurtenances.
TECHNICAL EVALUATION FACTOR C: Doors: one (1) 16' X 16'
TECHNICAL EVALUATION FACTOR D: Internal clear height: 16'
TECHNICAL EVALUATION FACTOR E: Capable of maintaining relative humidity <70% and temperature >41° fahrenheight.
Tab 2: TECHNICAL EVALUATION FACTORS “F” THROUGH “H:”
For Technical Evaluation Factors “F” through “H,” the offeror must provide written documentation or any submittal requested therein demonstrating its ability to meet the requirements contained described at Technical Evaluation Factors “F” through “H.”
TECHNICAL EVALUATION FACTOR F: Describe the overall security system of the storage facility and/or surrounding grounds by addressing each of the following: (i) the means of securing entrances (e.g. warehouse doors, gates, etc.), (ii) of the surveillance system (e.g. CCTV camera), and (iii) of the intrusion detection system. Failure to address any subpart will result in the assumption that the system does not exist. Photos are acceptable as part of narrative.
TECHNICAL EVALUATION FACTOR G: Fire alarm / fire suppression system used at proposed storage facility.
Photos are acceptable as part of narrative.
TECHNICAL EVALUATION FACTOR H: Provide resume (at least one) of a handling / shipping specialist. The specialist may be an employee of the Contractor or may be an outside consultant. The specialist must be experienced in packaging, picking, handling and transporting large fabricated items. Resumes that offer more experience in the above will be considered more favorably.
What qualifies as Acceptable: At a minimum, the Contractor has provided complete information called out in the Technical Evaluation factors.
What is considered Unacceptable: Incomplete description/details (totally absent or required/key elements not spoken to). Submittal item clearly does not meet requirements of the Statement of Work, and has not demonstrated an understanding of the government’s requirements.
Tab 3: PRICE PROPOSAL: Section B of the Solicitation document (Bid Schedule): The offeror shall fully complete the Bid Schedule, ensuring that it provides a price for all line items. The fully completed Bid Schedule serves as the offeror's “Price” Proposal.
Tab 4: PAST PERFORMANCE: PAST PERFORMANCE REFERENCE/INFORMATION ‐ The offeror shall provide a listing of three relevant projects, with detailed project description of each, along with a Point of Contact Name and Telephone Number. A minimum of 2 references will be interviewed and requested to provide a rating based on the Offeror’s: a) Quality of Work; b) Timely Performance; c) Effectiveness of Management; d) Compliance with Safety Standards; and e) Compliance with Labor Standards. In lieu of providing a list of relevant projects, Offerors who have sufficient ratings in the Federal Past Performance Information Retrieval System (PPIRS) may provide copies of their most recent ratings for evaluation by the Source Selection Evaluation Team.
PAST PERFORMANCE EVALUATION RATINGS:
Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable: Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability.
PAST PERFORMANCE RISK ASSESSMENT:
LOW RISK – Based on offeror’s past performance record, essentially no doubt exists that the offeror will successfully perform the required effort.
MODERATE RISK – Based on the offeror’s past performance record, some doubt exists that the offeror willsuccessfully perform the required effort.
HIGH RISK – Based on the offeror’s past performance record, extreme doubt exists that the offeror will successfully perform the required effort.
UNKNOWN RISK – No relevant performance record is identifiable upon which to base a meaningful performance risk prediction. A search was unable to identify any relevant past performance information for the offeror or key team members/subcontractors or their key personnel. This is neither a negative or positive assessment.
Tab 5: SIGNED PROPOSAL, Representations and Certifications, and any Amendments:
SF 1449 ‐ return Page 1 with Blocks 30a, 30b and 30c completed by an authorized person from the company or joint venture.
Section K of the Solicitation document (Representations and Certifications): The offeror must complete and submit the Representations and Certifications contained in Section K of this Solicitation.
Amendments: Any Amendments issued against this Solicitation shall be acknowledged on a SF 30.
4. BASIS FOR AWARD.
Subject to the provisions contained herein, award will be made to one (1) Offeror who is deemed responsible in accordance with the FAR, who conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, provides the best value to the Government in accordance with the evaluation criteria.
The Government intends to award a contract without discussions based on initial proposals received;
therefore, the proposals shall contain the Offeror’s best terms from a cost and technical standpoint.
However, the Government reserves the right to conduct discussions in accordance with FAR 52.215‐1.
Should discussions be necessary after evaluations, the Government will establish a competitive range of the Offerors that are the most highly rated. The Government reserves the right to seek clarification in the proposals.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
