The USG expects adequate competition to assist in determining a fair and reasonable price.
However, if adequate competition does not materialize, the Contracting Officer may require the submission of Other than Certified Cost or Pricing Data to support the quote.
Contract award may only be made to responsible parties IAW RFO FAR 9.103. As part of the Responsibility determination, the Contracting Officer will consider suppler risk using the Supplier Performance Risk System IAW RFO DFARS 204.7602.

RFO FAR 52.212-2 Evaluation--Commercial Products and Commercial Services.
BASIS OF AWARD- EVALUATION
Basis for Contract Award - This solicitation is conducted in accordance with Revolutionary FAR Overhaul Federal Acquisition Regulations (RFO FAR) Part 12, Acquisition of Commercial Products and Commercial Services, as supplemented by the RFO Defense Federal Acquisition Regulation Supplement (RFO DFARS), and the RFO Army Federal Acquisition Regulation Supplement (RFO AFARS). The Government (USG) intends to award a single contract in response to this solicitation. The USG will utilize trade-off procedures as detailed below to award to the solicitation that conforms to the solicitation and will be most advantageous. The USG intends to award without discussions but reserves the right to do so, if necessary. Offerors are cautioned to ensure strict adherence to the Instructions to Offerors as contained in 52.212-1, Instructions to Offerors - Commercial Products and Commercial Services and its Addendum as contained in this solicitation. Incomplete responses may be considered non-responsive to the solicitation and may not be evaluated for award.
For the purposes of this solicitation, non-responsiveness refers to (but is not limited to): failure to follow submission procedures and format (as contained/described herein), and failure to provide a unit Price and Extended Total/Amount for each Contract Line Item as required by this solicitation. The offer shall be compliant with the requirements as stated in the PWS. Non-conformance with the instructions provided may result in an unfavorable evaluation.
I. Basis for Contract Award - Evaluation of Quotations-Simplified Acquisition Procedures
(a) In accordance with RFO FAR 12.203 Evaluation, the Government will award a contract resulting from this solicitation to the responsible offer whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers comparatively without priced tradeoffs:
(i) Price
(ii) Technical Acceptance
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. This includes options under FAR clause 52.217-8, Option to Extend Services, if included in this solicitation. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract.
Therefore, issuance by the Government of an order in response to a supplier's quotation does not establish a contract.
A written notice of award or purchase order mailed or otherwise furnished to the successful offer is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.
II. Offer Evaluation: The evaluation process will be accomplished as follows (Organized by Volume):
A. General: We will award a contract to the offer responsible who represents the best value to the Government on the basis of comparison of its (1) offer, and (2) technical - risk.
B. Volume I, Offer
1. General: We will determine the merits of your offer on the basis of (a) its acceptability and (b) its offer price.
(a) Acceptability: We will determine the acceptability of your quote on an acceptable or unacceptable basis. We will consider your quote acceptable if it (i) conforms to the material solicitation requirements; (ii) manifests your unconditional assent to the terms of this Request for Quote (RFQ), and (iii) you are a responsible prospective contractor pursuant to RFO FAR 9.104-1. (NOTE: By submission of a quote, the quoter represents that it unconditionally assents to the terms of this Request for Quote, except for any written express exceptions.)
(i) Conformance. Material solicitation requirements include those terms affecting quality, quantity, price, or delivery.
(ii) Assent. If you (1) make exception to any term of this RFQ, (2) propose any additional terms, or (3) omit material information required by this RFQ then we will consider your quote to be unacceptable and ineligible for the contract award.
(b) Price: We will evaluate your price for fairness and reasonableness in accordance with RFO FAR 12.204.
C. Volume II, Technical Acceptablility
1. Acceptability: We will determine the acceptability of your item quoted on an acceptable or unacceptable basis. We will consider your quote acceptable if it (i) conforms to all the requirements of the item requested requirements.
The Government may only award to a contractor the Contracting Officer is able to make an affirmative determination of responsibility IAW RFO FAR 9.103(b). As part of this determination, the Government will consider supplier risk using the Supplier Performance Risk System.
The USG is placing an emphasis on a technical solution with by an Offeror with proven past performance. The USG will award to the highest technically rated quote with satisfactory or higher past performance with a fair and reasonable price as allowed by RFO FAR 12.201-1(d). The relative order of importance: Technical rating, followed by price.
(End of Addendum)
National Guard Bureau, Agency Protest Program
NG Agency Protest Program is intended to encourage interested parties to seek resolution of their concerns with the National Guard (NG) as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum.
Contract award or performance is suspended during the protest to the same extent, and within the same time periods as if filed at the GAO. The NG protest decision goal is to resolve protests within 35 calendar days from filing. An agency protest may be filed with either the Contracting Officer or the NG Agency's Protest Decision Authority, but not both, in accordance with NG protest procedures.
To be timely, the protests must be filed with the periods specified in FAR 33.103.
