Section M - Evaluation Factors for Award

EVALUATION CRITERIA

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered in accordance with the acquisition procedures established in

13.106-2 (b). The following factors shall be used to evaluate offers:

Proposals will be evaluated to determine compliance with the terms and conditions of the solicitation. The resultant contract will be based on the technically acceptable, lowest evaluated price quote. In order to be considered for award, an offeror must comply with solicitation requirements, meet an acceptable delivery schedule as defined by both parties, and meet acceptable standards for past performance.

Technical Acceptability Standards:

Technical acceptability shall be defined as an offeror that meets the Government's requirements, services requirements, and any other requirement identified in the solicitation.

Technically - Acceptable is defined as the quote clearly meets the minimum requirements of the solicitation.

Technically - Unacceptable is defined as the quote does not clearly meet the minimum requirements of the solicitation.

1. Services; Terms and Conditions will be evaluated on an acceptable or unacceptable basis.

a. Acceptable Services/Performance; shall be defined as an offer that meets the minimum requirements of the solicitation thereby meeting the Government's sought services requirements, and all requirements identified as technical requirements for services sought in the Performance

Work Statement.

b. Unacceptable Services/performance; shall be defined as an offer that does not meet the minimum requirements of the solicitation.

2. Past Performance: Past performance will be evaluated on an acceptable or unacceptable basis.

The Government may use information provided by the offeror and/or Government sources to determine technical acceptability. Contractor Performance Assessment Reporting System

(CPARS) scores and other sources available to the Government may be used for past performance evaluation. An offeror with CPARS scores that are excessively low will not meet acceptability standards. For details concerning CPARS Classification calculations and contractor data challenge procedures refer to the CPARS Procedural Guide for Application Development at:

https://www.cpars.gov/

a. An offeror's past performance will be determined to be acceptable if, based on the offeror's recent performance record on efforts involving same or similar items, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.

b. An offeror's past performance will be determined to be unacceptable if, based on the offeror's recent performance record relating to contracts for same or similar items, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

c. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" shall be considered

"acceptable". Offerors are highly encouraged to submit performance references on past similar and/or relevant projects as well as key trainer staff professional references/resumes to ascertain

Technical Acceptability factor, however it would not be weighted ultimately for a final determination on Technical Acceptability, only the records found on CPARS.

(b) The Government will evaluate offers for award purposes by evaluating the total price quoted to the total price of the Independent Government Cost Estimate. The Government may determine that an offer is unacceptable if the prices are not deemed fair and reasonable.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
