SECTION H - SPECIAL CONTRACT REQUIREMENTS

The following have been modified:

SPECIAL CONTRACT REQUIREMENTS

SPECIAL CONTRACT REQUIREMENTS – REQUIRED INSURANCE

1. REQUIRED INSURANCE

a. The contract shall procure and maintain during the entire period of performance under this contract, the following minimum insurance:

TYPE AMOUNT PROPERTY DAMAGE

Comprehensive General Liability $500,000.00 Each Occurrence ----- ----- Each Accident $100,000.00 $500,000.00 Aggregate ----- Automobile Liability $200,000.00 Each Person ----- $500,000.00 Each Accident $100,000.00 Worker’s Compensation & Employer’s Liability Minimum $100,000.00

c. The Contractor shall insert the substance of the clause entitled “Insurance Work on a Government Installation (FAR 52.228-5),” in subcontracts under this contract, that require work on a Government Installation and require subcontractors to provide and maintain the insurance required above.

SECTION L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR QUOTERS

The following have been added by full text:

Q&A Question No. 1: L.2.1 – indicates that offerors are to submit the Definitive Responsibility Criteria with their bid.

However both L.1.11 and M.DRC indicate that the bidder is not required to submit at the time of bid. Please clarify if it is required to be submitted with the bid or if it will be requested from the apparent lowest bidder after bid opening.

Answer: Reference Solicitation, Section M – Evaluation Factors for Award, Definitive Responsibility Criteria, Note, which states, in relevant part that, “bidders are not required to submit additional documentation related to these criteria at the time of the bid. Instead, within four (4) days after the date of the bid opening, the Government will request supporting documentation from the apparent low bidder.”

(emphasis added).

Question No. 2: Per Exhibit A.# - Contract Personnel: Is the Government requiring a QC Supervisor and one or more QC Inspectors on this contract or is the make-up of personnel at the Contractors’ discretion?

Answer: The Government requires a Superintendent or Contract Representative to be on-site while work is being performed, and the Contractor shall appoint at least two Quality Control Inspectors to perform quality control, safety and work crew supervision (C-1.14 and C-1.18).

Question No. 3: Section C-2.4 – Mowing Cycle: This section states, “Mowing and trimming shall commence within forty-eight (48) hours… and each park completed with two days.” Will the government stagger the release of individual parks to enable a reasonable size mowing crew to work full time, or is the intent to release the entire lake at one time with all areas due within two days? This creates a surge requirement that is very difficult to staff without bringing in multiple subcontracted crews, resulting in scatter service and higher costs.

Answer: Refer to Section C-2 of the Scope of Work (C-2.1) and the Schedule of Work (C-2.3(a)). The Government has requested that work be completed before the following weekend. While not all areas may be released the same week, historically all areas have been released at the same time.

Question No. 4: Section C-2.3(b) – Perimeter Trimming. Will this work be paid by the linear foot per item #16 on the Bid Schedule rather than part of the general mowing requirement?

Answer: CLIN 0016 is paid by linear foot.

Question No. 5: Will the government ensure all area are brought to the specified standard prior to the gaining contractor beginning operations or pay to bring to standard?

Answer: The areas are currently being maintained in accordance with the standard set forth in the Performance Work Statement and will be maintained as such until contract award.

Question No. 6: Can the government further clarify, “trim any encroaching vegetation 4 foot into the unmaintained zone line and 10 feet up over the maintained area or as COR designates.” When the COR can “designate” the parameters for approximately 10 miles of perimeter trimming, the contractor has no way of pricing the COR’s interpretation of this requirement. Can the government please quantify the standard?

Answer: The COR’s interpretation would always be a subtraction to the requirement due to rocks, terrain, utility poles, etc. that may interfere with the Contractor’s ability to clear vegetation. There would not be an additional requirement imposed that would exceed 4 foot into the unmaintained zone line and 10 feet up over the maintained area.

Question No. 7: Does the Government provide the necessary internet and hard phone line necessary in the administration office area?

Answer: A phone line will be provided by the Government, but internet services will not be provided.

Question No. 8: Section C.4 – Janitorial Services. As custodians do not work the ten Government Holidays however FTE’s are paid for those days as per the D.O.L. wage determination. Does the Government pay the contractor for paid Holidays in which the contractor is not working or is it the responsibility of the contractor to incur costs for Holidays and vacation time?

Answer: The contractor is responsible for paying its employees in accordance with applicable wage determinations and wage regulations. The Government is only responsible to pay for services rendered pursuant to the terms of the Contract.

Question No. 9: Section C.4 – Janitorial Services. Approximately how many square feet of rugs and carpets are to be shampooed or steam cleaned twice annually?

Answer: Reference Section C-4, Table 4.2 for the approximate size of each building.

Question No. 10: Would the Government consider adding a Line Item to the pricing schedule for reimbursement of Performance and Payment bonds at actual contractor cost? It is difficult to estimate the cost of the bonding necessary when quantities performed can vary so drastically.

Answer: Yes. Reference Amendment 0001, which includes a revised Bid Schedule.

Question No. 11: What methods will the Government utilize to ensure that bids are responsible based on FAR 14.408-2 “Reasonableness of Price” thus ensuring that the award minimizes Government risk and is fair to other responsible bona fide bidders? I.E. Will the Government use the Internal Government Estimate or historical pricing data as pricing standards?

Answer: Price reasonableness will be determined in accordance with the considerations set forth in Federal Acquisition Regulation (FAR) 13.106-3, FAR 14.408-2, and FAR Subpart 15.4.

Question No. 12: Can you confirm that Underwriters Laboratories, Inc. provided testing for the beach waters?

Answer: Underwriters Laboratories, Inc. has no required role in testing beach water. See Section C-9.2 for the standard of Beach Water Testing.

Question No. 13: Is the contractor responsible for paying Underwriters Laboratories, Inc if they win the bid?

Answer: The awardee will be responsible for testing beach waters in accordance with Section C-9. Water samples shall be tested in accordance with the procedures contained in the latest edition of the Environmental Protection Agency’s (EPA’s) Standard Methods for the Examination of Water and Wastewater Analysis and in 40 CFR, Part 136.

Question No. 14: Can you provide the previous Contractor’s information?

Answer: That information can be provided pursuant to a Freedom of Information Act (FOIA) request and may be available by searching for the former contract on www.beta.sam.gov.

Question No. 15: We are planning to use all subcontractors – do they have to be WOSB certified?

Answer: Reference FAR 52.219-30(d), Limitations on subcontracting, as well as Class Deviation 2020- O0008, Revision 2 – Limitations on Subcontracting for Small Business.

Question No. 16: Can you verify what the white markings on the tree represent? Do we cut down everything in front of it?

Answer: The white lines delineate the edge of the mow line that can eventually be ordered through perimeter trimming. The contractor is not expected to cut to the white marked trees unless specifically ordered through Section C-2.3 b. Perimeter Trimming .

Question No. 17: What constitutes the mow line?

Answer: Reference Section C-2 Table 2.5 Estimated Seasonal Mowing and Approximate Acreage and Section C-1.31 (s.) Maintained Area: The area designated at start of contract and marked in conjunction with maps Exhibit J of each area. Generally, this is 4 feet into the tree line of a mowed area down to 4 feet into the water’s edge.

Question No. 18: Verify if the leaves are to be cleaned up and removed or just blown off the paved surfaces?

Answer: Leaves can be blown off the impact sites, campsites, and paved areas. Please reference Section C- 2.3.

Question No. 19: On the locations that receive heavy traffic, what are the best days or time to mow?

Answer: Reference Section C-2.3(a). Typically mowing is released on Mondays to ensure mowing is complete by weekends.

Question No. 20: Could you confirm that every single CLIN from 0028 through 0077 should have labor rates attached to the equipment, vehicle and/or tool?

Answer: Reference Amendment 0001. The Bid Schedule was revised to remove the Note and labor rates apply to the corresponding labor categories.
