25 July 2019 MEMORANDUM FOR Record SUBJECT: Justification for other than full and open competition – Ixia Brand Name

1. The Louisiana Army National Guard (LAARNG) Purchasing & Contracting (P&C) office requests justification for other than full and open competition.

2. This request will justify the solicitation and acquisition of an Ixia brand name item, but will not limit the acquisition to a sole source.

3. The J6 owns IXOS Core Software and wish to purchase an extended maintenance renewal (909-0506) for SN D6F5-4C02-EC72-2FED, and extended warranty renewal for hardware products (909-0509) SN: 093075, and a Breaking Point Application program (909-0856) for SN: 093075. The estimated value of this acquisition is $119,261.06.

4. Justification: Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1) and FAR 6.302-1(c)(1)(ii), where it states that:

An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer—

(i) Does not provide for full and open competition, regardless of the number of sources solicited; and

(ii) Shall be justified and approved in accordance with 6.303 and 6.304

5. No other brand name item offers the extended warranty and maintenance renewals for the IXOS Core Software. In order to comply with NGB guidance, the current system must remain under maintenance and warranty, which can only be done by using Ixia brand items. Attempting to utilize another brand of equipment would require the purchase of an entirely new system which would create a financial burden, consume many hours / days of down time to remove and install the new equipment, and training for a large number of J6 Soldiers. The cost savings of just maintaining the existing brand of equipment is substantial.

6. Offerors will be solicited on CHESS and FBO, to ensure that offers are solicited from as many sources as practicable. If an offeror is received through CHESS, a notice will not be publicized, in accordance with the exception at FAR 5.202(a)(5). If no offers are received, a posting will be placed on GPE.

7. The anticipated cost to the Government will be fair and reasonable.

8. Market Research was conducted by reviewing the results of recent market research undertaken to meet similar or identical requirements, publishing formal requests for information in CHESS. Results showed that commercial items will meet the government’s needs.

9. No CHESS vendors responded to the RFI with the ability to provide the required software.
