JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
B120 Cockpit Air Supply Insulation
Project Number: CURZ192304
1. PROCUREMENT OFFICE: 158th Fighter Wing, 105 NCO Dr, South Burlington, VT, 05403
2. NATURE AND DESCRIPTION OF THE ACTION BEING APPROVED
The 158th Fighter Wing Contracting Office intends to award a firm-fixed price sole-source purchase order on or about 4
January 2019 to Stewart Construction to install black armouflex insulation on the cockpit air ducts.
3. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
A Project will include the installation of black armourflex insulation on the cockpit air ducts for the B120 FMS bays.
This is a time sensitive requirement as Lockheed Martin is due on 8 January 2019 to finish the installation of the SIMs and all insulation is needed to be complete prior to their arrival. The insulation will eliminate condensation from forming on the ductwork and dripping onto the FMS system.
B Project will include modification to the helmet room (room 113) wall adjacent to briefing room 1. The modification include removing existing data/power outlets, patch holes and repair, fire tape, install hatch channel and 5/8”
QuietRock with tape/prime/paint of wall. Will install surface mounted devices, rework acoustic ceiling, and install new vinyl baseboard.
4. ESTIMATED DOLLAR VALUE:
The estimate for the current requirement is approx $40,000
5. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
10 U.S.C. 2304(c)(1) - Only one responsible source and no other supplies or services will satisfy agency requirements; as implemented by Federal Acquisition Regulation 6.302-1. IAW FAR 8.405-6(a)(2), the award will be made for an item peculiar to one manufacturer and is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
6. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF
THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.
FAR 6.302-1(c) provides the use of brand name descriptions when the requirement can only be met by one brand name product. Stewart Construction was the general contractor who constructed the repair/modification and has intimate knowledge and experience with this building. They also sub-contracted Alliance Mechanical who installed all of the ductwork and HVAC systems and control systems. Therefore with this time sensitive requirement for this insulation, Stewart was the contractor of choice who had the best chance of meeting the time requirement. They also own the current one year warranty period on the building. Any other contractor in this area could potentially void the warranty of all work completed by this project.
7. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY
BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES
REQUIRED.
At this time, the 158th FW would another contractor to gain the knowledge of the system to include measurements, layout, sizes that would preclude them from completing the work on time. Another contractor working in this area that is under warranty would also cause issues for any future warranty claims in this area.
