PERFORMANCE WORK STATEMENT (PWS) – Services Non-Personal Training Exercise - 82nd Civil Support Team (CST) Collective Lanes Training

Full-Scale CBRNE Field Training Exercise (Item Numbers 0010-0030)
1. Exercise will facilitate the need/use of the entire 82nd CST; approximately 22 personnel.
2. Desired facility (determined by Contractor with assistance from the 82nd CST as necessary) will be located in the training vicinity identified or local area of 80 mile radius of the training incident and must be adequate enough to exercise the entire response of the CST and meet the training objectives established by the CST.
3. Each exercise will commence NLT 0700 hours on the exercise training day and will conclude when all phases of the CST operational deployment and IC objectives have been completed or the timeline from the venue/facility management has been exhausted (approximately 8 – 12 hour operational period). Exact start time will be confidential until commencement (Alert/Notification) of the exercise. 82nd CST will be alerted/notified of exercise start via SD National Guard Joint Operations Center.
4. Exercise will be a free-flowing, full-scale CBRNE response with CST actions driven by the exercise scenario and contractor intelligence/injects as pre-determined/discussed and evidenced on the MSEL.
5. Exercise will be designed to create an environment for the Unit’s Commander to accurately measure the team’s training and proficiency levels.
6. Any laboratory scenes utilized for training should include fully functional lab ware/apparatuses with the exception of any materials, products, or processes deemed illegal by the State of South Dakota, specific facility management team, or the Federal Government.
7. Laboratory scenarios should have any of the following: lab-grade or improvised glassware, hot plates, cooling/heating baths, centrifuge, pipettes, condensers, diffusers, incubators, and/or any other lab item/process deemed necessary by the Contractor; with the exception of any item deemed illegal by the State of South Dakota, facility management, or the Federal Government. (82nd may have access to some of these items).
8. It is the responsibility of the Contractor to receive prior approval from the facility management team of the ‘target’ location/venue, in order to utilize materials or products for simulation during this scenario.
9. The training lane will provide an environment to successfully evaluate the twelve (12) Civil Support Team Mission Essential Tasks during a realistic CBRNE scenario with sophisticated training aids and simulators in order to challenge the CSTs detection and analytical capabilities.
10. The exercise should involve one (1) or more civilian first responder or emergency operations agencies (Fire, Law Enforcement, Emergency Managers, EMS, Local hospitals, EOD/Bomb, etc.) in order to test the cooperation, communication, and coordination of a multi-agency response to a CBRNE, man-made, or natural event/incident/disaster in which the CST would be involved.
11. The 82nd CST Command and/or Operations sections will assist with the coordination/notification of individuals or agencies that have typically been able and willing to assist with FTX inclusion/training opportunities.
Contractors will not contact local agencies without approval of CST trusted agent.
*CST must be able to pick up ‘readings’ while utilizing their organic detection and monitoring devices from stimulants/simulants in order to create a ‘real’ scenario and assist in creating the common operational picture.
**Simply giving verbal readings/numbers throughout the duration of exercises is not sufficient to test and/or provide confidence in the CST CBRNE equipment or personnel.
*The CST does not exercise Mass Casualty scenarios in which the CST is expected or requested to participate in the extrication, triage, and evacuation of casualties from the incident location. Although considered a first responder agency, the CST will not respond to an incident during the initial ‘golden hour’ when the loss of life, limb, or eyesight is an eminent threat.
Contractor will provide:
1. Design of the exercise to meet objectives set by the 82nd Civil Support Team.
2. Each exercise will be designed for an operational period of 8-12 hours of response activity in order to allow the 82nd CST adequate time to employ all aspects of a response; Alert & Notification, Movement from predetermined staging areas in the vicinity of the incident location, PMT/Hot Zone verification, Site Characterization Monitoring & Detection (2-4 entries in order exhaust/stress the CST future plans process and/or personnel; will be negotiated based on CST Commander input, objectives, and outcomes), Sample Retrieval and Analysis, and Re-deployment.
Decontamination operations will take place between each down range entry operation along with team briefings and debriefings.
3. Command and Control of the exercise to include the use of an Incident Commander (local Fire personnel or Contractor provided) knowledgeable in ICS and NIMS; operational flow and intelligence injects; safety oversight (with assistance from 82nd CST Safety Officer/NCO); exercise feedback.
4. Contractor will provide and utilize a staff that is adequate to assist in facilitating a safe and successful scenario as well as providing adequate feedback to all sections of the CST.
5. Development of a written exercise plan and evaluation. The written evaluation format is not specified and is left to the discretion of the vendor. The 82nd CST relies heavily on written feedback and a fully honest evaluation that is quantifiable and can be used as a learning tool to implement change or improvements into the process of the 82nd CSTs incident response. The use of the Army UTL 0300627-35 will be a very good guide for evaluation.
6. Facilitation of an exercise Hot Wash/After Action Review (AAR) at the conclusion of the operational period/exercise that gives brief observations of CST performance in all phases of the operation as well as Contractor OC/T observations, improvements, and sustained best practices.
7. A written AAR delivered to the 82nd CST no later than 21 days after completion of the exercise in order to utilize feedback for process improvement, best practices, SOP revisions, and TPE preparations.
8. Design, Construction, Installation and removal of HazMat/CBRNE/WMD scene created by a manmade or natural incident (82nd CST may assist in removal as necessary).
9. Development of a master event scenario list (MESL)/exercise plan (EXPLAN) to facilitate a smooth and successful scenario (presented to 82nd CST at the completion of the exercise).
10. Contractor will facilitate adequate exercise planning meeting(s) to determine CST objectives and venue for the full-scale FTX. At a minimum, one face to face coordination meeting will occur approximately 4 weeks prior to each scheduled exercise lanes at the training location identified (two in Rapid City and one in Sioux Falls).. Additional planning meeting(s) may be conducted via video-teleconference, conference phone call or other means available in order to provide effective and efficient planning in lieu of fiscal and/or time constraints.
11. Shipping of props, equipment, simulants (items necessary for the scenario) to and from exercise location.
12. No contractor will be on government orders at any given time.
13. All Monitoring/Testing equipment necessary for successful completion within the scope of the exercise will be provided and utilized by the 82nd CST.
14. The CST Command and/or Operations sections WILL assist with the coordination/notification of individuals or agencies that have typically been able and willing to assist with FTX inclusion/training opportunities. Contractors will not contact local agencies without approval of CST trust agent.
*NO CONTRACTOR WILL BE ALLOWED TO CONTACT FIRST RESPONDER AGENCIES IN THE RAPID
CITY AREA WITHOUT THE APPROVAL AND ASSISTANCE OF THE 82ND CIVIL SUPPORT TEAM.
THIS IS TO PREVENT EROSION OF RELATIONSHIPS THAT HAVE BEEN ESTABLISHED BY THE CST
OVER THE COURSE OF 10-15 YEARS OF MUTUAL ASSISTANCE.
Contractor Staffing & Qualifications:
Contractor will provide and utilize a staff that is adequate to assist in facilitating a safe and successful scenario.
Contractor will identify in their quote the number of staff, staff positions and duties of staff they will provide for the individual lanes training. The following are staffing imperatives in order to provide adequate safety, observation, data collection, medical intelligence and updates, and comprehensive evaluation of sections and overall team operations as it benefits the 82nd CST:
1. One (1) Exercise Planner/Observer-Controller – with CST-specific planning experience to facilitate planning, meetings, exercise design, exercise control, and evaluates the 82nd CST Command section during the response operation.
2. One (1) Senior Observer-Controller – with direct CST-specific experience assist with exercise design, supervise OC’s, safety over-site, and evaluate CST Operations and Communications during the response operation.
3. One (1) Survey Observer-Controller – with CST-specific experience to provide safety over-site and evaluation of the Survey section’s down-range/entry teams and response operations.
4. One (1) Medical Observer-Controller – with CST-specific, patientcare or other healthcare-related occupation & experience to provide information flow between the CST Physician Assistant and a simulated Medical Treatment Facility for casualty updates/signs & symptoms/general medical information exchange for realistic inclusion and engagement of medical personnel.
Contractor Qualifications:
1. Contractor and their staff must have previously facilitated or participated in full-scale training exercises as identified in the PWS for each CLIN/exercise stated in the requirement. This includes full-scale CBRNE/Hazardous Materials training exercises specifically for Civil Support Teams and multiple first responder agencies.
2. Contractor and their staff must be intimately familiar with the mission, objectives, training requirements, equipment parameters and shortfalls, and exercise needs of a Civil Support Team, (Weapons of Mass Destruction);
based on prior experience and membership with Civil Support Teams within the region/nation or as a member of an Army North (ARNORTH) Observer/Controller-Trainer team.
3. Anti-terrorism/Operations Security (AT-OPSEC). AT Level I Training: The contractor and their staff will complete Level I AT Training and provide the certificates at least one week prior to the exercise. Certificates, if training was previously completed, shall be dated within one year of the first exercise.
OPERATIONAL SECURITY
Operational Security Requirements
1. AT Level I Training: The contractor and their staff will complete Level I AT training up receiving award.
2. Access & general protection: The contractor and all associated sub-contractors shall comply with applicable installation, facility and area access and local security policies and procedures (Provided by gov't representative). If required, contractor must comply with all personal identity verification requirements as directed by local policy. If unescorted access is deemed necessary, contractor will submit a NCIC background check and favorable evaluation as required.
3. OPSEC Info: The contractor will protect controlled unclassified information (i.e. training times, number of personnel, etc) pertaining to daily operations.

Focus of CLIN 0020 will be a training lane focused on an event/incident created by a medical nexus scenario to immediately exercise medical knowledge/reachback, man-down scenario and decontamination assistance to include, but not limited to, lab set ups and dispersal devices that focuses on meeting the CST Commander’s training objectives and designed to test the full readiness and response capabilities/operations of the 82nd CST. The intent is not for mass casualty or multiple man-down situations but rather an event with medical focus.
Exercise Date and Location: Week of 13-16 April 2021, vicinity of Sioux Falls, South Dakota.

Focus of CLIN 0030 will be preparation of the 82nd for EXEVAL with ARNORTH in September 2021. This training lane shall include, but not limited to, biological and/or chemical lab set ups and dispersal devices with possibility of suspected radiation exposure that focuses on meeting the CST Commander’s training objectives and designed to test the full readiness and response capabilities/operations of the 82nd CST.
Exercise Date and Location: Week of 17-20 August 2021, vicinity of Rapid City, SD.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
(a) Definitions. As used in this clause--
Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
Covered foreign country means The People's Republic of China.
Covered telecommunications equipment or services means--
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means--
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing--
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:
(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (DEC
2019)
(a) Definitions. As used in this provision, “covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government intends to award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government reserves the right to reject any and all offers, to award a single contract or multiple contracts, and to award any, all or none of the training exercises, if such action is considered to be in the best interest of the Government. The award will be made based on the best overall (i.e. best value) quote, that is determined to be the most beneficial to the Government, with appropriate consideration given to the following evaluation factors: Price and Past Performance. The following factors shall be used to evaluate offers:

(b) The following factors shall be used to evaluate offers:
1. Pricing. Collective training exercises typically consist of three lanes with each lane listed as a separate Item Number. The Item description identifies which lanes are part of a single exercise conducted during the same training period. Lanes that are part of the same exercise will not be awarded separately.
2. Past Performance: Provide a minimum of 2 references from within one year for similar training exercise.
Provide point of contact name, location, phone number, exercise conducted and date of exercise.
a. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be determined favorably or unfavorably on past performance.
b. The offeror may provide past performance information regarding key personnel who have relevant experience as required. If using past performance/experience of key personnel, provide two references within the past year for each employee.
c. Offerors may provide information on problems encountered on prior contracts and the offeror's corrective actions. The Government shall consider this information, as well as information obtained from any other sources, when determining acceptability of past performance. The government shall determine the relevance of similar past performance information.
3. Contractor Staffing: Reference PWS Contractor Staffing & Requirements.
Identify the number of staff, staff positions and duties of staff the offeror will provide for the individual lanes training. The CST has the authority/right to request additional staff if they do not feel it is adequate to provide a thorough and effective evaluation of all sections identified in the CST objectives.
(c) The contracting officer may determine an offer noncompliant with the terms and conditions of the solicitation if the contractor does not provide the information requested, specifically:

(d) To be eligible for award, a proposal must meet all requirements listed in the Statement of Work, Clause 52.212-2 Evaluation, conform to all required terms and conditions and include all information required.
(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.
