52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is

52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT--CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American --Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested--
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.
52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be Twenty percent (20%) of the bid price or Three Million Dollars ($3,000,000), whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
52.233-2 SERVICE OF PROTEST (SEP 2006)
(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from

QUOTE INSTRUCTIONS
1. DESCRIPTION OF WORK: This is a 100% Small Business set-aside for asphalt overlay, seal coat (fog seal) and pavement striping at Martins Fork Lake located at Smith, Harlan County, Kentucky in accordance with the scope of work.
2. TYPE OF CONTRACT: The Government intends to award a Firm-Fixed Price Construction contract.
3. BASIS FOR SELECTION OF AWARD: Award shall be made to the lowest priced offeror who is determined to be responsive and responsible. Quotes must meet or exceed the technical specifications and delivery schedule to be considered for award.
4. PLACE OF DELIVERY: Martins Fork Lake Field Office, 5965 Hwy 987, Smith, KY 40831.
5. PERIOD OF PERFORMANCE: The period of performance is sixty (60) calendar days from the date of award.

Section 00 70 00 - Conditions of the Contract
SCOPE OF WORK
MARTINS FORK LAKE
ASPHALT OVERLAY, ASPHALT SEAL COAT and PAVEMENT STRIPING
SMITH, HARLAN COUNTY, KENTUCKY
DESCRIPTION
The Contractor shall provide all labor, transportation, materials, tools, and equipment necessary to apply a compacted asphalt overlay, asphalt seal coat (fog seal) and pavement striping at Martins Fork Lake. Martins Fork Lake is located at Smith, Kentucky approximately 12 miles southeast of Harlan, Kentucky.
The Work shall include all necessary work to prepare the existing surfaces and apply an asphalt overlay, asphalt pavement seal, striping of parking spaces, handicap parking symbols and access aisles. The new pavement striping layout shall approximate the existing pavement striping layout.
All work shall be completed within 60 calendar days from Notice of Award.
GENERAL
1. The work included in this project consists the following:
a. Cleaning, preparing and placing hot mix asphalt (HMA) for patch work repairs in damaged pavement areas (potholes):
1. All potholes in the areas scheduled to receive an asphalt overlay or asphalt seal coat shall be repaired.
b. Cleaning, preparing and placing sealant into the pavement cracks:
1. All cracks greater than 0.25 inches in width in the areas scheduled to receive an asphalt overlay or asphalt seal coat shall be sealed.
c. Cleaning, preparing and placing a compacted 2-inch hot mix asphalt (HMA) overlay to the following area:
1. Entrance Road: State Hwy 987 to boat ramp parking area – approximately 1,950 square yards (approximately 230 tons of asphalt).
d. Cleaning, preparing and applying an asphalt seal coat in the following area:
1. Office / Storage Complex: Roads and Parking Areas - approximately 2,900 square yards.
2. Dam Site: Roads and Parking Areas - approximately 3,150 square yards.
3. Tail Water / Fishing Area: Roads and Parking Areas - approximately 850 square yards.
4. Tail Water / River Area (below State Hwy 987 Bridge): Parking Area - approximately 500 square yards.
e. Pavement Striping
1. Twenty-seven (18.5 feet long by 9 feet wide) standard parking spaces.
2. One (18.5 feet long by 9 feet wide) handicapped parking space with handicap symbol and a 5 foot wide access aisle. Located at office complex.
3. One (18.5 feet long by 9 feet wide) handicapped parking space with handicap symbol.
Located at the tail water / fishing area.
f. Provide a 2- foot wide dense graded aggregate (DGA) shoulder to allow for a smooth transition of the pavement to the existing ground.
1. Entrance road (both sides) from State Hwy 987 to boat ramp parking area – approximately 400 square yards. (approximately 45 tons of DGA).
2. The new pavement striping layout shall approximate the existing pavement striping layout.
3. The Contractor shall minimize the time that the areas is closed to traffic. Once work has begun, the Contractor shall work consecutive days to complete the project.
4. The Contractor will be provided with a staging area adjacent to the project site.
5. The Contractor is responsible for securing all equipment, tools, materials and supplies.
6. The Contractor shall remove and dispose of all waste material not identified by the Government (Corps of Engineers) to be saved and turned over to the Government.
7. Provide submittals for the proposed materials to the Government for approval prior to beginning work.
8. All work shall meet the requirements of the 2012 Edition of the Kentucky Transportation Cabinet (KTC) “Standard Specifications for Road and Bridge Construction”.
MATERIAL
Hot Mix Asphalt (HMA)
1. Hot Mix Asphalt for the overlay and repair work (potholes) shall be CL2 Asphalt Surface 0.38D PG64-22 in accordance with KTC Standard Specifications Section 401 and Section 402.
2. Asphalt mixing plants shall conform to requirements of AASHTO M156.
Tack Coat
1. Emulsified asphalt for tack coat shall be SS-1 or SS-1h in accordance with KTC Standard Specifications Section 806.
2. Conforms to ASTM D977.
Seal Coat
1. Emulsified asphalt for seal coat shall be SS-1h (or equivalent) in accordance with KTC Standard Specifications Section 806.
2. Conforms to ASTM D977.
Crack Sealing
1. Provide Type I or Type II sealant conforming to ASTM D6690.
Paint
1. White paint shall be in accordance with KTC Standard Specifications Section 842 and Section 846.
2. Blue paint in accordance with industry standard “Handicap Blue” color.
3. Paint shall be manufactured and formulated for use as traffic paint.
Shoulder Material
1. Dense Graded Aggregate (DGA): 1-inch to fine, evenly graded.
2. Conforms to KTC Standard Specifications Section 805.
Water
1. Water shall be reasonably clean and free from oil, salt, acid, alkali, sugar, vegetable, or other substances detrimental to the finished product.
2. The water shall be in accordance with KTC Standard Specifications Section 803.
EQUIPMENT
Crack Sealing
1. Melter / Applicator (Hot Applied Material)
a. Provide equipment that is capable of heating the material to the require temperature and to then maintain the temperature as long as required.
b. Equipment shall be capable of continuously agitating the material to ensure uniformity of temperature.
c. The applicator shall have a nozzle shaped for inserting into the crack to be filled and have sufficient pressure to apply the fill material at the recommended rate.
d. Conforms to ASTM D6690.
Asphalt Overlay
1. Hot Mix Asphalt Paver
a. Asphalt pavers shall be self-propelled and capable of spreading and finishing the HMA courses to the required widths, depths, line, grade, elevation and cross section, with a smooth finish, uniform density and texture without requiring an undue amount of back dressing.
b. HMA must be delivered to the paver in a manner to maintain a relatively constant head of material in front of the screed.
i. Maintaining a minimum amount of HMA in the hopper.
ii. Regulating HMA feed rate by controlling conveyor/auger speed and flow gate openings (if present).
iii. Maintaining a constant paving speed.
c. The hopper should never be allowed to empty during paving operations.
d. Avoid spilling asphalt in front of the paver.
e. Comply with applicable provisions of KTC Standard Specifications Section 403.
Roller
1. Provide self-propelled rollers that are capable of reversing smoothly.
2. Steel-wheeled rollers shall be equipped with adjustable scrapers, spray bars and wetting pads to keep the wheels clean at all times.
3. The number, type and weight of the rollers shall be sufficient to compact the mixture while it is still in a workable condition.
1. Provide equipment that is capable of heating the material to the required temperature without introducing moisture, overheating the material or otherwise changing the characteristics of the material.
2. Use a distributor designed to apply the material at the required rate.
3. Comply with applicable provisions of KTC Standard Specifications Section 406.
1. The asphalt emulsion may be applied with a standard bituminous distributor.
2. Spreader bar shall be clean, free of burrs and of a consistent size to maintain an even distribution of fog seal material.
3. The equipment shall be capable of the application rate specified in this document.
4. Heating and mixing of the asphalt emulsion shall be in accordance with manufacturer’s recommendations.
5. Comply with applicable provisions of KTC Standard Specifications Section 406.
WORK EXECUTION
All work shall be applicable requirements of standard specifications of the 2012 Edition of the Kentucky Transportation Cabinet (KTC) “Standard Specifications for Road and Bridge Construction”. The Contractor shall schedule work to minimize the time that the areas are closed to traffic. The following information is generalized summary of work and may not cover all work necessary to provide a complete and final product.
Patch Work
1. The edges of the pothole shall be cut away to sound material and cut vertically to provide a shoulder against movement of the patch.
2. The area to be patched shall extend 1-foot beyond the damaged area.
3. The prepared pothole shall have square edges.
4. If an unstable base is found, remove and replace with HMA.
5. Potholes shall be cleaned of all loose material or other deleterious.
6. Apply a tack coat to the area to be repaired before placing HMA.
7. Place HMA into repair area in one lift.
8. Compact using roller compactor.
Crack Repair
1. Cracks larger than 0.25 inches shall be cleaned and sealed.
2. Cracks shall be cleaned of all loose material or other deleterious substances (including loose sealant from previous repairs).
3. Cracks shall be dry before sealant is applied.
4. Fill the crack from the bottom up and to the proper level.
5. The level of crack sealant material shall be slightly lower than the surrounding pavement surface and should not spill over the top of the crack, where it could create a bump in the new seal coat.
