SUMMARY OF CHANGES
SECTION A - SOLICITATION/CONTRACT FORM
The following have been added by full text:
Q&A for W912P5-15-R-0016
Q1. Reference Paragraph C-1.33 Payment: The Contractor will be paid only for work accomplished and performed in accordance with these specifications and the requirements of Delivery Orders. The Contractor's administrative time to accomplish work, including time spent traveling to and from the job site and for the purpose of transporting personnel, equipment, materials, and supplies or other Items to the job site will not be considered as work for payment under this contract. Please further clarify how this restriction applies, does it mean that if the contractor drives one its vehicles off Cordell Dam proper, to pick up a part or some type of supplies in a nearby city and returns to the Contractors Compound, then time traveling is not considered work and will not be reimbursed?
A1: The cost for transporting Contractor-Furnished Items (CFI) for work required for this contract is the contractor’s responsibility and will not be reimbursed. For example, cleaning supplies, trash bags, mowing equipment and their delivery to the jobsites shall be the responsibility of the contractor and will not be reimbursed.
When the contractor is required to transport Government-Furnished Items (GFI) to the jobsite from the Cordell Hull Service Base, and the size or the quantity of GFI exceeds the capacity of the Contractor’s service vehicle (see C-1.23 b. and c.), the contractor will be reimbursed as a part of the negotiated task order for the job. On the rare occasion when the contractor is tasked with the pickup of GFI at a location other than the Service Base the contractor will be reimbursed as a part of the negotiated task order for the job.
Q2: Reference Proposal Evaluation Paragraph 4.2 Evaluation of Factor II – Operations sub paragraph 4.2.3 Operations Plans proposing personnel (current employees or proposed employees supported by letters of commitment) with more than two (2) years of recent experience (within the last 10 years) with similar work or contracts will be rated more favorably than Operations Plans proposing less experienced employees (current or proposed). How does a contractor propose current employees and employees with letters of commitment and still meet the requirements of FAR Clause 52.222-17, Nondisplacement of Qualified Workers (MAY 2014) (E.O.13495)?
A2: There is no conflict between Proposal Evaluation Paragraph 4.2 and the requirements of FAR Clause 52.222-17. The intent of Paragraph 4.2, and specifically paragraphs 4.2.3 and 2.2.1. (f), is to describe managerial and supervisory personnel. These personnel are not “service employees” in the definition of FAR 52.222-17 (a), and are not covered under the right of first refusal criteria.
Q3: Reference Section C-5 Facility Repair, Maintenance and Other Non-Routine Work Paragraph C-5.2 Emergency Work. This Paragraph reads in part… A surcharge will be paid to the Contractor as an additional cost per hour added to the basic hourly rate of the services. How will this be applied and will the contractor be able to add the allowable markup to this rate, and how would that be accomplished?
A3: On the rare occasion that emergency work is ordered, the contractor shall add 1 hour of the emergency work bid item to each hour of labor used to perform the emergency work task. The additional surcharge would
W912P5-15-R-0016 be a line item on the contractor’s estimate for the task order that is negotiated after the emergency work is completed.
Q4: Reference Section B Schedule of Prices. Section C-3 Cleaning Services Recreational Facilities and Areas and Section C-6 Beaches, Playgrounds, Water Testing and Sand Filter Sewer Systems. Would the government consider adding a statement that reads in part that a surcharge would be added to the labor rate for holiday pay for hours worked on holidays under the sections listed above?
A4: No, an item for holiday surcharge will not be added. It is the contractor’s responsibility to comply with Department of Labor Guidelines for employees that work on holidays. See C-1.5 b. for a list of observed holidays.
Q5: First it was mentioned during the site meeting that the contract has been revised since it was solicited five years ago and new items were included in this one. What are the differences between this version and the previous? What new items and services were included?
A5: The revisions made from the previous contract consisted of removing Section 12 -Maintenance of Landscape Areas and adjustments to the estimated quantities from the previous contract. Section 12 included items such as Trimming and Pruning, Mulching, Seeding, Overseeding, and Fertilizing.
Q6: On the price schedule item 44 Emergency Work, is that a price per hour in addition to the price of whatever service on the price schedule they are providing? If not how does it apply?
A6: On the rare occasion that emergency work is ordered, the contractor shall add 1 hour of the emergency work bid item to each hour of labor used to perform the emergency work task. The additional surcharge would be a line item on the contractor’s estimate for the task order that is negotiated after the emergency work is completed.
Q7: Would the government consider adding Section C-1 Management and ODC to Section B Schedule of Prices to enable issuing a funded task order for the cost of salaries for the Superintendent, Quality Inspector and Clerk and other direct cost that are associated with management of the contract.
A7: No, each Offeror must determine how to recover these costs within the price schedule furnished in the solicitation.
Q8: Does the government intend for the contractor to recover its direct cost of management, equipment, ODC, G&A and Fee by calculating and using a percentage rate, multiplied times the direct labor for each line item to recovery these cost?
A8: Each Offeror must determine how to recover these costs with the price schedule furnished in the solicitation.
