Justification and Approval for Other Than Full and Open Competition

1. Contracting Activity: National Guard Bureau Operational Contracting Division (NGB-AQ) 43200 Maple, Building 105, Room 36, Selfridge ANGB, MI 48045

2. Description of Action: This justification is prepared for a new firm fixed price construction contract to construct a new Space Battalion Readiness Center located at Fort Carson, Colorado. This project includes for two brand name components along with the sole source for the installation of the components. The project is solicited under Invitation for Bid (IFB) Number W912LC-17-B-0001. MILCON ARNG funds are appropriated for this action.

3. Description of Supplies/Services: As part of the construction of the New Space Battalion Readiness Center, the contractor is required to:

a. Procure the Schneider Electric “SmartStruxure” Energy Management Control System (EMCS). This system is a single source solution for HVAC and electronic access control.

b. Procure the services of Westover Controls Corporation of Denver, CO for the installation of the SmartStruxure System.

c. Procure the Schneider Electric American Power Conversion Uninterrupted Power Supply (APC-UPS). This product is to provide holdover power to the network equipment during power failure. This allows for graceful shutdown of a system and for users to save their work before losing network connectivity. It acts as a backup generator to take control, allowing operations to continue in the event of a power outage. This system is a long term infrastructure standardization goal for the Colorado Army National Guard (COARNG).

4. Authority Cited: The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.203-1, Only one responsible source and no other supplies or services will satisfy agency requirements. It is likely that any other source would result in substantial duplication of cost to the Government that will not be recovered through competition.

5. Reason for Authority Cited:

a. Schneider Electric’s SmartStruxure Energy Management Control System (EMCS)/Building Control System is required to be utilized on all COARNG facilities in order to comply and integrate with the current system utilized by the Construction Facility Management Office (CFMO) for the buildings across the state. The use of a single product line/manufacturer enables the systematic management and seamless operation of our EMCS within the facilities belonging to the COARNG. Utilizing the common product line for our EMCS within our facilities allow for reduced staff to operate and maintain our EMCS as well as the equipment the EMCS interfaces with.

This results in reduced maintenance and training costs for the COARNG over the lifecycle of the building. This building will be an independent stand-alone facility. Given the geographic dispersion of the facilities, individuals are able to monitor and control the building systems of several facilities separated by miles. In order to do this effectively, a single building control line has been established. Departing from the standardization would not be sustainable, and would be detrimental to the organization.

The estimate to purchase the equipment is approximately $195,500

b. Westover Controls Corporation, located in Denver, CO, is the only authorized factory representative/installer in Colorado Area for the SmartStruxure product line. If this product line is distributed and/or installed by another company, Schneider Electric explicitly voids the warranty on the equipment and installation of the equipment. The estimate to install the equipment is approximately $90,500.

c. Schneider Electric’s American Power Conversion Uninterrupted Power Supply (APC- UPS) is compatible with the StruxtureWare Management Software, the software currently in place for all COARNG facilities. Since COARNG owns the management server and licenses of the StruxureWare Management Software and that software monitors and manages all APC-UPS throughout the state, a new uninterrupted power supply would not be feasible. The APC-UPS is the only compatible UPS system.

Estimated cost to purchase this equipment is approximately $7,000.

6. Efforts to Obtain Competition: The solicitation for the construction of the Readiness Center will be a competitive Invitation for Bid (IFB) set aside for small businesses. The brand name components represent a small portion, less than 5% of the overall construction project that is being competed.

7. Actions to Increase Competition: This J&A will be posted to FedBizOpps with the solicitation and potential suppliers may have the opportunity to propose compatible products for consideration.

8. Market Research: The following market research techniques were conducted within the previous 12 months:

a. A Sources Sought notice was posted to FedBizOpps on March 10, 2017 for Schneider Electric’s SmartStruxure System for 21 days. The purpose of the notice was publicize our intent for a brand name only and to seek potential sources that could offer a fully compatible system to provide a fully integrated Direct Digital Control (DDC) system connected to the pre-existing Schneider Electric SmartStruxure/Andover hardware and software owned by the COARNG. The COARNG did not receive any responses from industry.

b. A Sources Sought notice was posted to FedBizOpps on March 17, 2017 for 18 days for the installation of the SmartStruxure System. The notice was to determine if other firms within the project location is a certified installer. COARNG-Purchasing and Contracting (P&C) received one response on March 20, 2017. It was confirmed by Schneider Electric that the firm was not a certified installer. Westover Corporation is the only authorized installer for the state of Colorado. They are factory trained to provide engineering, networking, programming, systems installation and commissioning of the SmartStruxure Energy Management Control System (EMCS)/Building Control System.

c. No additional market research was conducted for the Schneider Electric’s American

Power Conversion Uninterrupted Power Supply. This document will be posted to FedBizOpps during the solicitation of the construction project. Any firms will have the opportunity to provide a substitute for this equipment for consideration.

9. Interested Sources: To date, no other sources have written to express an interest. There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned and experience of the Colorado Army National Guard and National Guard Bureau.

10. Other Facts: The following facts are identified:

a. Maintenance and repair training for these systems is brand name specific, and it is necessary to integrate the Space Battalion Readiness Center facility and facilitate the seamless communication between the CFMO-CO and Colorado Army National Guard facilities as well as allow for spare parts compatibility and reduce storage and efficient training requirements. With multiple brand names, the end user of the facility would need to be trained on how to utilize, maintain, and repair all the different systems. The costs over the lifecycle of the facility would also be increased for service and annual maintenance.

b. The Facilities Management spare parts inventory will remain manageable with all systems of the specified brand name. For each different brand name specified, a different software system would be required, resulting in additional costs to the Government for the maintenance of each system. By using the aforementioned systems listed, communication and compatibility issues will be alleviated and result in a fully integrated and functioning base wide system. Having the same brand name on all required systems would be the most cost effective solution for the government.

c. The selection of the SmartStruxure product line and the American Power Conversion Uninterrupted Power Supply ensures facility security on the installation and seamless integration and communication of COARNG facilities. While providing reduced maintenance costs over the lifecycle of the facility, training costs & requirements for end users, response time in emergency situations, and spare parts stock costs for COARNG.
