STATEMENT OF WORK

Statement Of Work (SOW) For

PORTABLE RESTROOMS,

HOLDING TANK AND HAND WASH STATIONS CONTRACT

AT

CORPUS CHRISTI ARMY DEPOT

1.0 GENERAL: To provide portable restroom, holding tank and hand wash stations throughout the Corpus Christi Army Depot.

1.1 Scope: The Contractor shall provide portable restrooms, holding tank and hand wash stations throughout the

Corpus Christi Army Depot. The Contractor shall perform to the standards of this contract. The Government will not exercise any supervision or control over the contract service providers performing the service herein.

Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Contractor shall be knowledgeable, skilled, trained, qualified, certified, registered, licensed, insured, bonded, permit to handle, treat and dispose of collected sewer waste in accordance with permits, local, city, state, federal, environmental regulations and applicable laws. At no time shall waste be treated and/or disposed of on Naval Air Station (NAS) Corpus Christi. The treatment and/or disposal of waste generated by portable restrooms, holding tank, and hand wash stations shall be done off base and in accordance with applicable local, city, state, federal, environmental regulations, and laws.

1.2 Equipment Requirement: Upon notification by the COR, phone or email request for either equipment delivery and/or pick up, the Contractor shall respond within 24 hours. Under special circumstances and/or emergencies as declared by the COR, the Government will require a 12 hour response time. All delivered units shall be ready for use with an adequate amount of supplies, e.g. toilet paper, paper towels, filled water reservoirs, ready to use and no leaks. The Contractor shall be notified by the COR for exact location for placement of units. At no time shall the Contractor place units without receiving instruction from the COR. Unit(s) shall be consistent in color, appearance and age to represent a positive image.

1.3 Place of Performance: Corpus Christi Army Depot located on the Naval Air station in Corpus Christi, Texas.

1.4 All Contractor Personnel shall limit their travel on the installation only to specific areas required for performance of the contract, specified break and meal areas, or in travel directly to and from these locations.

Contractor personnel found on the installation away from officially designated work areas may be detained and/or debarred from the installation.

1.5 Quality Control (QC): The Contractor shall develop and maintain an effective Quality Control Program (QCP) to ensure services are performed in accordance with this SOW. The Contractor shall develop and implement procedures to identify, prevent and ensure non-recurrence of defective services. The Contractor’s QCP is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the Contractor shall develop QC procedures that address the areas identified in the Performance Requirements Summary.

1.6 Quality Assurance (QA): The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government will do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.7 Recognized Holidays: The following are recognized US holidays. The Contractor shall not perform services on these days:

CCAD may schedule a “compressed work schedule” during various times of the year. The Contracting Officer may authorize a “compressed work schedule” for Contractor operations during a planned CCAD “compressed work schedule”. The Contracting Officer will inform the Contractor of any planned CCAD “compressed work schedule” at least 7 calendar days prior to the change via email or memorandum.

1.8 Hours of Operation: The Contractor shall provide services based on a 40 hour week, except on US Holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings. Normal hours of operation are 40 hours per week. The hours of required support shall parallel with those hours that the regular CCAD maintenance teams are available to provide assistance. The exact hours and days may change in instances of Government furloughs or shift changes.

No overtime is authorized without prior approval from the contracting officer (KO). For other than firm fixed price contracts, the Contractor shall not be reimbursed when the Government facility is closed for the above reasons. The Contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this SOW when the Government facility/installation is not closed.

1.9 Security Requirements: The Contractor shall obtain a credential by enrolling in DBIS ID through the U. S. Navy Security Office and the CCAD Security Office. Identification media provided by Security shall be surrendered to the Navy Security Office upon completion or termination of the contract or upon termination of an individual’s employment with the Contractor.

1.9.1 The Contractor personnel shall obey all rules and regulations of this installation where services are performed while on the premises of such installation. These regulations include, but are not limited to, presenting valid identification for installation entrance, obtaining and using vehicle passes for all Contractor-owned vehicles, obeying all posted directives, and providing strict adherence to Military Police direction in instances where Military Police have been dispatched to a particular location.

1.9.2 The Contractor shall comply with all Federal, Navy, Army, CCAD policies and regulations as well as environmental regulations and laws.

1.10 Physical Security: The Contractor shall be responsible for safeguarding all Government equipment, information and property for Contractor use. At the close of each work period, Government facilities, equipment and materials shall be secured. The Contractor shall clean repair site and dispose of used materials/parts daily from the work site and occupied office/on-site assigned premises. The Contractor shall maintain good housekeeping practices to reduce the risk of fire, damage, and personal injury. The Contractor is responsible for the safekeeping and all contractor-owned equipment at the job sites. If the Contractor stores materials, tools and equipment at the work-site, it is at his own risk. The Contractor shall coordinate with the COR prior to this action. The Government is not responsible for theft, damage, etc., of this property.

1.11 Key Control: The Contractor shall establish and implement methods of ensuring all keys/key cards issued by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. NO keys issued by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the QC Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicated keys/key cards to the Contracting Officer’s Representative (COR).

1.11.1 In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction by the KO, re-key or replace the affected lock or locks; however, the Government, at its option, replaces the affected lock or locks or performs re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due to the Contractor.

1.11.2 Government Keys/Key Cards: The Contractor shall prohibit the use of the Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of services in those areas, or personnel authorized entrance by the KO.

1.11.3 Lock Combinations: The Contractor shall establish and implement methods of ensuring all lock combination are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know on such combinations. These procedures shall be included in the Contractor’s QC Plan (if one is required).

1.12 Conservation of Utilities: The Contractor shall instruct employees in utilities conservation practices. The Contractor shall operate under conditions that preclude the waste of utilities which include turning off the water faucets or valves after using the required amount.

1.13 Special Qualifications: On-site contractor personnel shall consist of field service representatives with proper skill sets and in adequate numbers to provide clean functional portable restroom rental in accordance with statement of work paragraph 5.0 requirements. NOTE: The Government will not provide training to Contractors.

Contractors shall ensure that any personnel performing under a contract are fully trained, licensed, certified and qualified for the position in which they will be serving.

1.14 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the KO in accordance with the Federal Acquisition Regulations Subpart 42.5. The KO, COR, and other Government Personnel, as appropriate, may meet periodically with the Contractor to review the Contractor’s performance. At these meetings, the KO will apprise the Contractor of how the Government views the Contractor’s performance and the Contractor shall apprise the Government of problems, if any, being experienced.

The Contractor shall resolve outstanding issues raised by the Government. Contractor attendance at these meetings shall be at no additional cost to the Government.

1.15 Contracting Officer Representative (COR): The COR will be identified by a separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.16 The Contractor personnel shall be knowledgeable on, handling and servicing of portable restroom facilities to include portable restrooms, holding tank and hand wash stations.

1.17 The Contractor shall address all typical support issues, procedures, and repair.

1.18 The on-site Contractor representative shall have reach-back support from their home office as required.

PART 2

DEFINITIONS & ACRONYMS

2.0 DEFINITIONS AND ACRONYMS:

2.1 DEFINITIONS:

2.1.1 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or services to the Government. The term used in this contract refers to the prime.

2.1.2 CONTRACTING OFFICER (KO). A contracting officer is a person who has authority to enter into, administer, and/or terminate contracts, and make related determinations and findings on behalf of the Government.

Note: The only individual who can legally bind the Government.

2.1.3 CONTRACTING OFFICER’S REPRESENTATIVE (COR). A U.S. Government employee who has been designated by the KO to monitor Contractor performance. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the

SOW.

2.1.5 DELIVERABLE. A deliverable is anything that can be physically delivered and includes non-manufactured items such as meeting minutes or reports.

2.1.6 KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process that may be required to be used in the performance of a contract by the Key Personnel listed in the SOW. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7 PHYSICAL SECURITY. Physical security is actions taken to prevent the loss or damage of Government property.

2.1.8 QUALITY ASSURANCE. The Government procedures to verify that services being performed by the Contractor are performed according to the acceptable standards.

2.1.9 QUALITY ASSURACNE SURVEILLANCE PLAN (QASP). It is a document written to outline the surveillance methodology to be used for surveillance of Contractor performance.

2.1.10 QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11 SUBCONTRACTOR. A subcontractor is an individual that enters into a contract with a prime contractor.

The Government contracts with the Prime not the subcontractor.

2.1.12 WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

2.1.13 WORK WEEK. Monday through Friday, unless specified otherwise.

PART 3

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT AND SERVICES

3.0 GOVERNMENT FURNISHED ITEMS AND SERVICES:

a. The Contractor shall be furnished with access to various locations throughout the Corpus Christi Army Depot during normal working hours as previously defined.

b. The Contractor shall be provided potable water for holding tank.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4.0 CONTRACTOR FURNISHED ITEMS AND RESPONSBILITIES: The Contractor shall provide all labor, material, supervision, equipment, supplies, transportation, quality control and other items and non-personal services necessary to provide the handling and servicing of portable restroom facilities to include portable restrooms, holding tank and hand wash stations at the Corpus Christi Army Depot.

4.1 General: Except for those items specifically stated to be Government-Furnished in paragraph 3.0, the Contractor shall furnish everything required to provide portable restrooms as indicated in paragraph 1.1.

4.2 Secret Facility Clearance: N/A

4.3 The Government is not liable for damage or loss of equipment as a result of storm. The Contractor shall coordinate pick up and return.

PART 5

SPECIFIC TASKS

5.0 REQUIREMENTS:

5.1 Basic Services: The Contractor shall provide the handling and servicing of portable restroom facilities to include ten (10) each portable restrooms for male and two (2) each for female, two (2) Handicap restrooms, one (1) 250 gallon holding tank, and four (4) hand wash stations at the Corpus Christi Army Depot. On-site contractor personnel will provide turnkey work.

5.1.1 Description of Services: The Contractor shall provide handling and servicing of portable restroom facilities to include, ten (10) each portable restrooms for male and two (2) each for female, two (2) Handicap restrooms, one (1) 250 gallon holding tank, and four (4) hand wash stations at various locations throughout Corpus Christi Army Depot.

A. Delivery, Relocation and Pick up: Upon approval by the Contracting Officer and notification by the COR by phone requesting equipment delivery, relocation or pick up, the Contractor shall respond within 24 hours.

B. Material / Equipment / Unit:

1. Portable Restrooms: The Contractor shall ensure each unit is equipped with a working lock system, occupied/vacant indicator, tissue paper holder firmly attached to the unit per manufacturer’s specification; seat cover shall be hinged, and in working order on a monthly basis.

2. The Contractor shall be capable of providing handicap accessible unisex restrooms on a monthly basis.

3. Holding Tank: The Contractor shall provide a 250 gallon Holding Tank on a monthly basis. The holding tank will be connected to a 2 inch – 3 inch pvc tube/pipe draining out of Portable building/trailer kitchen sink.

4. Hand Wash Stations: The Contractor shall provide portable hand wash stations on a montly basis that are capable of being used by a minimum of two persons simultaneously. The Contractor shall ensure each unit is equipped with a working lock system. Additionally, the Contractor shall ensure paper towel and hand soap holders are firmly attached to the unit per manufacturer’s specification.

5. At no time shall the placement of portable restrooms, portable hand wash stations, or holding tank placement block means of egress from CCAD buildings and/or trailers, on sidewalks where the path of travel is blocked or where access to them is inconvenient for the occupants who will be using the services.

6. The placement of portable restrooms, portable hand wash stations, or holding tank placement under this contract shall maintain a separation distance of at least 10 feet from any electrical substation/transformers, equipment main disconnects or electrical panels.

7. Services: The Contractor shall complete an Identification of Service record after each service. The record shall include as a minimum the identification of the Contractor who completed the service and date of service.

8. Portable Restrooms: Portable restrooms shall be emptied and cleaned twice a week and re-supplied with deodorized potable water, and toilet paper twice a week.

9. Holding Tank: Emptied weekly.

10. Hand Wash Stations: Cleaned and supplied twice a week with paper towels, hand soap and its holding tank filled with potable water.

11. Units shall be placed withing 50 feet of service trucks.

C. Unserviceable: In the event that the respective unit is not serviceable, the Contractor shall be required to replace the unit with a serviceable unit within 24 hours after notification by COR.

5.2 Task/Requirement Heading: The Contractor shall ensure all work be performed by qualified service technicians. If units cannot be delivered, serviced or picked up within 7 days the contractor shall inform the Government’s COR of any delays.

5.3 The Contractor shall provide this service in the presence of the assigned COR on regular workdays excluding federal holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings.

5.4 RESERVED

5.5 CONTRACTOR PERSONNEL

5.5.1 BASE PASS. The Contractor shall ensure all employees have a current and valid base pass when performing work on the installation. Contractor shall wear identification above the waist on the front of the body and will be worn at all times while the bearer is on the federal installation.

5.5.2 SAFETY. The Contractor bears sole responsibility for compliance at all times with Federal, state, and municipal safety and health laws, regulations, and standards that apply to the work performed under this contract, including the Occupational Safety and Health Act. The Contractor shall take all reasonable steps and precautions to maintain compliance with applicable regulations/ requirements, prevent accidents, and preserve the health and safety of Contractor and Government personnel performing or in any way coming in contact with the performance of the work required by this contract. The Contractor shall also take additional immediate actions/precautions as requested by the contracting officer when the contracting officer determines that such measures are necessary for safety and health purposes. The Contractor shall emphasize to all employees that intentional disregard for Contractor or Government safety requirements could be used as grounds for termination of employment. This shall include Contractor supervisors who condone such actions. If the Contractor fails or refuses to promptly comply with all safety requirements, the Contracting Officer may issue a stop order for all or part of the work until satisfactory corrective action has been taken. The Contractor shall not be granted an extension of time nor claim excess costs or damages due to any stop order. The Contractor shall be responsible for obtaining and wearing the appropriate safety personal protection devices, waste shall not be treated and disposed of on CCAD base installation according to local, city, state, federal and applicable environmental regulations and applicable laws. Applicable regulations include, but are not limited to the following:

a. EM 385-1-1 (USACE Safety and Health Requirements)

b. 29 CFR 1910 Department of Labor – Code of Federal Regulations – General Industry

c. 29 CFR 1910.26 Department of Labor – Code of Federal Regulations – Construction

5.5.3 Safety inspections. The safety plan will describe how the Contractor will accomplish frequent safety and health inspections of Contractor and subcontractor work sites, material, and equipment to ensure conformance to the Contractor’s Safety and Health Plan and the requirements of this contract. Inspection frequency shall be at least daily, or as described in the Contractor’s “safety and health capabilities and processes” narrative submitted in response to the solicitation for this contract, whichever is more frequent. Identify the personnel who will perform these inspections, and describe their qualifications. Inspections shall be documented in writing and made available to the contracting officer upon request. Inspection documentation shall include the name of the inspector, date of inspection, and all identified safety and health problems and deficiencies. Follow-up inspections to ensure correction of any identified deficiencies must also be conducted and documented in inspection reports

5.5.4 Accident Investigation and Reporting. The Contractor shall immediately notify the Chief, Safety and Occupational Health Division, Corpus Christi Army Depot and the COR of all accidents/mishaps which result in a lost-time injury or damage to Government or private property. The Contractor shall complete an incident report and submit it to the Chief, Safety and Occupational Health Division via the COR within twenty-four (24) hours. When the Chief, Safety and Occupational Health Division determines from the incident report that an investigation is warranted, the Contractor shall conduct an investigation and provide to the Chief, Safety and Occupational Division via the COR within ten (10) days a report which includes the facts surrounding the accident, statements from witnesses, findings regarding causative factors, corrective actions taken, and recommendations.

5.5.5 Mishap Statistics. The Contractor shall maintain statistics of all employee mishaps, occurring during the performance of the contract, which results in injury, death and/or damage to Government or private property.

5.5.6 Electrical Equipment Safety. The Contractor shall ensure all electrical and electronic equipment use and maintenance is perform IAW the National Fire Protection Association’s National Electrical Code and Subpart S of

29 CFR 1910.

5.5.7 Contractor employees working in areas where there are potential electrical hazards shall be provided by the contractor with, and shall use, electrical protective equipment that is appropriate for the specific parts of the body to be protected and for the work to be performed.

5.5.8 Contractor shall employ a written lockout/tagout program, as compliant with 29 CFR 1910.147 and 29 CFR 1926.417.

5.5.9 Contractor shall ensure all portable electric tools and equipment are protected by a ground fault circuit interrupter device (GFCI). The GFCI may be permanent GFCI integral receptacle; receptacle outlet protected by GFCI-type circuit breaker or portable GFCI device.

5.5.10 Accident Prevention Plan. The Contractor shall develop, promulgate and enforce an abbreviated accident prevention plan (APP) with a site safety and health plan (SSHP) as an appendix. The APP outlines occupational safety and health policies, responsibilities, and program requirements. The SSHP describes the site-specific safety practices. The written safety plan shall identify protocols and procedures to ensure a safe and healthful workplace.

A copy of the safety plan shall be submitted to the COR 15 calendar days after contract award. Guidance for developing an abbreviated APP and SSHP can be found in EM 385-1-1, Safety and Health Requirements Manual, located on the Army Corps of Engineers website: http://www.usace.army.mil/. Additional information may be obtain from the Chief, Safety and Occupational Health Division, CCAD, 361.961.3200.

5.5.10 Safety and Health Points of Contact. The Contractor shall provide names and contact information for key contractor personnel, and alternates, who may be contacted 24 hours a day concerning safety and health matters or emergencies. The Contractor shall appoint a site safety and health officer (SSHO) whose primary duty and responsibility is to prepare and enforce the Contractor’s safety program. The SSHO will have experience in preparing and enforcing the Contractor’s safety program on contracts of similar size and complexity in the past.

5.5.11 Activity Hazard Analysis (AHA). The Contractor will ensure an AHA is accomplished and submitted to the COR for acceptance for all critical or high risk activities being to be performed under the contract. AHA will identify the sequence, the specific anticipated hazard, equipment, materials, and the control measures to be implemented to eliminate or reduce each hazard to an acceptable level of risk.

5.5.12 Regulatory Compliance-Safety. The Contractor shall ensure that all work is performed in full compliance with all Federal, State, and local occupational safety and health regulations. This includes, but is not limited to, workplace safety, development of protocols and procedures, inspections, medical surveillance, and maintenance of compliance records. The Contractor shall notify the COR immediately upon shutdown of any operation due to non-compliance with any safety regulations.

5.5.13 Safety and Occupational Health Training. The safety plan will describe how the Contractor will implement and operate a safety and health training program encompassing all Contractor and subcontractor employees who will work on-site at the Government installation/facility. All affected employees shall be trained in accordance with the safety and occupational health training program prior to performing work on-site at the Government installation/facility, except where an alternative training schedule is approved in writing by the contracting officer.

The training program shall include the following, at a minimum:

5.5.14 Written procedures and schedules for training of affected employees.

5.5.15 Employee rights under the Occupational Safety and Health Act.

5.5.16 Hazardous conditions that may be encountered during the performance of work at the Government installation/facility, how to recognize hazardous conditions, and the signs and symptoms of workplace related illnesses and injuries.

5.5.17 The hazard control methods, safe work methods, and personal protective equipment that will be applied to prevent work related illnesses and injuries, including the proper use and limitations of personal protective equipment.

5.5.18 Procedures to be followed in the event of a fire/emergency or fire/emergency drill, while employees are working on-site at the Government installation/facility, including procedures for obtaining medical treatment/assistance when needed.

5.5.19 Responsibilities and procedures for reporting of hazardous conditions and work related accidents, illnesses, and injuries.

5.5.20 Applicable safety and health rules of the Government installation/facility that must be followed by Contractor employees. (NOTE: Obtain information on applicable Safety and Health rules of the Government installation/facility from the contracting officer).

5.5.21 Documentation of the training provided, including date(s) of training, name(s) of employees trained, training topic, instructor (if applicable), and means used to verify that the training was understood. This documentation shall be retained for the duration of the contract, and shall be made available to the contracting officer upon request.

5.5.22 Certifications/Licenses. Contractor shall ensure all mandatory training or certification that are applicable to this project (e.g. air conditioning/refrigeration license, asbestos, lead, crane operators, aerial lift operators, crane operation, riggers, material handling equipment operators) are acquired and any requirements for periodic retraining/recertification is accomplished throughout the contract award period.

5.5.23 Personal Protective Equipment (PPE). The Contractor personnel shall utilize the proper PPE where appropriate including head, eye, hand, foot, respiratory, and hearing protection. All required PPE shall be maintained serviceable and worn properly when required. The Contractor safety plan shall clearly identify the work areas requiring PPE and the type of PPE required. Unserviceable PPE shall be removed from service and properly disposed. The PPE utilized shall comply with all applicable American National Safety Institute (ANSI) and OSHA standards. Training of employees on the proper use of PPE shall be an integral part of the Contractor Safety and Occupational Health Program.

5.5.24 The minimum PPE requirements required for all Contractor personnel entering CCAD Industrial areas shall include but not limited to:

a. High impact safety glasses with side shields that meet or exceed ANSI Z87.1-2015, American National Standard for Occupational and Educational Personal Eye and Face Protection Devices;

b. Hearing protection in the form of plugs or muffs shall be worn by all who are exposed to high noise activities/operations that produce noise levels in excess of 85 decibels;

c. Hard hats shall be worn that comply ANSI Z89.1-2014, Industrial Head Protection, and shall be worn by all workers when overhead hazards exists or areas designated as Hard Hat Working Zones;

d. Gloves of the proper type shall be worn by persons involved in activities that expose the hands to cuts, abrasions, punctures, burns and chemical irritants;

e. Contractor will ensure contractor employees, including subcontractors, who enter industrial areas wear compression-type protective footwear with slip-resistant soles meeting ASTM F2413, Specification for Performance Requirements for Protective Footwear. NOTE: No open toe shoes or shoes with high heels (2.0 or high) will be worn in CCAD industrial areas, production and/or service areas.

f. Additional PPE depending on the hazardous operation that is being performed, regardless of location on CCAD, shall include but is not limited respirators, appropriate protective gloves, personal fall arrest systems, welding goggles, hard hat, and face shield. The purchase and procurement of PPE is the responsibility of the Contractor.

5.5.25 Contractor will take immediate action to correct any contract employee violating CCAD PPE requirements.

5.5.26 Fall Protection. The Contractor shall implement a fall protection program for any operation performed 6 feet and above. Fall protection requirements are addressed in U.S. Army Corps of Engineers EM 385-1-1, Safety and Health Requirements Manual, and Subpart M of 29 CFR 1926, Fall Protection.

5.5.27 Welding, Cutting, and Brazing Operations. The Contractor is required to obtain a welding permit from the installation fire department before performing any welding, cutting, or brazing operation. Welding, cutting and brazing operations will comply with guidelines in U.S. Army Corps of Engineers EM 385-1-1, Safety and Health Requirements Manual, NFPA 51B, Standard for Fire Prevention during Welding, Cutting, and other Hot Work, and Subpart J of 29 CFR 1926, Welding and Cutting, as applicable.

5.5.28 Hazard Communication. The Contractor shall ensure all personnel handling, packing, storing, transporting, or using hazardous materials are provided training, per 29 CFR and 49 CFR, on the characteristics of the materials and proper safety precautions as detailed on the Safety Data Sheets (SDS). Contractor shall ensure personnel are fully familiar with the SDS for material handled and have unrestricted access to the SDS at all times. SDS shall be maintained in all areas for chemicals used or stored in the work area. The SDS shall be indexed so that any specific one is readily accessible. A master copy of all SDS shall be maintained in the Contractor Safety Office and submitted to the Chief, Environmental Programs Compliance Division via the COR upon receipt of Government request. These master copies shall, be updated whenever a new product requiring an SDS has been approved and purchased. The Contractor shall prepare and submit to the Contracting Officer via the COR thirty (30) days after contract award a Hazard Communication Plan to comply with provisions of 29 CFR 1910.1200, Hazard Communication.

5.5.29 Hazard Reporting and Abatement. The Contractor shall develop a program whereby personnel can report a hazardous situation to the Contractor safety representative with impunity/confidentiality. Timely abatement of confirmed hazards is required.

5.5.30 Hazardous or noncompliant conditions identified by the contracting officer shall be promptly corrected, and corrective action(s) taken shall be reported in writing to the contracting officer within 5 days of the contracting officer’s notification to the Contractor. In cases of serious and/or recurring hazards/noncompliance, the contracting officer may stop the work in question pending correction of the hazardous/noncompliant condition, and/or order the removal of the involved contractor/subcontractor employees from the Government installation/facility.

5.5.31 Files shall be maintained of reported hazards and the abatement method. At am minimum the files, the files shall provide the following information: date deficiency identified, person who identified the deficiency, description of deficiency, description of planned/actual corrective action, person responsible for correcting deficiency, projected resolution date, actual resolution date, date the person who identified the deficiency was notified of deficiency resolution. These files shall be made available to the Chief, Safety and Occupational Health Division through the COR upon request.

5.5.32 Investigation and Resolution of Safety and Health Matters. In addition to any other requirements of this contract, when requested by the contracting officer the Contractor shall investigate any safety and health matter connected with the performance of work under this contract. Matters for which investigations may be requested include, but are not limited to, significant failures to control hazardous conditions, significant compliance failures, significant unfavorable mishap or compliance trends, etc. When investigation is requested, the Contractor shall complete the investigation and provide a report of investigation findings, actions planned/taken resolve the problem and/or improve future performance, and target/actual dates for action completion. This report shall be provided to the contracting officer within 15 days of the request to investigate, except when an extension is granted in writing by the contracting officer.

5.5.33 Compliance with Environmental Laws and Regulations: Contractor shall comply with all applicable federal, state, and local environmental laws, statutes, regulations, executive orders, permits, Army regulations (with supplements), as well as Major Subordinate Commands (MSC) and installation regulation and policies. Contractor shall immediately report any conflicts between applicable federal, state, local environmental laws, statutes, executive orders, and provision of Army Regulation 200-1, and any specifications within this contract to the Contracting Officers Representative (COR), as well as to the Chief of the Environmental Programs Compliance Division.

1. Conduct and Behavior: IAW DoD Directive 5200.8, “Security of DoD Installations and Resources”, the NAS commander has broad authority to remove or exclude any person or persons from the military installation to protect personnel and property, to maintain good order and discipline, and to ensure the uninterrupted and successful performance of the installations mission. In the exercise of this authority, the commander may refuse to grant entry or may bar Contractor employees. Refusal of entry or barment of any employee does not relieve the Contractor of the responsibility to continue performance under this contract.

1.1. All personnel entering and working at CCAD are subject to all rules, regulations and applicable laws. All personnel and their effects are subject to search, to include vehicles and company belongings.

1.2. No person shall willfully fail or refuse to comply with lawful orders or direction of any civilian or military security police officer.

1.3. The Contractor shall not employ persons for work on this contract if such employees are identified to the

Contractor by the Government as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population. Disrespectful behavior, failure to obey orders or regulations, fighting, horseplay, stealing, illegal use of drugs (using/transporting/selling), consuming or being under the influence of alcohol, or being in the possession of illegal weapons are prohibited and subject to appropriate penalties. This may include being detained, banned from entering the Government facility, or remanded to civilian authorities.

1.4. All Contractor personnel will limit their travel on the installation only to specific areas required for performance of the contract, specified break and meal areas, or in travel directly to and from these locations.

Employees found on the installation away from officially identified areas may be detained and/or debarred from the installation.

1.5. Subcontracts; if the Contractor enters into a Subcontractor arrangement with another Contractor, the prime

Contractor is responsible for Subcontractor performance and compliance.
