Justification and Approval for Other Than Full and Open Competition Justification

AFARS 5153.9005

1. Contracting Activity: USP&FO for Arizona 5645 E. McDowell Road Phoenix, Arizona 85008

2. Description of Action: Approval is being requested for a follow-on to firm-fixed-price A-E contract DAHA02-01-D-0001-0023. The type of funds are American Recovery and Reinvestment Act of 2009..

3. Description of SupplieslServices: On 4130104, the USPFO for Arizona awarded a firm-fixed price A-E contract to Morrison-Maierle for the design of the renovation of Building 27 located at the 162'~ FW in Tucson, Az. The cost of this service was $54,313.00 and the cost for the Supervision, Inspection and Overhead (SIOH) services for the construction portion of the project is $14,888.00. The original Indefinite Delivery Indefinite Delivery (IDIQ) contract issued to Morrison-Maierle was competed and awarded in February of 2002. Funds for construction were sent in 2006 and the solicitation was put out to the local Arizona Multiple Award Task Order Contract (MATOC) contractors. Proposals were received and those exceeded the available funds and additional funds were not available, so the solicitation was cancelled. Funds have recently been sent and are now available through the American Recovery and Reinvestment Act. The designer of record is Morrison-Maierle, Inc and approval is requested for this contractor to act as the contractor for SIOH as a logical follow-on to their original contract. The original contract has expired and a new contract for this service will be processed.

4. Authority Cited: The authority cited that permits this action is FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: The incumbent contractor, Morrison- Maierle, Inc., own the professional stamp for the design and allowing a different A-E firm to perform the SIOH would put the Government at substantial risk if changes to the design during construction were required.

6. Efforts to Obtain Competition: this section is NIA

7. Actions to Increase Competition: There are no actions being taken to increase competition as this is a logical follow-on to the original contract.
