USACE Response: All excavated materials shall be disposed of off-site in accordance with Specification Section 01 10 00.00 03 para 1.17.

(22) Contractor Question: At the pre-bid meeting it was mentioned that electrical and water facilities are available at the site. Would usage of these utilities be metered and would there be cost associated with their use?

USACE Response: The Contractor shall be responsible for obtaining utilities required to perform the work. The costs of any utilities used shall be incidental to the work performed as described in Specification Section 01 22 00.00 10.

(23) Contractor Question: What is the intended purpose of the 23 grout holes indicated on drawing C-103?

USACE Response: The intent is ground water infiltration control – SEE Specification Section 31 75 07.

(24) Contractor Question: At the prebid meeting it was stated that the Corps will not require a dewatering system to be left in place at the completion of the shaft excavation work and that any dewatering system will be considered as means and methods for the sole purpose of the contractors shaft excavation work. Please confirm.

USACE Response: Pumps and dewatering equipment is not a permanent requirement for this Contract. Dewatering for this contract is only required for the duration of the work. SEE Specification Section 31 00 00.

(25) Contractor Question: Where will dewatering effluent be discharged to after it has passed thru the temporary settling tanks?

USACE Response: Handling, managing and disposal of the groundwater infiltrate are the Contractor's responsibility. All appropriate mining or other permits involved shall be obtained by the Contractor as part of this work. SEE Specification Section 01 57 20 01 05.

(26) Contractor Question: Hours of blasting states that “No blasting operations shall commence before 8:00 a.m. on any work day and all blasting operations (including the detonation of any placed charges) shall be completed prior to 7:00 p.m. of that same day”.

Please confirm that this restriction only applies to the detonation of placed charges. For example could a charge be loaded prior to 8am the day of a blast?

USACE Response: Preparations for blasting may be performed prior to the stipulated time.

The time for blasting itself is stipulated. SEE Specification Section 31 75 07.

(27) Contractor Question: Sheet C-502 shows the “Typical Support Detail for Clay Seam or Fracture Zone”. What bid item is this paid under and how is it paid for?

USACE Response: This part of the work is not anticipated and has been removed from the plans. Sheet C-502 has been updated.

(28) Contractor Question: Specification 31 75 07 section 3.5 states “Pre-excavation grouting of a minimum 25-ft deep zone of bedrock immediately below the top of the rock at the Access Shaft shall be performed prior to any shaft excavation to reduce groundwater infiltration in the shafts.” Drawing C-103 states “Grout 20 ft into rock”. Spec 31 73 00 section 3.2.2 states "It is anticipated that the required depth of ring grout holes will not exceed 150 feet…” Please clarify the depth of the grout hole.

USACE Response: Grout holes shall be a minimum of 25 feet into bedrock. Additional depth and additional holes may be necessary to control inflow. SEE Specification Section 31 75 07.

(29) Contractor Question: Are there any existing utilities available onsite for Contractor use for this project? If so, what are the size, capacity, and location of utilities?

USACE Response: The Contractor shall be responsible for obtaining utilities required to perform the work. The costs of any utilities used shall be incidental to the work performed as described in Specification Section 01 22 00.00 10.

(30) Contractor Question: Specification 01 35 26.00 03, section 3.1.3 Unforeseen Hazardous Material states that, "if material is hazardous and handling of the material is necessary to accomplish the work, the government will issue a modification pursuant to FAR…" If hazardous or special waste material is found during excavation and Contractor is directed to proceed with the work, is the USACE to be signatory as the "Generator of Waste"?

USACE Response: No. The site owner is the Generator of Waste. Based upon the past HTRW investigations, we do not think there should be any hazardous materials. However, if any hazardous material is found it will be handled on a case by case basis. SEE Specification Section 01 35 26.00 03.

(31) Contractor Question: The Contract includes FAR 52.232-15, which provides that a progress payment clause will not be included in the Contract. This appears to conflict with the payments clause at FAR 52.232-5(b), which calls for monthly progress payments. Please clarify the expected frequency of payments.

USACE Response: These two clauses are hereby deleted from the solicitation.

(32) Contractor Question: Clause FAR 52.232-5003 is included in this contract and states that only $500,000 is available to fund the Project for the current fiscal year. If no work occurs during this fiscal year, will the current reserved funds ($500,000) be applied to this project? Is there any further information with respect to funding for this project?

USACE Response: Yes; if no work is performed during this current fiscal year, the reserved amount of $500,000.00 will remain on the contract to be carried forward/and or used during the next fiscal year. The funding aspect of this project is captured in the EFARS Clause 52.232- 5003, which is incorporated into Section 00800 of the Solicitation (See page 53 of 55 of the Solicitation document).

(33) Contractor Question: Spec 31 75 07 section 2.4 states that wood will only be allowed for initial shaft ground support that is to be covered later by sheet piling unless otherwise approved by the COR. Section 3.41 states that initial shaft ground support systems for shaft excavation in soil may consist of steel ribs and lagging. Please clarify if wood lagging is acceptable to use in the initial shaft ground support system, and if used, is it required to be covered by sheet pile as stated in section 2.4?

USACE Response: Wood lagging is acceptable as a part of initial support and is not required to be covered by sheet piling provided the design is by a registered Professional Engineer or Professional Structural Engineer. SECTION 31 75 07 Para 2.4 has been updated.

4. CONTRACTOR PERFORMANCE EVALUATIONS. In accordance with the provisions of Subpart 36.201(Evaluation of Contractor Performance) of the Federal Acquisition Regulation (FAR), construction contractor’s performance shall be evaluated throughout the performance of the contract. The United States Army Corps of Engineers (USACE) follows the procedures outlined in Engineering Regulation 415-1-17 to fulfill this FAR requirement. For construction contracts awarded at or above $100,000.00, the USACE will evaluate contractor’s performance and prepare a performance report using the Construction Contractor Appraisal Support System (CCASS), which is now a web-based system. After an evaluation (interim or final) is written up by the USACE, the contractor will have the ability to access, review and comment on the evaluation for a period of 30 days. Accessing and using CCASS requires specific software, called PKI certification, which is installed on the user’s computer. The certification is a Department of Defense requirement and was implemented to provide security in electronic transactions. The certification software could cost approximately $110 - $125 per certificate per year and is purchased from an External Certificate Authorities (ECA) vendor. Current information about the PKI certification process and for contacting vendors can be found on the web site: http://www.cpars.navy.mil/. If the Contractor wishes to participate in the performance evaluation process, access to CCASS and PKI certification is the sole responsibility of the Contractor.
