This section provides general guidance as well as specific instructions on the format and content of an offerors submissions. The offeror’s submission must include all data and information requested and shall be submitted in accordance with these instructions. Any offeror who submits an incomplete package will be considered non-responsive to this solicitation and may not be evaluated for award. For the purposes of this solicitation, non-responsiveness refers to (but is not limited to): failure to follow submission procedures and format (as contained/described herein), and failure to provide a Unit Price and Extended Total/Amount for each Contract Line Item as required by this solicitation. The offer shall be compliant with the requirements as stated in the

Performance Work Statement (PWS). Non-conformance with the instructions provided may result in an unfavorable evaluation.

Elaborate brochures or documentation, binding, detailed artwork, or other embellishments are unnecessary and are not desired.

GENERAL INFORMATION

Point of Contact – The Contracting Officer (KO) is the sole point of contact for this acquisition.

Discrepancies – If an offeror believes the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the KO in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial submissions, as received, without discussion.

ORGANIZATION/NUMBER OF COPIES/PAGE LIMITS

The offeror shall prepare submissions as set forth in the organizational table below.

Volume 1 - Technical Information

Technical Quote Information – All technical performance information shall be addressed

ONLY in Volume 1.

The following information shall be provided and will be evaluated. Quotes shall be clear, concise, and include sufficient detail for effective evaluation. Offerors shall assume that the

52.212-2 ADDENDUM

Addendum to 52.212-2 EVALUATION-COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (Nov 2021)

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factor(s) shall be used to evaluate offers:

Factor 1: Technical Factor 2: Price

Offers will be evaluated on price after receiving no less than an Acceptable rating on technical.

Options - The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

This requirement contains 52.217-8, Option to Extend Services. Circumstances may arise that require the Contracting Officer to utilize FAR 52.217-8, Option to Extend Services for no more than six (6) months. Inclusion of this clause shall not obligate the Government to exercise the options(s). Pricing for this option will be pro-rated to the contracted rate for the Period of

Performance immediately preceding it.

Basis for Contract Award - This solicitation is conducted in accordance with Federal

Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, FAR Part 13, Simplified Acquisition Procedures, and FAR Part 15, Contracting by Negotiation as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS). These regulations are available electronically at https://acquisition.gov/browse/index/far

A contract will be made based on the lowest-priced technically-acceptable quote that is determined to be the best value to the Government and conforms to the solicitation requirements

(to include all stated terms, conditions, representations, certifications, and all other information required by Addendum to 52.212-1). The government intends to award without discussions but reserves the right to do so.

Number of Contracts to be Awarded -The Government intends to award one (1) contract as a result of this solicitation.

Evaluation Process

The award will be made based on the lowest-priced technically-acceptable quote that is determined to be the best value to the Government, with appropriate consideration given to the https://acquisition.gov/browse/index/far two evaluation factors: technical and cost/price. To receive consideration for award, a rating of no less than “acceptable” must be achieved for the technical factor, to include all sub-factors.

Factor One: Technical Quote

Evaluation Factors: In order to be considered for further evaluation, an Offeror must first be determined “Acceptable” in the Technical factor. In order to be determined “Acceptable”, an

Offeror shall, in the determination of evaluator, be rated “Acceptable” in ALL criteria stated below.

a. Conformance with PWS Section 5;

Technical Evaluation Ratings: The ratings of “Acceptable” or “Unacceptable” will be used in the evaluation and assessment of each Technical Sub-factor and the overall

Technical rating of the Technical Quote.

Failure to provide required technical data with quotes may render an offeror’s quote noncompliant with the solicitation requirements and ineligible for award. The Technical

Quote shall be prepared in accordance with the instructions given in this section and will be evaluated in accordance with FAR 52.212-2 Evaluation –Commercial Items and FAR

Part 15.305 Proposal Evaluation. Technical Quote binders shall not include price or pricing information.

Factor Two: Price

The Government will verify unit prices and extended (CLIN) pricing is accurate as offered.

Upon verification of CLIN prices, the Government will add all CLINs plus ½ of the price for

CLIN 3001, ½ of the price for CLIN 3002 and ½ of the price for CLIN 3003 (to account for the

52.217-8 price) to arrive at a Total Evaluated Price. Put another way, the formula for the Total

Evaluated Price is as follows: 0001 + 0002 +0003 + 1001 + 1002 + 1003 + 2001 + 2002 + 2003

+ 3001 + 3002 + 3003 + (.5 * 3001) + (.5 * 3002) + (.5 * 3003) = Total Evaluated Price.

The Government expects adequate competition to assist in determining a fair and reasonable price. However, the Government reserves the right to request other than certified cost or pricing data to assist in determining a fair and reasonable price. Failure to provide realistic prices may result in an offer being rated unawardable on the basis that unrealistically low prices are an indication that the Offeror does not understand the requirements. The Government reserves the right to evaluated for unbalanced pricing. The presence of unbalanced pricing introduces risk to successful performance. If unbalanced pricing is present in an offer, the Government may reject the offer if the lack of balance poses an unacceptable risk to the Government.

The Government intends to award a single contract resulting from this solicitation to the technically acceptable – lowest priced, responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government.

PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

FOR

Industrial Hygiene Services

1.0 General: This is a non-personal services requirement that will anticipate, recognize, and evaluate potential health hazards associated with processes performed at Army National Guard

(ARNG) facilities. These services will provide sound recommendations for hazard control. The purpose of this requirement is to identify, measure, and recommend methods to control the existence and extent of potentially hazardous worker operations and/or conditions at ARNG facilities. Industrial Hygiene (IH) surveys establish baselines, follow-ups, and special surveys of workplace conditions. IH surveys document and make recommendations for worker protection based on conditions and potential exposures found at the time of survey.

1.1 Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary, except as specified in Paragraph 3.0 as Government Furnished, to perform Industrial Hygiene Services as defined in this PWS.

1.2 Background: The National Guard Bureau (NGB) Industrial Hygiene Region West

(IHRW) office has a requirement to anticipate, recognize, and evaluate potential health hazards associated with processes performed at Army National Guard (ARNG) working facilities and to provide sound recommendations for hazard control. IH surveys will serve to establish a baseline of workplace conditions or update a previous baseline so that a worker’s history of exposure is provided for both civilian and military employees (Army Regulation (AR) 385-10 The Army

Safety Program). Training events provided by the Contractor will prepare ARNG IH personnel to survey facilities for workplace hazards.

1.3 Period of Performance (PoP): The Period of Performance (PoP) shall be one (1) Base

Year of twelve (12) months plus three (3) 12-month Option Years. The Contractor shall not be on-site more than five (5) business days per visit to conduct industrial hygiene survey activities.

1.4 General Information:

1.4.1 Place and Performance of Services: The contractor shall provide services between the core hours of facility availability, typically from 6:00 AM to 6:00 PM (local time), Monday through

Friday, except on recognized US holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government directed facility/installation closings. The contractor shall verify with each facility the hours of operation, as every state and facility operate on different flex schedules. Performance shall be at ARNG facilities, where federal employees operate, within California. The Contractor shall always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce is essential.

1.4.1.1 Teleworking is NOT authorized, as services shall be required on-site at ARNG facilities within California assigned to this requirement. Travel throughout the state is required and essential to the success of the ARNG IH program. The ARNG IH program requirements cannot be met if the Contractor is permitted to telework.

1.4.1.2 Facility Closures: Unscheduled gate closures by the Military Police or security may occur at any time causing all personnel entering or exiting a closed installation to experience a delay.

This cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the contractor employee’s installation driving privileges.

1.4.1.3 Contractor Familiarization: The contractor’s employees shall become familiar with and obey the rules and regulations of the installation/facility; including fire, traffic, safety, and security while on the installation/facility. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All contractor employees shall always carry proper identification with them and shall be subject to such checks as may be deemed necessary. The contractor shall ensure compliance with all regulations and orders of the installation, which may affect performance. The Government reserves the right to direct the removal of an employee from Government property or revoke access to Government systems for misconduct, security reasons, or any overt evidence of communicable disease. Removal of contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract.

1.4.2 Recognized Holidays: The following are recognized United States (US) holidays. The contractor shall not perform services on these days:

1.4.2.1 New Year’s Day: January 1st

1.4.2.2 Martin Luther King, Jr.’s Birthday: 3rd Monday of January

1.4.2.3 President’s Day: 3rd Monday of February

1.4.2.4 Memorial Day: Last Monday in May

1.4.2.5 Juneteenth: June 19th

1.4.2.6 Independence Day: July 4th

1.4.2.9 Veteran’s Day: November 11th

1.4.2.10 Thanksgiving Day: 4th Thursday in November

1.4.2.11 Christmas Day: December 25th

1.4.3 Quality Control (QC): The contractor shall develop and maintain an effective Quality

Control Plan (QCP) to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s QCP is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the contractor shall develop QC procedures that address the areas identified in Technical Exhibit 1, Performance

Requirements Summary. A final QCP shall be submitted to the Contracting Officer

Representative (COR) NLT ten (10) days after contract award. After acceptance of the QCP, the contractor shall obtain the Contracting Officer’s (KO) acceptance in writing of any proposed changes to its QCP.

1.4.4 Quality Assurance (QA): The Government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government will do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) or defect rate(s).

1.4.5 Installation Access and Security Requirements. The Contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR. The Contractor and all associated subcontractor employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, or
