QUESTIONS AND ANSWERS
LOYALL SLIDE REMEDIATION
1.) What forms are required for use of materials and what is the approval process for said form/materials?
Answer: Reference Specification Section 01 33 00 for a description of the submittals process. Also, reference Specification Section 01 45 00.15 for the requirement to use the Resident Management System Contractor Mode (RMS CM). The cover sheet for all submittals, ENG Form 4025, is generated directly from RMS CM.
2.) Also, could you briefly tell me about other paperwork required throughout the process?
Answer: Reference Specification Section 01 95 00 for a list of required submittals and Specification Section 01 330 for description of the submittals process. Additionally, pursuant to Specification Section 01 45 00, the contractor is required provide QC daily reports and three phase meeting minutes Pursuant to FAR Clause 52.222-8, the contractor is required to provide certified payrolls (FAR 52.222-8).
3.) Are submittals required to be submitted through RMS and if so, how do I get access to RMS?
Answer: See the Government’s Response to Question No. 1.
4.) Are there any bodies or remains left in the area covered in the plans and specifications?
Answer: All known human remains have been removed from the contract work limits.
5.) What do we do if we encounter remains/bodies during the excavation/construction process?
Answer: In the unlikely event human remains are discovered in the contract work limits, the contractor will be required to follow the procedures set forth in Specification Section 31 00 00 EARTHWORK, Paragraph 3.1.5.1; Drawing VS-1-06, note 4.
6.) Regarding CLIN 0017 (A&B); where are these in the specifications?
Answer: Reference Specification Section 31 00 00, Paragraph 3.5: Rock Buttress.
7.) Is the Corps open to other VCE Submittals?
Answer: Prospective bidders should bid as specified. After award, pursuant to FAR Clause 52.248-3, Value Engineering – Construction (OCT 2015), which is incorporated in this IFB by reference, the Contractor is encouraged to develop, prepare, and submit value engineering change proposals (VECP’s) voluntarily. However, the acceptance of a VECP should not be assumed or factored into the development of the bid.
8.) Does the Corps have a specific design they want utilized for the river diversion during construction? Is there a size requirement for the diversion?
Answer: Reference Specification Section 01 14 02 STRUCTURAL PRACTICES and Section 01 57 19 TEMPORARY ENVIRONMENTAL CONTROLS, Paragraph 3.3, for the minimum requirements for the diversion structure. Note: Specification Section 01 14 02 STRUCTURAL PRACTICES states the temporary diversion structure must be built from clean rock, the Government will consider other designs so long as none of the proposed materials would potentially have an adverse effect on water quality.
9.) Is there a CLIN for Diversion design? If not; which CLIN would pricing for Diversion Design fall under?
Answer: The Diversion Design is considered a submittal and, therefore, pricing for such design should be included in CLIN 0001 Mobilization/Demobilization.
10.) Do any designs submitted have to be certified by an Engineer with a PE Stamp?
Answer: Reference Specification 31 68 13 REINFORCEMENT FOR SLOPE PROTECTION, which requires the Slope Protection Plan must be certified by a licensed Engineer or Geologist. Reference Specification Section 31 00 00, Paragraph 3.2.2 Geotechnical Engineer, for all other submittals requiring certification by a licensed engineer.
11.) Is the Contractor required to provide their own QC Lab onsite? If so, is the lab required to be certified?
Answer: Contractor is not required to provide their own onsite QC lab. Instead, the Contract requires the Contractor is required to use a USACE-validated testing laboratory or establish a USACE-validated onsite testing laboratory. Reference 01 45 00 section 3.7 for additional details regarding QC lab testing.
12.) Is P6 scheduling required?
Answer: Currently, the Government uses Primavera P6 version 8.4. Reference Specification Section 01 32
01.10 for the minimum requirements for the scheduling software utilized by the Contractor.
13.) Specifications 1.2.2.2: Earthworks - There is a NOTE that states the maximum grade allowed is 10%; however, the plans have an 11.9% grade on CP1-01, please clarify.
Answer: ENG 385-1-1 Page 4-4, Section 4: Temporary Facilities, Paragraph 04.B.10 (b & c) specify that:
b. Access/haul roads should be kept to less than a 10% grade. There should be no more than 400 ft (121.9 m) of grade exceeding 10%.
c. The maximum allowable grade shall not exceed 12% ppp.
The 11.9% grade included in the plans on CP1-01 is less than 400 feet.
14.) ENG 385-1-1: Safety and Health Requirements link provided.
Answer: https://www.publications.usace.army.mil/Portals/76/Publications/EngineerManuals/EM_385-1- 1.pdf?ver=2015-04-09-142531-467
15.) The haul route goes through the City of Loyall. What permitting is required and is the use of off road articulated trucks permissible or do all trucks need to be road trucks?
Answer: All contractor traffic on public roads are subject to applicable local and state regulations.
16.) Can the awarded Contractor utilize their own disposal site?
Answer: Subject to approval of the Contracting Officer, the contractor may use an alternative disposal site.
17.) What are the requirements for utilizing a private disposal site?
Answer: To be approved, an alternative disposal site must have all applicable state and local permits required to receive waste materials from the site.
18.) Are there any limitations to removing the access road from the church up to the cemetery? If so, please explain?
Answer: Yes. In order to prevent drainage from being directed onto the property, the side of the access road that adjoins the church property needs to remain intact and the access road embankment that adjoins the church property and parking lot must not be destabilized by excavation or road construction. Note: no drainage or material should leave the work area limits shown on Drawing VC-1-04
19.) Can asphalt be disposed of in the disposal area?
Answer: The awarded Contractor is required to submit a disposal plan for approval per the Specifications 31 00 00.
Kentucky regulation (401 KAR 47:150) allows for onsite disposal of demolition debris, including asphalt.
If the asphalt is used in construction of the road between the cemetery road and the disposal area, that would be acceptable so long as it is contained entirely in uplands and is not below the ordinary high water mark of a stream or in a wetland area.
If the asphalt is stored in the disposal area, it must be segregated from all other material and clearly identified in plans. It is not to be mixed with any other rock in the disposal area. Either way, the awarded Contractor shall clearly identify how the asphalt was used, whether it be in construction of a new road or stored in a segregated manner in the disposal area.
20.) Will blasting be necessary to meet an allowable grade to the disposal area?
Answer: Blasting for the haul road is not required, but may be necessary to meet the allowable grade.
21.) Is blasting required for slide material excavation?
Answer: Blasting is not required for slide material excavation, but may be utilized at the contractor’s discretion and with prior approval of the Contracting Officer.
22.) Have the residents that share the haul road been notified of the pending project and increased utilization of the road by construction vehicles? If so; what was their response?
Answer: No. after contract award, the Government intends to hold a public meeting to inform the public of the anticipated schedule and activities associated with the contract. The contractor should plant to participate in the meeting.
23.) There is a fact sheet for this project on the USACE Nashville District Media website that shows the total estimated cost at $5.3M dollars; yet the solicitation states an estimated magnitude of between $1M and $5M dollars.
Which is correct?
Answer: The estimated magnitude on the solicitation is correct. The total estimated cost shown on the fact sheet is for the entire project, including the following costs: study, design deficiency determination, planning, S&A, construction, and engineering during construction.
24.) Is this job restricted to a certain type of haulage equipment?
Answer: USACE does not recommend the use of off road equipment on the highway. However, the contractor may request permission to utilize such equipment from the City of Loyall, KY-DOT & Harlan County DOT. If such approvals are obtained, USACE will permit use of such equipment.
25.) What is the maximum slope that tracked haulage equipment can travel?
Answer: 12% is the maximum haul road slope for any type of equipment. Per the specifications Section 1.2.2.2: Earthworks - Note and ENG 385-1-1 Page 4-4, Section 4: Temporary Facilities, Paragraph 04.B.10 (b & c) specify that:
b. Access/haul roads should be kept to less than a 10% grade. There should be no more than 400 ft.
(121.9 m) of grade exceeding 10%.
c. The maximum allowable grade shall not exceed 12% ppp.
26.) We would like to use a tracked haulage truck (morooka) to haul the material, which can haul up to a 30% slope (manufacture spec).
Answer: Reference the Government’s Response to Questions 24 and 25.
27.) We are proposing to haul the material through the cemetery road to reduce town disturbance and reduce street damage. To do this it would put us at about a max of 17.5% slope. Does this method seem appropriate?
Answer: No, material cannot be hauled through the cemetery to the disposal site.
28.) How long will the contractor be shut down if any material from a grave is found?
Answer: The length of a shutdown depends on the type of remains found. See Specification 31 23 05, Section 3.13, and Drawings VS-1-06 and CG-1-01 for additional information. However, in the unlikely event remains are discovered the contractor should establish a 25 foot buffer around the remains and immediately contact: the Contracting Officer Representative, the Harlan County Coroner (606-573-3030) and the Kentucky State Archaeologist (859-323-1968). All work outside the buffer zone may continue.

If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey.
Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH- 0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations.
Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7).
Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board).
Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
