52.212-2 Evaluation-Commercial Products and Commercial Services (Deviation 2026-O0038) (Tailored) 2026-02

Evaluation-Commercial Products and Commercial Services (Feb 2026)

(Deviation 2026-O0038)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

1. Technical Capability: The Government will evaluate the quoted product on an "Acceptable" or "Unacceptable" basis to determine if it meets the minimum salient characteristics defined in the Statement of Work (Brand Name or Equal). Quotations determined to be technically

"Unacceptable" will not be evaluated further.

2. Delivery Schedule: The Government will evaluate the quoter's proposed delivery timeline.

Shorter delivery lead times may be evaluated more favorably.

3. Warranty and Maintenance Plan: The Government will evaluate the terms, duration, and comprehensiveness of the offeror's proposed commercial warranty and planned maintenance package. More robust coverage (e.g., longer duration, fewer exclusions, comprehensive preventative maintenance) may be evaluated more favorably.

4. Value-Added Features / Enhancements: The Government will evaluate any additional features, capabilities, accessories, or services proposed by the offeror that exceed the minimum requirements of the Statement of Work. Enhancements that provide a tangible operational, safety, or economic benefit to the Government may be evaluated favorably.

5. Past Performance: The Government will evaluate the quoter's recent and relevant past performance, focusing on the timely delivery and post-delivery support of machinery.

6. Price: The Government will evaluate the total overall price inclusive of transportation charges to the delivery destination for reasonableness.

Evaluation factors other than price (Delivery Schedule, Warranty and Maintenance Plan, Value-

Added Features, and Past Performance), when combined, are approximately equal to price.

(b) Options (if applicable). (Not Applicable to this requirement) The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
