PERFORMANCE WORK STATEMENT

[2018 Minnesota State Fair Agreement]

1.2. BASIC SERVICES/TERMS AND CONDITIONS: The Contractor shall provide qualified personnel, services, materials, equipment, supplies and facilities necessary to perform all terms of this contract. The contractor shall furnish all management, labor, transportation, and pick-up and delivery service and facility operation in accordance with the terms and conditions of this contract. This contract includes all other tasks and responsibilities deemed necessary and spelled out in this contract. The contractor shall receive, account for, process, and return all organizational and individual items tendered if applicable. The details and terms of contract are as follows:

1.2.1. 2018 Minnesota State Fair dates 23 Aug – 3 Sept 2018

1.2.2. MN State Fair License Fees for Block: 26, Building/Area: 262, Lot#: 15,16,17,18, Size: 80X27

1.2.3. MN State Fair Assessment Fees for Block: 26, Building/Area: 262, Lot#: 15,16,17,18, Size: 80X27

1.2.4. MN State Fair Utility Fees for Block: 26, Building/Area: 262, Lot#: 15,16,17,18, Size: 80X27, Utilities consumed during the fair dates

1.2.5. MN State Fair Environmental Fees

1.2.6. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase to contract price. If repair/replacement of reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies and services. The Government must exercise its post-acceptance rights (1) within a reasonable time after the defect was discovered or should have been discovered; and (2) before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

1.2.7. Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement or any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
